THE COMMISSION OF THE EUROPEAN COMMUNITIES,

DE COMMISSIE VAN DE EUROPESE GEMEENSCHAPPEN,

Having regard to the Treaty establishing the European Community,

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap,

Having regard to Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A (I) to Directive 90/425/EEC(1), as last amended by Decision 95/176/EC(2), and in particular Articles 17 and 18 thereof,

Gelet op Richtlijn 92/65/EEG van de Raad van 13 juli 1992 tot vaststelling van de veterinairrechtelijke voorschriften voor het handelsverkeer en de invoer in de Gemeenschap van dieren, sperma, eicellen en embryo's waarvoor ten aanzien van de veterinairrechtelijke voorschriften geen specifieke communautaire regelgeving als bedoeld in bijlage A, onder I, van Richtlijn 90/425/EEG geldt(1), laatstelijk gewijzigd bij Beschikking 95/176/EG(2) van de Commissie, en met name op de artikelen 17 en 18,

Whereas:

Overwegende hetgeen volgt:

(1) Those third countries from which Member States authorise imports of bees/hives or queens (with attendants) into the Community must be established in accordance with the requirements of Council Directive 92/65/EEC; this authorisation shall apply to any third country.

(1) De derde landen waaruit de lidstaten invoer in de Gemeenschap toestaan van bijen/bijenkasten of koninginnen (met voedsterbijen), moeten worden vastgesteld met inachtneming van de eisen van Richtlijn 92/65/EEG.

(2) A health certification must be established for imports into the Community of bees/hives, queens and their attendants in accordance with the requirements of Council Directive 92/65/EEC.

(2) Voor invoer in de Gemeenschap van bijen/bijenkasten of koninginnen (met voedsterbijen) moet een gezondheidscertificering worden vastgesteld die beantwoordt aan de eisen van Richtlijn 92/65/EEG.

(3) Additional disease measures must be taken in the case of new or exotic diseases as necessary.

(3) In het geval van nieuwe of exotische ziekten moeten zo nodig aanvullende gezondheidsmaatregelen worden genomen.

(4) Council Directive 96/93/EEC(3) lays down standards of certification which are necessary for valid certification and to prevent fraud; whereas it is appropriate to ensure that the rules and principles applied to third country certifying officers provide guarantees which are at least equivalent to those laid down in this Directive.

(4) Bij Richtlijn 96/93/EG van de Raad(3) zijn certificeringsvoorschriften vastgesteld waaraan moet worden voldaan om geldig te kunnen certificeren en om fraude te voorkomen. Er moet op worden toegezien dat de voor de certificerende ambtenaren van derde landen toegepaste regels en principes garanties bieden die ten minste gelijkwaardig zijn aan die welke in die richtlijn zijn vastgelegd.

(5) Considering that a new certification regime is hereby established, a period of time should be provided for its implementation.

(5) Er moet een termijn worden gelaten om de nieuwe certificeringsregeling die hierbij wordt ingesteld, in te voeren.

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Veterinary Committee,

HAS ADOPTED THIS DECISION:

HEEFT DE VOLGENDE BESCHIKKING GEGEVEN:

Article 1

Member States shall authorise the importation of bees (Apis mellifera)/hives, queens and their attendants coming from any third country, only if they comply with the guarantees laid down in the health certificate corresponding to the specimen drawn up in the Annex to this Decision.

De lidstaten staan alleen toe dat bijen (Apis mellifera)/bijenkasten, koninginnen met voedsterbijen uit een derde land worden ingevoerd als daarvoor de garanties worden gegeven die zijn vermeld in het gezondheidscertificaat van het model in de bijlage bij deze beschikking.

This Decision is applicable from 1 November 2000.

Deze beschikking is van toepassing met ingang van 1 november 2000.
