COUNCIL DIRECTIVE 93/52/EEC of 24 June 1993 amending Directive 89/556/EEC on animal health conditions governing intra-Community trade in and importation from third countries of embryos of domestic animals of the bovine species

RICHTLIJN 93/52/EEG VAN DE RAAD van 24 juni 1993 tot wijziging van Richtlijn 89/556/EEG tot vaststelling van veterinairrechtelijke voorschriften voor het intracommunautaire handelsverkeer in embryo's van als huisdier gehouden runderen en de invoer daarvan uit derde landen

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

DE RAAD VAN DE EUROPESE GEMEENSCHAPPEN,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 43 thereof;

Gelet op het Verdrag tot oprichting van de Europese Economische Gemeenschap, inzonderheid op artikel 43,

Having regard to the proposal from the Commission (1),

Gezien het voorstel van de Commissie (1),

Having regard to the opinion of the European Parliament (2),

Gezien het advies van het Europees Parlement (2),

Whereas Article 1 of Council Directive 89/556/EEC of 25 September 1989 on animal health conditions governing intra-Community trade in and importation from third countries of embryos of domestic animals of the bovine species (3) excluded embryos derived by certain techniques from the scope of the said Directive; whereas embryos which are to be subjected to techniques which involve the penetration of the zona pellucida may be traded or imported as long as they meet the requirements of the said Directive before recourse is had to these techniques, with certain additional safeguards; whereas embryos derived by in vitro fertilization may also be traded or imported, with appropriate safeguards;

Overwegende dat krachtens artikel 1 van Richtlijn 89/556/EEG van de Raad van 25 september 1989 tot vaststelling van veterinairrechtelijke voorschriften voor het intracommunautaire handelsverkeer in embryo's van als huisdier gehouden runderen en de invoer daarvan uit derde landen (3) de richtlijn niet van toepassing is op embryo's die met bepaalde technieken zijn verkregen; dat embryo's waarop technieken worden toegepast waarbij de zona pellucida wordt doorgeprikt, in het handelsverkeer mogen worden gebracht of mogen worden ingevoerd voor zover zij, voordat de betrokken techniek wordt toegepast, aan de eisen van Richtlijn 89/556/EEG voldoen en voor zover enkele bijkomende garanties gelden; dat embryo's die zijn verkregen door toepassing van in vitro-bevruchting, eveneens in het handelsverkeer mogen worden gebracht en mogen worden ingevoerd, voor zover passende garanties worden gegeven;

Whereas the additional safeguards require amendments to the Annexes, which, under Article 16 of Directive 89/556/EEC, come within the competence of the Commission;

Overwegende dat in verband met deze bijkomende garanties de bijlagen moeten worden gewijzigd, en dat deze wijzigingen, krachtens artikel 16 van Richtlijn 89/556/EEG, onder de bevoegdheid van de Commissie vallen;

Whereas other amendments should be made to the Directive to clarify the status of semen used for fertilization of ova and to take account of the new foot-and-mouth disease policy in the Community,

Overwegende dat Richtlijn 89/556/EEG ook op enkele andere punten moet worden gewijzigd ten einde de status van sperma dat voor de bevruchting van eicellen wordt gebruikt te verduidelijken en rekening te houden met het nieuwe beleid van de Gemeenschap inzake mond- en klauwzeer,

HAS ADOPTED THIS DIRECTIVE:

HEEFT DE VOLGENDE RICHTLIJN VASTGESTELD:

Article 1

Artikel 1

Directive 89/556/EEC is hereby amended as follows:

Richtlijn 89/556/EEG wordt als volgt gewijzigd:

1. Article 1 (2) shall be replaced by the following:

1. artikel 1, lid 2, wordt vervangen door:

'2. This Directive shall not apply to embryos derived by transfer of nuclei.';

"2. Deze richtlijn is niet van toepassing op embryo's die zijn verkregen door transfer van celkernen.";

2. the following shall be added to Article 2:

2. aan artikel 2 wordt het volgende punt toegevoegd:

'(g) "embryo production team " means an officially approved embryo collection team for in vitro fertilization in accordance with the conditions laid down in the relevant Annex.';

"g) "embryoproduktieteam": embryoteam dat officieel erkend is voor de bevruchting in vitro overeenkomstig de in de desbetreffende bijlage vermelde voorwaarden.";

3. the first subparagraph of Article 3 (a) shall be replaced by the following:

3. artikel 3, onder a), eerste alinea, wordt vervangen door:

'(a) they must have been conceived as a result of artificial insemination or in vitro fertilization with semen from a donor sire standing at a semen collection centre approved by the competent authority for the collection, processing and storage of semen or by semen imported in accordance with Directive 88/407/EEC (*).

"a) de bevruchting moet door kunstmatige inseminatie of in vitro zijn geschied, met sperma van een donordier uit een spermacentrum dat door de bevoegde autoriteit is erkend voor de winning, de behandeling en de opslag van sperma, of met overeenkomstig Richtlijn 88/407/EEG (*) ingevoerd sperma;

4. Article 4 shall be deleted;

5. the following paragraph shall be inserted in Article 5:

5. aan artikel 5 wordt het volgende lid toegevoegd:

'2a. Approval of an embryo production team for embryos derived by in vitro fertilization shall be granted only where the provisions of the relevant Annex to this Directive are observed and where the embryo production team is able to satisfy the other relevant provisions of this Directive and in particular the provisions of paragraphs 1 and 2 of this Article, which shall apply mutatis mutandis.';

"2 bis. Erkenning van een produktieteam van door toepassing van in vitro-bevruchting verkregen embryo's wordt uitsluitend verleend wanneer aan de desbetreffende bijlage van deze richtlijn is voldaan en wanneer het embryoproduktieteam bij machte is om aan de overige ter zake doende bepalingen van deze richtlijn en met name de leden 1 en 2 van dit artikel te voldoen. Genoemde leden zijn mutatis mutandis van toepassing.";

6. Article 9 (3) shall be replaced by the following:

6. artikel 9, lid 3, wordt vervangen door:

'3. In laying down animal health provisions concerning foot-and-mouth disease in accordance with paragraph 1, it must be taken into account that:

"3. Bij de vaststelling overeenkomstig lid 1 van de veterinairrechtelijke voorschriften ten aanzien van mond- en klauwzeer wordt er rekening mee gehouden dat:

- only frozen embryos may be imported from third countries where vaccination against foot-and-mouth disease is practised. The embryos must be stored under approved conditions for a minimum of 30 days before consignment,

- alleen bevroren embryo's mogen worden ingevoerd uit derde landen die tegen mond- en klauwzeer inenten. Deze embryo's moeten vóór de verzending gedurende een periode van minstens 30 dagen onder goedgekeurde omstandigheden zijn bewaard,

- donor animals must come from a holding in which no animal has been vaccinated against foot-and-mouth disease during the 30 days prior to collection, and which is not subject to any prohibition or quarantine measures.';

- de donordieren afkomstig moeten zijn van een bedrijf waar tijdens de 30 dagen vóór het verzamelen geen enkel dier tegen mond- en klauwzeer is ingeënt en ten aanzien waarvan geen verbods- of quarantainemaatregelen gelden.";

7. Articles 11, 12 and 13 shall be replaced by the following:

7. de artikelen 11, 12 en 13 worden geschrapt en vervangen door het volgende artikel:

"Artikel 11

The principles and rules laid down by Directive 90/675/EEC (*) shall apply, in particular as regards the organization of the checks to be carried out by Member States and the follow-up to those checks as well as the safeguard measures to be implemented.

De beginselen en voorschriften van Richtlijn 90/675/EEG (*) zijn van toepassing, met name wat betreft de organisatie van de door de Lid-Staten te verrichten controles, de aan deze controles te verbinden gevolgen en de ten uitvoer te leggen vrijwaringsmaatregelen.

Article 2

Artikel 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive before 1 January 1994. They shall forthwith inform the Commission thereof.

1. De Lid-Staten doen de nodige wettelijke en bestuursrechtelijke bepalingen in werking treden om vóór 1 januari 1994 aan deze richtlijn te voldoen. Zij stellen de Commissie daarvan onverwijld in kennis.

When Member States adopt these provisions, the provisions shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The procedure for such references shall be adopted by Member States.

Wanneer de Lid-Staten deze bepalingen aannemen, wordt in die bepalingen naar de onderhavige richtlijn verwezen of wordt hiernaar verwezen bij de officiële bekendmaking van die bepalingen. De regels voor deze verwijzing worden door de Lid-Staten vastgesteld.

2. Member States shall communicate to the Commission the text of the main provisions of domestic law they adopt in the field covered by this Directive.

2. De Lid-Staten delen de Commissie de tekst van de belangrijkste bepalingen van intern recht mede die zij op het onder deze richtlijn vallende gebied vaststellen.

This Directive is addressed to the Member States.

Deze richtlijn is gericht tot de Lid-Staten.
