Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 96/49/EC of 23 July 1996 on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail(1), and in particular Article 8 thereof,

atsižvelgdama į 1996 m. liepos 23 d. Tarybos direktyvą 96/49/EB dėl valstybių narių teisės aktų, susijusių su pavojingų krovinių vežimu geležinkeliais, suderinimo(1), ypač į jos 8 straipsnį,

Whereas:

kadangi:

(1) The Annex to Directive 96/49/EC refers to the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID), as applicable with effect from 1 July 2003 .

(1) Direktyvos 96/49/EB priede nurodomos pavojingų krovinių tarptautinio vežimo geležinkeliais taisyklės (RID), taikomos nuo 2003 m. liepos 1 d.

(2) The RID is normally updated every two years, the latest update being in force from 1 January 2003 , with a transitional period up to 30 June 2003 .

(2) RID įprastai yra atnaujinamos kas dveji metai, o jų paskutiniai pakeitimai taikomi nuo 2003 m. sausio 1 d. su pereinamuoju laikotarpiu iki 2003 m. birželio 30 d.

(3) Exceptionally the RID was updated again after one year so that the amended version entered into force on 1 January 2004 .

(3) Išimties tvarka RID buvo dar kartą atnaujintos po vienerių metų, o jų iš dalies pakeista redakcija įsigaliojo 2004 m. sausio 1 d.

(4) It is therefore necessary to amend the Annex to Directive 96/49/EC.

(4) Todėl būtina iš dalies pakeisti Direktyvos 96/49/EB priedą.

(5) The measures provided for in this Directive are in accordance with the opinion of the Committee on the transport of dangerous goods referred to in Article 9 of Directive 96/49/EC,

HAS ADOPTED THIS DIRECTIVE:

Article 1

1 straipsnis

The Annex to Directive 96/49/EC is replaced by the following:

Direktyvos 96/49/EB priedas keičiamas taip:

«Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) appearing in Annex I to Appendix B to the Convention concerning International Carriage by Rail (COTIF), as applicable with effect from 1 January 2004 , it being understood that the terms «contracting party» and «the States or the railways» will be replaced by the term «Member State» .

ĢPavojingų krovinių tarptautinio vežimo geležinkeliu taisyklėse (RID), pateiktose Konvencijos dėl tarptautinio vežimo geležinkeliais (COTIF) B priedėlio I priede, įsigaliojusiame nuo 2004 m. sausio 1 d. terminai Ģsusitariančioji šalisģ ir Ģvalstybės ar geležinkeliaiģ keičiami terminu Ģvalstybė narėģ .

The text of the amendments of the 2004 version of the RID will be published as soon as it is available in all official languages of the Community.»

2004 m. RID redakcijos pakeitimų tekstas bus skelbiamas jį parengus visomis oficialiosiomis Bendrijos kalbomis.ģ

Article 2

2 straipsnis

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 October 2004 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

1. Valstybės narės priima įstatymus ir kitus teisės aktus, kurie įsigalioję ne vėliau kaip iki 2004 m. spalio 1 d. , įgyvendina šią direktyvą. Šių nuostatų tekstą ir koreliacinę lentelę tarp tų nuostatų ir šios direktyvos jos nedelsdamos perduoda Komisijai.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Valstybės narės, priimdamos tas nuostatas, pateikia jose nuorodą į šią direktyvą arba tokia nuoroda daroma jas oficialiai skelbiant. Nuorodos darymo tvarką nustato valstybės narės.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Valstybės narės pateikia Komisijai šios direktyvos taikymo srityje priimtų nacionalinės teisės aktų pagrindinių nuostatų tekstus.

Article 3

3 straipsnis

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

Šis reglamentas įsigalioja dvidešimtą dieną po jo paskelbimo Europos Sąjungos oficialiajame leidinyje .

Article 4

4 straipsnis

This Directive is addressed to the Member States.

Ši direktyva skirta valstybėms narėms.
