Whereas one of the main objectives of the Community is to complete the internal market, of which the tourist sector is an essential part;

jednym z głównych celów Wspólnoty jest dopełnienie rynku wewnętrznego, którego istotną część stanowi sektor turystyczny;

Whereas the national laws of Member States concerning package travel, package holidays and package tours, hereinafter referred to as 'packages', show many disparities and national practices in this field are markedly different, which gives rise to obstacles to the freedom to provide services in respect of packages and distortions of competition amongst operators established in different Member States;

przepisy prawa krajowego Państw Członkowskich dotyczące zorganizowanych podróży, wakacji i wycieczek, zwanych dalej "imprezami turystycznymi", wykazują wiele rozbieżności, a praktyka poszczególnych państw w tej dziedzinie znacznie się różni, co ogranicza swobodę świadczenia usług tego rodzaju oraz powoduje zniekształcenia konkurencji pomiędzy podmiotami gospodarczymi mającymi siedzibę w różnych Państwach Członkowskich;

Whereas the establishment of common rules on packages will contribute to the elimination of these obstacles and thereby to the achievement of a common market in services, thus enabling operators established in one Member State to offer their services in other Member States and Community consumers to benefit from comparable conditions when buying a package in any Member State;

ustanowienie wspólnych reguł dotyczących imprez turystycznych przyczyni się do usunięcia tych przeszkód i tym samym do powstania wspólnego rynku w sferze usług, umożliwiając w ten sposób podmiotom gospodarczym mającym siedzibę w jednym Państwie Członkowskim świadczenie usług w pozostałych Państwach Członkowskich, a konsumentom Wspólnoty czerpanie korzyści z porównywalnych warunków zakupu we wszystkich Państwach Członkowskich;

Whereas paragraph 36 (b) of the Annex to the Council resolution of 19 May 1981 on a second programme of the European Economic Community for a consumer protection and information policy (4) invites the Commission to study, inter alia, tourism and, if appropriate, to put forward suitable proposals, with due regard for their significance for consumer protection and the effects of differences in Member States' legislation on the proper functioning of the common market;

ust. 36 lit. b) Załącznika do rezolucji Rady z dnia 19 maja 1981 r. w sprawie drugiego programu Europejskiej Wspólnoty Gospodarczej w dziedzinie ochrony konsumentów i polityki informacyjnej [4] zachęca Komisję do zajęcia się między innymi turystyką i w razie potrzeby przedłożenia odpowiednich propozycji z należytym uwzględnieniem ich znaczenia dla ochrony konsumentów i wpływu różnic istniejących w ustawodawstwach Państw Członkowskich na właściwe funkcjonowanie wspólnego rynku;

Whereas in the resolution on a Community policy on tourism on 10 April 1984 (5) the Council welcomed the Commission's initiative in drawing attention to the importance of tourism and took note of the Commission's initial guidelines for a Community policy on tourism;

Whereas the Commission communication to the Council entitled 'A New Impetus for Consumer Protection Policy', which was approved by resolution of the Council on 6 May 1986 (6), lists in paragraph 37, among the measures proposed by the Commission, the harmonization of legislation on packages;

Whereas tourism plays an increasingly important role in the economies of the Member States; whereas the package system is a fundamental part of tourism; whereas the package travel industry in Member States would be stimulated to greater growth and productivity if at least a minimum of common rules were adopted in order to give it a Community dimension; whereas this would not only produce benefits for Community citizens buying packages organized on the basis of those rules, but would attract tourists from outside the Community seeking the advantages of guaranteed standards in packages;

Whereas disparities in the rules protecting consumers in different Member States are a disincentive to consumers in one Member State from buying packages in another Member State;

rozbieżności w przepisach chroniących konsumentów w poszczególnych Państwach Członkowskich odstraszają konsumentów z jednego Państwa Członkowskiego od dokonywania zakupu imprez turystycznych w innym Państwie Członkowskim;

Whereas this disincentive is particularly effective in deterring consumers from buying packages outside their own Member State, and more effective than it would be in relation to the acquisition of other services, having regard to the special nature of the services supplied in a package which generally involve the expenditure of substantial amounts of money in advance and the supply of the services in a State other than that in which the consumer is resident;

czynnik ten szczególnie skutecznie odstrasza konsumentów od zakupu imprez turystycznych poza ich Państwem Członkowskim i jest o wiele bardziej skuteczny niż w przypadku nabywania innych usług, mając na uwadze szczególny charakter usług wchodzących w skład imprezy turystycznej, które generalnie wymagają wydatkowania znacznych kwot pieniędzy z góry, podczas gdy wykonanie usług następuje w państwie innym niż to, w którym konsument stale zamieszkuje;

Whereas the consumer should have the benefit of the protection introduced by this Directive irrespective of whether he is a direct contracting party, a transferee or a member of a group on whose behalf another person has concluded a contract in respect of a package;

Whereas the organizer of the package and/or the retailer of it should be under obligation to ensure that in descriptive matter relating to packages which they respectively

organizator imprezy turystycznej i/lub punkt sprzedaży detalicznej powinien być zobowiązany do zagwarantowania, że informacja podana w materiałach opisowych dotyczących imprezy nie wprowadza w błąd, a broszury udostępniane konsumentom zawierają wyczerpującą i rzetelną informację;

organize and sell, the information which is given is not misleading and brochures made available to consumers contain information which is comprehensible and accurate;

konsument potrzebuje urzędowego potwierdzenia warunków umowy mających zastosowanie do imprezy turystycznej; można to łatwo osiągnąć przez nałożenie wymogu, aby wszystkie postanowienia umowy były sporządzone na piśmie w formie wyczerpującej i przystępnej dla konsumenta, a także przez wydawanie mu kopii takiego dokumentu;

Whereas the consumer needs to have a record of the terms of contract applicable to the package; whereas this can conveniently be achieved by requiring that all the terms of the contract be stated in writing of such other documentary form as shall be comprehensible and accessible to him, and that he be given a copy thereof;

Whereas the consumer should be at liberty in certain circumstances to transfer to a willing third person a booking made by him for a package;

cena ustalona w umowie w zasadzie nie powinna ulegać zmianie, z wyjątkiem przypadków, gdy podwyższenie lub obniżenie ceny jest wyraźnie przewidziane w umowie; niemniej jednak możliwość ta powinna podlegać pewnym ograniczeniom;

Whereas the price established under the contract should not in principle be subject to revision except where the possibility of upward or downward revision is expressly provided for in the contract; whereas that possibility should nonetheless be subject to certain conditions;

Whereas the consumer should in certain circumstances be free to withdraw before departure from a package travel contract;

uprawnienia konsumenta w przypadku gdy organizator imprezy odwołuje ją przed uzgodnioną datą wyjazdu, powinny być jasno określone;

Whereas there should be a clear definition of the rights available to the the consumer in circumstances where the organizer of the package cancels it before the agreed date of departure;

już po rozpoczęciu podróży dochodzi często do niewykonania usługi, której umowa dotyczy, lub organizator uświadamia sobie, że nie będzie w stanie dostarczyć znaczącej części umówionych usług; na organizatora powinny być nałożone pewne obowiązki wobec konsumenta;

Whereas if, after the consumer has departed, there occurs a significant failure of performance of the services for which he has contracted or the organizer perceives that he will be unable to procure a significant part of the services to be provided; the organizer should have certain obligations towards the consumer;

organizator i/lub punkt sprzedaży detalicznej powinien być odpowiedzialny wobec konsumenta za właściwe wykonanie zobowiązań wynikających z umowy; co więcej, organizator i/lub punkt sprzedaży detalicznej powinien ponosić odpowiedzialność za szkodę wyrządzoną konsumentowi z tytułu niewykonania lub niewłaściwego wykonania umowy, chyba że wadliwe wykonanie umowy nie wynika z jego winy ani z winy innego usługodawcy;

Whereas the organizer and/or retailer party to the contract should be liable to the consumer for the proper performance of the obligations arising from the contract; whereas, moreover, the organizer and/or retailer should be liable for the damage resulting for the consumer from failure to perform or improper performance of the contract unless the defects in the performance of the contract are attributable neither to any fault of theirs nor to that of another supplier of services;

jeżeli organizator i/lub punkt sprzedaży detalicznej są odpowiedzialni za niewykonanie lub niewłaściwe wykonanie usług składających się na imprezę turystyczną, taka odpowiedzialność powinna być ograniczona zgodnie z konwencjami międzynarodowymi, w szczególności Konwencją Warszawską z 1929 r. o międzynarodowym przewozie lotniczym, Konwencją Berneńską z 1961 r. o przewozie kolejowym, Konwencja Ateńską z 1974 r. o przewozie morskim i Konwencja Paryską z 1962 r. o odpowiedzialności właścicieli hoteli; co więcej, w przypadku szkody innej niż uszkodzenie ciała powinna istnieć możliwość ograniczenia odpowiedzialności z tytułu umowy udziału w imprezie turystycznej, pod warunkiem jednak, że ograniczenia takie nie są bezzasadne;

Whereas in cases where the organizer and/or retailer is liable for failure to perform or improper performance of the services involved in the package, such liability should be limited in accordance with the international conventions governing such services, in particular the Warsaw Convention of 1929 in International Carriage by Air, the Berne Convention of 1961 on Carriage by Rail, the Athens Convention of 1974 on Carriage by Sea and the Paris Convention of 1962 on the Liability of Hotel-keepers; whereas, moreover, with regard to damage other than personal injury, it should be possible for liability also to be limited under the package contract provided, however, that such limits are not unreasonable;

powinny zostać zawarte pewne porozumienia w zakresie informowania konsumentów i rozpatrywania reklamacji;

Whereas certain arrangements should be made for the information of consumers and the handling of complaints;

zarówno dla konsumentów, jak i sektora imprez turystycznych, korzystne byłoby nałożenie na organizatorów i/lub punkty sprzedaży detalicznej obowiązku właściwego udokumentowania zabezpieczenia finansowego na wypadek swojej niewypłacalności;

Whereas both the consumer and the package travel industry would benefit if organizers and/or retailers were placed under an obligation to provide sufficient evidence of security in the event of insolvency;

Państwa Członkowskie powinny zachować możliwość przyjmowania lub utrzymania w mocy bardziej surowych przepisów dotyczących umów udziału w imprezach turystycznych w celu ochrony konsumenta,

Whereas Member States should be at liberty to adopt, or retain, more stringent provisions relating to package travel for the purpose of protecting the consumer,

PRZYJMUJE NINIEJSZĄ DYREKTYWĘ:

HAS ADOPTED THIS DIRECTIVE:

Artykuł 1

Article 1

Celem niniejszej dyrektywy jest zbliżenie przepisów ustawowych, wykonawczych i administracyjnych Państw Członkowskich dotyczących imprez turystycznych sprzedawanych lub oferowanych na sprzedaż na terytorium Wspólnoty.

The purpose of this Directive is to approximate the laws, regulations and administrative provisions of the Member States relating to packages sold or offered for sale in the territory of the Community.

Artykuł 2

Article 2

Do celów niniejszej dyrektywy:

For the purposes of this Directive:

1) "impreza turystyczna" oznacza wcześniej ustaloną kombinację nie mniej niż dwóch z następujących usług sprzedawanych lub oferowanych do sprzedaży w łącznej cenie, o okresie ich świadczenia dłuższym niż 24 godziny lub obejmującym nocleg:

1. 'package' means the pre-arranged combination of not fewer than two of the following when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four hours or includes overnight accommodation:

a) transport;

(a) transport;

b) zakwaterowanie;

(b) accommodation;

c) inne usługi turystyczne nie związane z transportem lub zakwaterowaniem stanowiące znaczącą część imprezy turystycznej.

(c) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package.

Oddzielne fakturowanie różnych składników tej samej imprezy nie zwalnia organizatora lub punktu sprzedaży detalicznej z obowiązków wynikających z niniejszej dyrektywy;

The separate billing of various components of the same package shall not absolve the organizer or retailer from the obligations under this Directive;

2) "organizator" oznacza podmiot, który zawodowo organizuje imprezy turystyczne i sprzedaje je lub oferuje na sprzedaż, zarówno w sposób bezpośredni, jak i za pośrednictwem punktu sprzedaży detalicznej;

2. 'organizer' means the person who, other than ocasionally, organizes packages and sells or offers them for sale, whether directly or through a retailer;

3) "punkt sprzedaży detalicznej" oznacza podmiot, który sprzedaje lub oferuje sprzedaż usług zestawionych przez organizatora w formie imprezy;

3. 'retailer' means the person who sells or offers for sale the package put together by the organizer;

4) "konsument" oznacza każdego, kto nabywa imprezę turystyczną lub wyraża zgodę na jej nabycie ("główny kontrahent") lub osobę, w imieniu której główny kontrahent wyraża zgodę na nabycie imprezy ("inni beneficjenci") bądź osobę, na którą główny kontrahent lub którykolwiek z innych beneficjentów przenosi prawa do udziału w imprezie ("cesjonariusz");

4. 'consumer' means the person who takes or agrees to take the package ('the principal contractor'), or any person on whose behalf the principal contractor agrees to purchase the package ('the other beneficiaries') or any person to whom the principal contractor or any of the other beneficiaries transfers the package ('the transferee');

5) "umowa" oznacza umowę łączącą konsumenta z organizatorem i/lub punktem sprzedaży detalicznej.

5. 'contract' means the agreement linking the consumer to the organizer and/or the retailer.

Artykuł 3

Article 3

1. Materiały opisowe dotyczące usług składających się na imprezę turystyczną i dostarczone konsumentowi przez organizatora lub punkt sprzedaży detalicznej, cena imprezy i pozostałe warunki umowy nie mogą zawierać informacji wprowadzających w błąd.

1. Any descriptive matter concerning a package and supplied by the organizer or the retailer to the consumer, the price of the package and any other conditions applying to the contract must not contain any misleading information. 2. When a brochure is made available to the consumer, it shall indicate in a legible, comprehensible and accurate manner both the price and adequate information concerning:

2. Jeżeli konsumentowi udostępnia się broszurę, to powinna ona w sposób czytelny, wyczerpujący i rzetelny określać cenę, jak również zawierać odpowiednie informacje dotyczące:

(a) the destination and the means, characteristics and categories of transport used;

a) celu podróży oraz charakterystyki i kategorii środków transportu;

(b) the type of accommodation, its location, category or degree of comfort and its main features, its approval and tourist classification under the rules of the host Member State concerned;

b) zakwaterowania, jego lokalizacji, kategorii lub standardu wraz z jego potwierdzeniem według klasyfikacji turystycznej państwa, w którym się ono znajduje;

(c) the meal plan;

c) wyżywienia;

(d) the itinerary;

d) trasy podróży;

(e) general information on passport and visa requirements for nationals of the Member State or States concerned and health formalities required for the journey and the stay;

e) ogólnej informacji o wymogach paszportowych i wizowych dla obywateli Państw Członkowskich lub odnośnych państw oraz warunkach zdrowotnych, jakie należy spełnić w czasie podróży i pobytu;

(f) either the monetary amount or the percentage of the price which is to be paid on account, and the timetable for payment of the balance;

f) kwoty zaliczki wyrażonej w walucie lub procentowo w stosunku do ceny oraz terminu płatności pozostałej sumy;

(g) whether a minimum number of persons is required for the package to take place and, if so, the deadline for informing the consumer in the event of cancellation.

g) minimalnej liczby uczestników jako warunku odbycia imprezy, jak również nieprzekraczalnego terminu, w którym konsument musi być poinformowany o ewentualnym jej odwołaniu.

The particulars contained in the brochure are binding on the organizer or retailer, unless:

Dane szczegółowe zawarte w treści broszury są wiążące dla organizatora lub punktu sprzedaży detalicznej, chyba że:

- changes in such particulars have been clearly communicated to the consumer before conclusion of the contract, in which case the brochure shall expressly state so,

- o ich zmianach konsument został wyraźnie poinformowany przed zawarciem umowy;

- changes are made later following an agreement between the parties to the contract.

- zmiany zostały dokonane po zawarciu umowy w wyniku porozumienia między stronami umowy.

Article 4

Artykuł 4

1. (a) The organizer and/or the retailer shall provide the consumer, in writing or any other appropriate form, before the contract is concluded, with general information on passport and visa requirements applicable to nationals of the Member State or States concerned and in particular on the periods for obtaining them, as well as with information on the health formalities required for the journey and the stay;

1. a) Przed zawarciem umowy, organizator i/lub punkt sprzedaży detalicznej udzielą konsumentowi, na piśmie lub w innej odpowiedniej formie, ogólnych informacji o wymogach paszportowych oraz wizowych wobec obywateli Państw Członkowskich lub odnośnych państw, w szczególności o terminach oczekiwania na te dokumenty, jak również o warunkach zdrowotnych, które należy spełnić w czasie podróży i pobytu.

(b) The organizer and/or retailer shall also provide the consumer, in writing or any other appropriate form, with the following information in good time before the start of the journey:

b) We właściwym czasie przed rozpoczęciem podróży organizator i/lub punkt sprzedaży detalicznej udzielą konsumentowi następujących informacji:

(i) the times and places of intermediate stops and transport connections as well as details of the place to be occupied by the traveller, e.g. cabin or berth on ship, sleeper compartment on train;

i) o czasie i miejscu postojów oraz połączeń komunikacyjnych, jak również szczegółów dotyczących miejsca, które ma zająć konsument w czasie podróży, np.: kabina lub koja na statku, przedział sypialny w pociągu;

(ii) the name, address and telephone number of the organizer's and/or retailer's local representative or, failing that, of local agencies on whose assistance a consumer in difficulty could call.

ii) o nazwie, adresie i numerze telefonu lokalnego przedstawiciela organizatora i/lub punktu sprzedaży detalicznej, a przypadku braku takiego, lokalnych agencji, na których pomoc mógłby liczyć konsument w razie pojawienia się trudności.

Where no such representatives or agencies exist, the consumer must in any case be provided with an emergency telephone number or any other information that will enable him to contract the organizer and/or the retailer;

W przypadku braku takich przedstawicieli lub agencji konsument musi dysponować numerem telefonu lub inną informacją, która pozwoli mu skontaktować się z organizatorem i/lub punktem sprzedaży detalicznej;

(iii) in the case of journeys or stays abroad by minors, information enabling direct contact to be established with the child or the person responsible at the child's place of stay;

iii) w przypadku podróży lub pobytu za granicą osób małoletnich informacji umożliwiających nawiązanie bezpośredniego kontaktu z dzieckiem lub osobą odpowiedzialną za dziecko w miejscu jego pobytu;

(iv) information on the optional conclusion of an insurance policy to cover the cost of cancellation by the consumer or the cost of assistance, including repatriation, in the event of accident or illness.

iv) o możliwości wykupu dobrowolnej polisy ubezpieczeniowej na pokrycie kosztów odstąpienia konsumenta od umowy lub kosztów pomocy, w tym kosztów powrotu do kraju w razie wypadku lub choroby.

2. Member States shall ensure that in relation to the contract the following principles apply:

2. Państwa Członkowskie zagwarantują stosowanie następujących zasad w odniesieniu do zawieranych umów:

(a) depending on the particular package, the contract shall contain at least the elements listed in the Annex;

a) w zależności od rodzaju imprezy umowa powinna zawierać co najmniej warunki wymienione w Załączniku;

(b) all the terms of the contract are set out in writing or such other form as is comprehensible and accessible to the consumer and must be communicated to him before the conclusion of the contract; the consumer is given a copy of these terms;

b) wszystkie postanowienia umowy sporządza się na piśmie lub w innej, zrozumiałej i przystępnej dla konsumenta formie, o której został poinformowany przed zawarciem umowy; konsument otrzymuje kopię tych postanowień;

(c) the provision under (b) shall not preclude the belated conclusion of last-minute reservations or contracts.

c) przepis lit. b) nie wyklucza opóźnionego dokonania rezerwacji lub zawarcia umowy "w ostatniej chwili".

3. Where the consumer is prevented from proceeding with the package, he may transfer his booking, having first given the organizer or the retailer reasonable notice of his intention before departure, to a person who satisfies all the conditions applicable to the package. The transferor of the package and the transferee shall be jointly and severally liable to the organizer or retailer party to the contract for payment of the balance due and for any additional costs arising from such transfer.

3. Jeżeli zaistnieją przeszkody uniemożliwiające konsumentowi skorzystanie z imprezy turystycznej, może on odstąpić rezerwację osobie, która spełnia wszystkie warunki wymagane do udziału w imprezie - po uprzednim powiadomieniu o swoim zamiarze organizatora lub punktu sprzedaży detalicznej przed datą rozpoczęcia podróży. Osoba przekazująca prawo do uczestnictwa w imprezie i cesjonariusz są odpowiedzialni solidarnie wobec organizatora lub punktu sprzedaży detalicznej za zapłatę nieuiszczonej dotąd sumy oraz za wszystkie dodatkowe koszty wynikłe z takiego przekazania praw.

4. (a) The prices laid down in the contract shall not be subject to revision unless the contract expressly provides for the possibility of upward or downward revision and states precisely how the revised price is to be calculated, and solely to allow for variations in:

4. a) Ceny ustalone w umowie nie podlegają zmianie, chyba że umowa wyraźnie przewiduje możliwość podwyższenia lub obniżenia ceny i precyzyjnie określa sposób jej kalkulacji, dopuszczając zmiany w:

- transportation costs, including the cost of fuel,

- wysokości kosztów transportu, w tym kosztów paliwa,

- dues, taxes or fees chargeable for certain services, such as landing taxes or embarkation or disembarkation fees at ports and airports,

- wysokości opłat, podatków i narzutów obciążających pewne usługi, jak opłaty lotniskowe lub opłaty za wejście na pokład i zejście na ląd,

- the exchange rates applied to the particular package.

- kursach wymiany walut, które dotyczą danej imprezy turystycznej.

(b) During the twenty days prior to the departure date stipulated, the price stated in the contract shall not be increased.

5. If the organizer finds that before the departure he is constrained to alter significantly any of the essential terms, such as the price, he shall notify the consumer as quickly as possible in order to enable him to take appropriate decisions and in particular:

5. Jeżeli organizator przed datą rozpoczęcia podróży stwierdza, że jest zmuszony zmienić w sposób znaczący którekolwiek z istotnych postanowień umowy (np. cenę), zawiadamia o tym konsumenta możliwie jak najszybciej, aby umożliwić mu podjęcie właściwej decyzji, w szczególności:

- either to withdraw from the contract without penalty,

- albo o odstąpieniu od umowy bez zapłacenia kary umownej,

- or to accept a rider to the contract specifying the alterations made and their impact on the price.

- albo o zaakceptowaniu Załącznika do umowy określającego dokonane zmiany i ich wpływ na cenę.

The consumer shall inform the organizer or the retailer of his decision as soon as possible.

Konsument zawiadomi jak najszybciej o swej decyzji organizatora lub punkt sprzedaży detalicznej.

6. If the consumer withdraws from the contract pursuant to paragraph 5, or if, for whatever cause, other than the fault of the consumer, the organizer cancels the package before the agreed date of departure, the consumer shall be entitled:

6. Jeżeli konsument, zgodnie z ust. 5, odstąpi od umowy lub jeśli z jakiejkolwiek przyczyny organizator odwoła usługę przed uzgodnioną datą rozpoczęcia podróży, konsument jest uprawniony:

(a) either to take a substitute package of equivalent or higher quality where the organizer and/or retailer is able to offer him such a substitute. If the replacement package offered is of lower quality, the organizer shall refund the difference in price to the consumer;

a) albo do skorzystania z imprezy zastępczej takiej samej lub wyższej jakości, jeżeli organizator lub punkt sprzedaży detalicznej może zaoferować taką usługę zastępczą; jeżeli oferowana impreza jest niższej jakości, organizator zwraca konsumentowi różnicę w cenie;

(b) or to be repaid as soon as possible all sums paid by him under the contract.

b) albo do żądania zwrotu całości kwot wpłaconych w ramach umowy.

In such a case, he shall be entitled, if appropriate, to be compensated by either the organizer or the retailer, whichever the relevant Member State's law requires, for non-performance of the contract, except where:

W takim przypadku konsument ma prawo, stosownie do okoliczności, do odszkodowania od organizatora lub punktu sprzedaży detalicznej, w zależności od przepisów prawa Państwa Członkowskiego regulujących zasady odpowiedzialności z tytułu niewykonania umowy, z wyjątkiem przypadków, gdy odwołanie imprezy wynika z:

(i) cancellation is on the grounds that the number of persons enrolled for the package is less than the minimum number required and the consumer is informed of the cancellation, in writing, within the period indicated in the package description; or

i) braku minimalnej liczby uczestników wymaganych do odbycia się imprezy, a konsument został powiadomiony na piśmie o jej odwołaniu w terminie wskazanym w opisie; lub

(ii) cancellation, excluding overbooking, is for reasons of force majeure, i.e. unusual and unforeseeable circumstances beyond the control of the party by whom it is pleaded, the consequences of which could not have been avoided even if all due care had been exercised.

ii) działania siły wyższej, tzn. niezwykłych i nieprzewidzianych okoliczności niezależnych od strony, która się na nie powołuje i których konsekwencji mimo zachowania należytej staranności nie można było uniknąć, z wyłączeniem sprzedania większej niż dostępne ilości miejsc.

7. Where, after departure, a significant proportion of the services contracted for is not provided or the organizer perceives that he will be unable to procure a significant proportion of the services to be provided, the organizer shall make suitable alternative arrangements, at no extra cost to the consumer, for the continuation of the packag, and where appropriate compensate the consumer for the difference between the services offered and those supplied.

7. W przypadku gdy po rozpoczęciu podróży znacząca część usług objętych imprezą nie została zrealizowana lub organizator przewiduje, że nie będzie w stanie zrealizować znacznej ich części, wprowadzi on alternatywne rozwiązania bez dodatkowych kosztów ponoszonych przez konsumenta w celu kontynuowania imprezy i stosownie do okoliczności zapłaci konsumentowi odszkodowanie z tytułu różnicy pomiędzy usługami oferowanymi a tymi, które zostały zrealizowane.

If it is impossible to make such arrangements or these are not accepted by the consumer for good reasons, the organizer shall, where appropriate, provide the consumer, at no extra cost, with equivalent transport back to the place of departure, or to another return-point to which the consumer has agreed and shall, where appropriate, compensate the consumer.

Jeżeli nie można zaoferować takich rozwiązań lub z uzasadnionych powodów konsument odmawia ich zaakceptowania, organizator, stosownie do okoliczności, zapewni konsumentowi odpowiedni transport do miejsca rozpoczęcia podróży lub innego miejsca uzgodnionego z konsumentem oraz odpowiednio wypłaci mu odszkodowanie.

Article 5

Artykuł 5

1. Member States shall take the necessary steps to ensure that the organizer and/or retailer party to the contract is liable to the consumer for the proper performance of the obligations arising from the contract, irrespective of whether such obligations are to be performed by that organizer and/or retailer or by other suppliers of services without prejudice to the right of the organizer and/or retailer to pursue those other suppliers of services.

Państwa Członkowskie podejmą wszelkie niezbędne kroki w celu zapewnienia odpowiedzialności organizatora i/lub punktu sprzedaży detalicznej wobec konsumenta za właściwe wykonanie zobowiązań wynikających z umowy, niezależnie od tego, czy obowiązki te mają być wykonane przez organizatora i/lub punkt sprzedaży detalicznej czy usługodawcę. Nie narusza to uprawnień organizatora i/lub punktu sprzedaży detalicznej w stosunku do tych usługodawców.

2. With regard to the damage resulting for the consumer from the failure to perform or the improper performance of the contract, Member States shall take the necessary steps to ensure that the organizer and/or retailer is/are liable unless such failure to perform or improper performance is attributable neither to any fault of theirs nor to that of another supplier of services, because:

W odniesieniu do szkody wyrządzonej konsumentowi w wyniku niewykonania lub nienależytego wykonania umowy, Państwa Członkowskie podejmą niezbędne kroki w celu zagwarantowania odpowiedzialności organizatora i/lub punktu sprzedaży detalicznej, chyba że niewykonanie lub nienależyte wykonanie umowy nie wynika ani z ich winy, ani z winy innego usługodawcy, a jest wynikiem:

- the failures which occur in the performance of the contract are attributable to the consumer,

- zaniedbań, które ujawnią się w trakcie wykonywania umowy, spowodowanych przez konsumenta,

- such failures are attributable to a third party unconnected with the provision of the services contracted for, and are unforeseeable or unavoidable,

- takich zaniedbań, które spowodowane są przez stronę trzecią, niezwiązaną ze świadczeniem usług objętych umową i których nie można ich było przewidzieć lub uniknąć,

- such failures are due to a case of force majeure such as that defined in Article 4 (6), second subparagraph (ii), or to an event which the organizer and/or retailer or the supplier of services, even with all due care, could not foresee or forestall.

- braków spowodowanych siłą wyższą, jak określono w art. 4 ust. 6 akapit drugi ppkt ii), lub zdarzeniem, którego organizator i/lub punkt sprzedaży detalicznej lub usługodawca, nawet zachowując należytą staranność, nie mógł przewidzieć lub im zapobiec.

In the cases referred to in the second and third indents, the organizer and/or retailer party to the contract shall be required to give prompt assistance to a consumer in difficulty.

W przypadkach określonych w drugim i trzecim tiret od organizatora i/lub punktu sprzedaży detalicznej będących stroną umowy wymagane będzie udzielenie natychmiastowej pomocy konsumentowi, który znalazł się w trudnej sytuacji.

In the matter of damages arising from the non-performance or improper performance of the services involved in the package, the Member States may allow compensation to be limited in accordance with the international conventions governing such services.

W kwestiach szkód wynikających z niewykonania lub nienależytego wykonania usług objętych imprezą Państwa Członkowskie mogą dopuszczać ograniczenie wysokości odszkodowania zgodnie z konwencjami międzynarodowymi regulującymi takie usługi.

In the matter of damage other than personal injury resulting from the non-performance or improper performance of the services involved in the package, the Member States may allow compensation to be limited under the contract. Such limitation shall not be unreasonable.

Na wypadek szkody innej niż uszkodzenie ciała, wynikłej na skutek niewykonania lub nienależytego wykonania usług objętych imprezą, Państwa Członkowskie mogą dopuszczać w rozsądnych granicach umowne ograniczenie wysokości odszkodowania.

3. Without prejudice to the fourth subparagraph of paragraph 2, there may be no exclusion by means of a contractual clause from the provisions of paragraphs 1 and 2.

3. Bez uszczerbku dla ust. 2 akapit czwarty można zastrzec, że wyłączenie przepisów ust. 1 i 2 w drodze klauzuli umownej nie jest dopuszczalne.

4. The consumer must communicate any failure in the performance of a contract which he perceives on the spot to the supplier of the services concerned and to the organizer and/or retailer in writing or any other appropriate form at the earliest opportunity.

4. Konsument ma obowiązek zawiadomienia danego usługodawcy oraz organizatora i/lub punktu sprzedaży detalicznej o zauważonym na miejscu jakimkolwiek zaniedbaniu w wykonaniu umowy. Zawiadomienie to ma być dokonane przy najbliższej sposobności na piśmie lub w innej właściwej formie.

This obligation must be stated clearly and explicily in the contract. Article 6

Obowiązek ten musi być jasno i wyraźnie określony w umowie.

In cases of complaint, the organizer and/or retailer or his local representative, if there is one, must make prompt efforts to find appropriate solutions.

W przypadku reklamacji organizator i/lub punkt sprzedaży detalicznej lub jego lokalny przedstawiciel, jeżeli taki istnieje, muszą podjąć natychmiastowe starania w celu znalezienia właściwych rozwiązań.

The organizer and/or retailer party to the contract shall provide sufficient evidence of security for the refund of money paid over and for the repatriation of the consumer in the event of insolvency.

Artykuł 7

Article 8

Na wypadek swojej niewypłacalności organizator i/lub punkt sprzedaży detalicznej, będący stroną umowy, powinni zapewnić dostateczne zabezpieczenie umożliwiające zwrot nadpłaconych pieniędzy oraz powrót konsumenta z podróży.

Member States may adopt or return more stringent provisions in the field covered by this Directive to protect the consumer.

Artykuł 8

Article 9

W celu ochrony konsumenta Państwa Członkowskie mogą przyjąć lub przywrócić obowiązywanie bardziej surowych przepisów w zakresie objętym niniejszą dyrektywą.

1. Member States shall bring into force the measures necessary to comply with this Directive before 31 December 1992. They shall forthwith inform the Commission thereof.

Artykuł 9

2. Member States shall communicate to the Commission the texts of the main provisions of national law which they adopt in the field governed by this Directive. The Commission shall inform the other Member States thereof.

1. Państwa Członkowskie podejmą środki niezbędne do wykonania niniejszej dyrektywy do dnia 31 grudnia 1992 r. i niezwłocznie powiadomią o tym Komisję.

Article 10

2. Państwa Członkowskie przekazują Komisji teksty podstawowych przepisów prawa krajowego przyjętych na podstawie niniejszej dyrektywy. Komisja informuje o tych przepisach pozostałe Państwa Członkowskie.

This Directive is addressed to the Member States.

(c) where the package includes accommodation, its location, its tourist category or degree of comfort, its main features, its compliance with the rules of the host Member State concerned and the meal plan;

a) cel podróży i, jeżeli przewidziane są terminy pobytu, właściwe terminy wraz z datami pobytu;

(d) whether a minimum number of persons is required for the package to take place and, if so, the deadline for informing the consumer in the event of cancellation;

b) środki, cechy i kategorie transportu; daty oraz miejsca wyjazdu i powrotu;

(e) the itinerary;

c) w przypadku gdy impreza zawiera zakwaterowanie – jego lokalizacja, kategoria turystyczna lub poziom komfortu, najważniejsze cechy, zgodność z zasadami danego Państwa Członkowskiego oraz rozkład posiłków;

(f) visits, excursions or other services which are included in the total price agreed for the package;

d) jeżeli do odbycia imprezy wymagana jest minimalna liczba uczestników – nieprzekraczalny termin, w jakim konsument powinien zostać poinformowany o odwołaniu podróży;

(g) the name and address of the organizer, the retailer and, where appropriate, the insurer;

e) trasa podróży;

(h) the price of the package, an indication of the possibility of price revisions under Article 4 (4) and an indication of any dues, taxes or fees chargeable for certain services (landing, embarkation or disembarkation fees at ports and airports, tourist taxes) where such costs are not included in the package;

f) zwiedzanie, wycieczki lub inne usługi, które są włączone w ogólną, uzgodnioną cenę imprezy;

(i) the payment schedule and method of payment;

g) nazwa i adres organizatora, punktu sprzedaży detalicznej oraz w razie potrzeby ubezpieczyciela;

(j) special requirements which the consumer has communicated to the organizer or retailer when making the booking, and which both have accepted;

h) cena imprezy, wskazanie możliwości zmiany ceny na podstawie art. 4 ust. 4 i określenie opłat, podatków i narzutów obciążających usługi (opłaty lotniskowe, opłaty za wejście na pokład i zejście na ląd w portach oraz na lotniskach, opłaty turystyczne), jeżeli takie koszty nie są uwzględnione w cenie imprezy;

(k) periods within which the consumer must make any complaint concerning failure to perform or improper performance of the contract.

i) harmonogram i sposób płatności;

j) szczególne wymagania, o których konsument poinformował organizatora i/lub punkt sprzedaży detalicznej podczas dokonywania rezerwacji, a które zostały zaakceptowane przez obie strony;

k) terminy składania przez konsumenta skarg dotyczących niewykonania lub niewłaściwego wykonania umowy.
