Wara li kkunsidra t-Trattat li jistabbilixxi l-Komunità Ekonomika Ewropea, u partikolarment l-Artikolu 100a tiegħu,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 100a thereof,

Having regard to the opinion of the Economic and Social Committee (3),
|
Billi l-Artikolu 13 tad-Direttiva 86/298/KEE [4] jistabbilixxi li d-dispożizzjonijiet li bħalissa huma fis-seħħ għandhom ikunu ssuplimentati b’dispożizzjonijiet li jintroduċu t-testijiet ta’ l-impatt fil-proċedura tat-test dinamiku;

Whereas it is necessary to adopt measures with the aim of progressively establishing the internal market over a period expiring on 31 December 1992; whereas the internal market comprises an area without internal frontiers in which the

Billi, minħabba li diġà hemm dispożizzjoni għal test addizzjonali fil-każ tal-proċedura tat-test statiku, huwa meħtieġ li anki fil-proċedura tat-test dinamiku jkun hemm provvediment għal test ieħor li b’mod iktar preċiż jirrifletti s-sitwazzjoni fil-każ li jinqaleb xi tractor sabiex dawn iż-żewġ proċeduri ta’ test ikunu jistgħu jsiru ekwivalenti u l-iżbilanċ preżenti li hemm bejniethom ikun eliminat;

free movement of goods, persons, services and capital is ensured;

Billi l-parametri purament teoretiċi u l-kalkoli li fuqhom kien inizjalment ibbażat it-test dinamiku ta’ l-impatt kien is-suġġett ta’ l-esperimenti prattiċi li ma jħallux dubju dwar il-fiduċja tagħhom;

Whereas Article 13 of Directive 86/298/EEC (4) lays down that the provisions at present in force shall be supplemented by provisions introducing additional impact tests into the dynamic test procedure;
|
Billi huwa meħtieġ ukoll li jkun emendat l-iskop tad-Direttiva 86/298/KEE sabiex ikun iċċarat il-kliem tat-tieni inċiż ta’ l-Artikolu 1 li jikkonċerna t-tyres immuntati fuq il-fusien ta’ quddiem u ta’ wara, u b’hekk tkun eliminata kull possibbiltà ta’ interpretazzjonijiet differenti,

Whereas, since provision is already made for an additional test in the case of the static test procedure, it is necessary also in that of the dynamic test procedure to provide for an additional test which more accurately reflects the situation in the event of tractor roll-over in order that these two test procedures may be rendered equivalent and the present imbalance between them eliminated;
|
ADOTTA DIN ID-DIRETTIVA:
|
|
Whereas the purely theoretical parameters and calculations on which the additional dynamic impact test was initially based have been the subject of practical experiments that leave no doubt as to their reliability;
|

|
|
Whereas it is also necessary to amend the scope of Directive 86/298/EEC so as to clarify the wording of the second indent of Article 1 concerning the tyres fitted to the front and rear axles, and thus eliminate any possibility of differing interpretations,
|
Id-Direttiva 86/298/KEE hija hawnhekk emendata kif ġej:
|
|
|
1. It-tieni inċiż ta’ l-Artikolu 1 huwa mibdul b’dan li ġej:
|
|
|
"- wisa’ ta’ l-ispessur tal-fus fissa jew li tista’ tkun aġġustata ta’ anqas minn 1150 mm għall-fusien mgħammra bl-aktar tyres wesgħin; ladarba l-fus mgħammar bl-aktar tyres wesgħin hu meqjus li jista’ jkun aġġustat għal spessur ta’ wisa’ massima ta’ 1150 mm, il-fus l-ieħor għandu jkun jista’ jiġi aġġustat b’tali mod li t-trufijiet ta’ barra ta’ l-idjaq tyres ma joħorġux lil hemm mit-trufijiet ta’ barra tat-tyres fuq il-fus bl-aktar tyres wesgħin. Meta ż-żewġ fusien huma mgħammra b’roti u tyres ta’ l-istess daqs, il-wisa’ fissa jew aġġustata ta’ l-ispessur taż-żewġ fusien għandha tkun anqas minn 1150 mm;"

2. Fl-Anness II, il-punt 3.1.1 huwa mibdul b’dan li ġej:
|

"3.1.1.Wara kull test parzjali fil-proċedura tat-test dinamiku, għandu jkun ħieles minn tiċrit jew xquq kif deskritti fil-punt 3.1 ta’ l-Anness III (A).
|
|
|
Jekk, matul it-test dinamiku, jidhru ammont ta’ tiċrit jew xquq, test addizzjonali dwar l-impatt jew it-tgħaffiġ kif definit fil-punt 1.6 ta’ l-Anness III (A) għandu jkun imwettaq immedjatament wara t-test li jkun ikkaġuna dawn it-tiċritiet jew xquq li jidhru";

HAS ADOPTED THIS DIRECTIVE:
|
3. Fl-Anness III (A), il-punt 1.6 huwa mibdul b’dan li ġej:
|
|
|
"1.6. Test addizzjonali
|
|
|
1.6.1. Jekk tiċritiet jew xquq li ma jistgħux jitqiesu negliġibbli jidhru waqt it-test ta’ l-impatt, it-tieni test simili, iżda b’għoli ta’ waqgħa ta’:
|
|

Directive 86/298/EEC is hereby amended as follows:
|

1.

the second indent of Article 1 is replaced by the following:
|

'- fixed or adjustable minimum track width of less than 1 150 mm for the axles fitted with the widest tyres; since the axle fitted with the widest tyres is assumed to be adjusted to a maximum track width of 1 150 mm, the other axle must be capable of being adjusted in such a way that the outer edges of the narrowest tyres do not project beyond the outer edges of the tyres on the axle with the widest tyres. Where both axles are equipped with wheels and tyres of the same size, the fixed or adjustable track width of both axles must be less than 1 150 mm;'

Sabiex ikun jista’ jitwettaq test ieħor, jeħtieġ li titkejjel id-diformazzjoni elastika waqt it-testijiet kollha ta’ l-impatt.

1.6.2. Jekk, waqt it-test tat-tgħaffiġ, jidhru ammont ta’ tiċritiet jew xquq, it-tieni test simili ta’ tgħaffiġ, iżda b’saħħa ekwivalenti għal 1,2 Fv, għandu jitwettaq immedjatament wara t-test tat-tgħaffiġ li kkaġuna dawn it-tiċritiet jew xquq li jidhru.";

in Annex II, point 3.1.1 is replaced by the following:

After each partial test in the dynamic test procedure, it shall be free from tears or cracks as described in point 3.1 of Annex III (A).
|
L-Artikolu 2
|
|
If, during the dynamic test, significant tears or cracks appear, an additional impact test or crushing test as defined in point 1.6 of Annex III (A) must be performed immediately after the test which caused these tears or cracks to appear.';
|
L-Istati Membri għandhom idaħħlu fis-seħħ il-liġijiet, ir-regolamenti u d-dispożizzjonijiet amministrattivi meħtieġa biex ikunu konformi ma’ din id-Direttiva sa mhux aktar tard minn 12-il xahar mit-3 ta’ Jannar 1990. Għandhom mill-ewwel jgħarrfu lill-Kummissjoni dwarhom.

to the elastic deformation (a = Dp/De) as measured at the point of impact.
|

The additional permanent deformation due to the second impact must not exceed 30 % of the permanent deformation due to the first impact.
|
|
|
In order to be able to carry out the additional test, it is necessary to measure the elastic deformation during all of the impact tests.
|
|
|
,1.6.2.
|
|
|
If, during a crushing test, significant tears or cracks appear, a second, similar crushing test, but with a force equal to 1,2 Fv, shall be performed immediately after the crushing test which caused these tears and cracks to appear.';
|
|
|
4.
|
|
|
in Annex VI, the following point is inserted:

Indication and results of any additional dynamic test.'
|
|
|
|
|
|
Article 2
|
|
|
Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive not later than 12 months from 3 January 1990. They shall forthwith inform the Commission thereof.
|
|
|
|
|
|
Article 3
|
|
|
This Directive is addressed to the Member States.
|
|
