uwzględniając Traktat ustanawiający Wspólnotę Europejską,

Having regard to the Treaty establishing the European Community,

a także mając na uwadze, co następuje:

Whereas:

(1) W czerwcu 2001 r. Komisja przyjęła decyzję 2001/527/WE [1] oraz 2001/528/WE [2] ustanawiającą odpowiednio Komitet Europejskich Organów Nadzoru Papierów Wartościowych i Europejski Komitet Papierów Wartościowych.

(1) In June 2001, the Commission adopted Decisions 2001/527/EC(1) and 2001/528/EC(2), setting up the Committee of European Securities Regulators and the European Securities Committee respectively.

(2) W rezolucji z dnia 5 lutego 2002 r. oraz 21 listopada 2002 r. Parlament Europejski zatwierdził czterostopniowe ramy regulacyjne zalecane w raporcie końcowym Komitetu Mędrców w rozporządzeniu w sprawie europejskich papierów wartościowych i wezwał do poszerzenia niektórych aspektów tego podejścia na sektory bankowości i ubezpieczeń, pod warunkiem że Rada zobowiąże się zdecydowanie do reform celem zagwarantowania odpowiedniej równowagi.

(2) In its Resolutions of 5 February 2002 and 21 November 2002, the European Parliament endorsed the four-level regulatory framework advocated in the Final Report of the Committee of Wise Men on the regulation of European securities markets and called for certain aspects of that approach to be extended to the banking and insurance sectors, subject to a clear Council commitment to reform to guarantee a proper institutional balance.

(3) Dyrektywa Rady 85/611/EWG z dnia 20 grudnia 1985 r. w sprawie koordynacji przepisów ustawodawczych, wykonawczych i administracyjnych odnoszących się do przedsiębiorstw zbiorowego inwestowania w zbywalne papiery wartościowe (UCITS) [3], ostatnio zmieniona dyrektywą Parlamentu Europejskiego i Rady 2001/108/WE [4], ustanowiła Komitet Kontaktowy UCITS mający na celu ułatwienie zharmonizowanego wdrażania niniejszej dyrektywy poprzez regularne konsultacje wszelkich problemów wynikających z jej stosowania i w związku z którymi sensowna wydaje się wymiana poglądów, a także mający ułatwić konsultacje między Państwami Członkowskimi i w razie konieczności wspomóc Komisję przy zmianach tejże dyrektywy.

(3) Council Directive 85/611/EEC of 20 December 1985 on the coordination of laws, regulations and administrative provisions relating to undertakings for collective investments in transferable securities (UCITS)(3), as last amended by Directive 2001/108/EC of the European Parliament and of the Council(4), set up the UCITS Contact Committee in order to facilitate the harmonised implementation of that Directive through regular consultations on any practical problems arising from its application and on which exchanges of views are deemed useful, to facilitate consultation between Member States and to advise the Commission, if necessary, on amendments to be made to that Directive.

(4) Dnia 3 grudnia 2002 r. Rada zwróciła się do Komisji z prośbą o podjęcie kroków w celu przekazania tych zadań i upoważnień ustanowionym już w dziedzinie papierów wartościowych strukturom.

(4) On 3 December 2002, the Council invited the Commission to take steps in order to transfer those functions and powers to the structures already established in the securities field.

(5) Komisja przedstawiła propozycję dyrektywy zmieniającej między innymi dyrektywę 85/611/EWG, mającej na celu usunięcie zadań nałożonych na Komitet Kontaktowy UCITS w art. 53 tejże dyrektywy i przekazanie zadań wymienionych w art. 53 lit. a) na rzecz Europejskiego Komitetu Papierów Wartościowych, ustanowionego decyzją 2001/528/WE.

(5) The Commission has proposed a Directive amending, inter alia, Directive 85/611/EEC to delete the functions of the UCITS Contact Committee provided for by Article 53 of this Directive, and to transfer those laid down under Article 53a of the same Directive to the European Securities Committee established by Decision 2001/528/EC.

(6) Zmiana ta wymaga odpowiedniej i równoległej zmiany kompetencji Komitetu Europejskich Organów Nadzoru Papierów Wartościowych, zgodnie z art. 2 decyzji 2001/527/WE,

(6) Such an amendment will require a corresponding and simultaneous amendment of the competences of the Committee of European Securities Regulators, as defined in Article 2 of Decision 2001/527/EC,

STANOWI, CO NASTĘPUJE:

HAS DECIDED AS FOLLOWS:

Artykuł 1

W decyzji 2001/527/WE wprowadza się następujące zmiany:

1) artykuł 2 otrzymuje brzmienie:

Decision 2001/527/EC is amended as follows:

"Artykuł 2

1. Article 2 is replaced by the following:

Zadaniem tego Komitetu jest doradzanie Komisji na jej wniosek, w ustalonym według Komisji okresie w zależności od pilności sprawy, lub z własnej inicjatywy, w szczególności w celu przygotowania przepisów wykonawczych w zakresie papierów wartościowych łącznie z przedsiębiorstwami zbiorowego inwestowania w zbywalne papiery wartościowe (UCITS)."

"Article 2

:

The role of the Committee shall be to advise the Commission, either at the Commission's request, within a time limit which the Commission may lay down according to the urgency of the matter, or on the Committee's own initiative, in particular for the preparation of draft implementing measures in the field of securities, including those relating to undertakings for collective investment in transferable securities (UCITS)."

2) artykuł 3 ustęp pierwszy zdanie pierwsze otrzymuje brzmienie:

2. In Article 3, the first sentence of the first paragraph is replaced by the following:"The Committee shall be composed of high-level representatives from the national public authorities competent in the field of securities, including UCITS."

"W skład Komitetu wchodzą wysocy rangą przedstawiciele władz publicznych właściwych w zakresie papierów wartościowych, łącznie z UCITS.".

Niniejsza decyzja wchodzi w życie tego samego dnia z jakąkolwiek dyrektywą zmieniającą zadania Komitetu Kontaktowego UCITS i przekazującą je na rzecz Europejskiego Komitetu Papierów Wartościowych

This Decision shall enter into force on the same day as the entry into force of any directive amending the functions of the UCITS Contact Committee to transfer them to the European Securities Committee.
