COMMISSION REGULATION (EC) No 2772/95 of 30 November 1995 replacing the values in ecus in Council Regulation (EEC) No 2078/92 on agricultural production methods compatible with the requirements of the protection of the environment and the maintenance of the countryside

VERORDENING (EG) Nr. 2772/95 VAN DE COMMISSIE van 30 november 1995 tot vervanging van de waarden in ecu in Verordening (EEG) nr. 2078/92 van de Raad betreffende landbouwproduktiemethoden die verenigbaar zijn met de eisen inzake milieubescherming, en betreffende natuurbeheer

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 3813/92 of 28 December 1992 on the unit of account and the conversion rates to be applied for the purposes of the common agricultural policy (1), as last amended by Regulation (EC) No 150/95 (2),

Gelet op Verordening (EEG) nr. 3813/92 van de Raad van 28 december 1992 betreffende de rekeneenheid en de omrekeningskoersen die in het kader van het gemeenschappelijk landbouwbeleid moeten worden toegepast (1), laatstelijk gewijzigd bij Verordening (EG) nr. 150/95 (2),

Having regard to Commission Regulation (EEC) No 1068/93 of 30 April 1993 on detailed rules for determining and applying the agricultural conversion rates (3), as last amended by Regulation (EC) No 1053/95 (4), and in particular Article 18 (2) thereof,

Gelet op Verordening (EEG) nr. 1068/93 van de Commissie van 30 april 1993 houdende nadere voorschriften voor de vaststelling en de toepassing van de gebruikte omrekeningskoersen in de landbouwsector (3), laatstelijk gewijzigd bij Verordening (EG) nr. 1053/95 (4), en met name op artikel 18, lid 2,

Whereas with effect from 1 February 1995, Article 13 (2) of Council Regulation (EEC) No 3813/92 alters the value in ecus of certain prices and amounts in order to neutralize the effects of the abolition of the corrective factor of 1,207509 which until 31 January 1995 affected the conversion rates used for agriculture;

Overwegende dat bij artikel 13, lid 2, van Verordening (EEG) nr. 3813/92 de waarde in ecu van bepaalde prijzen en bedragen per 1 februari 1995 is gewijzigd om het effect te neutraliseren van de afschaffing van de correctiefactor 1,207509 die tot en met 31 januari 1995 werd toegepast op de voor de landbouw gebruikte omrekeningskoersen;

Whereas the new values in ecus of the prices and amounts concerned have been established as of 1 February 1995 according to the rules laid down in Article 13 (2) of Regulation (EEC) No 3813/92 and Article 18 (1) of Regulation (EEC) No 1068/93;

Overwegende dat de nieuwe waarden in ecu van de betrokken bedragen sinds 1 februari 1995 zijn vastgesteld volgens het bepaalde in artikel 13, lid 2, van Verordening (EEG) nr. 3813/92 en artikel 18, lid 1, van Verordening (EEG) nr. 1068/93;

Whereas, in accordance with Article 18 (2) of Regulation (EEC) No 1068/93, in order to avoid confusion and to facilitate the application of the common agricultural policy, the values in ecus of the amounts given in Council Regulation (EEC) No 2078/92 (5), as last amended by the Act of Accession of Austria, Finland and Sweden, which apply at least from:

Overwegende dat, om verwarring te voorkomen en om de toepassing van het gemeenschappelijk landbouwbeleid te vergemakkelijken, overeenkomstig artikel 18, lid 2, van Verordening (EEG) nr. 1068/93 de waarden in ecu van de bedragen in Verordening (EEG) nr. 2078/92 van de Raad (5), laatstelijk gewijzigd bij de Akte van Toetreding van Oostenrijk, Finland en Zweden, in ieder geval moeten worden vervangen met ingang van:

- 1 January 1996 for amounts which are not affected by a marketing year,

- 1 januari 1996 voor de bedragen waarvoor geen verkoopseizoen geldt,

- the beginning of the 1996 marketing year in the case of amounts for which the marketing year begins in January 1996, and - the beginning of the 1995/96 marketing year in the other cases,

- het verkoopseizoen 1996 voor de bedragen waarvoor dat verkoopseizoen in januari 1996 begint,

and which are among the legal instruments coming into force before 1 February 1995, should be replaced,

- het verkoopseizoen 1995/1996 in de overige gevallen,

HAS ADOPTED THIS REGULATION:

die zijn vermeld in de vóór 1 februari 1995 in werking getreden besluiten,

HEEFT DE VOLGENDE VERORDENING VASTGESTELD:

Article 1

As a consequence of the adjustment with effect from 1 February 1995, pursuant to Article 13 (2) of Regulation (EEC) No 3813/92 and to Article 18 (1) of Regulation (EEC) No 1068/93, on the amounts in ecus in Regulation (EEC) No 2078/92, the latter shall be amended as laid down in Article 2 hereof.

Artikel 1

Als uitvloeisel van de aanpassing per 1 februari 1995 van de bedragen in ecu in Verordening (EEG) nr. 2078/92 overeenkomstig artikel 13, lid 2, van Verordening (EEG) nr. 3813/92 en artikel 18, lid 1, van Verordening (EEG) nr. 1068/93, wordt deze verordening gewijzigd zoals is aangegeven in artikel 2.

Article 2

Regulation (EEC) No 2078/92 is amended as follows:

Artikel 2

1. in Article 4 (2) the amount 'ECU 150` is replaced by 'ECU 181,1`; the amounts 'ECU 250` are replaced by 'ECU 301,9`; the amount 'ECU 100` is replaced by 'ECU 120,8`; the amount 'ECU 400` is replaced by 'ECU 483,0`; the amount 'ECU 1 000` is replaced by 'ECU 1 208`; the amount 'ECU 700` is replaced by 'ECU 845,3` and the amount 'ECU 600` is replaced by 'ECU 724,5`;

Verordening (EEG) nr. 2078/92 wordt als volgt gewijzigd:

2. in Article 4 (3) the amount 'ECU 350` is replaced by 'ECU 422,6`;

1. In artikel 4, lid 2, wordt "150 ecu" vervangen door "181,1 ecu"; "250 ecu" vervangen door "301,9 ecu"; "100 ecu" vervangen door "120,8 ecu"; "400 ecu" vervangen door "483,0 ecu"; "1 000 ecu" vervangen door "1 208 ecu"; "700 ecu" vervangen door "845,3 ecu" en "600 ecu" vervangen door "724,5 ecu".

3. in Article 6 (1) the amount 'ECU 2 500` is replaced by 'ECU 3 019`.

2. In artikel 4 lid 3, wordt "350 ecu" vervangen door "422,6 ecu".

3. In artikel 6, lid 1, wordt "2 500 ecu" vervangen door "3 019 ecu".

Article 3

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

Artikel 3

It shall apply, for each amount in question, from the date on which an agricultural conversion rate fixed on or after 1 February 1995 is first applied.

Deze verordening treedt in werking op de zevende dag volgende op die van haar bekendmaking in het Publikatieblad van de Europese Gemeenschappen.

De verordening geldt, voor elk betrokken bedrag, met ingang van de eerste toepassing van een landbouwomrekeningskoers die met ingang van 1 februari 1995 is vastgesteld.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Deze verordening is verbindend in al haar onderdelen en is rechtstreeks toepasselijk in elke Lid-Staat.
