Having regard to the Treaty establishing the European Community,

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap,

Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community(1), as last amended by Commission Directive 2002/28/EC(2), and in particular the second paragraph, subparagraphs (c) and (d) of Article 14, thereof,

Gelet op Richtlijn 2000/29/EG van de Raad van 8 mei 2000 betreffende de beschermende maatregelen tegen het binnenbrengen en de verspreiding in de Gemeenschap van voor planten en voor plantaardige producten schadelijke organismen(1), laatstelijk gewijzigd bij Richtlijn 2002/28/EG(2), en met name op artikel 14, lid 2, onder c) en d),

Whereas:

Overwegende hetgeen volgt:

(1) Measures should be taken to protect the Community against Anisogramma anomala (Peck) E. Müller, Anoplophora glabripennis (Motschulsky) and Naupactus leucoloma Boheman, harmful organisms which have not hitherto been known to occur in the Community.

(1) Er dienen maatregelen te worden genomen om de Gemeenschap te beschermen tegen Anisogramma anomala (Peck) E. Müller, Anoplophora glabripennis (Motschulsky) en Naupactus leucoloma Boheman, schadelijke organismen die, voorzover bekend, tot dusverre in de Gemeenschap niet voorkwamen.

(2) The current provisions against Liriomyza bryoniae (Kaltenbach) should be modified by restricting them to protected zones in Ireland and the United Kingdom (North Ireland) where it has been determined that this organism is not present.

(2) De huidige bepalingen betreffende Liriomyza bryoniae (Kaltenbach) moeten worden gewijzigd door te bepalen dat ze uitsluitend gelden voor beschermde gebieden in Ierland en het Verenigd Koninkrijk (Noord-Ierland) waar is vastgesteld dat dit organisme er niet aanwezig is.

(3) The list of host plants of Liriomyza huidobrensis (Blanchard) and Liriomyza trifolii (Burgess) should be modified to take into account of the updated information on the relationship between these harmful organisms and their host plants.

(3) De lijst van waardplanten voor Liriomyza huidobrensis (Blanchard) en Liriomyza trifolii (Burgess) moet worden gewijzigd om rekening te houden met de nieuwe informatie over het verband tussen deze schadelijke organismen en hun waardplanten.

(4) Due to continued interceptions of Bemisia tabaci Genn., Liriomyza sativae (Blanchard), Amauromyza maculosa (Malloch), Liriomyza huidobrensis (Blanchard), Liriomyza trifolii (Burgess) and Thrips palmi Karny on commodities, the current provisions on protective measures against the introduction into and spread within the Community, with a view to ensuring more effective protection, should be improved.

(4) Aangezien herhaalde malen producten zijn onderschept waarop Bemisia tabaci Genn., Liriomyza sativae (Blanchard), Amauromyza maculosa (Malloch), Liriomyza huidobrensis (Blanchard), Liriomyza trifolii (Burgess) en Thrips palmi Karny werden aangetroffen, dienen de huidige bepalingen betreffende beschermende maatregelen tegen het binnenbrengen en de verspreiding van deze schadelijke organismen in de Gemeenschap te worden verbeterd met het oog op een doeltreffender bescherming.

(5) These improved protective measures should include the use of a plant passport for plants or plant products originating in the Community and a phytosanitary certificate for plants or plant products originating in third countries.

(5) Deze verbeterde beschermende maatregelen moeten voorzien in het gebruik van een paspoort voor planten of plantaardige producten van oorsprong uit de Gemeenschap en een fytosanitair certificaat voor planten of plantaardige producten van oorsprong uit derde landen.

(6) The current provisions against beet necrotic yellow vein virus should be modified in order to reflect the conclusions of a Commission Working Group having assessed the phytosanitary risk associated with this harmful organism in the relevant protected zones recognised in the Community.

(6) De huidige bepalingen betreffende Beet necrotic yellow vein virus moeten worden gewijzigd om rekening te houden met de conclusies van een werkgroep van de Commissie die de fytosanitaire risico's van dit schadelijke organisme in de relevante beschermde gebieden in de Gemeenschap heeft onderzocht.

(7) The current provisions against Tilletia indica Mitra should be modified to take into account of the updated information on the presence of this harmful organism in South Africa.

(7) De huidige bepalingen betreffende Tilletia indica Mitra moeten worden gewijzigd om rekening te houden met de bijgewerkte informatie over de aanwezigheid van dit schadelijke organisme in Zuid-Afrika.

(8) The incorrect listing of Malta and Cyprus as non-European countries should be rectified in Annex IV, Part A, Section I, point 34, and Annex V, Part B, Section I, point 7(b), to Directive 2000/29/EC.

(8) De onjuiste indeling van Malta en Cyprus als niet-Europese landen moet worden gecorrigeerd in bijlage IV, deel A, rubriek I, punt 34, en bijlage V, deel B, rubriek I, punt 7, onder b), van Richtlijn 2000/29/EG.

(9) The amendments are in accordance with the requests of the Member States concerned.

(9) Met deze wijzigingen wordt voldaan aan de door de betrokken lidstaten ingediende verzoeken.

(10) Therefore the relevant annexes to Directive 2000/29/EC should be amending accordingly.

(10) De desbetreffende bijlagen bij Richtlijn 2000/29/EG moeten derhalve dienovereenkomstig worden gewijzigd.

(11) The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Plant Health,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Artikel 1

Annexes I, II, IV and V to Directive 2000/29/EC are hereby amended as indicated in the Annex to this Directive.

De bijlagen I, II, IV en V bij Richtlijn 2000/29/EG worden overeenkomstig de bijlage bij deze richtlijn gewijzigd.

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive on 1 April 2003. They shall forthwith inform the Commission thereof.

1. De lidstaten doen de nodige wettelijke en bestuursrechtelijke bepalingen in werking treden om op 1 april 2003 aan deze richtlijn te voldoen. Zij stellen de Commissie daarvan onverwijld in kennis.

When Member States adopt these measures, these shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The procedure for such reference shall be adopted by Member States.

Wanneer de lidstaten deze bepalingen aannemen, wordt in die bepalingen naar de onderhavige richtlijn verwezen of wordt hiernaar verwezen bij de officiële bekendmaking van die bepalingen. De regels voor deze verwijzing worden vastgesteld door de lidstaten.

2. The Member States shall immediately communicate to the Commission the main provisions of domestic law which they adopt in the field covered by this Directive. The Commission shall inform the other Member States thereof.

2. De lidstaten delen de Commissie onverwijld de belangrijke bepalingen van intern recht mee die zij op het onder deze richtlijn vallende gebied vaststellen. De Commissie stelt de andere lidstaten daarvan in kennis.

Article 3

Artikel 3

This Directive shall enter into force on the day following its publication in the Official Journal of the European Communities.

Deze richtlijn treedt in werking op de dag volgende op die van haar bekendmaking in het Publicatieblad van de Europese Gemeenschappen.
