EXPLANATORY MEMORANDUM

EXPOSIÇÃO DE MOTIVOS

1. On 27 October 2009 the Council adopted Common Position 2009/788/CFSP in response to the violent crackdown by security forces on political demonstrators in Conakry on 28 September 2009, the reported human rights abuses following the crackdown and the violent repression and political stalemate in the country. The Common Position imposed an embargo on the export of arms to Guinea, and imposed a travel ban on 42 individuals named in the Annex to the Common Position, being members of the ruling NCDD and persons closely associated with them.

Em 27 de Outubro de 2009, o Conselho adoptou a Posição Comum 2009/788/PESC em resposta à violenta repressão de manifestantes políticos pelas forças de segurança, em Conacri, no dia 28 de Setembro de 2009, e às subsequentes violações dos direitos humanos e à repressão violenta e ao impasse político em que se encontra o país. A Posição Comum impôs um embargo das exportações de armas para a Guiné, bem como uma interdição de viajar a 42 pessoas enumeradas na lista constante do Anexo da Posição Comum, membros do CNDD no Governo e a pessoas a elas estreitamente associadas.

2. Council is preparing a subsequent CFSP Common Position calling for additional restrictive measures including (i) the freezing of funds and economic resources of the individuals and entities listed in the Annex to the Common Position; and (ii) a prohibition on the provision of technical and financial assistance and other services related to military activities to any person in Guinea.

2. O Conselho está a preparar uma nova Posição Comum PESC, instando à imposição de medidas restritivas adicionais, nomeadamente (i) o congelamento de fundos e de recursos económicos das pessoas e entidades enumeradas no Anexo da Posição Comum; e (ii) uma proibição da prestação de assistência técnica e financeira, bem como de outros serviços relacionados com actividades militares, a qualquer pessoa da Guiné.

3. These measures fall within the scope of the Treaty establishing the European Community. The Commission therefore proposes, in anticipation, a Regulation implementing these restrictive measures.

3. Estas medidas são abrangidas pelo âmbito de aplicação do Tratado que institui a Comunidade Europeia. Por conseguinte, a Comissão propõe, desde já, um regulamento de execução destas medidas restritivas.

4. The restrictive measures adopted under this Regulation shall be implemented in full respect of fundamental rights, in particular in light of recent case law of the European Court of Justice.

4. As medidas restritivas adoptadas ao abrigo deste regulamento serão executadas no pleno respeito dos direitos fundamentais, nomeadamente, à luz da recente jurisprudência do Tribunal de Justiça das Comunidades Europeias.

5. Several provisions of the proposed Regulation are taken from the Guidelines on Implementation and Evaluation of Restrictive Measures (Sanctions) in the Framework of the EU Common Foreign and Security Policy[1].

6. The EU Best Practices for the Effective Implementation of Restrictive Measures[2] provide additional guidance for the application of the proposed measures.

Having regard to the Treaty establishing the European Community, and in particular Articles 60 and 301 thereof,

(1) Common Position 2009/…./CFSP provides for certain restrictive measures concerning members of the National Council for Democracy and Development (NCDD) and individuals associated with them, responsible for the violent repression of 28 September 2009 or the political stalemate in the country

(1) A Posição Comum 2009/…./PESC prevê certas medidas restritivas relativamente a membros do Conselho Nacional para a Democracia e o Desenvolvimento (CNDD) e a pessoas a eles associadas, responsáveis pela repressão violenta de 28 de Setembro de 2009 ou pelo impasse político em que se encontra o país.

(2) These measures include the freezing of funds and economic resources of the natural or legal persons, entities and bodies listed in the Annex to the Common Position as well as a prohibition on the provision of technical and financial assistance and other services related to military activities to any person in Guinea or for use in Guinea.

(2) Estas medidas incluem o congelamento de fundos e de recursos económicos das pessoas singulares ou colectivas, entidades e organismos enumerados na lista constante do Anexo à Posição Comum, bem como uma proibição da prestação de assistência técnica e financeira e outros serviços relacionados com actividades militares a qualquer pessoa da Guiné ou para utilização neste país.

(3) These measures fall within the scope of the Treaty establishing the European Community and, therefore, notably with a view to ensuring their uniform application by economic operators in all Member States, Community legislation is necessary in order to implement them as far as the Community is concerned.

(3) Estas medidas são abrangidas pelo âmbito de aplicação do Tratado que institui a Comunidade Europeia e, por conseguinte, a fim de garantir a sua aplicação uniforme por parte dos operadores económicos de todos os Estados-Membros, é necessária legislação comunitária que permita a sua aplicação a nível da Comunidade.

(4) This Regulation respects the fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and notably the right to an effective remedy and to a fair trial, the right to property and the right to protection of personal data. This Regulation should be applied in accordance with those rights and principles.

(4) O presente regulamento respeita os direitos fundamentais e observa os princípios reconhecidos, nomeadamente, pela Carta dos Direitos Fundamentais da União Europeia e, em especial, o direito à acção e a um tribunal imparcial, o direito de propriedade e o direito à protecção de dados pessoais. O presente regulamento deve ser aplicado em conformidade com estes direitos e princípios.

(5) For the implementation of this Regulation some personal data concerning natural and legal persons, entities and bodies whose funds and economic resources must be frozen in accordance with this Regulation must be made public and treated in an appropriate manner under Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data[3] and Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data[4].

(5) Para a aplicação do presente regulamento, é necessário que determinados dados pessoais relativos a pessoas singulares ou colectivas, entidades e organismos cujos fundos e recursos económicos devem ser congelados por força do presente regulamento sejam tornados públicos e objecto de um tratamento adequado, em conformidade com o Regulamento (CE) n.° 45/2001 do Parlamento Europeu e do Conselho, de 18 de Dezembro de 2000, relativo à protecção das pessoas singulares no que diz respeito ao tratamento de dados pessoais pelas instituições e pelos órgãos comunitários e à livre circulação desses dados[3], bem como com a Directiva 95/46/CE do Parlamento Europeu e do Conselho, de 24 de Outubro de 1995, relativa à protecção das pessoas singulares no que diz respeito ao tratamento de dados pessoais e à livre circulação desses dados[4].

(6) Provision should be made for the handling of classified information at the Commission.

(7) In order to ensure that the measures provided for in this Regulation are effective, this Regulation must enter into force immediately,

HAS ADOPTED THIS REGULATION:

Article 1

Artigo 1.º

For the purposes of this Regulation, the following definitions shall apply:

Para efeitos do presente regulamento, entende-se por:

(a) ‘technical assistance’ means any technical support related to repairs, development, manufacture, assembly, testing, maintenance, or any other technical service, and may take forms such as instruction, advice, training, transmission of working knowledge or skills or consulting services; including verbal forms of assistance;

(a) «Assistência técnica», qualquer apoio técnico relacionado com reparação, desenvolvimento, fabrico, montagem, ensaio, manutenção ou qualquer outro serviço técnico, podendo assumir formas tais como instrução, aconselhamento, formação, transmissão de conhecimentos práticos ou capacidades ou prestação de serviços de consultoria; a assistência técnica inclui assistência sob a forma oral;

(b) ‘funds’ means financial assets and benefits of every kind, including but not limited to:

(b) «Fundos»: activos financeiros e benefícios económicos de qualquer tipo, nomeadamente, mas não exclusivamente:

(i) cash, cheques, claims on money, drafts, money orders and other payment instruments;

(i) numerário, cheques, créditos em numerário, saques, ordens de pagamento e outros instrumentos de pagamento;

(ii) deposits with financial institutions or other entities, balances on accounts, debts and debt obligations;

(ii) depósitos em instituições financeiras ou outras entidades, saldos de contas, créditos e títulos de crédito;

(iii) financial instruments listed in section C of Annex I of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments (OJ L 145, 30.4.2004, p1);

(iii) os instrumentos referidos na Secção C do Anexo I da Directiva 2004/39/CE do Parlamento Europeu e do Conselho, de 21 de Abril de 2004, relativa aos mercados de instrumentos financeiros (JO L 145 de 30.4.2004, p1);

(iv) interest, dividends or other income on or value accruing from or generated by assets;

(iv) juros, dividendos ou outros rendimentos de activos ou mais-valias provenientes de activos;

(v) credit, right of set-off, guarantees, performance bonds or other financial commitments;

(v) créditos, direitos de compensação, garantias, garantias de boa execução ou outros compromissos financeiros;

(vi) letters of credit, bills of lading, bills of sale;

(vi) cartas de crédito, conhecimentos de embarque, comprovativos de vendas;

(vii) documents evidencing an interest in funds or financial resources;

(vii) documentos que atestem a detenção de fundos ou recursos financeiros;

(c) ‘freezing of funds’ means preventing any move, transfer, alteration, use of, access to, or dealing with funds in any way that would result in any change in their volume, amount, location, ownership, possession, character, destination or other change that would enable the funds to be used, including portfolio management;

(c) «Congelamento de fundos», qualquer acção destinada a impedir o movimento, transferência, alteração, utilização ou operação de fundos, ou acesso a estes, que seja susceptível de provocar uma alteração do respectivo volume, montante, localização, propriedade, posse, natureza, destino ou qualquer outra alteração que possa permitir a sua utilização, incluindo a gestão de carteiras de valores mobiliários;

(d) ‘economic resources’ means assets of every kind, whether tangible or intangible, movable or immovable, which are not funds but may be used to obtain funds, goods or services;

(d) «Recursos económicos», activos de qualquer tipo, corpóreos ou incorpóreos, móveis ou imóveis, que não sejam fundos mas que possam ser utilizados na obtenção de fundos, bens ou serviços;

(e) ‘freezing of economic resources’ means preventing their use to obtain funds, goods or services in any way, including, but not limited to, by selling, hiring or mortgaging them;

(e) «Congelamento de recursos económicos», qualquer acção destinada a impedir a respectiva utilização para a obtenção de fundos, bens ou serviços por qualquer meio, designadamente mas não exclusivamente, mediante a sua venda, locação ou hipoteca;

(f) ‘territory of the Community’ means the territories to which the Treaty establishing the European Community is applicable, under the conditions laid down in the Treaty.

(f) «Território da Comunidade», os territórios aos quais o Tratado é aplicável, nas condições nele previstas.

Article 2

Artigo 2.º

It shall be prohibited:

É proibido:

(a) to provide, directly or indirectly, technical assistance related to military activities, to goods and technology listed in the Common Military List of the European Union [5], or related to the provision, manufacture, maintenance and use of goods included in that list to any natural or legal person, entity or body in, or for use in, Guinea;

(a) Prestar, assistência técnica relacionada com as actividades militares, os produtos e tecnologias enumerados na Lista Militar Comum da União Europeia[5], ou com o fornecimento, o fabrico, a manutenção e a utilização dos produtos enumerados nessa lista, a qualquer pessoa singular ou colectiva, entidade ou organismo da Guiné ou para utilização neste país;

(b) to provide, directly or indirectly, financing or financial assistance related to military activities, or to goods and technology listed in the Common Military List of the European Union including in particular grants, loans and export credit insurance, for any sale, supply, transfer or export of such items, or for any provision of related technical assistance to any natural or legal person, entity or body in, or for use in, Guinea;

(b) Financiar ou prestar, directa ou indirectamente, assistência financeira relativa a actividades militares ou, aos produtos e tecnologias enumerados na Lista Militar Comum da União Europeia, incluindo em particular subvenções, empréstimos e seguros de crédito à exportação, para qualquer venda, fornecimento, transferência ou exportação desses artigos, ou para a prestação, neste contexto, de assistência técnica, directa ou indirectamente, a qualquer pessoa singular ou colectiva, entidade ou organismo da Guiné, ou para utilização neste país;

(c) to participate, knowingly and intentionally, in activities, the object or effect of which is to circumvent the prohibitions referred to in points (a) and (b)

(c) Participar, com conhecimento de causa e intencionalmente, em actividades cujo objectivo ou efeito seja contornar as proibições referidas nas alíneas a) ou b).

Article 3

Artigo 3.º

1. All funds and economic resources belonging to, owned, held or controlled by the natural or legal persons, entities and bodies listed in Annex I shall be frozen.

1. São congelados todos os fundos e recursos económicos pertencentes às pessoas singulares ou colectivas, entidades ou organismos enumerados no Anexo I ou por eles detidos ou controlados.

2. No funds or economic resources shall be made available, directly or indirectly, to or for the benefit of the natural or legal persons, entities or bodies listed in Annex I.

2. É proibido colocar, directa ou indirectamente, fundos ou recursos económicos à disposição das pessoas singulares ou colectivas, entidades ou organismos enumerados no Anexo I, ou disponibilizá-los em seu benefício.

3. Annex I shall consist of natural or legal persons, entities and bodies who, in accordance with Article […] of Common Position 2009/…/CFSP, have been identified by the Council as being:

3. O Anexo I enumera as pessoas singulares ou colectivas, entidades e organismos que, em conformidade com o artigo […] da Posição Comum 2009/…/PESC, foram identificados pelo Conselho como

(a) members of the National Council for Democracy and Development (NCDD);

(a) membros do Conselho Nacional para a Democracia e o Desenvolvimento (CNDD);

(b) natural persons associated with them, responsible for the violent repression of 28 September 2009 or the political stalemate in Guinea, or

(b) pessoas singulares a eles associadas, responsáveis pela violenta repressão de 28 de Setembro de 2009 ou pelo impasse político em que se encontra o país, ou

4. The participation, knowingly and intentionally, in activities the object or effect of which is, directly or indirectly, to circumvent the measures referred to in paragraphs 1 and 2 shall be prohibited.

4. É proibido participar, com conhecimento de causa e intencionalmente, em actividades cujo objectivo ou efeito seja contornar, directa ou indirectamente, as medidas referidas nos n.ºs 1 e 2.

Article 4

Artigo 4.º

The prohibitions set out in Articles 2(b) and 3(2) shall not give rise to any liability of any kind on the part of the natural and legal persons, entities and bodies who made funds or economic resources available if they did not know, and had no reasonable cause to suspect, that their actions would infringe the prohibition in question.

As proibições previstas no artigo 2.º, alínea b), e no artigo 3.º, n.º 2, não acarretam qualquer responsabilidade para as pessoas singulares ou colectivas, entidades e organismos que tenha disponibilizado fundos ou recursos económicos, se estes não tinham conhecimento, nem deviam razoavelmente suspeitar, que as suas acções constituiriam uma infracção à proibição em causa.

Article 5

Artigo 5.º

1. By way of derogation from Article 3, the competent authorities of the Member States as listed in Annex II may authorise the release of certain frozen funds or economic resources, or the making available of certain funds or economic resources, under such conditions as they deem appropriate, after having determined that the funds or economic resources are:

1. Em derrogação do disposto no artigo 3º, as autoridades competentes dos Estados-Membros, enumeradas no Anexo II, podem autorizar o desbloqueamento de determinados fundos ou recursos económicos congelados ou a disponibilização de determinados fundos ou recursos económicos, nas condições que considerarem adequadas, quando determinarem que os fundos ou recursos económicos em causa:

(a) necessary to satisfy the basic needs of persons listed in Annex I, and their dependent family members, including payments for foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums, and public utility charges;

(a) São necessários para cobrir as necessidades básicas das pessoas enumeradas no Anexo I e dos membros da família a seu cargo, incluindo os pagamentos de géneros alimentícios, rendas ou empréstimos hipotecários, medicamentos e tratamentos médicos, impostos, apólices de seguro e serviços públicos,

(b) intended exclusively for payment of reasonable professional fees and reimbursement of incurred expenses associated with the provision of legal services;

(b) Se destinam exclusivamente ao pagamento de honorários profissionais razoáveis e ao reembolso de despesas associadas à prestação de serviços jurídicos,

(c) intended exclusively for payment of fees or service charges for routine holding or maintenance of frozen funds or economic resources; or

(c) Se destinam exclusivamente ao pagamento de encargos ou taxas de serviço correspondentes à manutenção ou gestão normal de fundos ou de recursos económicos congelados; ou

(d) necessary for extraordinary expenses, provided in this case that the Member State has notified the grounds on which it considers that a specific authorisation should be granted to all other Member States and to the Commission at least two weeks prior to authorisation.

(d) São necessários para cobrir despesas extraordinárias, desde que o Estado-Membro tenha comunicado aos restantes Estados-Membros e à Comissão, num prazo mínimo de duas semanas antes da autorização, os motivos por que considera que deve ser concedida uma autorização específica.

2. The relevant Member State shall inform the other Member States and the Commission of any authorisation granted under paragraph 1.

2. O Estado-Membro em causa informa os outros Estados-Membros e a Comissão de qualquer autorização concedida ao abrigo do n.º 1.

Article 6

Artigo 6.º

By way of derogation from Article 3, a competent authority listed in Annex II may authorise the release of certain frozen funds or economic resources, if the following conditions are met:

Em derrogação do disposto no artigo 3º, a autoridade competente indicada no Anexo II pode autorizar o desbloqueamento de determinados fundos ou recursos económicos congelados, se estiverem reunidas as seguintes condições:

(a) the funds or economic resources in question are the subject of a judicial, administrative or arbitral lien established prior to the date on which the person, entity or body referred to in Article 3 was included in Annex I, or of a judicial, administrative or arbitral judgment rendered prior to that date;

(a) Os fundos e recursos económicos em questão foram objecto de uma garantia judicial, administrativa ou arbitral constituída antes da data da inclusão no Anexo I da pessoa, entidade ou organismo referido no artigo 3.º, ou de uma decisão judicial, administrativa ou arbitral proferida antes dessa data;

(b) the funds or economic resources in question will be used exclusively to satisfy claims secured by such a lien or recognised as valid in such a judgment, within the limits set by applicable laws and regulations governing the rights of persons having such claims;

(b) Os fundos ou os recursos económicos em questão destinam-se a ser exclusivamente utilizados para satisfazer créditos assim garantidos ou reconhecidos como válidos por essa decisão, nos limites fixados pelas leis e regulamentação que regem os direitos das pessoas titulares desses créditos;

(d) recognising the lien or judgment is not contrary to public policy in the Member State concerned; and

(d) O reconhecimento da garantia ou decisão não é contrário à ordem pública no Estado-Membro em questão; e

(e) the lien or judgment has been notified by the Member State to the Commission.

(e) A garantia ou decisão foi notificada pelo Estado-Membro à Comissão.

Article 7

Artigo 7.º

1. Article 3(2) shall not apply to the addition to frozen accounts of:

(a) interest or other earnings on those accounts; or

(a) Juros ou outras somas devidas a título dessas contas; ou

(b) payments, and transfers of financial instruments due under contracts, agreements or obligations that were concluded or arose before the date on which the natural or legal person, entity or body referred to in Article 3 has been included in Annex I,

(b) Pagamentos e transferências de instrumentos financeiros devidos a título de contratos ou acordos celebrados ou de obrigações contraídas antes da data em que a pessoa singular ou colectiva, entidade ou organismo referido no artigo 3.° foi incluída no Anexo I,

provided that any such interest, other earnings, payments or financial instruments are frozen in accordance with Article 3(1).

desde que os referidos juros, outras somas e pagamentos ou instrumentos financeiros fiquem congelados em conformidade com o artigo 3.º, n.º 1.

2. Article 3(2) shall not prevent financial or credit institutions in the Community from crediting frozen accounts where they receive funds transferred to the account of a listed natural or legal person, entity or body, provided that any additions to such accounts will also be frozen. The financial or credit institution shall inform the relevant competent authority about any such transaction without delay.

O artigo 3.º, n.º 2 não impede que as contas congeladas sejam creditadas por instituições financeiras ou de crédito da Comunidade que recebam fundos transferidos por terceiros para a conta da pessoa singular ou colectiva, entidade ou organismo constante da lista, desde que os valores creditados nessas contas sejam igualmente congelados. A instituição financeira ou de crédito deverá informar sem demora as autoridades competentes acerca dessas transacções.

Article 8

Artigo 8.º

The freezing of funds and economic resources or the refusal to make funds or economic resources available, carried out in good faith on the basis that such action is in accordance with this Regulation, shall not give rise to liability of any kind on the part of the natural or legal person or entity or body implementing it, or its directors or employees, unless it is proved that the funds and economic resources were frozen or withheld as a result of negligence.

O congelamento ou a não disponibilização de fundos e recursos económicos, realizados de boa-fé, no pressuposto de que essa acção está em conformidade com o disposto no presente regulamento, em nada responsabilizam a pessoa singular ou colectiva ou entidade ou organismo que os execute, nem os seus directores ou assalariados, excepto se se provar que o congelamento desses fundos e recursos económicos resulta de negligência.

Article 9

Artigo 9.º

1. Without prejudice to the applicable rules concerning reporting, confidentiality and professional secrecy, natural and legal persons, entities and bodies shall:

1. Sem prejuízo das regras aplicáveis em matéria de comunicação de informações, confidencialidade e sigilo profissional, as pessoas singulares e colectivas, entidades e organismos devem:

(a) supply immediately any information which would facilitate compliance with this Regulation, such as accounts and amounts frozen in accordance with Article 2, to the competent authority listed in Annex II for the country where they are resident or located and shall transmit such information, directly or through the competent authority listed in Annex II, to the Commission; and

(a) Comunicar imediatamente às autoridades competentes enumeradas no Anexo II do país em que residem ou estão estabelecidos todas as informações que facilitem a observância do presente regulamento, nomeadamente dados relativos a contas e montantes congelados em conformidade com o artigo 2.°, bem como transmitir, directamente ou através dessas autoridades, essas informações à Comissão; e

(b) co-operate with that competent authority in any verification of this information.

(b) Colaborar com essas autoridades competentes na verificação dessas informações.

2. Any information provided or received in accordance with this Article shall be used only for the purposes for which it was provided or received.

Article 10

Artigo 10.º

The Commission and Member States shall immediately inform each other of the measures taken under this Regulation and shall supply each other with any other relevant information at their disposal in connection with this Regulation, in particular information in respect of violation and enforcement problems and judgments handed down by national courts.

A Comissão e os Estados-Membros informam-se mútua e imediatamente das medidas adoptadas por força do presente regulamento e comunicam-se todas as informações pertinentes de que disponham relacionadas com o presente regulamento, em especial informações relativas à violação das suas disposições e a problemas ligados à sua aplicação ou a decisões dos tribunais nacionais.

Article 11

Artigo 11.º

1. Annex I shall include only the following information on listed natural persons:

1. O Anexo I incluirá apenas as seguintes informações sobre as pessoas singulares incluídas na lista:

(a) for identification purposes: surname and given names (including alias names and titles, if any); date and place of birth; nationality; passport and identity card numbers; tax and social security numbers; sex; address or other information on whereabouts; function held or profession;

(a) Para efeitos de identificação: os apelidos e nomes próprios, incluindo eventualmente os nomes pelos quais a pessoa também é conhecida e os títulos; a data e o local de nascimento; a nacionalidade; os números de passaporte e de bilhete de identidade; o número de contribuinte e o número da segurança social; o sexo; o endereço ou outras informações sobre o paradeiro; as funções ou profissão;

(b) the date referred to in Articles 6(a) and 7(1)(b);

(b) A data referida no artigo 6.º, alínea a) e no artigo 7.º, n.º 1, alínea b);

2. Annex I may also include information on family members of the persons listed, provided that the inclusion of this information is necessary in a specific case for the sole purpose of verifying the identity of the listed natural person in question.

2. O Anexo I pode também incluir informações sobre os familiares das pessoas constantes da lista, se esses dados forem necessários num caso específico, unicamente para efeitos de verificação da identidade da pessoa singular em causa.

Article 12

Artigo 12.º

1. The Commission shall be empowered to:

(a) amend Annex I on the basis of decisions taken in respect of the Annex to Common Position 2009/…/CFSP; and

(a) Alterar o Anexo I, com base nas decisões adoptadas relativamente ao Anexo da Posição Comum 2009/…/ PESC; e

(b) amend Annex II on the basis of information supplied by Member States.

2. The Commission shall state individual and specific reasons for the decisions taken pursuant to paragraph 1(a), providing the individual, entity or body concerned with an opportunity to express his, her or its view on the matter.

2. A Comissão deve indicar os motivos individuais e específicos das decisões tomadas ao abrigo do n.º 1. alínea a), dando à pessoa, entidade ou organismo em causa a oportunidade de se pronunciar sobre a questão.

3. The Commission shall process personal data in order to carry out its tasks under this Regulation. These tasks include:

3. A Comissão assegura o tratamento dos dados pessoais por forma a exercer as tarefas previstas no presente regulamento. Essas tarefas incluem:

(a) preparing amendments of Annex I to this Regulation;

(a) A preparação das alterações ao Anexo I do presente regulamento;

(b) including the contents of Annex I in the electronic, consolidated list of persons, groups and entities subject to EU financial sanctions available on the Commission website[6];

(b) A consolidação do conteúdo do Anexo I na lista electrónica consolidada das pessoas, grupos e entidades sujeitos às sanções financeiras da UE disponível no sítio Web da Comissão[6];

(d) processing of information on the impact of the measures of this Regulation such as the value of frozen funds and information on authorisations granted by the competent authorities.

(d) O tratamento das informações sobre os efeitos das medidas previstas no presente regulamento, como o valor dos fundos congelados e as informações sobre as autorizações concedidas pelas autoridades competentes.

4. The Commission may process relevant data relating to criminal offences committed by listed natural persons, and to criminal convictions or security measures concerning such persons, only to the extent that such processing is necessary for the preparation of a statement of reasons and review of the views on it expressed by the natural person concerned, subject to appropriate specific safeguards. Such data shall not be made public or exchanged.

4. A Comissão pode tratar dados relevantes relativos a infracções penais cometidas pelas pessoas singulares incluídas na lista, assim como a condenações penais ou medidas de segurança relativas a tais pessoas, apenas se tal se revelar necessário para a preparação de uma exposição de motivos ou para a apreciação das observações apresentadas pela pessoa singular em causa, sob reserva das garantias específicas adequadas. Tais dados não serão divulgados publicamente, nem objecto de intercâmbio.

5. For the purposes of this Regulation, the Commission unit listed in Annex II is designated as “controller” within the meaning of Article 2(d) of Regulation (EC) No 45/2001, in order to ensure that the natural persons concerned can exercise their rights under Regulation (EC) No 45/2001.

5. Para efeitos do presente regulamento, a unidade da Comissão indicada no Anexo II é designada «responsável pelo tratamento» na acepção do artigo 2.º, alínea d), do Regulamento (CE) n.º 45/2001, no sentido de assegurar que as pessoas singulares em causa podem exercer os seus direitos ao abrigo do Regulamento (CE) n.º 45/2001.

6. When the Commission receives classified information, it shall treat it in accordance with Commission Decision 2001/844/EC, ECSC, Euratom[7] and, where applicable, the agreement on the security of classified information concluded between the European Union and the submitting State.

6. Quando a Comissão recebe informações classificadas, trata estas informações em conformidade com o disposto na Decisão 2001/844/CE, CECA, Euratom[7] da Comissão e, se for caso disso, do Acordo sobre a segurança das informações classificadas celebrado entre a União Europeia e o Estado em causa.

7. Documents classified at a level corresponding to ‘TRES SECRET UE/EU TOP SECRET’, ‘SECRET UE’ or ‘CONFIDENTIEL UE’ shall not be released without the consent of the originator.

7. Os documentos classificados num nível correspondente a «TRES SECRET UE/EU TOP SECRET», «SECRET UE» ou «CONFIDENTIEL UE» não serão divulgados sem o consentimento da entidade que os transmitiu.

Article 13

Artigo 13.º

1. Member States shall lay down the rules on penalties applicable to infringements of the provisions of this Regulation and shall take all measures necessary to ensure that they are implemented. The penalties provided for must be effective, proportionate and dissuasive.

1. Os Estados-Membros estabelecem o regime de sanções aplicáveis em caso de infracção ao presente regulamento e tomam as medidas necessárias para assegurar a sua aplicação. As sanções previstas devem ser eficazes, proporcionadas e dissuasivas.

2. Member States shall notify the Commission of those rules without delay after the entry into force of this Regulation and shall notify it of any subsequent amendment.

2. Os Estados-Membros devem notificar esse regime à Comissão imediatamente após a entrada em vigor do regulamento e informá-la de qualquer alteração posterior.

Article 14

Artigo 14.º

Where there is, in this Regulation, a requirement to notify, inform or otherwise communicate with the Commission, the address and other contact details to be used for such communication shall be those indicated in Annex II.

Sempre que o presente regulamento previr uma obrigação de notificação, de informação ou de qualquer outra forma de comunicação com a Comissão, os endereços e outros contactos a utilizar para esses intercâmbios são os que figuram no Anexo II.

Article 15

Artigo 15.º

This Regulation shall apply:

O presente regulamento é aplicável:

(a) within the territory of the Community, including its airspace;

(b) on board any aircraft or any vessel under the jurisdiction of a Member State;

(b) A bordo de qualquer aeronave ou navio sob jurisdição de um Estado-Membro;

(d) to any legal person, entity or body which is incorporated or constituted under the law of a Member State;

(d) A todas as pessoas colectivas, entidades ou organismos registados ou constituídos nos termos do direito de um Estado-Membro;

(e) to any legal person, entity or body in respect of any business done in whole or in part within the Community.

(e) A todas as pessoas colectivas, entidades ou organismos para qualquer actividade económica exercida, total ou parcialmente, na Comunidade.

Article 16

Artigo 16.º

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union .

O presente regulamento entra em vigor na data da sua publicação no Jornal Oficial da União Europeia .

This Regulation shall be binding in its entirety and directly applicable in all Member States.

O presente regulamento é obrigatório em todos os seus elementos e directamente aplicável em todos os Estados-Membros.
