THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 175(1) thereof, in conjunction with Article 300(2), first sentence of the first subparagraph and Article 300(3), first subparagraph thereof,

Having regard to the proposal from the Commission,

Having regard to the opinion of the European Parliament(1),

Having regard to the opinion of the European Economic and Social Committee(2),

After consulting the Committee of the Regions,

Whereas:

Overwegende hetgeen volgt:

(1) The promotion of measures at international level to deal with regional or worldwide environmental problems is one of the objectives of the Community's policy on the environment, in accordance with Article 174 of the Treaty.

(1) De internationale bevordering van maatregelen tegen regionale of mondiale milieuproblemen is, overeenkomstig artikel 174 van het Verdrag, een van de doelstellingen van het beleid van de Gemeenschap op milieugebied.

(2) The Community signed in Aarhus on 24 June 1998 the Protocol to the 1979 Convention on Long Range Transboundary Air Pollution on Persistent Organic Pollutants (hereinafter referred to as the Protocol).

(2) De Gemeenschap heeft op 24 juni 1998 te Aarhus het Protocol inzake persistente organische verontreinigende stoffen bij het Verdrag van 1979 betreffende grensoverschrijdende luchtverontreiniging over lange afstand (hierna "het protocol "te noemen) ondertekend.

(3) The Protocol aims at controlling, reducing or eliminating discharges, emissions and losses of persistent organic pollutants that cause significant adverse effects on human health or the environment as a result of their long-range transboundary atmospheric transport.

(3) Het doel van het protocol is het beheersen, terugdringen of elimineren van lozingen, emissies en verliezen van persistente organische verontreinigende stoffen die ten gevolge van hun grensoverschrijdende verplaatsing door de lucht over lange afstand aanzienlijke nadelige gevolgen hebben voor de volksgezondheid of het milieu.

(4) The Protocol stipulates, in principle, the elimination or reduction of production and use of thirteen substances regarded as persistent organic pollutants. In addition, Parties have to take effective measures to reduce or stabilise total annual emissions of certain substances.

(4) Het protocol voorziet in beginsel in staking of beperking van de productie en het gebruik van dertien stoffen die als persistente organische verontreinigende stoffen worden beschouwd. Daarnaast moeten de partijen doeltreffende maatregelen nemen om de totale jaarlijkse emissies van bepaalde stoffen te beperken of te stabiliseren.

(5) The Protocol is open to ratification, acceptance, approval or accession by States and by regional economic integration organisations Parties to the Convention.

(5) Het protocol staat open voor bekrachtiging, aanvaarding, goedkeuring of toetreding door staten en door regionale organisaties voor economische integratie die partij zijn bij het Verdrag.

(6) As most of the provisions of the Protocol concern environmental protection and the protection of human health, it is appropriate to choose Article 175(1) as the legal basis, in conjunction with Article 300.

(6) Aangezien de meeste bepalingen van het protocol betrekking hebben op de bescherming van het milieu en van de volksgezondheid, dient artikel 175, lid 1, in samenhang met artikel 300 als rechtsgrondslag te worden gekozen.

(7) The Protocol contributes to the achievement of the objectives of the environmental policy of the Community. It is therefore appropriate that the Community approves this Protocol as soon as possible.

(7) Het protocol draagt bij tot de verwezenlijking van de doelstellingen van het milieubeleid van de Gemeenschap. Het is derhalve dienstig dat de Gemeenschap dit protocol zo spoedig mogelijk goedkeurt.

(8) The Community has already adopted instruments covering matters governed by the Protocol, including Council Directives 79/117/EEC of 21 December 1978 prohibiting the placing on the market and use of plant protection products containing certain active substances(3), and 96/59/EC of 16 September 1996 on the disposal of polychlorinated biphenyls and polychlorinated terphenyls (PCB/PCT)(4),

(8) De Gemeenschap heeft reeds instrumenten op het gebied van de bij het protocol geregelde aangelegenheden aangenomen, onder meer Richtlijn 79/117/EEG houdende verbod van het op de markt brengen en het gebruik van bestrijdingsmiddelen bevattende bepaalde actieve stoffen(3), en Richtlijn 96/59/EG betreffende de verwijdering van polychloorbifenylen en polychloorterfenylen (PCB's/PCT's)(4),

HAS DECIDED AS FOLLOWS:

BESLUIT:

Article 1

Artikel 1

The Protocol to the 1979 Convention on Long Range Transboundary Air Pollution on Persistent Organic Pollutants, is hereby approved on behalf of the Community.

Het protocol inzake persistente organische verontreinigende stoffen bij het Verdrag van 1979 betreffende grensoverschrijdende luchtverontreiniging over lange afstand wordt namens de Gemeenschap goedgekeurd.

The text of the Protocol is attached to this Decision.

De tekst van het protocol wordt aan dit besluit gehecht.

Article 2

Artikel 2

The President of the Council is hereby authorised to designate the person(s) empowered to deposit the instrument of approval on behalf of the Community with the Secretary-General of the United Nations, in accordance with Article 16 of the Protocol.

De voorzitter van de Raad wordt gemachtigd de persoon/personen aan te wijzen die bevoegd is/zijn de akte van goedkeuring overeenkomstig artikel 16 van het protocol namens de Europese Gemeenschap bij de secretaris-generaal van de Verenigde Naties neder te leggen.
