Having regard to the Treaty establishing the European Community,

Having regard to Directive 98/8/EC of the European Parliament and of the Council of 16 February 1998 concerning the placing of biocidal products on the market [1], and in particular the second subparagraph of Article 16(2) thereof,

uwzględniając dyrektywę 98/8/WE Parlamentu Europejskiego i Rady z dnia 16 lutego 1998 r. dotyczącą wprowadzania do obrotu produktów biobójczych [1], w szczególności jej art. 16 ust. 2 akapit drugi,

Whereas:

a także mając na uwadze, co następuje:
|
|
(1) Commission Regulation (EC) No 1451/2007 of 4 December 2007 on the second phase of the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market [2] establishes a list of active substances to be assessed, with a view to their possible inclusion in Annex I, IA or IB to Directive 98/8/EC.

(1) Rozporządzenie Komisji (WE) nr 1451/2007 z dnia 4 grudnia 2007 r. w sprawie drugiej fazy 10-letniego programu prac, o którym mowa w art. 16 ust. 2 dyrektywy 98/8/WE Parlamentu Europejskiego i Rady dotyczącej wprowadzania do obrotu produktów biobójczych [2] ustanawia wykaz substancji czynnych, które mają zostać poddane ocenie w celu ich ewentualnego włączenia do załącznika I, IA lub IB do dyrektywy 98/8/WE.

(2) For a number of substances/product-type combinations included in that list, either all participants have withdrawn or no dossier has been received within the deadline specified in Article 9(2)(c) of Regulation (EC) No 1451/2007 by the Member State designated as Rapporteur for the evaluation.
|
(2) We wspomnianym wykazie figuruje szereg kombinacji substancji i rodzajów produktów, w przypadku których albo wszyscy uczestnicy wycofali się z uczestnictwa w programie przeglądu, albo państwo członkowskie wyznaczone jako sprawozdawca w zakresie oceny nie otrzymało w terminie określonym w art. 9 ust. 2 lit. c) rozporządzenia (WE) nr 1451/2007 żadnej dokumentacji.

(3) Consequently, and pursuant to Article 11(2) of Regulation (EC) No 1451/2007, the Commission informed the Member States thereof. That information was also made public by electronic means on 18 January 2008.
|
(3) W związku z tym oraz na mocy art. 11 ust. 2 rozporządzenia (WE) nr 1451/2007 Komisja dokonała stosownego powiadomienia państw członkowskich. Dnia 18 stycznia 2008 r. informacja ta została również podana do wiadomości publicznej w formie elektronicznej.

(4) Within three months of the electronic publication of that information, an interest in taking over the role of participant has been demonstrated for some of the substances and product-types concerned, in accordance with Article 12(1) of Regulation (EC) No 1451/2007.
|
(4) W okresie trzech miesięcy od opublikowania tej informacji w formie elektronicznej wyrażono zainteresowanie przejęciem roli uczestnika w odniesieniu do niektórych substancji i typów produktów zgodnie z art. 12 ust. 1 rozporządzenia (WE) nr 1451/2007.

(5) A new deadline should therefore be established for the submission of dossiers for these substances and product-types in accordance with the second subparagraph of Article 12(3) of that Regulation.
|
(5) Należy zatem ustanowić nowy termin składania dokumentacji dotyczącej wspomnianych substancji i typów produktów zgodnie z art. 12 ust. 3 akapit drugi wymienionego rozporządzenia.
|

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products,

For the substances and the product-types set out in the Annex, the new deadline for the submission of dossiers shall be 31 May 2010.
|
Nowy termin składania dokumentacji dotyczącej substancji i rodzajów produktów wymienionych w załączniku upływa dnia 31 maja 2010 r.

This Decision is addressed to the Member States.
