ņemot vērā Eiropas Kopienas dibināšanas līgumu,

Having regard to the Treaty establishing the European Community,

ņemot vērā Padomes 1993. gada 8. februāra Regulu (EEK) Nr. 315/93, ar ko nosaka Kopienas procedūras attiecībā uz piesārņotājiem pārtikā [1], un jo īpaši tās 2. panta 3. punktu,

Having regard to Council Regulation (EEC) No 315/93 of 8 February 1993 laying down Community procedures for contaminants in food(1), and in particular Article 2(3) thereof,

tā kā:

Whereas:

(1) Komisijas 2001. gada 8. marta Regula (EK) Nr. 466/2001, ar ko nosaka atsevišķu piesārņotāju maksimālos pieļaujamos daudzumus pārtikas produktos [2], nosaka maksimālos pieļaujamos dioksīnu daudzumus dažos pārtikas produktos.

(1) Commission Regulation (EC) No 466/2001 of 8 March 2001 setting maximum levels for certain contaminants in foodstuffs(2), establishes maximum levels for dioxins in certain foodstuffs.

(2) Maksimālos pieļaujamos dioksīnu daudzumus piemēro no 2002. gada 1. jūlija. Dokumentu piemērojot, ir atklājies, ka jāprecizē to produktu vai produktu daļu apraksti, kuriem piemēro maksimālo pieļaujamo daudzumu.

(2) The maximum levels for dioxins apply from 1 July 2002. The application of the text has revealed a need for some clarification of the description of the products or the parts of the product to which the maximum level apply.

(3) Pieejamie dati norāda, ka brīvās turēšanas apstākļos un daļēji intensīvas ražošanas apstākļos dētas olas var saturēt lielāku daudzumu dioksīnu nekā būru baterijās turētu vistu olas. Jāveic pasākumi, lai nodrošinātu dioksīna daudzuma samazināšanu brīvās turēšanas apstākļos vai daļēji intensīvas ražošanas apstākļos dētās olās, un daudzumu piemērošanai ir paredzēts pārejās periods līdz 2004. gada 1. janvārim. Tagad šķiet, ka ir vajadzīgs ilgāks laiks pētījumiem, lai noteiktu iespējamos pasākumus dioksīna daudzuma samazināšanai brīvās turēšanas apstākļos vai daļēji intensīvas ražošanas apstākļos dētās olās un lai šos pasākumus īstenotu. Tādēļ pārejas periodu ir lietderīgi pagarināt par vienu gadu.

(3) Available data indicate that free range and semi-intensive eggs may contain higher levels of dioxin than battery eggs. Measures have to be taken to ensure that dioxin levels in free range and semi-intensive eggs are reduced and a transition period for the application of the levels was foreseen until 1 January 2004. It now appears that more time is needed for the investigations to define possible measures to reduce the dioxin levels in free range and semi-intensive eggs and for implementing these measures. It is therefore appropriate to extend the transition period for one year.

(4) Pa to laiku ir pieņemta Komisijas 2002. gada 30. jūlija Direktīva 2002/69/EK, ar ko nosaka paraugu ņemšanas metodes un analīzes metodes dioksīnu koncentrācijas oficiālajai kontrolei un dioksīniem līdzīgu PCB kvantitatīvai noteikšanai pārtikas produktos [3].

(4) In the meantime, Commission Directive 2002/69/EC of 30 July 2002 laying down the sampling methods and the methods of analysis for the official control of dioxins and the determination of dioxin-like PCBs in foodstuffs(3) has been adopted.

(5) Tādēļ attiecīgi jāgroza Regula (EK) Nr. 466/2001.

(5) Regulation (EC) No 466/2001 should therefore be amended accordingly.

(6) Šajā regulā paredzētie pasākumi ir saskaņā ar Pastāvīgās pārtikas aprites un dzīvnieku veselības komitejas atzinumu,

IR PIEŅĒMUSI ŠO REGULU.

HAS ADOPTED THIS REGULATION:

1. pants

Regulas (EK) Nr. 466/2001 I pielikuma 5. iedaļu groza šādi:

Article 1

1. Pirmajā slejā 5.1.2. punktā vārdus "Aknas un atvasināti produkti" aizstāj ar vārdiem "Aknas un atvasināti sauszemes dzīvnieku izcelsmes produkti".

Annex I, section 5 of Regulation (EC) No 466/2001 is amended as follows:

2. Pirmajā slejā 5.2. punktā 5. zemsvītras piezīmei pievieno šādu teikumu: "Ja zivis paredzēts ēst veselas, maksimālais pieļaujamais daudzums attiecas uz veselu zivi."

1. in the first column, point 5.1.2., "Liver and derived products" is replaced with "Liver and derived products originating from terrestrial animals";

3. Pirmajā slejā 5.4. punktā 8. zemsvītras piezīmē vārdus "2004. gada 10. janvāra" aizstāj ar vārdiem "2005. gada 1. janvāra".

2. in the first column, point 5.2., the following sentence is added to footnote (5): "Where fish are intended to be eaten whole, the maximum level shall apply to the whole fish".

4. Pirmajā slejā 5.4. punkta "Eļļas un tauki" otro ievilkumu "Augu eļļa" aizstāj ar "Augu eļļas un tauki".

3. in the first column, point 5.4., footnote (8), "10 January 2004" is replaced with "1 January 2005".

5. Trešajā un ceturtajā slejā 5.1.1. līdz 5.5. punktā vārdus "Direktīva 2001/…/EK (*)" aizstāj ar vārdiem "Direktīva 2002/69/EK [9] OV L 209, 6.8.2002., 5. lpp.."

4. in the first column, point 5.5 Oils and fats, second indent "Vegetable oil" is replaced with "Vegetable oils and fats".

2. pants

5. in the third and fourth column, point 5.1.1. to point 5.5., the words "Directive 2001/.../EC (*)" is replaced with "Directive 2002/69/EC(4)."

Šī regula stājas spēkā divdesmitajā dienā pēc publicēšanas Eiropas Savienības Oficiālajā Vēstnesī.

Šī regula uzliek saistības kopumā un ir tieši piemērojama visās dalībvalstīs.

Article 2

This Regulation shall enter into force on the 20th day following that of its publication in the Official Journal of the European Union.
