COMMISSION DECISION of 11 June 1992 laying down certain rules to ensure coordination between organizations and associations which maintain or establish stud-books for registered equidae (92/354/EEC)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

DE COMMISSIE VAN DE EUROPESE GEMEENSCHAPPEN,

Having regard to the Treaty establishing the European Economic Community,

Gelet op het Verdrag tot oprichting van de Europese Economische Gemeenschap,

Having regard to Council Directive 90/427/EEC of 26 June 1990 on the zootechnical and genealogical conditions governing intra-Community trade in equidae (1), and in particular Article 4 (2) (e) thereof,

Gelet op Richtlijn 90/427/EEG van de Raad van 26 juni 1990 tot vaststelling van zooetechnische en genealogische voorschriften voor het intracommunautaire handelsverkeer in paardachtigen (1), inzonderheid op artikel 4, lid 2, onder e),

Whereas Decision 92/353/EEC (2) lays down the criteria for the approval or recognition of organizations and associations which maintain or establish stud-books for registered equidae; whereas that Decision provides that the authorities of the Member State concerned are responsible for approving or recognizing organizations or associations which maintain or establish stud-books;

Overwegende dat de Commissie bij Beschikking 92/353/EEG (2) de criteria heeft vastgesteld voor de erkenning van organisaties en verenigingen die stamboeken voor geregistreerde paardachtigen bijhouden of aanleggen; dat volgens deze beschikking de organisaties of verenigingen die stamboeken bijhouden of aanleggen, door de autoriteiten van de betrokken Lid-Staat worden erkend;

Whereas in this context, therefore, rules should be laid down to govern the relations between the organization or association which maintains the stud-book of the origin of the breed and an organization or association which maintains or establishes a stud-book or a section of a stud-book for that breed;

Overwegende dat in dit verband met name de voorschriften moeten worden vastgesteld voor de relaties tussen de organisatie of vereniging die het oorspronkelijke stamboek van het ras bijhoudt en een organisatie of vereniging die een stamboek of een sectie van een stamboek voor dat ras bijhoudt of aanlegt;

Whereas provisions should be made for a procedure enabling the competent authorities concerned to ensure, in special circumstances, coordination between two organizations or associations; whereas it is also important that all the information required for the adoption of the specific coordination rules pursuant to Article 4 (2) (e) of Directive 90/427/EEC be made available to the Commission;

Overwegende dat moet worden voorzien in een procedure in het kader waarvan de betrokken bevoegde autoriteiten, in bijzondere omstandigheden, kunnen zorgen voor de cooerdinatie tussen twee organisaties of verenigingen; dat, bovendien, de Commissie moet kunnen beschikken over de nodige gegevens voor de vaststelling van specifieke voorschriften voor de cooerdinatie als bedoeld in artikel 4, lid 2, onder e), van Richtlijn 90/427/EEG;

Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Zootechnics,

Overwegende dat de in deze beschikking vervatte maatregelen in overeenstemming zijn met het advies van het Permanent Zooetechnisch Comité,

HAS ADOPTED THIS DECISION:

HEEFT DE VOLGENDE BESCHIKKING GEGEVEN:

Article 1

Artikel 1

The organization or association which maintains the stud-book of the origin of the breed must ensure close collaboration with the organization and associations which maintain stud-books or sections of a stud-book of the same breed, particularly with a view to preventing any dispute.

De organisatie of vereniging die het oorspronkelijke stamboek van het ras bijhoudt, zorgt voor een nauwe samenwerking met de organisaties of verenigingen die stamboeken of secties van stamboeken voor datzelfde ras bijhouden, meer in het bijzonder om geschillen te vermijden.

1. Where the competent authority of a Member State considers that an approved or recognized organization or association in another Member State is not complying with the rules laid down in the relevant Community legislation, and particularly with the principles laid down by the organization or association which maintains the stud-book of the origin of the breed, it shall contact the competent authority of the other Member State concerned forthwith.

1. Wanneer de bevoegde autoriteit van een Lid-Staat van oordeel is dat een in een andere Lid-Staat erkende organisatie of vereniging de in het Gemeenschapsrecht ter zake vastgestelde voorschriften niet in acht neemt en met name de beginselen die zijn vastgesteld door de organisatie of vereniging die het oorspronkelijke stamboek voor het ras bijhoudt, niet eerbiedigt, neemt zij onmiddellijk contact op met de bevoegde autoriteit van die andere Lid-Staat.

The latter shall take all the necessary measures and inform the competent authority of the first Member State of the type of checks carried out, the decisions taken and the reasons for those decisions.

Deze laatste neemt de nodige maatregelen en deelt de bevoegde autoriteit van de eerste Lid-Staat mee welke controles zijn verricht en welke beslissingen zijn genomen en waarom.

2. If the competent authorities of the first Member State considers these measures likely to be insufficient, it shall explore with the authority of the other Member State ways of remedying the situation, if necessary by visiting that Member State.

2. Wanneer de bevoegde autoriteit van de eerste Lid-Staat vreest dat de maatregelen niet toereikend zijn, zoekt zij samen met de autoriteit van de betrokken Lid-Staat naar de wijze waarop in deze situatie verbetering kan worden gebracht, eventueel door middel van een bezoek ter plaatse.

3. The competent authorities of the Member States shall inform the Commission of the solutions decided upon.

3. De bevoegde autoriteiten van de betrokken Lid-Staten delen de Commissie mee op welke wijze zij het probleem denken op te lossen.

4. In the event that no solution is found within six months, at the request of one of the authorities of the Member States concerned or on its own initiative, the Commission may, in particular, send an inspection team in collaboration with the competent national authorities.

4. Indien binnen zes maanden geen oplossing is gevonden, kan de Commissie, op verzoek van een van de autoriteiten van de betrokken Lid-Staten of op eigen initiatief, met name een inspectiebezoek ter plaatse gelasten in samenwerking met de bevoegde nationale autoriteiten.
