THE COMMISSION OF THE EUROPEAN COMMUNITIES,

A COMISSÃO DAS COMUNIDADES EUROPEIAS,

Having regard to the Treaty establishing the European Economic Community,

Tendo em conta o Tratado que institui a Comunidade Económica Europeia,

Having regard to Council Directive 72/462/EEC of 12 December 1972 on health and veterinary inspection problems upon importation of bovine animals, swine and fresh meat from third countries (1), as last amended by Regulation (EEC) No 3768/85 (2), and in particular Articles 4 (1) and 18 (1),

Tendo em conta a Directiva 72/462/CEE do Conselho, de 12 de Dezembro de 1972, relativa a problemas sanitários e do polícia sanitária na importação de animais das espécies bovina e suína e das carnes frescas provenientes de países terceiros (1), com a última redacção que lhe foi dada pelo Regulamento (CEE) nº 3768/85 (2), e, nomeadamente, o nº 1 do seu artigo 4º e nº 1 do seu artigo 18º,

Having regard to Council Directive 77/96/EEC of 21 December 1976 on the examination for trichinae (Trichinella spiralis) upon importation from third countries of fresh meat derived from domestic swine (3), as last amended by Regulation (EEC) No 3768/85, and in particular Article 4 thereof,

Tendo em conta a Directiva 77/96/CEE do Conselho, de 21 de Dezembro de 1976, relativa à investigação de triquinas aquando das importações, provenientes de países terceiros, de carne fresca de animais domésticos de espécie suína (3), com a última redacção que lhe foi dada pelo Regulamento (CEE) nº 3768/85, e, nomeadamente o seu artigo 4º,

Whereas a list of establishments in Romania, approved for the purpose of importing fresh meat into the Community, was drawn up initially by Commission Decision 83/218/EEC (4), as last amended by Decision 85/512/EEC (5);

Considerando que a lista dos estabelecimentos da Roménia aprovados para efeitos da importação de carnes frescas na Comunidade foi inicialmente estabelecida pela Decisão 83/218/CEE da Comissão (4), com a última redacção que lhe foi dada pela Decisão 85/512/CEE (5);

Whereas a routine inspection under Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 83/196/EEC of 8 April 1983 concerning on-the-spot inspections to be carried out in respect of the importation of bovine animals, swine and fresh meat from non-member countries (6) has revealed that the level of hygiene of certain establishments has altered since the last inspection;

Considerando que numa inspecção de rotina efectuada em aplicação do artigo 5º da Directiva 72/462/CEE e do nº 1 do artigo 3º da Decisão 83/196/CEE da Comissão, de 8 de Abril de 1983, relativa aos controlos efectuados in loco no âmbito do regime aplicável às importações de animais das espécies bovina e suína bem como de carnes frescas provenientes de países terceiros (6), se verificou que o nível de higiene de determinados estabelecimentos sofreu alterações relativamente à inspecção anterior;

Whereas this same inspection has shown that a further establishment complies with the conditions of Article 2 of Directive 77/96/EEC; whereas, therefore, this establishment may be authorized to carry out the examination to detect the presence of trichinae in fresh pigmeat;

Considerando que a mesma inspecção revelou que um novo estabelecimento está em conformidade com as condições previstas no artigo 2º da Directiva 77/96/CEE; que, por conseguinte, pode ser autorizado a executar o exame para a detecção de triquinas na carne fresca de suíno;

Whereas the list of establishments should therefore be amended;

Considerando que é necessário alterar em consequência a lista dos estabelecimentos;

Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Veterinary Committee,

Considerando que as medidas previstas na presente decisão estão em conformidade com o parecer do Comité Veterinário Permanente,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 83/218/EEC is hereby replaced by the Annex to this Decision.

O anexo da Decisão 83/218/CEE é substituído pelo anexo da presente decisão.

Article 2

This Decision is addressed to the Member States.

Os Estados-membros são destinatários da presente decisão.
