COUNCIL DIRECTIVE of 9 December 1974 amending Directive No 68/193/EEC on the marketing of material for the vegetative propagation of the vine (74/648/EEC)

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

(1974. gada 9. decembris),

Having regard to the Treaty establishing the European Economic Community, and in particular Article 43 thereof;

ar ko groza Direktīvu 68/193/EEK par vīnogulāju veģetatīvās pavairošanas materiāla tirdzniecību

Having regard to the proposal from the Commission;

ņemot vērā Eiropas Ekonomikas kopienas dibināšanas līgumu un jo īpaši tā 43. pantu,

Whereas, for the reasons given below, amendments should be made to certain provisions of Council Directive No 68/193/EEC (3) of 9 April 1968 on the marketing of material for the vegetative propagation of the vine, as amended by Directive No 71/140/EEC (4);

ņemot vērā Komisijas priekšlikumu,

Whereas the scope of Directive No 68/193/EEC should be made clear;

ņemot vērā Asamblejas atzinumu [1],

Whereas Member States must be authorized to distinguish between standard propagation material on the basis of different quality criteria;

ņemot vērā Ekonomikas un sociālo lietu komitejas atzinumu [2],

Whereas certain regions benefit from particular conditions which are so favourable for the development of propagation material that the Member State concerned should be enabled to authorize exemptions as to the length of the propagation material for production and marketing in their territories;

tā kā tālāk norādīto iemeslu dēļ būtu jāgroza daži Padomes 1968. gada 9. aprīļa Direktīvas Nr. 68/193/EEK [3] par vīnogulāju veģetatīvās pavairošanas materiāla tirdzniecību, kas grozīta ar Direktīvu Nr. 71/140/EEK [4], noteikumi;

Whereas the application of the Directive may cause difficulties for importation into certain Member States, since some of them require importers to supply different particulars ; whereas these particulars should therefore be harmonized;

tā kā būtu jāpaskaidro Direktīvas Nr. 68/193/EEK darbības joma;

Whereas the amendments to the Annex are intended essentially to permit the application of the Directive and, on these grounds, should be adopted in accordance with the procedure of the Standing Committee on Seeds and Propagating Material for Agriculture, Horticulture and Forestry;

tā kā dalībvalstīm ir jābūt pilnvarotām nošķirt standarta pavairošanas materiālu, pamatojoties uz dažādiem kvalitātes kritērijiem;

Whereas the growing of vines and the marketing of propagation material may be of minimal economic importance in a Member State ; whereas the Member State concerned should therefore have the possibility of being exempted from most of the provisions of the Directive,

tā kā dažiem reģioniem ir priekšrocības konkrētu apstākļu ziņā, kas ir tik labvēlīgi pavairošanas materiāla attīstībai, ka attiecīgajai dalībvalstij būtu jāļauj noteikt izņēmumus attiecībā uz to teritorijā gatavotā un tirgotā pavairošanas materiāla garumu;

HAS ADOPTED THIS DIRECTIVE:

tā kā direktīvas piemērošana var apgrūtināt importu noteiktās dalībvalstīs, jo dažas no tām pieprasa importētājiem sniegt atšķirīgas ziņas; tā kā tādēļ būtu jāsaskaņo šīs ziņas;

tā kā pielikuma grozījumi ir paredzēti galvenokārt, lai ļautu piemērot minēto direktīvu, un tāpēc tie būtu jāpieņem saskaņā ar Pastāvīgās lauksaimniecības, dārzkopības un mežsaimniecības sēklu un pavairošanas materiāla komitejas noteikto kārtību;

Article 1

tā kā vīnogulāju audzēšanai un pavairošanas materiāla tirdzniecībai dalībvalstī var būt minimāla ekonomiska nozīme; tā kā tādēļ attiecīgajai dalībvalstij būtu jābūt iespējai tikt atbrīvotai no lielākās daļas minētās direktīvas noteikumu,

Council Directive No 68/193/EEC is hereby amended as follows:

IR PIEŅĒMUSI ŠO DIREKTĪVU.

1. pants

Article 2

Ar šo Direktīvu Nr. 68/193/EEK groza šādi.

The following shall be substituted for Article 1:

2. pants

"This Directive shall apply to material for the vegetative propagation of the vine (hereinafter called "propagation material") marketed within the Community."

1. pantu aizstāj ar šo:

"Šī direktīva attiecas uz vīnogulāju veģetatīvās pavairošanas materiālu (še turpmāk "pavairošanas materiāls"), ko tirgo Kopienas teritorijā."

Article 3

3. pants

The following paragraph la shall be added to Article 3:

Direktīvas 3. pantam pievieno šādu 1.a punktu:

"1a The Member States may subdivide the category "standard material" laid down in Article 2 into classes which comply with special conditions. These special conditions, the appellation or a time limit, may be determined in accordance with the procedure laid down in Article 17."

"1.a Dalībvalstis drīkst iedalīt 2. pantā uzskaitīto kategoriju "standartmateriāls" klasēs, kas atbilst īpašiem nosacījumiem. Šos īpašos nosacījumus, nosaukumu vai termiņu drīkst noteikt saskaņā ar 17. pantā izklāstīto kārtību."

4. pants

Article 4

3. panta 4. punktam pievieno šādu c) daļu:

The following subparagraph (c) shall be added to Article 3 (4): (1)OJ No C 2, 9.1.1974, p. 66. (2)OJ No C 8, 31.1.1974, p. 19. (3)OJ No L 93, 17.4.1968, p. 15. (4)OJ No L 71, 25.3.1971, p. 16.

"c) atļaut dalībvalstīm neatkarīgi no II pielikuma III daļas 1.B un 2.B punkta samazināt minimālos noteiktos pavairošanas materiāla garumus, kas paredzēts sagatavošanai un tirgošanai dažās teritorijās, kur šāda atļauja ir attaisnojama ar īpašiem augšanas apstākļiem."

"(c) authorize Member States, notwithstanding Annex II (III) (1B) and (2B), to reduce the minimum stipulated lengths of propagation material, for production and marketing in certain areas where such authorization is justified by special conditions of growth."

5. pants

1. Minētās direktīvas 11. pants kļūst par 11. panta 1. punktu.

Article 5

2. Minētās direktīvas 11. pantam pievieno šādu 2. punktu:

1. Article 11 shall become Article 11 (1).

"2. Dalībvalstis veic visus vajadzīgos pasākumus, lai nodrošinātu, ka, tirgojot veģetatīvās pavairošanas materiālu, kura izcelsme ir citā dalībvalstī vai trešā valstī, kompetentām iestādēm tiek sniegtas šādas ziņas:

2. The following paragraph 2 shall be added to Article 11:

a) suga (botāniskais apzīmējums),

"2. The Member States shall take all necessary measures to ensure that the competent authorities are supplied with the following particulars during the marketing of vegetative propagation material, originating in another Member State or in a third country: (a) species (botanical designation),

b) šķirne un, pēc vajadzības, klons; attiecībā uz apsakņotiem potzariem šīs ziņas sniedz gan par potcelmiem, gan atkārtoti potētiem potzariem,

(b) variety and, where appropriate, the clone ; in the case of rooted grafts, these particulars shall be supplied for both the root stocks and the top graft cutting,

c) kategorija,

(c) category,

d) pavairošanas materiāla raksturs,

(d) nature of the propagation material,

e) ražošanas valsts un oficiālā pārbaudes iestāde,

(e) country of production and official control authority,

f) nosūtīšanas valsts,

(f) country of dispatch,

g) importētājs,

(g) importer,

h) materiāla daudzums.

(h) quantity of the material.

Šo ziņu sniegšanas veidu drīkst noteikt saskaņā ar 17. pantā izklāstīto kārtību."

6. pants

17.a pantu aizstāj ar šo:

The manner in which these particulars must be presented may be determined in accordance with the procedure laid down in Article 17."

"17.a pants

Lēmumus par grozījumiem, kas jāizdara pielikumos, ņemot vērā zinātnes un tehnikas attīstību, pieņem saskaņā ar 17. pantā noteikto kārtību."

Article 6

7. pants

The following shall be substituted for Article 17a:

18.a pantu aizstāj ar šo:

"Article 17a

"18.a pants

Any amendments to be made to the Annexes to the development of scientific knowledge or techniques shall be decided upon in accordance with the procedure laid down in Article 17."

Saskaņā ar 17. pantā izklāstīto kārtību dalībvalsti drīkst pēc tās lūguma pilnīgi vai daļēji atbrīvot no pienākuma piemērot šo direktīvu, tomēr izņemot 12. panta 1. punktu un 12.a pantu, ja vīnogulāju audzēšanai un pavairošanas materiāla tirdzniecībai tās teritorijā ir minimāla ekonomiska nozīme."

8. pants

Article 7

IV pielikuma A daļas a) punkta 2. apakšpunktu aizvieto ar šo:

The following shall be substituted for Article 18a:

"2. Personas, kas atbild par noslēgšanu, vārds un adrese vai identifikācijas numurs."

"Article 18a

9. pants

In accordance with the procedure laid down in Article 17, a Member State may, if it so requests, be wholly or partially released from the obligation to apply this Directive with the exception, however, of Articles 12 (1) and 12a, in so far as the growing of vines and the marketing of propagation material are of minimal economic importance in its territory."

Dalībvalstīs, vēlākais, līdz 1976. gada 1. jūlijam stājas spēkā normatīvi un administratīvi akti, kas vajadzīgi, lai izpildītu šīs direktīvas prasības.

10. pants

Article 8

Šī direktīva ir adresēta dalībvalstīm.

The following shall be substituted for point 2 of Annex IV, Section A (a):

"2. Name and address of the person responsible for sealing or his identification number."

Member States shall, not later than 1 July 1976, bring into force the laws, regulations or administrative provisions needed in order to comply with the requirements of this Directive.
