THE COUNCIL OF THE EUROPEAN UNION,

uwzględniając Traktat ustanawiający Wspólnotę Europejską, w szczególności jego art. 133 wraz z art. 300 ust. 2 akapit pierwszy zdanie pierwsze,

Having regard to the Treaty establishing the European Community and in particular Article 133, in conjunction with Article 300(2), first paragraph, first sentence, thereof,

uwzględniając wniosek Komisji,

Having regard to the proposal from the Commission,

a także mając na uwadze, co następuje:

Whereas:

(1) Dla Wspólnoty oraz Republiki Południowej Afryki konieczne jest ustanowienie tymczasowego stosowania Umowy między Wspólnotą Europejską a Republiką Południowej Afryki w sprawie handlu wyrobami spirytusowymi ("Umowa") od dnia 28 stycznia 2002 r., do czasu zakończenia procedur wymaganych przez Republikę Południowej Afryki w celu wejścia w życie Umowy.

(1) It is necessary for the Community and South Africa to provide for the provisional application of the Agreement between the European Community and the Republic of South Africa on trade in spirits as from 28 January 2002 (the "Agreement"), pending the completion of the procedures required by South Africa to bring the Agreement into force.

(2) W celu ułatwienia wykonania niektórych postanowień Umowy, Komisja powinna zezwolić na dokonanie niezbędnych dostosowań technicznych, zgodnie z procedurą ustanowioną w art. 15 rozporządzenia Komisji (WE) nr 1576/89 z dnia 29 maja 1989 r., ustanawiającego ogólne zasady definicji, opisu i prezentacji napojów spirytusowych [1].

(2) In order to facilitate the implementation of certain provisions of the Agreement, the Commission should be allowed to make the necessary technical adjustments in accordance with the procedure laid down in Article 15 of Council Regulation (EEC) No 1576/89 of 29 May 1989 laying down general rules on the definition, description and presentation of spirit drinks(1).

PRZYJMUJE NINIEJSZA DECYZJĘ:

Artykuł 1

Niniejszym zatwierdza się w imieniu Wspólnoty Porozumienie w formie wymiany listów przewidujące tymczasowe stosowanie od dnia 28 stycznia 2002 r. Umowy między Wspólnotą Europejską a Republiką Południowej Afryki w sprawie handlu wyrobami spirytusowymi.

Article 1

Tekst Porozumienia w formie wymiany listów oraz tekst Umowy w sprawie handlu wyrobami spirytusowymi są załączone do niniejszej decyzji.

The Agreement in the form of an Exchange of Letters which provides for the provisional application of the Agreement between the European Community and the Republic of South Africa on trade in spirits as from 28 January 2002 is hereby approved on behalf of the Community.

Artykuł 2

The text of the Agreement in the form of an Exchange of Letters and the text of the Agreement on trade in spirits are attached to this Decision.

Niniejszym upoważnia się Przewodniczącego Rady do wyznaczenia osoby(osób) umocowanej(-ych) do podpisania Porozumienia w formie wymiany listów w celu uczynienia jej wiążącą dla Wspólnoty.

Artykuł 3

Article 2

Niniejszym upoważnia się Komisję, zgodnie z procedurą ustanowioną w art. 15 rozporządzenia (WE) nr 1576/89, do celów stosowania art. 5 ust. 8 i art. 16 ust. 2 Umowy w sprawie handlu wyrobami spirytusowymi do sporządzenia dokumentów wymaganych do zmiany Umowy.

The President of the Council is authorised to designate the person(s) authorised to sign the Agreement in the form of an Exchange of Letters and thus express the Community's agreement to be bound by it.

Artykuł 4

Komisja reprezentuje Wspólnotę we Wspólnym Komitecie ustanowionym przez art. 17 Umowy w sprawie handlu wyrobami spirytusowymi.

For the purposes of applying Articles 5(8) and 16(2) of the Agreement on trade in spirits, the Commission is hereby authorised, in accordance with the procedure laid down in Article 15 of Council Regulation (EEC) No 1576/89, to conclude the instruments required to amend the Agreement.

Niniejsza decyzja zostaje opublikowana w Dzienniku Urzędowym Wspólnot Europejskich.

Article 4

Sporządzono w Brukseli, dnia 21 stycznia 2002 r.

The Commission shall represent the Community in the Joint Committee set up under Article 17 of the Agreement on trade in spirits.
