THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

HET EUROPEES PARLEMENT EN DE RAAD VAN DE EUROPESE UNIE,

Having regard to the Treaty establishing the European Community, and in particular Article 95(1) thereof,

Na raadpleging van het Comité van de Regio's,

Acting in accordance with the procedure laid down in Article 251 of the Treaty [2],

Handelend volgens de procedure van artikel 251 van het Verdrag [2],

Whereas:

Overwegende hetgeen volgt:

(1) Article 6(2) of Directive 2006/66/EC [3] should be clarified in order that batteries and accumulators which were legally placed on the market anywhere in the Community before 26 September 2008 and which do not comply with that Directive can remain on the market in the Community after this date. This clarification would provide legal certainty for batteries placed on the market in the Community and would ensure the smooth functioning of the internal market. The clarification is in line with the principle of waste minimisation and would contribute to reducing administrative burdens.

(1) Artikel 6, lid 2, van Richtlijn 2006/66/EG [3] moet worden verduidelijkt om ervoor te zorgen dat batterijen en accu's die voor 26 september 2008 rechtmatig in de Gemeenschap op de markt zijn gebracht maar niet voldoen aan genoemde richtlijn, ook na die datum op de markt mogen blijven. Deze verduidelijking biedt rechtszekerheid met betrekking tot batterijen die in de Gemeenschap op de markt zijn gebracht en waarborgt een goede werking van de interne markt. De voorgestelde verduidelijking is in overeenstemming met het beginsel van afvalreductie en draagt bij aan een daling van de administratieve lasten.

(2) Directive 2006/66/EC should therefore be amended accordingly,

HAVE ADOPTED THIS DIRECTIVE:

HEBBEN DE VOLGENDE RICHTLIJN VASTGESTELD:

Article 1

Amendment to Directive 2006/66/EC

Wijziging van Richtlijn 2006/66/EG

Article 6(2) of Directive 2006/66/EC shall be replaced by the following:

Artikel 6, lid 2, van Richtlijn 2006/66/EG wordt vervangen door:

"2. Member States shall take the necessary measures to ensure that batteries or accumulators which do not meet the requirements of this Directive are not placed on the market after 26 September 2008.

"2. De lidstaten treffen de nodige maatregelen om ervoor te zorgen dat batterijen en accu's die niet aan de in deze richtlijn vastgestelde bepalingen voldoen, niet meer op de markt worden gebracht na 26 september 2008.

Batteries and accumulators which do not meet the requirements of this Directive and which are placed on the market after this date shall be withdrawn from the market."

Batterijen en accu's die niet aan de eisen van deze richtlijn voldoen en die na die datum op de markt worden gebracht, worden van de markt genomen.".

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 5 January 2009.

1. De lidstaten doen de nodige wettelijke en bestuursrechtelijke bepalingen in werking treden om uiterlijk op 5 januari 2009 aan deze richtlijn te voldoen.

When Member States adopt these measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. The methods of making such reference shall be laid down by Member States.

Wanneer de lidstaten deze bepalingen aannemen, wordt in de bepalingen zelf of bij de officiële bekendmaking daarvan naar deze richtlijn verwezen. De regels voor deze verwijzing worden vastgesteld door de lidstaten.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. De lidstaten delen de Commissie de tekst van de belangrijkste bepalingen van intern recht mee die zij op het onder deze richtlijn vallende gebied vaststellen.

This Directive shall enter into force on the day of its publication in the Official Journal of the European Union.

Deze richtlijn treedt in werking op de dag van haar bekendmaking in het Publicatieblad van de Europese Unie.
