THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

uwzględniając Traktat ustanawiający Wspólnotę Europejską, w szczególności jego art. 95,

Having regard to the Treaty establishing the European Community, and in particular Article 95 thereof,

uwzględniając wniosek Komisji [1],

Having regard to the proposal from the Commission(1),

uwzględniając opinię Komitetu Ekonomiczno-Społecznego [2].

Having regard to the opinion of the Economic and Social Committee(2),

stanowiąc zgodnie z procedurą określoną w art. 251 Traktatu [3],

Acting in accordance with the procedure laid down in Article 251 of the Treaty(3),

a także mając na uwadze, co następuje:

Whereas:

(1) Ósma dyrektywa 97/44/WE Parlamentu Europejskiego i Rady z dnia 22 lipca 1997 r. w sprawie ustaleń dotyczących czasu letniego [4] wprowadziła, wspólną we wszystkich Państwach Członkowskich, datę i czas rozpoczęcia i końca czasu letniego w latach 1998, 1999, 2000 i 2001.

(1) The eighth Directive, 97/44/EC, of the European Parliament and of the Council of 22 July 1997 on summer-time arrangements(4) introduced a common date and time in all Member States, for the beginning and end of summer time in 1998, 1999, 2000 and 2001.

(2) Jeżeli Państwa Członkowskie zastosują ustalenia dotyczące czasu letniego, dla funkcjonowania rynku wewnętrznego ważne jest, aby wspólna data i czas rozpoczęcia i końca okresu obowiązywania czasu letniego zostały ustalone w całej Wspólnocie.

(2) Given that the Member States apply summer-time arrangements, it is important for the functioning of the internal market that a common date and time for the beginning and end of the summer-time period be fixed throughout the Community.

(3) Ponieważ okres czasu letniego uznany za najodpowiedniejszy przez Państwa Członkowskie trwa od końca marca do końca października, jest wskazane, aby okres ten został utrzymany.

(3) Since the summer-time period considered most appropriate by the Member States runs from the end of March to the end of October, it is appropriate that that period therefore be maintained.

(4) Sprawne funkcjonowanie określonych sektorów, nie tylko transportu i komunikacji, ale również innych sektorów przemysłu, wymaga stałego, długookresowego planowania. Zatem przepisy dotyczące czasu letniego powinny być ustanowione na czas nieokreślony. Artykuł 4 dyrektywy 97/44/WE przewiduje, że Parlament Europejski i Rada mają przyjąć do dnia 1 stycznia 2001 uregulowania, które będą stosowane od 2002 r.

(4) The proper functioning of certain sectors, not only transport and communications, but also other sectors of industry, requires stable, long-term planning. Provisions concerning summer time should therefore be laid down for an unspecified period. Article 4 of Directive 97/44/EC provides, in that respect, that the European Parliament and the Council are to adopt, by 1 January 2001, the arrangements to apply from 2002 onwards.

(5) Po to, aby informacje były jasne i dokładne, harmonogram wprowadzania okresu czasu letniego dla kolejnych pięciu lat powinien być publikowany, co pięć lat.

(5) For reasons of clarity and accuracy of information, a timetable for the implementation of the summer-time period for the following five years should be published every five years.

(6) Wdrażanie niniejszej dyrektywy powinno ponadto być monitorowane przy pomocy sprawozdania na temat oddziaływania niniejszych przepisów na wszystkie odnośne dziedziny, które ma być przedstawione przez Komisję Parlamentowi Europejskiemu, Radzie oraz Komitetowi Ekonomiczno-Społecznemu,. Sprawozdanie to powinno opierać się na informacjach udostępnionych Komisji przez Państwa Członkowskie w czasie wystarczającym od przedstawienia sprawozdania w określonym terminie.

(6) Implementation of this Directive should, moreover, be monitored by means of a report, to be presented by the Commission to the European Parliament, the Council and the Economic and Social Committee, on the impact of these provisions in all of the areas concerned. That report should be based on the information made available to the Commission by the Member States in sufficient time to enable the report to be presented at the specified time.

(7) Jeżeli Państwa Członkowskie nie zdołają wystarczająco zharmonizować harmonogramu dla okresu czasu letniego, w celu ułatwienia transportu i komunikacji, a cel ten może zostać lepiej osiągnięty na poziomie Wspólnoty, Wspólnota może podjąć środki, zgodnie z zasadą pomocniczości, jak określono w art. 5 Traktatu. Niniejsza dyrektywa nie dotyczy niczego ponad to, co jest konieczne do osiągnięcia tych celów.

(7) Given that the complete harmonisation of the timetable for the summer-time period with a view to facilitating transport and communications cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may take measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. This Directive does not go beyond what is necessary to achieve those objectives.

(8) For geographical reasons, the common summer-time arrangements should not apply to the overseas territories of the Member States,

PRZYJMUJĄ NINIEJSZĄ DYREKTYWĘ:

HAVE ADOPTED THIS DIRECTIVE:

Artykuł 1

Do celów niniejszej dyrektywy "okres czasu letniego" oznacza okres w roku, w którym zegary ustawia się o 60 minut do przodu w porównaniu do reszty roku.

Artykuł 2

For the purposes of this Directive "summer-time period" shall mean the period of the year during which clocks are put forward by 60 minutes compared with the rest of the year.

Począwszy od 2002 r. okres czasu letniego zaczyna się w każdym Państwie Członkowskim o godz. 1.00 czasu uniwersalnego (GMT) w ostatnią niedzielę marca.

Począwszy od 2002 r. okres czasu letniego kończy się w każdym Państwie Członkowskim o godz. 1.00 czasu uniwersalnego (GMT) w ostatnią niedzielę października.

From 2002 onwards, the summer-time period shall begin, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in March.

Artykuł 4

Komisja opublikuje komunikat w Dzienniku Urzędowym Wspólnot Europejskich [5] po raz pierwszy przy okazji publikowania niniejszej dyrektywy i potem, co pięć lat, zawierający harmonogram przedstawiający daty rozpoczęcia i końca okresu czasu letniego dla kolejnych pięciu lat.

From 2002 onwards, the summer-time period shall end, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in October.

Komisja składa sprawozdanie Parlamentowi Europejskiemu, Radzie i Komitetowi Ekonomiczno-Społecznemu w sprawie oddziaływania przepisów niniejszej dyrektywy na dane sektory, najpóźniej do dnia 31 grudnia 2007 r.

Sprawozdanie sporządza się w oparciu o informacje udostępnione Komisji przez każde Państwo Członkowskie, najpóźniej do dnia 30 kwietnia 2007 r.

Article 4

Jeśli będzie to konieczne, w wyniku wniosków płynących ze sprawozdania, Komisja składa właściwe propozycje.

The Commission shall publish a communication in the Official Journal of the European Communities(5), for the first time on the occasion of the publication of this Directive, and every five years thereafter, containing the timetable showing the dates on which the summer-time period will begin and end for the following five years.

Artykuł 6

Niniejsza dyrektywa nie ma zastosowania w odniesieniu do terytoriów zamorskich Państw Członkowskich.

The Commission shall report to the European Parliament, the Council and the Economic and Social Committee on the impact of the provisions of this Directive on the sectors concerned by 31 December 2007 at the latest.

Państwa Członkowskie wprowadzą w życie przed dniem 31 grudnia 2001 r. przepisy ustawowe, wykonawcze i administracyjne niezbędne do wykonania niniejszej dyrektywy i niezwłocznie powiadomią o tym Komisję.

That report shall be drawn up on the basis of the information made available to the Commission by each Member State by 30 April 2007 at the latest.

Przepisy przyjęte przez Państwa Członkowskie zawierają odniesienie do niniejszej dyrektywy lub odniesienie takie towarzyszy ich urzędowej publikacji. Metody dokonywania takiego odniesienia określane są przez Państwa Członkowskie.

The Commission shall, if necessary and following the conclusions of the report, make appropriate proposals.

Artykuł 8

Niniejsza dyrektywa wchodzi w życie w dniu jej opublikowania w Dzienniku Urzędowym Wspólnot Europejskich.

Article 6

Artykuł 9

This Directive shall not apply to the overseas territories of the Member States.

Niniejsza dyrektywa skierowana jest do Państw Członkowskich.

Article 7

Sporządzono w Brukseli, dnia 19 stycznia 2001 r.

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 December 2001 at the latest. They shall forthwith inform the Commission thereof.

W imieniu Parlamentu Europejskiego

When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.
