THE COUNCIL OF THE EUROPEAN UNION,

DE RAAD VAN DE EUROPESE UNIE,

(a) recalling Articles 81(2)(h) and 82(1)(c) of the Treaty on the Functioning of the European Union, which for the first time lays down specific competence to "support the training of the judiciary and of judicial staff" in civil and criminal matters;

a) Herinnerend aan de artikelen 81, lid 2, onder h), en 82, lid 1, onder c), van het Verdrag betreffende de werking van de Europese Unie, waarin voor de eerste keer de specifieke bevoegdheid is vastgelegd om in burgerlijke en strafzaken "de opleiding van magistraten en justitieel personeel" te ondersteunen;

(b) recalling the Stockholm Programme — An open and secure Europe serving and protecting the citizens, which stressed that "in order to foster a genuine European judicial and law enforcement culture, it is essential to step up training on Union-related issues and make it systematically accessible for all professions involved in the implementation of the area of freedom, security and justice";

b) Herinnerend aan het programma van Stockholm — een open en veilig Europa ten dienste en ter bescherming van de burger, waarin het volgende werd benadrukt: "van essentieel belang om een echte Europese justitiële en rechtshandhavingscultuur te kunnen kweken, is het uitbreiden van de scholing in Uniegerelateerde vraagstukken en die systematisch toegankelijk maken voor eenieder die beroepshalve bij de toepassing van het beleid inzake vrijheid, veiligheid en recht is betrokken";

(c) recalling Council Resolution (2008/C 299/01) on the training of judges, prosecutors and judicial staff in the European Union;

c) Herinnerend aan de resolutie van de Raad betreffende de opleiding van rechters, openbare aanklagers en justitieel personeel in de Europese Unie (2008/C 299/01);

(d) recalling the Resolution of the European Parliament of 9 July 2008 on the role of the national judge in the European judicial system (2009/C 294 E/06),

d) Herinnerend aan de resolutie van het Europees Parlement van 9 juli 2008 over de rol van de nationale rechter in het Europees rechtsstelsel (2009/C 294 E/06);

THE COUNCIL OF THE EUROPEAN UNION:

DE RAAD VAN DE EUROPESE UNIE,

1. Welcomes the European Commission's Communication "Building trust in EU-wide justice — A new dimension to European judicial training" [1], which stresses the importance of improving knowledge of EU law and mutual trust between legal practitioners to ensure efficient implementation of EU law and swift cross-border judicial cooperation across the Member States.

Is ingenomen met de mededeling van de Europese Commissie "Opbouwen van vertrouwen in justitie in de hele EU: een nieuwe dimensie in de Europese justitiële opleiding" [1], die het belang benadrukt van een betere kennis van het EU-recht alsmede wederzijds vertrouwen tussen beoefenaars van juridische beroepen teneinde een doeltreffende uitvoering van EU-recht en snelle grensoverschrijdende justitiële samenwerking tussen de lidstaten te bewerkstelligen.

2. Underlines the contribution that European judicial training could make for the development of a genuine European judicial culture, based on respect for the different legal systems and traditions of the Member States.

2. Onderstreept de bijdrage die de Europese justitiële opleiding kan leveren tot de ontwikkeling van een werkelijke Europese justitiële cultuur, gebaseerd op eerbiediging van de verschillende rechtsstelsels en -tradities van de lidstaten.

3. Strongly supports further efforts for training of judges, prosecutors and other judicial staff in European law and its application.

3. Geeft haar volledige steun aan de opleiding van rechters, openbare aanklagers en ander justitieel personeel in Europese recht en de toepassing daarvan.

4. Welcomes the facilitation of training of other legal practitioners, including bailiffs, notaries and advocates.

4. Is ingenomen met de bevordering van de opleiding van andere beoefenaars van juridische beroepen, inclusief gerechtsdeurwaarders, notarissen en advocaten.

5. Underlines that training should not jeopardise the independence of the legal and judicial professions.

5. Benadrukt dat de opleiding de onafhankelijkheid van de juridische en justitiële beroepsgroepen niet in gevaar mag brengen.

6. Considers quality of the training as the main benchmark for the evaluation of the training and welcomes the intention of the Commission to focus on priority areas, taking into consideration EU policy priorities and complexity of specific instruments. Aspects of cost-effectiveness should also be taken into account.

Acht de kwaliteit van de opleiding het belangrijkste ijkpunt voor de beoordeling van de opleiding, en is ingenomen met het voornemen van de Commissie om zich op prioritaire gebieden toe te spitsen, met inachtneming van de beleidsprioriteiten van de EU en de complexiteit van specifieke instrumenten. Tevens moet met de kosteneffectiviteit rekening worden gehouden.

7. Shares the need to take advantage of the existing structures, institutions and networks, in particular the European Judicial Training Network (EJTN).

7. Deelt de mening dat gebruik moet worden gemaakt van bestaande structuren, instellingen en netwerken, in het bijzonder het Europees netwerk voor justitiële opleiding (EJTN).

8. Welcomes the recognition of the key role played by training structures at national level for judges, prosecutors and other legal professionals, and welcomes that the Communication mentions the role of regional cooperation in developing best practices and new methods of learning.

8. Is ingenomen met de erkenning van de sleutelrol van opleidingsstructuren op nationaal niveau voor rechters, openbare aanklagers en andere beoefenaren van juridische beroepen, en met de vermelding in de Mededeling van de rol van regionale samenwerking bij de ontwikkeling van beste praktijken en nieuwe leermethoden.

9. The Council calls on Member States:

9. De Raad roept de lidstaten ertoe op:

- to strongly encourage that training on Union acquis is systematically made available for legal practitioners through initial and continuous training, reflecting how national and Union legislation interact and influence their everyday practice,

- sterk te bevorderen dat de opleiding over het acquis van de Unie door middel van de basisopleiding en permanente opleiding stelselmatig beschikbaar wordt gesteld voor beoefenaren van juridische beroepen, als weerspiegeling van de wisselwerking tussen nationale en Uniewetgeving en hoe die op hun dagelijkse praktijk van invloed is;

- to strongly encourage that legal practitioners, in particular judges and prosecutors, have the possibility of benefitting from at least one week's training on Union acquis and instruments during their career,

- sterk te bevorderen dat beoefenaren van juridische beroepen, met name rechters en openbare aanklagers, gedurende hun loopbaan ten minste één week opleiding over het acquis en de instrumenten van de Unie kunnen krijgen;

- to encourage national professional organisations of legal practitioners to promote participation in continuous training activities among its members,

- te bevorderen dat nationale beroepsorganisaties van beoefenaren van juridische beroepen deelname aan permanente-opleidingsactiviteiten onder hun leden stimuleren;

- to support their national bodies in charge of training judges, prosecutors and judicial staff in expanding training in European Union law and in national legal systems and in making training available at local, regional and national level,

- hun nationale organen die belast zijn met de opleiding van rechters, openbare aanklagers en justitieel personeel te steunen bij het uitbreiden van de opleiding in het recht van de Europese Unie en nationale rechtsstelsels, en bij het aanbieden van opleiding op lokaal, regionaal en nationaal niveau;

- to encourage the national judicial training structures to share yearly, if possible through the EJTN, information with the Commission on available trainings on EU law and on the number of practitioners trained,

- de netwerken van de nationale instanties voor justitiële opleiding te stimuleren om, indien mogelijk via het EJTN, jaarlijks met de Commissie informatie over de beschikbare opleidingen in EU-recht en het aantal opgeleide beoefenaars uit te wisselen;

- to encourage national legal professional organisations to inform the Commission through their European level organisations on available trainings on EU law and on the number of practitioners trained.

- nationale organisaties van juridische beroepen te stimuleren de Commissie via hun organisaties op Europees niveau in te lichten over de beschikbare opleidingen in EU-recht en het aantal opgeleide beoefenaars.

10. The Council invites the Commission:

10. De Raad verzoekt de Commissie:

- to build upon Articles 81(2)(h) and 82(1)(c) of the Treaty on the Functioning of the European Union, in particular to identify and assess solutions at European level, including European Training Schemes for all professionals involved,

- voort te bouwen op de artikelen 81, lid 2, onder h), en 82, lid 1, onder c), van het Verdrag betreffende de werking van de Europese Unie, met name om oplossingen op Europees niveau aan te duiden en te beoordelen, inclusief Europese opleidingen (ETS) voor alle betrokken beoefenaars van juridische beroepen;

- to build on the strengths of existing structures, actors and networks, whether national or European, such as the judicial training institutions and the EJTN, and calls on the Commission to further support them, while taking into account specific regional needs and the added value of regional cooperation,

- te bouwen op de sterke punten van bestaande structuren, actoren en netwerken op nationaal of Europees niveau, zoals de instanties voor justitiële opleiding en het EJTN, en verzoekt de Commissie deze verder te steunen, en daarbij specifieke regionale noden en de meerwaarde van regionale samenwerking in acht te nemen;

- to initiate a new exchange programme for newly appointed judges and prosecutors, to ensure that they are fully engaged in the European aspect of their role from the outset and to allow them to have first-hand experience with practical operation of legal system of other Member States; this new exchange programme would complement the existing exchange schemes for experienced judges and prosecutors,

- een nieuw uitwisselingsprogramma voor net aangestelde rechters en openbare aanklagers op te zetten, zodat zij zich van meet af aan helemaal bij het Europese aspect van hun rol betrokken voelen en ervaringen uit de eerste hand kunnen opdoen met de praktische werking van rechtsstelsels van andere lidstaten; dit nieuwe uitwisselingsprogramma moet een aanvulling vormen op de bestaande uitwisselingen voor ervaren rechters en openbare aanklagers;

- to further develop the judicial training section of the European e-Justice portal as a tool to develop European judicial training,

- het justitiële opleidingsonderdeel van het Europees e-justitieportaal verder te ontwikkelen als een instrument om de Europese justitiële opleiding te ontwikkelen;

- to further simplify administrative procedures for access to European financial programmes and, within these, make additional funds available for European judicial training,

- de administratieve procedures voor toegang tot Europese financiële programma's verder te vereenvoudigen en binnen deze programma's bijkomende middelen voor de Europese justitiële opleiding beschikbaar te maken;

- to use the Justice Forum to follow up the implementation of the communication and promote exchanges of best practices,

- het Forum Justitie te benutten om de uitvoering van de communicatie op te volgen en de uitwisseling van beste praktijken te stimuleren;

- to consider presenting yearly a report on European judicial training, based on any contributions received from the EJTN and its members and from legal professional organisations at national and EU level.

- te overwegen om jaarlijks een verslag van de Europese justitiële opleiding voor te leggen, op basis van alle bijdragen van het EJTN en zijn leden en van organisaties van juridische beroepen op nationaal en EU-niveau.

11. The Council encourages candidate and potential candidate countries to sign memorandums of understanding to take part in the European Union's financial programmes in the field of justice, according to the conditions set in those programmes, in order to ensure their effective participation in European judicial training projects.

11. De Raad spoort kandidaat-lidstaten en potentiële kandidaat-lidstaten aan memoranda van overeenstemming te ondertekenen teneinde, overeenkomstig de voorwaarden van de financiële programma's van de Europese Unie op het gebied van justitie, aan die programma's deel te nemen zodat zij op doeltreffende wijze aan de Europese projecten voor justitiële opleiding kunnen participeren.
