Having regard to the Treaty establishing the European Community, and in particular Article 175(1) thereof,

(1) Whereas Article 174 of the Treaty requires prudent and rational utilisation of natural resources; whereas the rational use of energy is one of the principal means by which this objective can be achieved and environmental pollution reduced;
|

(2) Whereas the ultimate objective of the UN Framework Convention on Climate Change is to achieve stabilisation of greenhouse gas concentrations in the atmosphere at a level that prevents dangerous anthropogenic interference with the climate system;
|
(2) Considerando que o objectivo final da Convenção-Quadro das Nações Unidas sobre as alterações climáticas é conseguir a estabilização das concentrações na atmosfera de gases com efeito de estufa a um nível que evite uma interferência antropogénica perigosa com o sistema climático;
|
|
(3) Whereas under the Kyoto Protocol to the United Nations Framework Convention on Climate Change agreed at the December 1997 Kyoto Conference, the Community has accepted the target of reducing its emissions during the period 2008 to 2012 in respect of a basket of greenhouse gases by 8 % relative to 1990 levels;
|
(3) Considerando que, no âmbito do protocolo adoptado na Conferência das Partes na Convenção-Quadro das Nações Unidas sobre as alterações climáticas realizada em Quioto, em Dezembro de 1997, a Comunidade aceitou o objectivo de redução das suas emissões de um conjunto de gases com efeito de estufa em 8 % em relação aos níveis de 1990 durante o período de 2008 a 2012;
|
|
(4) Whereas in recognition of the importance of passenger cars as a source of CO2 emissions, the Commission has proposed a Community strategy to reduce CO2 emissions from passenger cars and to improve fuel economy; whereas in its Conclusions of 25 June 1996 the Council welcomed the Commission's approach;
|
(4) Considerando que, reconhecendo a importância dos automóveis de passageiros como fonte de emissões de CO2, a Comissão propôs uma estratégia comunitária para reduzir as emissões de CO2 provenientes dos automóveis de passageiros e melhorar a economia de combustível; e que a abordagem sugerida pela Comissão foi favoravelmente acolhida pelo Conselho nas conclusões de 25 de Junho de 1996;
|
|
(5) Whereas information plays a key role in the operation of market forces; whereas the provision of accurate, relevant and comparable information on the specific fuel consumption and CO2 emissions of passenger cars may influence consumer choice in favour of those cars which use less fuel and thereby emit less CO2, thereby encouraging manufacturers to take steps to reduce the fuel consumption of the cars that they manufacture;
|
(5) Considerando que a informação desempenha um papel fundamental no funcionamento das forças de mercado; que o fornecimento de informações correctas, relevantes e comparáveis sobre o consumo específico de combustível e as emissões de CO2 provenientes dos automóveis de passageiros pode influenciar a escolha do consumidor em favor dos automóveis que utilizam menos combustível e portanto emitem menos CO2, incitando assim os fabricantes a adoptarem medidas para a redução do consumo de combustível dos automóveis por si fabricados;

(6) Whereas the presence of labels on used cars at the point of sale could influence buyers of new passenger cars towards low consumption cars, since this characteristic will be taken into account when the car is re-sold; whereas it is therefore appropriate, in connection with the first review of this Directive, to consider enlarging the scope to used cars covered by Commission Directive 93/116/EC of 17 December 1993 adapting to technical progress Council Directive 80/1268/EEC relating to the fuel consumption of motor vehicles(4);
|
(6) Considerando que a presença de etiquetas nos veículos usados no ponto de venda poderia influenciar os compradores de veículos de passageiros novos para a compra de carros de baixo consumo, uma vez que esta característica será tida em consideração quando o carro for de novo vendido; considerando que é por isso apropriado, no âmbito da primeira revisão da presente directiva, considerar o alargamento do seu âmbito aos veículos usados abrangidos pela Directiva 93/116/CE da Comissão, de 17 de Dezembro de 1993, que adapta ao progresso técnico a Directiva 80/1268/CEE do Conselho relativa ao consumo de combustível dos veículos a motor(4);
|
|
(7) Whereas it is therefore necessary to develop a fuel economy label for all new passenger cars displayed at the point of sale;
|
(7) Considerando que, por conseguinte, é necessário criar uma etiqueta relativa à economia de combustível para todos os automóveis novos de passageiros expostos nos pontos de venda;
|
|
(8) Whereas a fuel economy label should contain information on fuel consumption and specific emissions of CO2 that have been determined in accordance with the harmonised standards and methods laid down in Council Directive 80/1268/EEC of 16 December 1980 relating to the carbon dioxide emissions and fuel consumption of motor vehicles(5);
|
(8) Considerando que a etiqueta relativa à economia de combustível deve conter informações sobre o consumo de combustível e as emissões específicas de CO2 que tiverem sido determinadas de acordo com as normas e os métodos harmonizados previstos na Directiva 80/1268/CEE do Conselho, de 16 de Dezembro de 1980, relativa às emissões de dióxido de carbono e ao consumo de combustível dos veículos a motor(5);
|
|
(9) Whereas it is necessary that supplementary standardised information on the fuel consumption and specific CO2 emissions of all versions on the new car market is available in a suitable form both at the point of sale and from a designated body in each Member State; whereas such information may be useful to consumers who formulate their purchase decision before entering the showroom or who choose not to use the services of a dealer or visit a showroom when purchasing a passenger car;
|
(9) Considerando que é necessário que haja, tanto no ponto de venda como quando fornecidas por um organismo designado em cada Estado-Membro, informações normalizadas adicionais apresentadas de forma adequada, sobre o consumo de combustível e as emissões específicas de CO2 de todos os modelos no mercado dos automóveis novos; que essas informações podem ser úteis para os consumidores que tomam as suas decisões de compra antes de entrarem na sala de exposição ou que preferem não utilizar os serviços de um distribuidor nem visitar uma sala de exposição ao comprar um automóvel de passageiros;

(10) Whereas it is important that potential customers are made aware, at the point of sale, of the most fuel efficient passenger car models available through that point of sale;
|

(11) Whereas all promotional literature, and, as appropriate, all other promotional material, used in the marketing of new passenger cars, should contain data on the relevant fuel consumption and CO2 emissions for the passenger car models to which it pertains,
|

HAVE ADOPTED THIS DIRECTIVE:

Article 1
|
Artigo 1.o
|
|
The purpose of this Directive is to ensure that information relating to the fuel economy and CO2 emissions of new passenger cars offered for sale or lease in the Community is made available to consumers in order to enable consumers to make an informed choice.
|
A presente directiva tem por objectivo assegurar que os consumidores tenham ao seu dispor informações sobre a economia de combustível e as emissões de CO2 dos automóveis novos de passageiros oferecidos para venda ou locação financeira na Comunidade, a fim de lhes permitir uma escolha esclarecida.

Article 2
|
Artigo 2.o
|
|
For the purposes of this Directive:
|
Para efeitos da presente directiva, entende-se por:
|
|
1. "passenger car" means any motor vehicle of category M1, as defined in Annex II to Directive 70/156/EEC(6) and which falls under the scope of Directive 80/1268/EEC. It does not include vehicles falling under the scope of Directive 92/61/EEC(7) and special purpose vehicles as defined in the second indent of Article 4(1)(a) of Directive 70/156/EEC;

1. "Automóvel de passageiros", qualquer veículo a motor da categoria M1, tal como definido no anexo II da Directiva 70/156/CEE(6) e abrangido pela Directiva 80/1268/CEE. Estão excluídos os veículos abrangidos pela Directiva 92/61/CEE(7) e os veículos para fins especiais, tal como definidos no n.o 1, alínea a), segundo travessão, do artigo 4.o da Directiva 70/156/CEE.

2. "new passenger car" means any passenger car which has not previously been sold to a person who bought it for a purpose other than that of selling or supplying it;
|
2. "Automóvel novo de passageiros", qualquer automóvel de passageiros que não tenha sido previamente vendido a uma pessoa que o comprou para um fim diferente da sua venda ou fornecimento.

|
3. "certificate of conformity" means the certificate referred to in Article 6 of Directive 70/156/EEC;
|
3. "Certificado de conformidade", o certificado especificado no artigo 6.o da Directiva 70/156/CEE;
|
|
4. "point of sale" means a location, such as a car showroom or forecourt, where new passenger cars are displayed or offered for sale or lease to potential customers. Trade fairs where new passenger cars are presented to the public are included in this definition;
|
4. "Ponto de venda", um local, tal como um stand ou um átrio de exposição, em que os automóveis novos de passageiros estão expostos ou são oferecidos para venda ou locação financeira a potenciais compradores; as feiras comerciais onde os automóveis novos de passageiros são apresentados ao público fazem parte desta definição.

5. "official fuel consumption" means the fuel consumption type-approved by the approval authority in accordance with the provisions of Directive 80/1268/EEC and mentioned in Annex VIII of Directive 70/156/EEC and attached to the EC vehicle type-approval certificate or in the certificate of conformity. Where several variants and/or versions are grouped under one model, the value to be given for fuel consumption of that model shall be based on the variant and/or version with the highest official fuel consumption within that group;
|
5. "Consumo oficial de combustível", o consumo de combustível homologado pelas autoridades de homologação nos termos da Directiva 80/1268/CEE e referido no anexo VIII da Directiva 70/156/CEE, apenso ao certificado de homologação CE ou ao certificado de conformidade. Quando diferentes variantes e/ou versões estejam agrupadas num mesmo modelo, o valor referente ao consumo de combustível a apresentar para esse modelo deverá basear-se na variante e/ou versão que registe o mais elevado consumo oficial de combustível nesse grupo.

6. "official specific emissions of CO2" for a given passenger car means those measured in accordance with the provisions of Directive 80/1268/EEC and mentioned in Annex VIII of Directive 70/156/EEC and attached to the EC vehicle type-approval certificate or in the certificate of conformity. Where several variants and/or versions are grouped under one model, the values to be given for CO2 of that model shall be based on the variant and/or version with the highest official CO2 emissions within that group;
|
6. "Emissões específicas oficiais de CO2" de um dado automóvel de passageiros, as respectivas emissões de CO2 medidas nos termos da Directiva 80/1268/CEE e mencionadas no anexo VIII da Directiva 70/156/CEE, apensas ao certificado de homologação CE do veículo ou ao certificado de conformidade. Quando diferentes variantes e/ou versões estejam agrupadas num mesmo modelo, o valor referente às emissões de CO2 a apresentar para esse modelo deverá basear-se na variante e/ou versão que registe o mais elevado teor oficial de emissão de CO2 nesse grupo.

7. "fuel economy label" means a label which contains consumer information regarding the official fuel consumption and the official specific emissions of CO2 of the car to which the label is attached;
|
7. "Etiqueta relativa à economia de combustível", etiqueta que contém informações para o consumidor sobre o consumo oficial de combustível e as emissões específicas oficiais de CO2 do veículo em que está afixada.
|
|
8. "fuel economy guide" means a compilation of the official fuel consumption data and official specific emissions of CO2 for each motel available on the new car market;
|
8. "Guia de economia de combustível", a compilação dos dados relativos ao consumo oficial de combustível e às emissões específicas oficiais de CO2 para cada modelo disponível no mercado de automóveis novos.
|
|
9. "promotional literature" means all printed matter used in the marketing, advertising and promotion of vehicles to the general public. It includes, as a minimum, technical manuals, brochures, advertisements in newspapers, magazines and trade press and posters;
|
9. "Literatura promocional", todos os impressos utilizados na comercialização, publicidade e promoção dos veículos junto do público; inclui, no mínimo, manuais técnicos, brochuras, anúncios em jornais, revistas e imprensa do sector e cartazes.
|
|
10. "make" means the trade name of the manufacturer and is that which appears on the certificate of conformity and the type-approval documentation;
|
10. "Marca", o nome comercial do fabricante que consta do certificado de conformidade e da documentação da homologação.
|
|
11. "model" means the commercial description of the make, type, and, if available and appropriate, variant and version of a passenger car;
|
11. "Modelo", a descrição comercial da marca, do tipo, e, se pertinente, da variante e versão de um automóvel de passageiros.
|
|
12. "type", "variant" and "version" mean the differentiated vehicles of a given make that are declared by the manufacturer, as described in Annex II.B to Directive 70/156/EEC, and uniquely identified by type, variant and version alphanumeric characters.

Article 3

|
The Member States shall ensure that a label on fuel economy and CO2 emissions, which is in accordance with the requirements described in Annex I, is attached to or displayed, in a clearly visible manner, near each new passenger car model at the point of sale.

Os Estados-Membros assegurarão que seja fixada ou afixada, de modo claramente visível, junto de todos os modelos de automóveis novos de passageiros no ponto de venda uma etiqueta relativa à economia de combustível e às emissões de CO2 que satisfaça os requisitos do anexo I.

Article 4
|
Artigo 4.o
|
|
Without prejudice to the establishment by the Commission of an Internet guide at Community level, the Member States shall ensure that a guide on fuel economy and CO2 emissions is produced in consultation with manufacturers on at least an annual basis in accordance with the requirements of Annex II. The guide shall be portable, compact and available free of charge to consumers upon request both at the point of sale and also from a designated body within each Member State.

Sem prejuízo da criação pela Comissão de um guia acessível pela Internet a nível da Comunidade, os Estados-Membros assegurarão que seja elaborado, em consulta com os fabricantes, pelo menos anualmente, um guia sobre a economia de combustível e as emissões de CO2, que preencha os requisitos do anexo II. Esse guia deve ser compacto, portátil e posto gratuitamente à disposição dos consumidores a pedido destes, tanto no ponto de venda como em organismos designados em cada Estado-Membro.

The authority or authorities referred to in Article 8 may cooperate in the preparation of the guide.
|

Article 5
|

|
|
The Member States shall ensure that, for each make of car, a poster (or alternatively, a display) is exhibited with a list of the official fuel consumption data and the official specific CO2 emissions data of all new passenger car models displayed or offered for sale or lease at or through that point of sale. This data shall be displayed in a prominent position and in accordance with the format in Annex III.

Os Estados-Membros assegurarão que, para cada marca de automóveis, seja exibido um cartaz (ou, em alternativa, um expositor) com uma lista dos dados relativos ao consumo oficial de combustível e às emissões específicas oficiais de CO2 de todos os modelos de automóveis novos de passageiros expostos ou propostos para venda ou locação financeira no ponto de venda ou através deste. Esses dados serão expostos em posição de destaque, segundo o modelo do anexo III.

Article 6

The Member States shall ensure that all promotional literature contains the official fuel consumption and the official specific CO2 emission data of the passenger car models to which it refers in accordance with the requirements of Annex IV.
|
Os Estados-Membros assegurarão que toda a literatura promocional contenha os dados relativos ao consumo oficial de combustível e às emissões específicas oficiais de CO2 dos modelos de automóveis de passageiros a que se refere, de acordo com os requisitos do anexo IV.
|
|
Member States shall, as appropriate, provide for promotional material other than the promotional literature referred to above to indicate the official CO2 emission data and the official fuel consumption data of the specific car model to which it refers.
|
Os Estados-Membros elaborarão eventualmente material promocional, para além da literatura promocional acima referida, contendo dados sobre a emissão oficial de CO2 e o consumo oficial de combustível do modelo específico de veículo a que se refere.

Article 7
|
Artigo 7.o
|
|
The Member States shall ensure that the presence on labels, guides, posters or promotional literature and material referred to in Articles 3, 4, 5 and 6 of other marks, symbols or inscriptions relating to fuel consumption or CO2 emissions which do not comply with the requirements of this Directive is prohibited, if their display might cause confusion to potential consumers of new passenger cars.

Os Estados-Membros assegurarão que seja proibida a presença nas etiquetas, guias, cartazes ou literatura e material promocional referidos nos artigos 3.o, 4.o, 5.o, e 6.o, de outras marcas, símbolos ou inscrições relativas ao consumo de combustível ou às emissões de CO2 que não preencham os requisitos da presente directiva, se essa presença puder criar confusão aos potenciais consumidores de automóveis novos de passageiros.

Article 8
|
Artigo 8.o

|
The Member States shall notify the Commission of the competent authority or authorities responsible for the implementation and functioning of the consumer information scheme described in this Directive.
|
Os Estados-Membros notificarão a Comissão da autoridade ou autoridades competentes responsáveis pela aplicação e funcionamento do sistema de informação dos consumidores descrito na presente directiva.
|
|
|
|
|
Article 9
|
Artigo 9.o
|
|
Any amendments which are necessary in order to adapt the Annexes to this Directive shall be adopted by the Commission in accordance with the procedure set out in Article 10 and following consultation with consumer organisations and other interested parties.
|
As alterações necessárias para proceder à adaptação dos anexos da presente directiva serão adoptadas pela Comissão nos termos do artigo 10.o, após consulta das organizações de consumidores e das outras partes interessadas.
|
|
In order to assist this adaptation process, each Member State shall transmit to the Commission, by 31 December 2003, a report on the effectiveness of the provisions of this Directive, covering the period from 18 January 2001 until 31 December 2002. The format of this report shall be established in accordance with the procedure set out in Article 10 not later than 18 January 2001.
|
Em apoio deste processo de adaptação, cada Estado-Membro apresentará à Comissão, até 31 de Dezembro de 2003, um relatório sobre a eficácia das medidas previstas na presente directiva, que abranja o período compreendido entre 18 de Janeiro de 2001 e 31 de Dezembro de 2002. O modelo desse relatório será estabelecido nos termos do artigo 10.o, o mais tardar em 18 de Janeiro de 2001.

Furthermore, the Commission shall, in accordance with the procedure laid down in Article 10, take measures aiming at:
|
Além disso, a Comissão, nos termos do artigo 10.o, tomará medidas destinadas a:
|
|
(a) further specifying the format of the label referred to in Article 3 by amending Annex I;
|
a) Especificar melhor o formato da etiqueta prevista no artigo 3.o, através de uma alteração do anexo I;
|
|
(b) further specifying the requirements concerning the guide referred to in Article 4 with a view to classifying new car models thus enabling a listing of the models according to CO2 emissions and fuel consumption in specified classes including a class for a listing of the most fuel efficient new car models;
|
b) Especificar melhor os requisitos relativos ao guia previsto no artigo 4.o, a fim de classificar os novos modelos de veículos, permitindo assim uma listagem dos modelos de acordo com as emissões de CO2 e com o consumo de combustível em classes especificadas, nomeadamente numa classe em que sejam incluídos os novos modelos mais eficientes em termos de combustível;
|
|
(c) establishing recommendations in order to enable the application of the principles of the provisions on promotional literature referred to in the first paragraph of Article 6 to other media and material.
|
c) Formular recomendações destinadas a permitir a aplicação dos princípios das disposições sobre literatura promocional a que se refere o primeiro parágrafo do artigo 6.o a outros materiais e meios de comunicação social.

Article 10

The Commission shall be assisted by a committee composed of the representatives of the Member States and chaired by a representative of the Commission.
|
A Comissão será assistida por um comité composto por representantes dos Estados-Membros e presidido pelo representante da Comissão.
|
|
The representative of the Commission shall submit to the committee a draft of the measures to be taken. The committee shall deliver its opinion on that draft within a time limit which the chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 205 of the Treaty in the case of decisions which the Council is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the committee shall be weighted in the manner laid down in that Article. The chairman shall not vote.
|
O representante da Comissão submeterá à apreciação do comité um projecto das medidas a tomar. O comité emitirá o seu parecer sobre esse projecto num prazo que o presidente pode fixar em função da urgência da questão. O parecer será emitido por maioria, nos termos previstos no n.o 2 do artigo 205.o do Tratado para a adopção das decisões que o Conselho é chamado a tomar sob proposta da Comissão. Nas votações do comité, os votos dos representantes dos Estados-Membros estão sujeitos à ponderação definida no artigo atrás referido. O presidente não participa na votação.

|
The Commission shall adopt the measures envisaged if they are in accordance with the opinion of the committee.
|
A Comissão adoptará as medidas projectadas desde que sejam conformes com o parecer do comité.
|
|
If the measures envisaged are not in accordance with the opinion of the committee, or if no opinion is delivered, the Commission shall, without delay, submit to the Council a proposal relating to the measures to be taken. The Council shall act by a qualified majority.
|
Se as medidas projectadas não forem conformes com o parecer do comité, ou na ausência de parecer, a Comissão submeterá sem demora ao Conselho uma proposta relativa às medidas a tomar. O Conselho deliberará por maioria qualificada.
|
|
If, on the expiry of a period of three months from the date of referral to the Council, the Council has not acted, the proposed measures shall be adopted by the Commission.
|
Se, no termo de um prazo de três meses a contar da data em que o assunto foi submetido à apreciação do Conselho, este último ainda não tiver deliberado, a Comissão adoptará as medidas propostas.
|

Article 11
|
Artigo 11.o

|
Member States shall determine the penalties applicable to breaches of the national provisions adopted pursuant to this Directive. The penalties shall be effective, proportionate and dissuasive.
|
Os Estados-Membros determinarão as sanções aplicáveis às violações das disposições nacionais adoptadas nos termos da presente directiva. Essas sanções terão um carácter efectivo, proporcionado e dissuasivo.

Article 12
|

|
1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 18 January 2001. They shall forthwith inform the Commission thereof.
|
1. Os Estados-Membros porão em vigor as disposições legislativas, regulamentares e adminatrativas necessárias para dar cumprimento à presente directiva, o mais tardar em 18 de Janeiro de 2001. Do facto informarão imediatamente a Comissão.
|
|
When Member States adopt these provisions, they shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The procedure for such reference shall be adopted by Member States.
|

The Member States must ensure that all promotional literature contains the official fuel consumption and official specific CO2 emissions data of the vehicles to which it refers. This information should, as a minimum, meet the following requirements:

Os Estados-Membros assegurarão que toda a literatura promocional contenha os dados sobre o consumo oficial de combustível e as emissões específicas oficiais de CO2 dos veículos a que se refere. Essa informação deve, no mínimo, satisfazer os seguintes requisitos:

1. be easy to read and no less prominent than the main part of the information provided in the promotional literature;
