THE COMMISSION OF THE EUROPEAN COMMUNITIES,

A COMISSÃO DAS COMUNIDADES EUROPEIAS,

Having regard to the Treaty establishing the European Community,

Tendo em conta o Tratado que institui a Comunidade Europeia,

Having regard to Directive 2006/66/EC of the European Parliament and of the Council of 6 September 2006 on batteries and accumulators and waste batteries and accumulators and repealing Directive 91/157/EEC [1], and in particular point (b) of Article 10(4) thereof,

Tendo em conta a Directiva 2006/66/CE do Parlamento Europeu e do Conselho, de 6 de Setembro de 2006, relativa a pilhas e acumuladores e respectivos resíduos e que revoga a Directiva 91/157/CEE [1], nomeadamente o n.o 4, alínea b), do artigo 10.o,

Whereas:

Considerando o seguinte:

(1) The annual sales of portable batteries and accumulators to end-users should be expressed as the weight of the portable batteries and accumulators placed on the market in the territory of the Member State in the year concerned, excluding any portable batteries and accumulators that have left the territory of that Member State in that year before being sold to end-users.

(1) As vendas anuais de pilhas e acumuladores portáteis aos utilizadores finais devem ser expressas em peso das pilhas e acumuladores portáteis colocados no mercado no território do Estado-Membro no ano em causa, excluindo as pilhas e os acumuladores portáteis que tenham saído do território do Estado-Membro nesse ano antes da sua venda aos utilizadores finais.

(2) Member States should base the calculation of annual sales of portable batteries and accumulators to end-users on collected data. Statistically significant estimates based on the collected data may also be used for the calculation.

(2) Os Estados-Membros devem basear o cálculo das vendas anuais de pilhas e acumuladores portáteis aos utilizadores finais nos dados recolhidos. Podem também ser utilizadas para o cálculo estimativas estatisticamente significativas baseadas nos dados recolhidos.

(3) The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 18(1) of Directive 2006/12/EC of the European Parliament and the Council [2],

HAS ADOPTED THIS DECISION:

ADOPTOU A PRESENTE DECISÃO:

Article 1

Artigo 1.o

1. Member States shall calculate the annual sales of portable batteries and accumulators to end-users in a given year, as the weight of portable batteries and accumulators placed on the market in the territory of the Member State in the year concerned, excluding any portable batteries and accumulators that have left the territory of that Member State in that year before being sold to the end-users.

O cálculo pelos Estados-Membros das vendas anuais de pilhas e acumuladores portáteis aos utilizadores finais num dado ano será expresso em peso das pilhas e acumuladores portáteis colocados nos respectivos mercados no ano em causa, excluindo as pilhas e os acumuladores portáteis que tenham saído do território do Estado-Membro nesse ano antes da sua venda aos utilizadores finais.

2. The placing on the market of each battery shall be counted once.

2. A colocação de cada pilha no mercado será contabilizada uma vez.

Article 2

Artigo 2.o

The calculation provided for in Article 1 shall be based on collected data or statistically significant estimates based on collected data.

O cálculo previsto no artigo 1.o será baseado nos dados recolhidos ou em estimativas estatisticamente significativas baseadas nos dados recolhidos.

Article 3

Artigo 3.o

This Decision is addressed to the Member States.

Os Estados-Membros são os destinatários da presente decisão.
