Council Regulation (EC) No 930/2004 of 1 May 2004 on temporary derogation measures relating to the drafting in Maltese of the acts of the institutions of the European Union

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 290 thereof,

Having regard to the Treaty on European Union, and in particular Articles 28 and 41 thereof,

Gelet op het Verdrag betreffende de Europese Unie, en met name op de artikelen 28 en 41,

Having regard to Council Regulation No 1 of 15 April 1958 determining the languages to be used by the European Economic Community(1) and to Council Regulation No 1 of 15 April 1958 determining the languages to be used by the European Atomic Energy Community(2), which two Regulations are hereinafter referred to as «Regulation No 1» ,

Gelet op Verordening nr. 1 van de Raad van 15 april 1958 tot regeling van het taalgebruik in de Europese Economische Gemeenschap(1) en op Verordening nr. 1 van de Raad van 15 april 1958 tot regeling van het taalgebruik in de Europese Gemeenschap voor Atoomenergie(2), welke beide verordeningen hierna «Verordening nr. 1» worden genoemd,

Having regard to the Council Rules of Procedure, and in particular Article 14(1) thereof,

Gelet op het Reglement van orde van de Raad, en met name op artikel 14, lid 1,

Having regard to the request of 31 March 2004 by the Maltese Government,

Gezien het verzoek van de Maltese regering van 31 maart 2004 ,

Whereas:

Overwegende hetgeen volgt:

(1) Following the accession of Malta to the European Union, and in accordance with Article 1 of Regulation No 1, Maltese is an official language and a working language of the institutions of the Union.

(1) Vanaf de toetreding van Malta tot de Europese Unie is het Maltees overeenkomstig artikel 1 van Verordening nr. 1 een officiële taal en een werktaal van de instellingen van de Unie.

(2) Accordingly, regulations and other documents of general application are to be drafted also in Maltese, as provided for in Article 4 of Regulation No 1. The Official Journal of the European Union should also be published in Maltese, as provided for in Article 5 of that Regulation.

(2) Derhalve dienen de verordeningen en andere stukken van algemene strekking ook in het Maltees te worden gesteld, zoals bepaald in artikel 4 van Verordening nr. 1. Het Publicatieblad van de Europese Unie dient ook in het Maltees te verschijnen, zoals bepaald in artikel 5 van genoemde verordening.

(3) It appears from contacts between the Maltese authorities and the European Union institutions that, due to the current situation regarding the recruitment of Maltese linguists and the resulting lack of qualified translators, it is not possible to guarantee the drafting in Maltese of all acts adopted by the institutions.

(3) Uit contacten tussen de Maltese autoriteiten en de instellingen van de Europese Unie is gebleken dat de huidige stand van zaken op het gebied van de aanwerving van Maltese vertalers en het daaruit voortvloeiende tekort aan terzake gekwalificeerd personeel tot gevolg heeft dat niet kan worden ingestaan voor de beschikbaarheid van een Maltese versie van alle door de instellingen aangenomen rechtsbesluiten.

(4) This situation will prevail for some time, pending the implementation of transitional measures taken in close cooperation between the Maltese authorities and the European Union institutions to remedy the lack of qualified translators. In the meantime, this situation should not have a negative impact on the activities of the Union, slowing the work of its institutions.

(4) Deze situatie zal enige tijd blijven voortbestaan, in afwachting van de uitvoering van overgangsmaatregelen die in nauwe samenwerking tussen de Maltese autoriteiten en de instellingen van de Europese Unie zullen worden genomen om het tekort aan gekwalificeerde vertalers te ondervangen. Intussen mag deze situatie de activiteiten van de Unie niet nadelig beïnvloeden doordat de werkzaamheden van de instellingen zouden worden vertraagd.

(5) Article 8 of Regulation No 1 allows the Council, acting upon request of the Member State concerned, to decide on the use of languages as regards Member States which have more than one official language. According to the Constitution of Malta, Maltese and English are the official languages of Malta and every law is to be enacted in both the Maltese and English languages, the Maltese text prevailing in the case of conflict, unless provision is otherwise made.

(5) Wat de lidstaten betreft waar verschillende officiële talen bestaan, kan de Raad krachtens artikel 8 van Verordening nr. 1, op verzoek van de betrokken lidstaat, een besluit over het taalgebruik nemen. Luidens de grondwet van Malta zijn het Maltees en het Engels de officiële talen van Malta en dienen alle wetten zowel in het Maltees als in het Engels te worden vastgesteld, met dien verstande dat de Maltese tekst in het geval van een geschil prevaleert, tenzij anders is bepaald.

(6) In the light of the situation referred to above and on request by the Maltese Government, it is appropriate to decide that, on an exceptional and transitional basis, the institutions of the Union are not to be bound by the obligation concerning the drafting or translation of all acts, including judgments of the Court of Justice, in the Maltese language. However, it is appropriate that such derogation be partial and therefore to exclude from its scope regulations adopted jointly by the European Parliament and the Council.

(6) In het licht van het bovenstaande dient, op verzoek van de Maltese regering, te worden besloten dat de instellingen van de Unie bij wijze van uitzondering tijdelijk niet verplicht zijn om alle rechtsbesluiten, met inbegrip van de arresten van het Hof van Justitie, in de Maltese taal te redigeren of te vertalen. Deze afwijking dient echter van partiële aard te zijn, in die zin dat zij niet geldt voor verordeningen die door het Europees Parlement en de Raad gezamenlijk worden vastgesteld.

(7) The status of Maltese as an official language and a working language of the institutions of the Union remains unaffected.

(7) De status van het Maltees als officiële taal en als werktaal van de instellingen van de Unie blijft onverlet.

(8) At the end of the transitional period, all acts which at that time have not already been published in the Maltese language should also be published in that language,

(8) Aan het einde van de overgangsperiode dienen alle rechtsbesluiten ook in de Maltese taal te worden bekendgemaakt, voorzover zulks op dat tijdstip nog niet is gebeurd,

HAS ADOPTED THIS REGULATION:

HEEFT DE VOLGENDE VERORDENING VASTGESTELD:

Article 1

Artikel 1

By way of derogation from Regulation No 1 and for a period of three years beginning on 1 May 2004 , the institutions of the European Union shall not be bound by the obligation to draft all acts in Maltese and to publish them in that language in the Official Journal of the European Union .

In afwijking van Verordening nr. 1 zijn de instellingen van de Europese Unie voor een periode van drie jaar ingaande op 1 mei 2004 niet verplicht om alle rechtsbesluiten in het Maltees te redigeren en de teksten in die taal in het Publicatieblad van de Europese Unie bekend te maken.

This Article shall not apply to Regulations adopted jointly by the European Parliament and the Council.

Dit artikel geldt niet voor verordeningen die door het Europees Parlement en de Raad gezamenlijk worden vastgesteld.

Article 2

Artikel 2

Not later than 30 months after its adoption, the Council shall review the operation of this Regulation and determine whether to extend it for a further period of one year.

Uiterlijk 30 maanden na de aanneming van deze verordening, beziet de Raad de werking ervan en beslist hij of de geldigheidsduur met een jaar moet worden verlengd.

At the end of the transitional period, all acts which at that time have not already been published in the Maltese language shall also be published in that language.

Aan het einde van de overgangsperiode worden alle rechtsbesluiten in de Maltese taal bekendgemaakt, voorzover dat op dat tijdstip nog niet is gebeurd.

Article 4

Artikel 4

This Regulation shall enter into force on 1 May 2004 .

Deze verordening treedt in werking op 1 mei 2004 .

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Deze verordening is verbindend in al haar onderdelen en is rechtstreeks toepasselijk in elke lidstaat.
