THE COMMISSION OF THE EUROPEAN COMMUNITIES,

EIROPAS KOPIENU KOMISIJA,

Having regard to the Treaty establishing the European Community,

ņemot vērā Eiropas Kopienas dibināšanas līgumu,

Having regard to Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products [1], and in particular Article 11(1) thereof,

ņemot vērā Padomes 1991. gada 22. jūlija Direktīvu 91/493/EEK, ar ko paredz veselības nosacījumus zvejniecības produktu ražošanai un laišanai tirgū [1], un jo īpaši tās 11. panta 1. punktu,

Whereas:

(1) An inspection has been carried out on behalf of the Commission in Saudi Arabia to verify the conditions under which fishery products are produced, stored and dispatched to the Community.

(1) Komisijas vārdā Saūda Arābijā ir veikta pārbaude, lai pārbaudītu apstākļus, kādos zvejniecības produktus ražo, uzglabā un nosūta uz Kopienu.

(2) The requirements in the legislation of Saudi Arabia on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(2) Prasības Saūda Arābijas tiesību aktos par zvejniecības produktu veterināro ekspertīzi un uzraudzību var uzskatīt par līdzvērtīgām Direktīvā 91/493/EEK noteiktajām.

(3) In particular, the "General Directorate of Quality Control Laboratories (GDQCL)" is capable of effectively verifying the implementation of the rules in force.

(3) Konkrēti "General Directorate of Quality Control Laboratories (GDQCL)" (Kvalitātes kontroles laboratoriju ģenerāldirektorāts) spēj efektīvi pārbaudīt spēkā esošo noteikumu īstenošanu.

(4) The GDQCL has provided official assurances on compliance with the standards for health controls and monitoring of fishery products as set out in Chapter V of the Annex to Directive 91/493/EEC and on the fulfilment of hygienic requirements equivalent to those laid down by that Directive.

(4) GDQCL sniedza oficiālu apliecinājumu par Direktīvas 91/493/EEK pielikuma V nodaļā norādīto zvejniecības produktu veselības kontroles un uzraudzības standartu ievērošanu un par tādu higiēnas prasību izpildi, kas līdzvērtīgas minētajā direktīvā noteiktajām.

(5) It is appropriate to lay down detailed provisions concerning fishery products imported into the Community from Saudi Arabia, in accordance with Directive 91/493/EEC.

(5) Ir lietderīgi atbilstoši Direktīvai 91/493/EEK noteikt sīki izstrādātus noteikumus attiecībā uz zvejniecības produktiem, ko ieved Kopienā no Saūda Arābijas.

(6) It is also necessary to draw up a list of approved establishments, factory vessels, or cold stores, and a list of freezer vessels equipped in accordance with the requirements of Council Directive 92/48/EEC of 16 June 1992 laying down the minimum hygiene rules applicable to fishery products caught on board certain vessels in accordance with Article 3(1)(a)(i) of Directive 91/493/EEC [2]. Those lists should be drawn up on the basis of a communication from the GDQCL to the Commission.

(6) Jāizveido arī apstiprināto uzņēmumu, zivju pārstrādes kuģu un saldētavu saraksts, kā arī tādu saldētājkuģu saraksts, kas aprīkoti saskaņā ar prasībām Padomes 1992. gada 16. jūnija Direktīvā 92/48/EEK, ar ko nosaka higiēnas prasību minimumu, kuru piemēro zvejniecības produktiem, ko saskaņā ar Direktīvas 91/493/EEK 3. panta 1. punkta a) apakšpunkta i) ievilkumu nozvejo konkrēti kuģi [2]. Minētie saraksti jāveido, ņemot vērā GDQCL paziņojumu Komisijai.

(7) It is appropriate for this Decision to be applied 3 days after its publication providing for the necessary transitional period.

(7) Šo lēmumu ir lietderīgi piemērot trīs dienas pēc publicēšanas, paredzot vajadzīgo pārejas laiku.

(8) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

IR PIEŅĒMUSI ŠO LĒMUMU.

Article 1

1. pants

The "General Directorate of Quality Control Laboratories (GDQCL)" shall be the competent authority in Saudi Arabia identified for the purposes of verifying and certifying compliance of fishery products with the requirements of Directive 91/493/EEC.

"General Directorate of Quality Control Laboratories (GDQCL)" (Kvalitātes kontroles laboratoriju ģenerāldirektorāts) ir Saūda Arābijas kompetentā iestāde, kas pārbauda un apliecina zvejniecības produktu atbilstību Direktīvas 91/493/EEK prasībām.

Article 2

2. pants

Fishery products imported into the Community from Saudi Arabia shall meet the requirements set out in Articles 3, 4 and 5.

No Saūda Arābijas Kopienā importētajiem zvejniecības produktiem jāatbilst 3., 4. un 5. pantā noteiktajām prasībām.

Article 3

3. pants

1. Each consignment shall be accompanied by a numbered original health certificate in accordance with the model set out in Annex I and comprising a single sheet, duly completed, signed and dated.

1. Visiem sūtījumiem pievieno numurētu veselības sertifikāta oriģinālu, kas atbilst I pielikumā norādītajam paraugam un ir uz vienas lapas, pienācīgi aizpildīts, parakstīts un datēts.

2. The health certificate shall be drawn up in at least one official language of the Member State where the checks are carried out.

2. Sertifikātu sagatavo vismaz vienā tās dalībvalsts oficiālajā valodā, kurā veic pārbaudes.

3. The health certificate shall bear the name, capacity and signature of the representative of the GDQCL, and the latter’s official stamp in a colour different from that of the endorsements.

3. Veselības sertifikātā ir GDQCL pārstāvja vārds, amats, paraksts un oficiāls zīmogs krāsā, kas atšķiras no citu atzīmju krāsas.

Article 4

4. pants

The fishery products shall come from approved establishments, factory vessels, or cold stores, or from registered freezer vessels listed in Annex II.

Zvejniecības produkti ir no II pielikumā uzskaitītajiem apstiprinātajiem uzņēmumiem, zivju pārstrādes kuģiem, saldētavām vai reģistrētiem saldētājkuģiem.

Article 5

5. pants

All packages shall bear the words "SAUDI ARABIA" and the approval/registration number of the establishment, factory vessel, cold store or freezer vessel of origin in indelible letters, except in the case of frozen fishery products in bulk and intended for the manufacture of preserved foods.

Izņemot saldētus zvejniecības produktus, kuri nav fasēti un no kuriem paredzēts ražot konservētu pārtiku, uz visiem iepakojumiem ir vārds "SAŪDA ARĀBIJA" un izcelsmes uzņēmuma, zivju pārstrādes kuģa, saldētavas vai saldētājkuģa apstiprinājuma vai reģistrācijas numurs neizdzēšamiem burtiem.

Article 6

6. pants

This Decision shall apply from 19 March 2005.

Šo lēmumu piemēro no 2005. gada 19. marta.

Article 7

7. pants

This Decision is addressed to the Member States.

Šis lēmums ir adresēts dalībvalstīm.
