Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC [1], and in particular Article 14(1) thereof,

Gelet op Verordening (EG) nr. 396/2005 van het Europees Parlement en de Raad van 23 februari 2005 tot vaststelling van maximumgehalten aan bestrijdingsmiddelenresiduen in of op levensmiddelen en diervoeders van plantaardige en dierlijke oorsprong en houdende wijziging van Richtlijn 91/414/EEG van de Raad [1], en met name op artikel 14, lid 1,

Whereas:
|
Overwegende hetgeen volgt:
|
|
(1) 2-phenylphenol is an active substance belonging to the fourth stage of the review programme of Council Directive 91/414/EEC [2] for which the assessment report was presented to the Commission on 19 December 2008 in the format of the EFSA Scientific Report for 2-phenylphenol [3]. That report includes the opinion of the European Food Safety Authority, hereinafter "the Authority", on the necessity of setting MRLs for that active substance in accordance with Article 12(1)(b) of Regulation (EC) No 396/2005, and a proposal for such MRLs.

(1) 2-Fenylfenol is een werkzame stof, behorend tot de vierde fase van het evaluatieprogramma van Richtlijn 91/414/EEG van de Raad [2], waarvoor het evaluatieverslag op 19 december 2008 aan de Commissie is overgelegd in de vorm van het wetenschappelijke verslag van de EFSA voor 2-fenylfenol [3]. Dat verslag omvat het advies van de Europese Autoriteit voor voedselveiligheid (EFSA) over de noodzaak van de vaststelling van MRL’s voor die werkzame stof overeenkomstig artikel 12, lid 1, onder b), van Verordening (EG) nr. 396/2005 en een voorstel voor deze MRL’s.

(2) The Authority examined in particular the risks to consumers and animals. It evaluated the representative use as a post harvest fungicide on citrus and pears and concluded that, based on the available information, a maximum residue level (MRL) of 5 mg/kg should be set provisionally for the notified use on citrus fruit by drench application. In order to confirm the risk assessment, the Authority requested confirmation that the analytical method applied in the residue trials correctly quantifies the residues of 2-phenylphenol, 2-phenylhydroquinone and their conjugates. In addition, the Authority concluded that the notifier should submit two additional residue trials on citrus fruit and valid storage stability studies. As regards the notified use on pears, the Authority could not propose any MRL because the submitted residue data were not acceptable. In the absence of a specific MRL, the lowest limit of analytical determination should apply.

(2) De EFSA heeft met name de risico’s voor consumenten en dieren onderzocht. Zij heeft het representatieve gebruik als een na de oogst toe te passen fungicide op citrusvruchten en peren geëvalueerd en heeft geconcludeerd dat, op grond van de beschikbare informatie, voorlopig een maximumresidugehalte (MRL) van 5 mg/kg moest worden vastgesteld voor het in de kennisgeving vermelde gebruik op citrusvruchten door besproeiing. Om de risicobeoordeling te bevestigen heeft de EFSA verzocht om bevestiging dat de bij de residuproeven toegepaste analysemethode de residuen van 2-fenylfenol, 2-fenylhydrochinon en hun conjugaten correct kwantificeert. Bovendien heeft de EFSA geconcludeerd dat de kennisgever de resultaten van twee aanvullende residuproeven op citrusvruchten en deugdelijke opslagstabiliteitsstudies moest indienen. Wat het in de kennisgeving vermelde gebruik op peren betreft, kon de EFSA geen MRL voorstellen omdat de ingediende residugegevens niet aanvaardbaar waren. Bij ontstentenis van een specifiek MRL moet de bepaalbaarheidsgrens gelden.

(3) The risk assessment carried out by the Authority took into account the most recent information on the toxicological properties of 2-phenylphenol. It showed that an MRL of 5 mg/kg for citrus fruit is acceptable with regard to consumer safety on the basis of a consumer exposure assessment for 27 specific European consumer groups. The lifetime exposure assessment via consumption of all food products that may contain 2-phenylphenol showed that there is no risk that the acceptable daily intake (ADI) is exceeded. As an acute reference dose (ARfD) is not necessary for 2-phenylphenol, there was no need to evaluate the short term exposure.

(3) Bij de door de EFSA uitgevoerde risicobeoordeling is rekening gehouden met de meest recente informatie over de toxicologische eigenschappen van 2-fenylfenol. Uit de beoordeling is gebleken dat een MRL van 5 mg/kg voor citrusvruchten uit het oogpunt van de veiligheid van de consumenten op grond van een beoordeling van de blootstelling van de consumenten voor 27 specifieke Europese consumentengroepen aanvaardbaar is. Uit de beoordeling van de levenslange blootstelling via de consumptie van alle levensmiddelen die 2-fenylfenol kunnen bevatten, is gebleken dat er geen risico bestaat dat de aanvaardbare dagelijkse inname (ADI) wordt overschreden. Aangezien een acute referentiedosis (ARfD) niet nodig is voor 2-fenylfenol, hoefde de kortetermijnblootstelling niet te worden geëvalueerd.

(4) The Commission invited the notifier to submit its comments on the EFSA Scientific report for 2-phenylphenol, including the proposed MRLs. The notifier submitted its comments, which have been carefully examined.
|
(4) De Commissie heeft de kennisgever verzocht zijn opmerkingen over het wetenschappelijke verslag van de EFSA voor 2-fenylfenol, inclusief de voorgestelde MRL’s, in te dienen. De kennisgever heeft zijn opmerkingen ingediend en deze zijn zorgvuldig onderzocht.

(5) Based on the Scientific Report of the Authority and taking into account the factors relevant to the matter under consideration, the proposed MRLs fulfil the requirements of Article 14(2) of Regulation (EC) No 396/2005.
|
(5) Op grond van het wetenschappelijke verslag van de EFSA en rekening houdend met de ter zake relevante factoren voldoen de voorgestelde MRL’s aan de voorschriften van artikel 14, lid 2, van Verordening (EG) nr. 396/2005.

(6) Regulation (EC) No 396/2005 should therefore be amended accordingly.
|
(6) Verordening (EG) nr. 396/2005 moet daarom dienovereenkomstig worden gewijzigd.
|

(7) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health and neither the European Parliament nor the Council has opposed them,

This Regulation shall enter into force on 1 January 2011.
