Having regard to the Treaty establishing the European Community,

atsižvelgdama į Europos bendrijos steigimo sutartį,

Having regard to Council Directive 92/119/EEC of 17 December 1992 introducing general Community measures for the control of certain animal diseases and specific measures relating to swine vesicular disease [1], and in particular Article 24(2) thereof,

atsižvelgdama į 1992 m. gruodžio 17 d. Tarybos direktyvą 92/119/EEB, nustatančią Bendrijos bendrąsias tam tikrų gyvūnų ligų kontrolės priemones ir konkrečias priemones nuo kiaulių vezikulinės ligos, [1] ypač į jos 24 straipsnio 2 dalį,

Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption [2], and in particular of Article 4(3) thereof,

atsižvelgdama į 2002 m. gruodžio 16 d. Tarybos direktyvą 2002/99/EB, nustatančią gyvūnų sveikatos taisykles, reglamentuojančias žmonėms skirtų gyvūninės kilmės produktų gamybą, perdirbimą, paskirstymą ir importą [2], ypač į jos 4 straipsnio 3 dalį,

Whereas:

kadangi:

(1) Directive 92/119/EEC lays down measures for the control of certain animal diseases. Specific provisions for swine vesicular disease are laid down in Annex II to that Directive.

(1) Direktyvoje 92/119 nustatytos tam tikrų gyvūnų ligų kontrolės priemonės. Šios direktyvos II priede pateiktos konkrečios nuostatos dėl kiaulių vezikulinės ligos.

(2) Since Council Directives 72/461/EEC [3] and 80/215/EEC [4] have been repealed with effect from 1 January 2006, references to those Directives contained in Directive 92/119/EEC should be replaced by references to Annexes II and III to Directive 2002/99/EC.

(2) Kadangi Tarybos direktyvos 72/461/EEB [3] ir 80/215/EEB [4] nuo 2006 m. sausio 1 d. panaikintos, Direktyvoje 92/119/EEB pateiktos nuorodos į šias direktyvas turėtų būti pakeistos nuorodomis į Direktyvos 2002/99/EB II ir III priedus.

(3) It is appropriate to provide for a specific solution with respect to the marking of meat and its subsequent use, as well as the destination of the processed products, where the swine vesicular disease health situation so permits, provided that this is done in such a way that the degree of protection from swine vesicular by intra-Community trade or international trade is not impaired.

(3) Todėl tikslinga numatyti konkrečius sprendimus dėl mėsos ženklinimo ir vėlesnio panaudojimo, taip pat dėl perdirbtų produktų paskirties, jeigu kiaulių vezikulinės ligos padėtis tai leidžia, su sąlyga, kad dėl šių priežasčių priimtos priemonės nesusilpnintų apsaugos nuo kiaulių vezikulinės ligos dėl Bendrijos vidaus ar išorės prekybos.

(4) Certain Member States have informed the Commission that the identification mark provided for in Annex II to Directive 2002/99/EC is poorly accepted by operators and customers in the industry. Accordingly, it is appropriate to provide for an alternative identification mark that Member States may decide to apply. However, in the interests of controls, it is important that Member States inform the Commission beforehand, if they decide to apply the alternative identification mark in case of an outbreak of swine vesicular disease.

(4) Kai kurios valstybės narės informavo Komisiją, kad pramonės įmonės ir vartotojai vangiai priėmė Direktyvos 2002/99/EB II priede numatytą identifikavimo žymą. Todėl tikslinga numatyti alternatyviąją identifikacinę žymą, kurią valstybės narės galėtų nuspręsti naudoti. Visgi kontrolės sumetimais yra svarbu, kad valstybės narės iš anksto informuotų Komisiją apie sprendimą taikyti alternatyviąją identifikacinę žymą vezikulinės kiaulių ligos protrūkio atveju.

(5) The alternative identification mark provided for in this Directive should be clearly distinguishable from other identification marks to be applied to pig meat in accordance with Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin [5] or Commission Regulation (EC) No 2076/2005 of 5 December 2005 laying down transitional arrangements for the implementation of Regulations (EC) No 853/2004, (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council and amending Regulations (EC) No 853/2004 and (EC) No 854/2004 [6].

(5) Šioje direktyvoje numatyta alternatyvioji identifikacinė žyma turėtų būti aiškiai atskiriama nuo kitų identifikacinių žymų, dedamų ant kiaulienos pagal 2004 m. balandžio 29 d. Europos Parlamento ir Tarybos reglamentą (EB) Nr. 853/2004, nustatantį konkrečius gyvūninės kilmės maisto produktų higienos reikalavimus [5] arba 2005 m. gruodžio 5 d. Komisijos reglamentą (EB) Nr. 2076/2005, nustatantį pereinamojo laikotarpio priemones Europos Parlamento ir Tarybos reglamentams (EB) Nr. 853/2004, (EB) Nr. 854/2004 ir (EB) Nr. 882/2004 įgyvendinti ir iš dalies keičiantį reglamentus (EB) Nr. 853/2004 ir (EB) Nr. 854/2004 [6].

(6) Unlike the general provisions of Article 13 of Directive 92/119/EEC, the specific provisions for swine vesicular disease in Annex II to that Directive do not provide for an authorisation to remove the animals from a holding within the protection zone in case the removal prohibition is maintained beyond 30 days because of the occurrence of further cases of the disease. It is appropriate to provide for such derogation for holdings in which the keeping of animals for longer periods than 30 days would cause problems.

(6) Skirtingai nuo bendrųjų nuostatų, išdėstytų Direktyvos 91/119/EB 13 straipsnyje, šios direktyvos II priede pateiktose specialiosiose priemonėse dėl kiaulių vezikulinės ligos nenumatyta leisti išvežti gyvūnus iš ūkio, esančio apsaugos zonoje, jeigu, atsižvelgiant į naujus ligos atvejus, draudimas išvežti trunka ilgiau nei 30 dienų. Tikslinga numatyti tokią leidžiančią nukrypti nuostatą, taikytiną ūkiams, kuriuose laikant gyvūnus ilgiau nei 30 dienų, tai sukeltų problemų.

(7) The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DIRECTIVE:

Article 1

1 straipsnis

Section 7 of Annex II to Directive 92/119/EEC is amended as follows:

(1) Point 2 is amended as follows:

"(g) meat from the pigs referred to in point (f)(i):

(i) shall not enter into intra-Community or international trade and shall bear the health mark for fresh meat provided for in Annex II to Council Directive 2002/99/EC [];

i) nepatenka į Bendrijos vidaus arba išorės prekybą ir yra žymima šviežios mėsos sveikatos žyma, numatyta Tarybos direktyvos 2002/99/EB [] II priede;

(ii) shall be obtained, cut, transported and stored separately from meat intended for intra-Community and international trade and shall be used in such a way as to avoid it being introduced into meat products intended for intra-Community or international trade, unless it has undergone a treatment set out in Annex III to Directive 2002/99/EC;

ii) yra gaunama, pjaustoma, gabenama ir sandėliuojama atskirai nuo mėsos, skirtos Bendrijos vidaus ar išorės prekybai ir naudojama taip, kad būtų išvengta jos patekimo į mėsos produktus, skirtus Bendrijos vidaus ar išorės prekybai, nebent yra apdirbta taip, kaip nustatyta Direktyvos 2002/99/EB III priede".

(b) the following point (h) is added:

"(h) (i) by way of derogation from point (g), for meat from the pigs referred to in point (f)(i) Member States may decide to use an other identification mark than the special identification mark set out in Annex II to Directive 2002/99/EC, provided that it is clearly distinguishable from other identification marks to be applied to pig meat in accordance with Regulation (EC) No 853/2004 of the European Parliament and of the Council [] or Commission Regulation (EC) No 2076/2005 [];

"h) i) Nukrypdamos nuo g punkto nuostatų, valstybės narės gal nuspręsti ant kiaulių, nurodytų f punkto i papunktyje, mėsos dėti kitas identifikacines žymas, nei nustatytosios Direktyvos 2002/99/EB II priede, su sąlyga, kad tokios identifikacinės žymos būtų lengvai atskiriamos nuo identifikacinių žymų, dedamų pagal Europos Parlamento ir Tarybos reglamentą (EB) Nr. 853/2004 [] arba Komisijos reglamentą (EB) Nr. 2076/2005 [].

Member States that decide to use the alternative identification mark shall inform the Commission thereof in the framework of the Standing Committee on the Food Chain and Animal Health.

Valstybės narės, nusprendusios naudoti alternatyviąsias identifikacines žymas, informuoja apie tai Komisiją Maisto grandinės ir gyvūnų sveikatos nuolatiniame komitete.

(ii) for the purpose of (i) the identification mark must be legible and indelible, the characters easily readable and clearly displayed. The identification mark must have following shape and contain following indications:

XY means the relevant country code provided for in point 6 of Part B of Section I of Annex II to Regulation (EC) No 853/2004.

1234 means the approval number of the establishment referred to in point 7 of Part B of Section I of Annex II to Regulation (EC) No 853/2004.

(2) the following point 5 is added:

"5. Where the prohibitions provided for in point 2(f) are maintained beyond 30 days because of the occurrence of further cases of the disease and as a result problems arise in keeping the animals, the competent authority may, following an application by the owner explaining the grounds for such application and provided that the official veterinarian has verified the facts, authorise the removal of the animals from a holding within the protection zone. Points 2(f) and (h) shall apply mutatis mutandis."

"5. Jeigu 2 dalies f punkte numatyti draudimai taikomi ilgiau nei 30 dienų dėl naujų ligos atvejų ir dėl šios priežasties kyla problema dėl gyvūnų laikymo, gavusi pagrįstą savininko prašymą ir su sąlyga, kad oficialiai paskirtas veterinarijos gydytojas patikrino faktus, kompetentinga institucija gali leisti išvežti gyvūnus iš apsaugos zonoje esančio ūkio. 2 dalies f ir h punktai taikomi mutatis mutandis."

Article 2

2 straipsnis

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 January 2008 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

Valstybės narės priima įstatymus ir kitus teisės aktus šiai direktyvai įgyvendinti ne vėliau kaip iki 2008 m. sausio 1 d. Jos nedelsdamos pateikia Komisijai tų nuostatų tekstą bei tų nuostatų ir šios direktyvos atitikmenų lentelę.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Valstybės narės, priimdamos minėtas nuostatas, jose daro nuorodą į šią direktyvą arba tokia nuoroda daroma nuostatas oficialiai skelbiant. Valstybės narės nustato tokios nuorodos darymo tvarką.

Article 3

3 straipsnis

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

Ši direktyva įsigalioja dvidešimtą dieną nuo jos paskelbimo Europos Sąjungos oficialiajame leidinyje.

Article 4

4 straipsnis

This Directive is addressed to the Member States.

Ši direktyva skirta valstybėms narėms.
