Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 96/49/EC of 23 July 1996 on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail(1), and in particular Article 8 thereof,

uwzględniając dyrektywę Rady 96/49/WE z dnia 23 lipca 1996 r. w sprawie zbliżania ustawodawstw Państw Członkowskich w zakresie kolejowego transportu towarów niebezpiecznych(1), w szczególności jej art. 8,

Whereas:

(1) The Annex to Directive 96/49/EC refers to the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID), as applicable with effect from 1 July 2003 .

(1) W załączniku do dyrektywy 96/49/WE mowa jest o regulaminie międzynarodowego przewozu kolejami towarów niebezpiecznych (RID), stosowanym od 1 lipca 2003 r.

(2) The RID is normally updated every two years, the latest update being in force from 1 January 2003 , with a transitional period up to 30 June 2003 .

(2) RID jest zwykle aktualizowany co dwa lata. Ostatnia aktualizacja obowiązuje od 1 stycznia 2003 r. , z okresem przejściowym do 30 czerwca 2003 r.

(3) Exceptionally the RID was updated again after one year so that the amended version entered into force on 1 January 2004 .

(3) Wyjątkowo RID został zaktualizowany ponownie po upływie roku i jego aktualna wersja weszła w życie 1 stycznia 2004 r.

(4) It is therefore necessary to amend the Annex to Directive 96/49/EC.

(5) The measures provided for in this Directive are in accordance with the opinion of the Committee on the transport of dangerous goods referred to in Article 9 of Directive 96/49/EC,

HAS ADOPTED THIS DIRECTIVE:

The Annex to Directive 96/49/EC is replaced by the following:

Załącznik do dyrektywy 96/49/WE otrzymuje brzmienie:

«Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) appearing in Annex I to Appendix B to the Convention concerning International Carriage by Rail (COTIF), as applicable with effect from 1 January 2004 , it being understood that the terms «contracting party» and «the States or the railways» will be replaced by the term «Member State» .

ŤPrzepisy dotyczące międzynarodowego przewozu kolejami towarów niebezpiecznych (RID) zamieszczone w załączniku I do dodatku B do Konwencji o międzynarodowym przewozie kolejami (COTIF), stosowane z mocą od dnia 1 stycznia 2004 r. , przy zrozumieniu, że wyrażenia Ťumawiająca się stronať oraz ŤPaństwa lub drogi kolejoweť zastępuje się wyrażeniami ŤPaństwa Członkowskieť .

The text of the amendments of the 2004 version of the RID will be published as soon as it is available in all official languages of the Community.»

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 October 2004 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

1. Państwa Członkowskie wprowadzają w życie przepisy ustawowe, wykonawcze i administracyjne niezbędne do wykonania niniejszej dyrektywy najpóźniej do 1 października 2004 r. Państwa Członkowskie niezwłocznie przekazują Komisji teksty tych przepisów oraz tabele korelacji pomiędzy tymi przepisami a niniejszą dyrektywą.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Przepisy przyjęte przez Państwa Członkowskie zawierają odniesienie do niniejszej dyrektywy lub odniesienie takie towarzyszy ich urzędowej publikacji. Metody dokonywania takiego odniesienia określane są przez Państwa Członkowskie.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Państwa Członkowskie przekazują Komisji teksty podstawowych przepisów prawa krajowego, przyjętych w dziedzinach objętych niniejszą dyrektywą.

Article 3

Artykuł 3

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

Niniejsza dyrektywa wchodzi w życie dwudziestego dnia po jej opublikowaniu w Dzienniku Urzędowym Unii Europejskiej .

This Directive is addressed to the Member States.

Niniejsza dyrektywa skierowana jest do Państw Członkowskich.
