THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap,

Having regard to Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety [1], and in particular Article 53(1)(b) thereof,

Gelet op Verordening (EG) nr. 178/2002 van het Europees Parlement en de Raad van 28 januari 2002 tot vaststelling van de algemene beginselen en voorschriften van de levensmiddelenwetgeving, tot oprichting van een Europese Autoriteit voor voedselveiligheid en tot vaststelling van procedures voor voedselveiligheidsaangelegenheden [1], en met name op artikel 53, lid 1, onder b),

Whereas:

Overwegende hetgeen volgt:

(1) In accordance with Regulation (EC) No 178/2002, the necessary measures must be adopted where it is evident that food imported from a third country is likely to constitute a serious risk to human health, animal health or the environment and that such risk cannot be contained satisfactorily by means of measures taken by the Member State(s) concerned.

(1) Overeenkomstig Verordening (EG) nr. 178/2002 moeten de nodige maatregelen worden vastgesteld wanneer blijkt dat uit een derde land ingevoerde levensmiddelen een ernstig risico kunnen vormen voor de gezondheid van mens of dier of voor het milieu en dat dit risico niet op afdoende wijze kan worden beheerst met de door de betrokken lidsta(a)t(en) getroffen maatregelen.

(2) Under Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin [2], food business operators must ensure that the limits with regard to histamine in fishery products are not exceeded. Those limits, together with the sampling and analytical methods, were established by Commission Regulation (EC) No 2073/2005 of 15 November 2005 on microbiological criteria for foodstuffs [3].

(2) Krachtens Verordening (EG) nr. 853/2004 van het Europees Parlement en de Raad van 29 april 2004 houdende vaststelling van specifieke hygiënevoorschriften voor levensmiddelen van dierlijke oorsprong [2] moeten de exploitanten van levensmiddelenbedrijven ervoor zorgen dat de grenswaarden voor histamine in visserijproducten niet worden overschreden. Deze grenswaarden zijn tezamen met de bemonsterings- en analysemethoden vastgesteld bij Verordening (EG) nr. 2073/2005 van de Commissie 15 november 2005 inzake microbiologische criteria voor levensmiddelen [3].

(3) A recent Community inspection in Albania has revealed a limited capacity of the Albanian authorities to carry out the necessary checks, in particular to detect histamine in fish and fishery products.

(3) De Gemeenschap heeft onlangs in Albanië een inspectie uitgevoerd waaruit is gebleken dat de Albanese autoriteiten beschikken over een beperkte capaciteit om de nodige controles uit te voeren, met name om histamine in vis en visserijproducten op te sporen.

(4) Excessive levels of histamine in fishery products constitute a serious risk for human health.

(4) Zeer hoge histaminegehalten in visserijproducten vormen een ernstig risico voor de gezondheid van de mens.

(5) It is appropriate to adopt at Community level measures applicable to imports of fishery products which might be contaminated to ensure effective and uniform protection in all the Member States.

(5) Het is dienstig dat op communautair niveau maatregelen worden vastgesteld die van toepassing zijn op de invoer van visserijproducten die kunnen zijn besmet, om te zorgen voor een doeltreffende en uniforme bescherming in alle lidstaten.

(6) Imports into the Community of fishery products from fish species associated with a high amount of histamine, should be authorised only if it can be shown that they have been subjected to a systematic check at origin to verify that their histamine levels do not exceed the limits set by Regulation (EC) No 2073/2005.

(6) De invoer in de Gemeenschap van visserijproducten van vissoorten die met een hoog histaminegehalte in verband worden gebracht, mag alleen worden toegestaan als kan worden aangetoond dat zij in de plaats van oorsprong aan een systematische controle zijn onderworpen om na te gaan of hun histaminegehalten de bij Verordening (EG) nr. 2073/2005 vastgestelde grenswaarden niet overschrijden.

(7) However, it is appropriate to temporarily authorise, the import of consignments that are not accompanied by the results of checks at origin, provided that Member States ensure that those consignments undergo appropriate checks on arrival at the Community border to verify that their histamine levels do not exceed the limits set by Regulation (EC) No 2073/2005. This temporary authorisation should be limited to the time that would allow the Albanian authorities to build their own check capacity.

(7) Het is echter dienstig dat tijdelijk de invoer van zendingen wordt toegestaan die niet vergezeld gaan van de resultaten van de controles in de plaats van oorsprong, mits de lidstaten ervoor zorgen dat die zendingen bij aankomst aan de communautaire grens aan passende controles worden onderworpen om na te gaan of hun histaminegehalten de bij Verordening (EG) nr. 2073/2005 vastgestelde grenswaarden niet overschrijden. Deze tijdelijke vergunning moet beperkt zijn tot de tijd die de Albanese autoriteiten nodig hebben om hun eigen controlecapaciteit op te bouwen.

(8) Regulation (EC) No 178/2002 sets up the rapid alert system for food and feed, which should be used to implement the mutual information requirement provided for in Article 22(2) of Council Directive 97/78/EC [4]. In addition, the Member States should keep the Commission informed through periodical reports of all analytical results of official controls carried out in respect of consignments of fishery products from Albania.

(8) Bij Verordening (EG) nr. 178/2002 is een systeem voor snelle waarschuwing voor levensmiddelen en diervoeders opgezet, dat gebruikt moet worden met het oog op de wederzijdse kennisgevingsplicht van artikel 22, lid 2, van Richtlijn 97/78/EG [4]. Bovendien moeten de lidstaten de Commissie via periodieke verslagen op de hoogte houden van alle analyseresultaten van officiële controles die op zendingen van visserijproducten uit Albanië worden uitgevoerd.

(9) This Decision should be reviewed in the light of the guarantees offered by Albania and on the basis of the results of the tests carried out by Member States.

(9) Deze beschikking moet opnieuw worden bekeken in het licht van de door Albanië geboden garanties en op basis van de resultaten van de door de lidstaten uitgevoerde tests.

(10) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

Article 1

This Decision shall apply to fishery products of fish belonging to the families Scombridae, Clupeidae, Coryfenidae, Pomatomidae and Scombresosidae imported from Albania and intended for human consumption.

Deze beschikking is van toepassing op visserijproducten van vis behorende tot de families Scombridae, Clupeidae, Coryfenidae, Pomatomidae en Scombresosidae, ingevoerd uit Albanië en bestemd voor menselijke consumptie.

Analytical tests for histamine

Analytische tests op histamine

1. Member States shall authorise the import into the Community of products referred to in Article 1 only if they are accompanied by the results of an analytical test for histamine carried out in Albania or a foreign accredited laboratory before consignment which reveals histamine levels below the limits set by Regulation (EC) No 2073/2005. These tests must be carried out following the sampling and the analytical method referred in Regulation (EC) No 2073/2005.

De lidstaten staan de invoer in de Gemeenschap van de in artikel 1 bedoelde producten alleen toe als zij vergezeld gaan van de resultaten van een analytische test op histamine die vóór verzending in Albanië of een buitenlands erkend laboratorium is uitgevoerd en waaruit blijkt dat de histaminegehalten onder de bij Verordening (EG) nr. 2073/2005 vastgestelde grenswaarden liggen. Deze tests moeten worden uitgevoerd overeenkomstig de in Verordening (EG) nr. 2073/2005 bedoelde bemonsterings- en analysemethode.

2. By way of derogation from paragraph 1, Member States shall authorise the import of products referred to in Article 1 that are not accompanied by the results of the analytical test as referred to in paragraph 1 provided that the importing Member State ensures that each consignment of those products undergoes tests to verify that the histamine levels are below the limits set by Regulation (EC) No 2073/2005. These tests must be carried out following the sampling and the analytical method referred in Regulation (EC) No 2073/2005. The competent authority shall place the consignment concerned under official detention until it obtains a favourable result.

In afwijking van lid 1 staan de lidstaten de invoer van de in artikel 1 bedoelde producten toe die niet vergezeld gaan van de resultaten van de in lid 1 bedoelde analytische test, mits de invoerende lidstaat ervoor zorgt dat elke zending van die producten wordt onderworpen aan tests om na te gaan of de histaminegehalten onder de bij Verordening (EG) nr. 2073/2005 vastgestelde grenswaarden liggen. Deze tests moeten worden uitgevoerd overeenkomstig de in Verordening (EG) nr. 2073/2005 bedoelde bemonsterings- en analysemethode. De bevoegde autoriteit plaatst de zending in officiële inbewaringneming totdat zij een gunstig resultaat heeft ontvangen.

Member States shall immediately inform the Commission if tests carried out pursuant to Article 2(2) reveal histamine levels exceeding the limits set by Regulation (EC) No 2073/2005 for fishery products.

Als de overeenkomstig artikel 2, lid 2, uitgevoerde tests histaminegehalten laten zien die de bij Verordening (EG) nr. 2073/2005 voor visserijproducten vastgestelde grenswaarden overschrijden, stellen de lidstaten de Commissie daarvan onverwijld in kennis.

Member States shall submit to the Commission a report on all tests carried out pursuant to Article 2(2).

De lidstaten dienen bij de Commissie een verslag in over alle overeenkomstig artikel 2, lid 2, uitgevoerde tests.

Member States shall use the rapid alert system for food and feed set up by Regulation (EC) No 178/2002 for the submission of that information and those reports.

De lidstaten maken voor de indiening van die informatie en die verslagen gebruik van het bij Verordening (EG) nr. 178/2002 opgezette systeem voor snelle waarschuwing voor levensmiddelen en diervoeders.

All expenditure incurred in the application of this Decision shall be charged to the consignor, the consignee or the agent of either.

Alle uit deze beschikking voortvloeiende kosten zijn voor rekening van de verzender, de ontvanger of hun zaakwaarnemer.

Member States shall immediately inform the Commission of the measures they take to comply with this Decision.

De lidstaten stellen de Commissie onverwijld in kennis van de maatregelen die zij nemen om aan deze beschikking te voldoen.

This Decision shall be reviewed on the basis of the information and guarantees provided by the Albanian authority and, if necessary, the results of an on-the-spot inspection visit by Community experts.

Deze beschikking wordt opnieuw bezien in het licht van de door de Albanese autoriteit verstrekte informatie en garanties en, indien nodig, de resultaten van een door deskundigen van de Gemeenschap uitgevoerd inspectiebezoek ter plaatse.
