THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 75 thereof,
li jemenda r-Regolament (KEE) Nru 1108/70 li jintroduċi sistema ta' kontabilità għall-ispiża fuq infrastruttura f'dak li għandu x'jaqsam mat-trasport bil-ferrovija, bit-triq u bil-passaġġi fuq l-ilma interni
Having regard to the proposal from the Commission,
IL-KUNSILL TAL-KOMUNITAJIET EWROPEJ,
Having regard to the opinion of the European Parliament (1),
Wara li kkunsidra t-Trattat li jistabbilixxi l-Komunità Ekonomika Ewropea, u b'mod partikolari l-Artikolu 75 tiegħu,
Having regard to the opinion of the Economic and Social Committee (2),
Wara li kkunsidra l-proposta mill-Kummisjoni,
Whereas, in order to institute under the common transport policy a system of charging for the use of infrastructure, it is necessary to know what expenditure is incurred in respect of infrastructure;
Wara li kkunsidra l-opinjoni tal-Parlament Ewropew [1],
Whereas a permanent accounting system offers the most suitable means for knowing what expenditure is incurred in respect of infrastructure;
Wara li kkunsidra l-opinjoni tal-Kumitat Ekonimiku u Soċjali [2],
Whereas to this end the Council, by Regulation (EEC) No 1108/70 (3), introduced a permanent accounting system for such expenditure;
Billi, sabiex tiġi istitwita skond il-politika ta' trasport komuni sistema ta' ħlas għall-użu ta' l-infrastruttura, huwa meħtieġ li ssir magħrufa l-ispiża li saret fuq l-infrastruttura;
Whereas account should be taken of experience gained and of the development of the common transport policy ; whereas the forms of accounts, the list of types of infrastructure and the schedule of returns concerning the use of infrastructure provided for in Regulation (EEC) No 1108/70 should be adjusted accordingly,
Billi sistema ta' kontabilità permanenti toffri l-aktar mezz addattat sabiex ikun magħruf xi spiża saret f'dak li għandu x'jaqsam ma' l-infrastruttura;
HAS ADOPTED THIS REGULATION:
Billi għal dan il-għan il-Kunsill, permezz tar-Regolament (KEE) Nru 1108/70 [3], introduċa sistema ta' kontabilità permanenti għal dak l-infiq;
Billi għandha tiġi meqjusa l-esperjenza miksuba u l-iżvilupp fil-politika komuni tat-trasport; billi l-formoli tal-kontabilità, il-lista tat-tipi ta' infrastruttura u l-iskeda tal-prospetti li jirrigwardaw l-użu ta' l-infrastruttura stabbiliti fir-Regolament (KEE) Nru 1108/70 għandhom jiġu aġġustati kif meħtieġ,
Article 1
ADOTTA DAN IR-REGOLAMENT:
Regulation (EEC) No 1108/70 is hereby amended as follows: 1. Article 3 shall be replaced by the following:
L-Artikolu 1
"Article 3
Ir-Regolament (KEE) Nru 1108/70 huwa emendat kif ġej:
Infrastructure expenditure accounts shall be kept for each of the railway networks listed in Annex II (A. 1) and for the total of all the other networks listed in Annex II (A. 2), as well as for all roads and inland waterways open to public traffic, with the following exceptions: (a) roads closed to motor traffic, that is, to vehicles with a cylinder capacity equal to or exceeding 50 cm3;

Il-kontijiet tan-nefqa fuq l-infrastruttura għandhom jinżammu għal kull waħda min-networks tal-ferroviji elenkati fl-Anness II(A.1) u għat-total tan-networks l-oħrajn elenkati fl-Anness II(A.2), kif ukoll għat-toroq kollha u għall-passaġġi fuq l-ilma interni miftuħa għat-traffiku pubbliku, bl-eċċezzjonijiet li ġejjin:
(d) waterways of a maritime character, as listed in Regulation (EEC) No 281/71 (1).
(a) toroq magħluqa għat-traffiku bil-mutur, jiġifieri, għall-vetturi b'kapaċita ta' ċilindrata daqs jew li taqbez il-50 ċm3;
(b) toroq użati esklussivament minn vetturi agrikoli jew tal-forestrija li jservu biss biex jipprovdu aċċess għall-operazzjonijiet agrikoli jew tal-forestrija;
(ċ) passaġġi fuq l-ilma interni li fuqhom it-traffiku huwa limitat għall-vapuri ta' piż mejjet ta' anqas minn 250 tunellata;

"2. Separate accounts shall be presented:

3. The second indent of the first subparagraph of Article 6 shall be replaced by the following:

"- capital repayments and, separately, interest on loans contracted earlier."

4. Article 7 shall be replaced by the following:

Member States shall send to the Commission, at the same time as they send the accounts referred to in Article 5 and in respect of the same period, returns relating to the use of infrastructures in accordance with Tables A, B (1.1) and C of Annex III.
L-Istati Membri għandhom jibagħtu lill-Kummissjoni, fl-istess żmien li jibagħtu l-kontijiet li għalihom jirreferi l-Artikolu 5 u fir-rigward ta' l-istess perjodu, prospetti li għandhom x'jaqsmu ma' l-użu ta' l-infrastruttura skond it-Tabelli A, (1.1) u Ċ ta' l-Anness III.
The returns covered by Tables B (1.2) and B (2) of that Annex shall be sent only once every five years. In the case of Table B (1.2) returns shall be sent for the first time for the year 1980 and, in the case of Table B (2), returns shall be suspended until work on the system of charging for the use of infrastructure make them necessary."
Il-prospetti koperti bit-Tabelli B(1.2) u B(2) ta' dak l-Anness għandhom jintbagħtu biss darba kull ħames snin. Fil-każ tat-Tabella B(1.2) il-prospetti għandhom jintbagħtu għall-ewwel darba għas-sena 1980 u, fil-każ tat-Tabella B(2), il-prospetti għandhom jiġu sospiżi sakemm ix-xogħol fuq is-sistema ta' ħlasijiet għall-użu ta' l-infrastruttura tagħmilhom meħtieġa."
5. Annexes I, II and III are amended in accordance with the Annex.
5. L-Annessi I, II u III huma emendati skond l-Anness.
L-Artikolu 2
L-Istati Membri għandhom, fil-ħin u wara li jikkonsultaw lill-Kummissjoni, jadottaw dawk il-liġijiet, ir-regolamenti u d-dispożizzjonijiet amministrattivi kif jista' jkun meħtieġ għall-implimentazzjoni ta' dan ir-Regolament.
Meta Stat Membru hekk jitlob, jew meta il-Kummissjoni jidhrilha li huwa xieraq, il-Kummissjoni għandha tikkonsulta ma' l-Istati Membri konċernati dwar it-termini proposti tal-miżuri li għalihom jirreferi l-paragrafu preċedenti.
Article 2
Dan ir-Regolament għandu jorbot fl-intier tiegħu u japplika direttament fl-Istati Membri kollha.
Member States shall, in good time and after consulting the Commission, adopt such laws, regulations or administrative provisions as may be necessary for the implementation of this Regulation.
Where a Member State so requests, or where the Commission considers it appropriate, the Commission shall consult with the Member States concerned upon the proposed terms of the measures referred to in the preceding paragraph.
