IL-KUNSILL TA' L-UNJONI EWROPEA,

THE COUNCIL OF THE EUROPEAN UNION,

Wara li kkunsidra t-Trattat li jistabbilixxi l-Komunitajiet Ewropej, u b'mod partikolu l-Artikoli 47(2), 55 u 95 tiegħu, ma' l-ewwel sentenza ta' l-Artikolu 300(2) u t-tieni waħda ta' l-Artikolu 300(3),

Having regard to the Treaty establishing the European Community, and in particular Articles 47(2), 55 and 95 thereof, in conjunction with the first sentence of Article 300(2) and the second subparagraph of Article 300(3),
|
Wara li kkunsidra l-proposta mressqa mill-Kummissjoni [2],

|
Having regard to the proposal from the Commission(2),
|
Wara li kkunsidra l-approvazzjoni tal-Parlament Ewropew [3],
|
|
Having regard to the assent of the European Parliament(3),
|
Billi:

Whereas:
|
(1) It-Trattat WIPO dwar id-Dritt ta' l-Awtur (WCT) u t-Trattat WIPO dwar il-Preżentazzjonijiet u l-Fonogrammi (WPPT) adottat f'Ġeneva fl-20 ta' Diċembru 1996 taħt il-patroċinju ta' l-Organizzazzjoni Dinjija dwar il-Proprjetà Intellettwali se jgħinu biex jiżguraw livell bilanċjat ta' protezzjoni għal xogħlijiet u suġġetti oħra, waqt li jħallu l-aċċess pubbliku għal materjal disponibbli min-netwerks.

(1) The WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT) adopted in Geneva on 20 December 1996 under the auspices of the World Intellectual Property Organisation will help to ensure a balanced level of protection for works and other subject matter, while allowing the public access to material available via networks.

(2) Il-kompetenza tal-Komunità biex tikkonkludi jew taderixxi għal ftehim internazzjonali jew trattati ma tiġix biss mill-għotja espliċita mit-Trattat imma tista' tinkiseb minn disposizzjonijiet oħra tat-Trattat u minn atti adotatti skond dawn id-disposizzjonijiet ta' l-istituzzjonijiet tal-Komunità.

(2) The competence of the Community to conclude or accede to international agreements or treaties does not derive only from explicit conferral by the Treaty but may also derive from other provisions of the Treaty and from acts adopted pursuant to those provisions by Community institutions.
|
(3) Is-suġġett tal-WCT u tal-WPPT jaqa' sa ċertu punt fil-kamp ta' applikazzjoni tad-direttivi eżistenti tal-Komunità f'dan il-qasam.
|
|
(3) The subject matter of the WCT and the WPPT falls to a large extent within the scope of existing Community directives in this field.
|
(4) Dan ifisser li l-approvazzjoni tal-WCT u tal-WPPT hi ħaġa kemm għall-Komunità kif ukoll għall-Istati Membri.
|
|
(4) It follows that the approval of the WCT and the WPPT is a matter for both the Community and its Member States.
|
(5) Il-WCT u l-WPPT għandhom għalhekk ikunu approvati f'isem il-Komunità rigward materji fil-kompetenza tagħha.
|
|
(5) The WCT and the WPPT should therefore be approved on behalf of the Community with regard to matters within its competence.
|
(6) Il-Komunità diġà ffirmat il-WCT u l-WPPT, bla ħsara għal konklużjoni finali.
|
|
(6) The Community has already signed the WCT and the WPPT, subject to final conclusion.
|
(7) Id-depożitu ta' l-istrumenti tal-konklużjoni tal-Komunità għandu jseħħ kemm jista' jkun possibbli fl-istess ħin mad-depożitu ta' l-istrumenti ta' ratifika ta' l-Istati Membri,

(7) The deposit of the instruments of conclusion of the Community should take place as far as possible simultaneously with the deposit of the instruments of ratification of the Member States,

IDDEĊIEDA DAN LI ĠEJ:

HAS DECIDED AS FOLLOWS:
|
Artikolu 1

1. It-Trattat WIPO dwar id-Dritt ta' l-Awtur hu hawnhekk approvat f'isem il-Komunità rigward materji fil-kompetenza tagħha.
|
|
Article 1
|
2. It-Trattat WIPO dwar il-Preżentazzjonijiet u l-Fonogrammi hu hawnhekk approvat f'isem il-Komunità rigward materji fil-kompetenza tagħha.
|
|
1. The WIPO Copyright Treaty (WCT) is hereby approved on behalf of the Community with regard to matters within its competence.
|
3. It-testi tat-Trattati huma annessi ma' din id-Deċiżjoni.
|
|
2. The WIPO Performances and Phonograms Treaty (WPPT) is hereby approved on behalf of the Community with regard to matters within its competence.
|

3. The texts of the Treaties are attached to this Decision.

Il-President tal-Kunsill hu hawnhekk awtorizzat biex jiddepożita l-istrumenti ta' konklużjoni mad-Direttur-Ġenerali ta' l-Organizzazzjoni Dinjija dwar il-Proprjetà Intellettwali mid-data li fiha l-Istati Membri għandhom idaħħlu fis-seħħ il-miżuri adottati mill-Parlament Ewropew u mill-Kunsill li huma neċessarji biex il-leġislazzjoni eżistenti tal-Komunità tiġi addatta għall-obbligi li joħorġu mill-WCT u mill-WPPT.

Artikolu 3

Article 2
|
1. Il-Kummissjoni hi hawnhekk awtorizzata biex tirrappreżenta lill-Komunità fil-laqgħat ta' l-Assemblei msemmija fil-WCT u fil-WPPT.
|
|
The President of the Council is hereby authorised to deposit the instruments of conclusion with the Director-General of the World Intellectual Property Organisation as from the date by which the Member States will have to bring into force the measures adopted by the European Parliament and the Council necessary to adapt the existing Community legislation to the obligations deriving from the WCT and the WPPT.
|
2. Dwar il-materji kollha fl-isfera tal-kompetenza tal-Komunità, il-Kummissjoni għandha tinnegozja fl-Assembleji tal-WCT u tal-WPPT f'isem il-Komunità skond ir-regoli applikabbli tat-Trattat tal-KE, b'mod partikolari l-Artikolu 300 tiegħu.

3. Il-pożizzjoni li l-Komunità tista' tadotta fl-Assemblei għandha tkun ippreparata mill-grupp ta' ħidma relevanti tal-Kunsill.

Article 3
|
|
|
1. The Commission is hereby authorised to represent the Community at the meetings of the Assemblies referred to in the WCT and WPPT.
|
Magħmula fi Brussel, fis-16 ta' Marzu 2000.
|
|
2. On all matters within the sphere of competence of the Community, the Commission shall negotiate in the Assemblies of the WCT and the WPPT on behalf of the Community in accordance with the applicable rules of the EC Treaty, in particular Article 300 thereof.

3. The position which the Community may adopt within the Assemblies shall be prepared by the relevant Council working party.
