RESOLUTION OF THE COUNCIL AND THE MINISTERS FOR TRANSPORT, MEETING WITHIN THE COUNCIL of 18 July 1989 on air traffic system capacity problems (89/C 189/02)

THE COUNCIL OF THE EUROPEAN COMMUNITIES AND THE MINISTERS FOR TRANSPORT, MEETING WITHIN THE COUNCIL,

DE RAAD VAN DE EUROPESE GEMEENSCHAPPEN EN DE MINISTERS VAN VERVOER, IN HET KADER VAN DE RAAD BIJEEN,

Considering that the existence of an efficient air transport system will contribute to the unhindered movement of people and goods within the Community;

Overwegende dat het bestaan van een doeltreffend luchtvervoersysteem ertoe zal bijdragen het vrije verkeer van personen en goederen binnen de Gemeenschap te garanderen;

Considering that the smooth running of the air transport system will improve the implementation of the common transport policy in the field of civil aviation;

Overwegende dat een goede werking van het luchtvervoersysteem zal bijdragen tot de tenuitvoerlegging van het gemeenschappelijk vervoerbeleid op het gebied van de burgerluchtvaart;

Considering that air transport in Europe is at present under considerable strain due to air traffic congestion, especially at seasonal peaks, and that saturation of the available airspace is one of the primary causes of this congestion;

Overwegende dat de overbelasting van het luchtverkeer het luchtvervoer in Europa, vooral tijdens seizoenpieken, thans voor zeer grote problemen plaatst en dat de verzadiging van de beschikbare luchtruimte een van de voornaamste oorzaken van die overbelasting is;

Considering that this situation is partly due to the frequent lack of coordination between national air traffic services in air traffic control and in air traffic flow management;

Overwegende dat deze situatie gedeeltelijk te wijten is aan een vaak voorkomend gebrek aan coördinatie tussen de nationale luchtverkeersdiensten bij de controle van het luchtverkeer en het regelen van de luchtverkeersstromen;

Considering that a large number of international conferences and organizations such as the International Civil Aviation Organization (ICAO), the European Civil Aviation Commission (ECAC), the North Atlantic Treaty Organization (NATO) and the European Organization for the Safety of Air Navigation (Eurocontrol) are involved in air traffic control;

Overwegende dat een aantal internationale conferenties en organisaties, zoals de Internationale Burgerluchtvaartorganisatie (ICAO), de Europese Burgerluchtvaartconferentie (ECAC), de Noordatlantische Verdragsorganisatie (NAVO) en de Europese organisatie voor de veiligheid van het luchtverkeer (Eurocontrol), zich bezig houden met de controle van het luchtverkeer;

Considering that on 20 October 1988 the Ministers for Transport, meeting within the ECAC, adopted a set of decisions and that those decisions should be implemented with the utmost speed and efficiency;

Overwegende dat de Ministers van Vervoer, in het kader van de ECAC bijeen, op 20 oktober 1988 een reeks besluiten hebben aangenomen en dat deze besluiten zo snel en zo doeltreffend mogelijk ten uitvoer moeten worden gelegd;

Considering that the International Convention relating to Cooperation for the Safety of Air Navigation has made Eurocontrol the appropriate instrument to take the necessary measures to solve the problems currently existing in Europe;

Overwegende dat Eurocontrol, krachtens het Internationaal Verdrag tot samenwerking in het belang van de veiligheid van de luchtvaart, het aangewezen orgaan is om de nodige maatregelen te nemen ter oplossing van de problemen in Europa;

Considering that Community action in the field of air traffic control should avoid both duplication of effort and the introduction of new institutional measures parallel to the existing international organizations which are competent in this field, especially Eurocontrol;

Overwegende dat de Gemeenschap op het gebied van luchtverkeerscontrole doublures moet vermijden en geen nieuwe institutionele voorzieningen mag opzetten naast de bestaande ter zake bevoegde internationale instanties, met name Eurocontrol;

Considering, however, that the Community has legal instruments which are binding on the Member States and which, if appropriate, might prove suitable for ensuring effective and coordinated implementation of the decisions or recommendations adopted by other international organizations,

Overwegende evenwel dat de Gemeenschap beschikt over voor de Lid-Staten bindende rechtsinstrumenten, die in voorkomend geval geschikt kunnen zijn om de besluiten of aanbevelingen van andere internationale organisaties op doeltreffende en gecoördineerde wijze ten uitvoer te leggen,

HEREBY ADOPT THIS RESOLUTION:

NEMEN DE VOLGENDE RESOLUTIE AAN:

(a) Member States which are not members of Eurocontrol are invited to consider acceding, at the earliest opportunity, as contracting parties to the International Convention relating to Cooperation for the Safety of Air Navigation (Eurocontrol).

a) de Lid-Staten die geen lid zijn van Eurocontrol worden verzocht te bezien of het wenselijk is zo spoedig mogelijk partij te worden bij het Internationaal Verdrag tot samenwerking in het belang van de veiligheid van de luchtvaart (Eurocontrol). De Lid-Staten die reeds wel verdragssluitende partij bij het Verdrag zijn, zullen zich in Eurocontrol inzetten voor het treffen van maatregelen, in voorkomend geval, gericht op het vergemakkelijken van de toetreding van andere Lid-Staten tot deze organisatie;

Those Member States which are already contracting parties to the said Convention will strive, within Eurocontrol, to adopt, where appropriate, measures aimed at facilitating the accession of any other Member State to the said organization;

b) de Lid-Staten verbinden zich ertoe, ervoor te zullen ijveren dat de Commissie de status van waarnemer bij het beheerscomité van Eurocontrol krijgt;

(b) Member States undertake to strive for the Commission's being accorded observer status in the Eurocontrol Management Committee;

c) de Lid-Staten zullen samenwerken met het oog op de oprichting van een centraal systeem voor de regeling van de luchtverkeersstromen waartoe de ECAC op 20 oktober 1988 te Frankfurt heeft besloten;

(c) Member States will cooperate to establish a single air traffic flow management centre, as decided by the ECAC in Frankfurt on 20 October 1988;

d) de ontwikkeling van de centrale databank van Eurocontrol moet worden gestimuleerd en de prognosetechnieken moeten constant worden verbeterd;

(d) The development of the Eurocontrol Central Data Bank should be encouraged and forecast techniques constantly improved;

e) de nadruk wordt gelegd op de noodzaak bij Eurocontrol geleidelijk een gemeenschappelijke aanpak voor de controle van het luchtverkeer te ontwikkelen;

(e) The need to make progress within Eurocontrol in working out a common approach towards air traffic control is highlighted;

f) het is van groot belang dat de Samenwerkingsovereenkomst tussen de Gemeenschap en Eurocontrol nieuw leven wordt ingeblazen en verder wordt ontwikkeld ; zo moet de Commissie worden aangemoedigd deel te nemen aan studies en onderzoekprogramma's (bij voorbeeld het PHARE-programma) en moeten eventuele financiële bijdragen worden overwogen;

(f) It is very important to revitalize and improve the Cooperation Agreement between the Community and Eurocontrol ; the Commission's participation in studies and research programmes (e.g. the Phare programme) should be encouraged and possible financial contributions considered;

g) er moeten in de daarvoor geschikte fora inspanningen worden geleverd om vooruitgang te boeken bij het vaststellen van compatibele technische en functionele specificaties voor luchtvaartcontrolesystemen en -apparatuur;

(g) Efforts should be made in the relevant fora to make progress in establishing compatible technical and performance specifications for air traffic control systems and equipment;

h) de aanwervings- en opleidingsregelingen voor verkeersleiders op gemeenschappelijke grondslagen dienen te worden verbeterd ten einde te geraken tot onderlinge erkenning van vergunningen of diploma's en, voor zover mogelijk, tot de mobiliteit van verkeersleiders;

(h) Improvement of systems for recruiting and training controllers on common bases is of importance with a view to achieving mutual recognition of certificates or diplomas and, as far as possible, freedom of movement for air traffic controllers;

i) de Lid-Staten zouden in Eurocontrol-verband samen moeten werken om te bewerkstelligen dat een groter deel van het luchtruim voor de burgerluchtvaart wordt gereserveerd en om dit luchtruim soepeler en rationeler te gebruiken;

(i) Member States should cooperate within Eurocontrol to ensure that more airspace is made available for civil traffic and that it is used more flexibly and rationally;

j) het instellen van "crisiscellen" voor het vinden van snelle oplossingen voor specifieke overbelastingen dient te worden voortgezet en aangemoedigd;

(j) The creation of crisis management units should be maintained and encouraged as an instrument for finding urgent solutions to specific cases of congestion;

k) de Lid-Staten erkennen de wenselijkheid om, in voorkomend geval, via communautaire rechtsinstrumenten en in het kader van de bij het Verdrag tot oprichting van de Europese Economische Gemeenschap verleende bevoegdheden, uitvoering te geven aan de besluiten of resoluties die inzake luchtverkeerscontrole door de bevoegde internationale organisaties zijn aangenomen, zodat de maatregelen die nodig zijn om de overbelasting van het Europese luchtruim op te lossen, doeltreffend en gecoördineerd kunnen worden toegepast.

(k) Member States recognize the desirability of implementing, if appropriate by means of Community legal instruments and within the framework of the powers provided for in the Treaty establishing the European Economic Community, the decisions or resolutions adopted in the context of air traffic control by the international organizations involved, with the aim of guaranteeing effective and coordinated implementation of the necessary measures to tackle European airspace congestion.
