Having regard to the Treaty establishing the European Community, and in particular Articles 47(2), 55 and 95 thereof, in conjunction with the first sentence of Article 300(2) and the second subparagraph of Article 300(3),
|

Whereas:
|
Overwegende hetgeen volgt:
|
|
(1) The WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT) adopted in Geneva on 20 December 1996 under the auspices of the World Intellectual Property Organisation will help to ensure a balanced level of protection for works and other subject matter, while allowing the public access to material available via networks.

(1) Het WIPO-verdrag inzake het auteursrecht (WCT) en het WIPO-verdrag inzake uitvoeringen en fonogrammen (WPPT), welke op 20 december 1996 te Genève onder auspiciën van de Wereldorganisatie voor de intellectuele eigendom zijn goedgekeurd, zullen bijdragen tot het garanderen van een evenwichtig niveau van bescherming van werken en andere onderwerpen, en zullen tegelijkertijd de toegang van het publiek tot de inhoud welke over netwerken kan worden verstrekt, mogelijk maken.

(2) The competence of the Community to conclude or accede to international agreements or treaties does not derive only from explicit conferral by the Treaty but may also derive from other provisions of the Treaty and from acts adopted pursuant to those provisions by Community institutions.
|
(2) De bevoegdheid van de Europese Gemeenschap om internationale overeenkomsten of verdragen te sluiten, c.q. tot dergelijke overeenkomsten of verdragen toe te treden, vloeit niet alleen voort uit de uitdrukkelijke bevoegdheidstoewijzing in het Verdrag, doch kan ook worden afgeleid uit andere Verdragsbepalingen en uit besluiten die overeenkomstig die bepalingen door de Gemeenschapsinstellingen zijn genomen.

(3) The subject matter of the WCT and the WPPT falls to a large extent within the scope of existing Community directives in this field.
|
(3) Het onderwerp van het WCT en het WPPT valt voor een groot deel binnen de werkingssfeer van terzake vigerende communautaire richtlijnen.
|
|
(4) It follows that the approval of the WCT and the WPPT is a matter for both the Community and its Member States.
|
(4) De bevoegdheid om het WCT en het WPPT goed te keuren is derhalve een zaak van zowel de Gemeenschap als haar lidstaten.
|
|
(5) The WCT and the WPPT should therefore be approved on behalf of the Community with regard to matters within its competence.
|
(5) Het WCT en het WPPT dienen derhalve namens de Europese Gemeenschap te worden goedgekeurd voorzover deze aangelegenheden betreffen waarvoor zij bevoegd is.
|

(6) The Community has already signed the WCT and the WPPT, subject to final conclusion.
|
(6) De Europese Gemeenschap heeft het WCT en het WPPT reeds ondertekend, onder voorbehoud van de definitieve sluiting van deze verdragen.
|
|
(7) The deposit of the instruments of conclusion of the Community should take place as far as possible simultaneously with the deposit of the instruments of ratification of the Member States,

(7) Voorzover mogelijk dient de nederlegging van de sluitingsinstrumenten door de Gemeenschap gelijktijdig met de nederlegging van de bekrachtigingsinstrumenten door de lidstaten te geschieden,

HAS DECIDED AS FOLLOWS:

1. The WIPO Copyright Treaty (WCT) is hereby approved on behalf of the Community with regard to matters within its competence.
|
1. Het WIPO-verdrag inzake het auteursrecht (WCT) wordt namens de Europese Gemeenschap goedgekeurd ten aanzien van aangelegenheden waarvoor zij bevoegd is.
|

2. The WIPO Performances and Phonograms Treaty (WPPT) is hereby approved on behalf of the Community with regard to matters within its competence.
|
2. Het WIPO-verdrag inzake uitvoeringen en fonogrammen (WPPT) wordt namens de Europese Gemeenschap goedgekeurd ten aanzien van aangelegenheden waarvoor zij bevoegd is.
|
|
3. The texts of the Treaties are attached to this Decision.
|
3. De teksten van de verdragen zijn aan dit besluit gehecht.
|

|
The President of the Council is hereby authorised to deposit the instruments of conclusion with the Director-General of the World Intellectual Property Organisation as from the date by which the Member States will have to bring into force the measures adopted by the European Parliament and the Council necessary to adapt the existing Community legislation to the obligations deriving from the WCT and the WPPT.
|
De voorzitter van de Raad wordt gemachtigd de sluitingsinstrumenten neder te leggen bij de directeur-generaal van de Wereldorganisatie voor de intellectuele eigendom, zodra de lidstaten de door het Europees Parlement en de Raad aangenomen maatregelen voor de aanpassing van de vigerende communautaire wetgeving aan de verplichtingen, voortvloeiende uit het WCT en het WPPT, in werking dienen te doen treden.

1. The Commission is hereby authorised to represent the Community at the meetings of the Assemblies referred to in the WCT and WPPT.
|
1. De Commissie wordt gemachtigd de Europese Gemeenschap te vertegenwoordigen in de zittingen van de in de WCT en de WPPT genoemde vergaderingen.
|
|
2. On all matters within the sphere of competence of the Community, the Commission shall negotiate in the Assemblies of the WCT and the WPPT on behalf of the Community in accordance with the applicable rules of the EC Treaty, in particular Article 300 thereof.
|
2. Over alle aangelegenheden waarvoor de Gemeenschap bevoegd is, onderhandelt de Commissie in de vergaderingen van de WCT en de WPPT namens de Gemeenschap overeenkomstig de regels van het EG-Verdrag, in het bijzonder artikel 300.
|
|
3. The position which the Community may adopt within the Assemblies shall be prepared by the relevant Council working party.
|
3. Het standpunt dat de Gemeenschap in de vergaderingen zal innemen, wordt voorbereid door de bevoegde groep van de Raad.
