THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 95 thereof,

Having regard to the proposal from the Commission(1),

Having regard to the opinion of the Economic and Social Committee(2),

Acting in accordance with the procedure laid down in Article 251 of the Treaty(3),

Whereas:

Considerando o seguinte:

(1) The eighth Directive, 97/44/EC, of the European Parliament and of the Council of 22 July 1997 on summer-time arrangements(4) introduced a common date and time in all Member States, for the beginning and end of summer time in 1998, 1999, 2000 and 2001.

(1) A oitava Directiva 97/44/CE do Parlamento Europeu e do Conselho, de 22 de Julho de 1997, respeitante às disposições relativas à hora de Verão(4), introduziu uma data e uma hora comuns, em todos os Estados-Membros, para o início e o fim do período da hora de Verão nos anos de 1998, 1999, 2000 e 2001.

(2) Given that the Member States apply summer-time arrangements, it is important for the functioning of the internal market that a common date and time for the beginning and end of the summer-time period be fixed throughout the Community.

(2) Dado que os Estados-Membros aplicam disposições relativas à hora de Verão, é importante, para o funcionamento do mercado interno, continuar a fixar uma data e uma hora comuns para o início e o fim do período da hora de Verão, válidas no espaço comunitário.

(3) Since the summer-time period considered most appropriate by the Member States runs from the end of March to the end of October, it is appropriate that that period therefore be maintained.

(3) O período da hora de Verão que os Estados-Membros consideram mais adequado vai do final de Março ao final de Outubro, pelo que convém manter este período.

(4) The proper functioning of certain sectors, not only transport and communications, but also other sectors of industry, requires stable, long-term planning. Provisions concerning summer time should therefore be laid down for an unspecified period. Article 4 of Directive 97/44/EC provides, in that respect, that the European Parliament and the Council are to adopt, by 1 January 2001, the arrangements to apply from 2002 onwards.

(4) O bom funcionamento de determinados sectores, não só o dos transportes e o das comunicações, mas também outros sectores da indústria, exige uma programação estável a longo prazo. Consequentemente, justifica-se o estabelecimento, por um prazo não especificado, de disposições relativas ao período da hora de Verão. O artigo 4.o da Directiva 97/44/CE prevê, a esse respeito, que o Parlamento Europeu e o Conselho adoptem, antes de 1 de Janeiro de 2001, o regime aplicável a partir de 2002.

(5) For reasons of clarity and accuracy of information, a timetable for the implementation of the summer-time period for the following five years should be published every five years.

(5) Por motivos de clareza e de precisão da informação, convém publicar de cinco em cinco anos o calendário de aplicação do período da hora de Verão para os cinco anos seguintes.

(6) Implementation of this Directive should, moreover, be monitored by means of a report, to be presented by the Commission to the European Parliament, the Council and the Economic and Social Committee, on the impact of these provisions in all of the areas concerned. That report should be based on the information made available to the Commission by the Member States in sufficient time to enable the report to be presented at the specified time.

(6) Convém, além disso, seguir a aplicação da presente directiva através de um relatório a apresentar pela Comissão ao Parlamento Europeu, ao Conselho e ao Comité Económico e Social sobre a implicação das presentes disposições em todos os sectores envolvidos. Esse relatório deve basear-se nas informações comunicadas pelos Estados-Membros à Comissão em tempo útil, para permitir apresentá-lo dentro do prazo fixado.

(7) Given that the complete harmonisation of the timetable for the summer-time period with a view to facilitating transport and communications cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may take measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. This Directive does not go beyond what is necessary to achieve those objectives.

(7) Atendendo a que a harmonização completa do calendário do período da hora de Verão, com vista a facilitar os transportes e as comunicações, não pode ser suficientemente realizada pelos Estados-Membros e pode, pois, ser melhor alcançada ao nível comunitário, a Comunidade pode tomar medidas, em conformidade com o princípio da subsidiariedade tal como estabelecido no artigo 5.o do Tratado. A presente directiva não excede o que é necessário para a consecução dos objectivos.

(8) For geographical reasons, the common summer-time arrangements should not apply to the overseas territories of the Member States,

HAVE ADOPTED THIS DIRECTIVE:

Article 1

Artigo 1.o

For the purposes of this Directive "summer-time period" shall mean the period of the year during which clocks are put forward by 60 minutes compared with the rest of the year.

Para efeitos da presente directiva, entende-se por "período da hora de Verão", o período do ano durante o qual a hora é adiantada 60 minutos em relação à hora do resto do ano.

Article 2

Artigo 2.o

From 2002 onwards, the summer-time period shall begin, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in March.

A partir de 2002, em todos os Estados-Membros, o período da hora de Verão tem início à 1 hora da manhã, tempo universal, do último domingo de Março.

Article 3

Artigo 3.o

From 2002 onwards, the summer-time period shall end, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in October.

A partir de 2002, em todos os Estados-Membros, o período da hora de Verão termina à 1 hora da manhã, tempo universal, do último domingo de Outubro.

Article 4

Artigo 4.o

The Commission shall publish a communication in the Official Journal of the European Communities(5), for the first time on the occasion of the publication of this Directive, and every five years thereafter, containing the timetable showing the dates on which the summer-time period will begin and end for the following five years.

A Comissão publicará, no Jornal Oficial das Comunidades Europeias(5), pela primeira vez aquando da publicação da presente directiva e seguidamente todos os cinco anos, uma comunicação incluindo o calendário das datas de início e termo do período da hora de Verão para os cinco anos seguintes.

Article 5

Artigo 5.o

The Commission shall report to the European Parliament, the Council and the Economic and Social Committee on the impact of the provisions of this Directive on the sectors concerned by 31 December 2007 at the latest.

A Comissão apresentará, até 31 de Dezembro de 2007, um relatório ao Parlamento Europeu, ao Conselho e ao Comité Económico e Social sobre a incidência das disposições da presente directiva nos sectores envolvidos.

That report shall be drawn up on the basis of the information made available to the Commission by each Member State by 30 April 2007 at the latest.

O referido relatório deve ser estabelecido com base nas informações comunicadas por cada Estado-Membro até 30 de Abril de 2007.

The Commission shall, if necessary and following the conclusions of the report, make appropriate proposals.

A Comissão apresentará, se necessário e na sequência das conclusões do relatório, propostas adequadas.

Article 6

Artigo 6.o

This Directive shall not apply to the overseas territories of the Member States.

A presente directiva não é aplicável aos territórios ultramarinos dos Estados-Membros.

Article 7

Artigo 7.o

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 December 2001 at the latest. They shall forthwith inform the Commission thereof.

Os Estados-Membros devem pôr em vigor as disposições legislativas, regulamentares e administrativas necessárias para dar cumprimento à presente directiva até 31 de Dezembro de 2001 e informar imediatamente a Comissão desse facto.

When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Quando os Estados-Membros aprovarem essas disposições, estas devem incluir uma referência à presente directiva ou ser acompanhadas dessa referência aquando da publicação oficial. As modalidades dessa referência serão aprovadas pelos Estados-Membros.

Article 8

Artigo 8.o

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.

A presente directiva entra em vigor na data da sua publicação no Jornal Oficial das Comunidades Europeias.

Article 9

Artigo 9.o

This Directive is addressed to the Member States.

Os Estados-Membros são os destinatários da presente directiva.
