Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 91/676/EEC of 12 December 1991 concerning the protection of waters against pollution caused by nitrates from agricultural sources [1], and in particular the third subparagraph of paragraph 2 of Annex III thereto,

Whereas:

kadangi:

(1) If the amount of manure that a Member State intends to apply per hectare each year is different from the one specified in the first sentence of the second subparagraph of paragraph 2 of Annex III to Directive 91/676/EEC and in point (a) thereof, that amount has to be fixed so as not to prejudice the achievement of the objectives specified in Article 1 of that Directive and has to be justified on the basis of objective criteria, such as, in the present case, long growing seasons and crops with high nitrogen uptake.

(2) Belgium submitted to the Commission a request for a derogation under third subparagraph of paragraph 2 of Annex III to Directive 91/676/EEC referred to the region of Wallonia.

(2) Belgija pateikė Komisijai prašymą Valonijos regionui taikyti leidžiančią nukrypti nuostatą remiantis Direktyvos 91/676/EEB III priedo 2 skyriaus trečia pastraipa.

(3) The requested derogation concerns the intention of Belgium to allow the application in Wallonia of up to 230 kg nitrogen per hectare per year from livestock manure in specific holdings with more than 48 % of acreage as grassland. The nitrogen application from livestock manure on grassland would not exceed 230 kg per hectare per year, while on arable crops of these farms it would not exceed 115 kg/ha nitrogen per hectare per year.

(3) Prašoma leidžianti nukrypti nuostata yra susijusi su Belgijos ketinimu leisti Valonijoje naudoti iki 230 kg/ha azoto, kurio yra gyvulių mėšle, per metus specialiuose ūkiuose, kurių pievos sudaro ne mažiau kaip 48 % valdos ploto. Gyvulių mėšle esančio azoto naudojimas pievose neturėtų viršyti 230 kg/ha azoto per metus, o šių ūkių pasėliams neturėtų viršyti 115 kg/ha azoto per metus.

(4) The designation of nitrates vulnerable zones in respect to Wallonia, in conformity with paragraphs 2 and 4 of Article 3 of Directive 91/676/EEC, covers approximately 42 % of this region’s territory and 54 % of utilised agricultural land.

(4) Pagal Direktyvos 91/676/EEB 3 straipsnio 2 ir 4 dalių nuostatas Valonijoje nitratais pažeidžiamos zonos sudaro maždaug 42 % regiono teritorijos ir 54 % kultivuojamų žemės ūkio naudmenų.

(5) Approximately 500 farms, corresponding to 5,6 % of total number of farms in nitrate vulnerable zones, and 3 % of the Utilised Agricultural Land are estimated to be encompassed by the derogation.

(5) Paskaičiuota, kad ši leidžianti nukrypti nuostata yra taikytina maždaug 500 ūkių, sudarančių 5,6 % visų nitratais pažeidžiamose zonose esančių ūkių ir 3 % kultivuojamų žemės ūkio naudmenų.

(6) The legislation implementing Directive 91/676/EEC in Wallonia "Arrêté du Gouvernement wallon du 15 février 2007 modifiant le Livre II du Code de l’Environnement constituant le Code de l’Eau en ce qui concerne la gestion durable de l’azote en agriculture" has been adopted and applies equally to the requested derogation.

(6) Valonijoje buvo priimtas Direktyvą 91/676/EEB įgyvendinantis įstatymas "Arrêté du Gouvernement wallon du 15 février 2007 modifiant le Livre II du Code de l’Environnement constituant le Code de l’Eau en ce qui concerne la gestion durable de l’azote en agriculture", kuris taip pat taikomas ir prašomai leidžiančiai nukrypti nuostatai.

(7) Water quality data submitted show that in Wallonia in 2005 average nitrate concentration in surface water in nitrate vulnerable zones was 16,7 mg/L, with stable or decreasing trends in 84 % of monitoring sites in the period from 2001 to 2005. Median groundwater concentration in 2005 was 24,8 mg/L nitrates, with stable or decreasing trends in 74 % of monitoring sites in the period from 2001 to 2005.

(7) Pateikti vandens kokybės duomenys rodo, kad 2005 m. Valonijoje nitratais pažeidžiamose zonose vidutinė nitratų koncentracija paviršiniame vandenyje buvo 16,7 mg/l, 2001–2005 m. 84 % stebėjimo vietų būdingos stabilumo arba mažėjimo tendencijos. 2005 m. vidutinė gruntinio vandens koncentracija buvo 24,8 mg/l nitratų ir 2001–2005 m. 74 % stebėjimo vietų tendencijos buvo stabilios arba mažėjančios.

(8) Average nitrogen input per hectare from livestock manure decreased by 12 % since 1990 and in 2004 was 101 kg/ha of Utilised Agricultural Land, of which 94 % from cattle manure, 3 % from pig manure and 2 % from poultry manure. Average application of chemical fertilisers decreased for both nitrogen and phosphate since 1990, respectively by 19 % and by 49 % and in 2004 was on average of 109 kg/ha and 28 kg/ha respectively for nitrogen and phosphate.

(8) Vidutinis vienam hektarui naudojamo azoto iš gyvulių mėšlo kiekis nuo 1990 m. sumažėjo 12 % ir 2004 m. buvo 101 kg/ha kultivuojamų žemės ūkio naudmenų, 94 % azoto buvo iš galvijų mėšlo, 3 % iš kiaulių mėšlo ir 2 % iš paukščių mėšlo. Vidutinis naudojamų azoto ir fosfatinių cheminių trąšų kiekis nuo 1990 m. sumažėjo atitinkamai 19 % ir 49 %, o 2004 m. vidutiniškai buvo sunaudota 109 kg/ha azoto ir 28 kg/ha fosfatinių trąšų.

(9) The supporting documents presented in the notification show that the proposed amount of 230 kg per hectare per year of nitrogen from manure is justified on the basis of objective criteria such as long growing seasons and crops with high nitrogen uptake.

(9) Pranešime pateikti patvirtinamieji dokumentai rodo, kad siūlomas 230 kg/ha azoto iš gyvulių mėšlo kiekis per metus yra pagrįstas objektyviais kriterijais – ilgu vegetaciniu periodu ir pasėliais, kurie įsisavina didelį azoto kiekį.

(10) The Commission after examination of the request considers that the proposed amount of 230 kg per hectare per year nitrogen from manure will not prejudice the achievement of the objectives of Directive 91/676/EEC, subject to certain strict conditions being met.

(10) Komisija, išnagrinėjusi prašymą, mano, kad siūlomas 230 kg/ha azoto iš mėšlo kiekis per metus netrukdys siekti Direktyvoje 91/676/EEB numatytų tikslų, jeigu bus laikomasi tam tikrų griežtų sąlygų.

(11) This Decision should be applicable in connection with the second action programme in force for the region of Wallonia for the period 2007 to 2010.

(12) The measures provided for in this Decision are in accordance with the opinion of the Nitrates Committee set up pursuant to Article 9 of Directive 91/676/EEC,

HAS ADOPTED THIS DECISION:

PRIĖMĖ ŠĮ SPRENDIMĄ:

Article 1

1 straipsnis

The derogation requested by Belgium referred to the region of Wallonia by letter of 19 October 2006, for the purpose of allowing a higher amount of livestock manure than that provided for in the first sentence of the second subparagraph of paragraph 2 of Annex III to Directive 91/676/EEC and in point (a) thereof, is granted, subject to the conditions laid down in this Decision.

Šiame sprendime nurodytomis sąlygomis suteikiama 2006 m. spalio 19 m. laišku Belgijos prašoma Valonijos regionui skirta leidžianti nukrypti nuostata dėl didesnio gyvulių mėšlo kiekio nei nurodyta Direktyvos 91/676/EEB III priedo 2 skyriaus antros pastraipos pirmame sakinyje ir a punkte.

Article 2

2 straipsnis

Definitions

For the purpose of this decision, the following definitions shall apply:

Šiame sprendime naudojamos sąvokos apibrėžiamos taip:

(a) "cattle farms" means holdings with more than three livestock units, where at least two-thirds of livestock are cattle;

a) galvijų ūkiai – tai ūkiai, kuriuose yra daugiau kaip trys gyvulių vienetai ir ne mažiau kaip du trečdaliai gyvulių yra galvijai;

(b) "grassland" means acreage of the cattle farm cultivated with permanent or temporary grassland (generally temporary lies less than four years).

b) pieva – tai galvijų ūkio valdos plotas, kuriame kultivuojamos nuolatinės arba laikinos ganyklos (laikinose ganyklose žolė auginama mažiau kaip ketverius metus).

Article 3

Scope

This Decision applies on an individual basis and subject to the conditions set out in Articles 4, 5 and 6 to cattle farms.

Šis sprendimas taikomas individualiai ir laikantis 4, 5 ir 6 straipsniuose nustatytų sąlygų galvijų ūkiams.

Article 4

4 straipsnis

Annual authorisation and commitment

Metinis leidimas ir įsipareigojimas

1. Farmers who want to benefit from a derogation shall submit an application to the competent authorities annually.

1. Ūkininkai, norintys pasinaudoti leidžiančia nukrypti nuostata, kasmet pateikia prašymą kompetentingoms institucijoms.

2. Together with the annual application referred to in paragraph 1 they shall undertake in writing to fulfil the conditions provided for in Articles 5 and 6.

2. Pateikdami 1 straipsnio dalyje nurodytą metinį prašymą jie raštu įsipareigoja vykdyti 5 ir 6 straipsniuose nustatytas sąlygas.

3. The competent authorities shall ensure that all the applications for derogation are subject to administrative control. Where the control carried out by the national authorities of the applications referred to in paragraph 1 demonstrates that the conditions provided for in Articles 5 and 6 are not fulfilled, the applicant shall be informed thereof and the application shall be considered to be refused.

3. Kompetentingos institucijos užtikrina, kad visiems prašymams dėl leidžiančios nukrypti nuostatos būtų taikoma administracinė kontrolė. Jei po nacionalinių institucijų atliktos 1 dalyje minimų prašymų kontrolės paaiškėja, kad 5 ir 6 straipsniuose pateiktos sąlygos nėra įvykdytos, apie tai pranešama prašymo pateikėjui, o prašymas laikomas atmestu.

Article 5

5 straipsnis

Application of manure and other fertilisers

Mėšlo ir kitų trąšų naudojimas

1. The amount of livestock manure applied each year on cattle farms, including by the animals themselves, shall not exceed the amount of manure containing 230 kg of nitrogen per hectare, subject to the conditions laid down in paragraphs 2 to 8.

1. Kasmet galvijų ūkiuose naudojamo gyvulių mėšlo kiekis (įskaitant pačių gyvulių paliekamą mėšlą) neviršija 230 kg/ha azoto turinčio mėšlo kiekio, laikantis 2–8 dalyse nurodytų sąlygų.

2. The amount of livestock manure applied on grassland each year shall not exceed 230 kg of nitrogen per hectare. The amount of livestock manure applied on other farmland each year shall not exceed 115 kg of nitrogen per hectare.

2. Kasmet pievoje naudojamo gyvulių mėšlo kiekis neviršija 230 kg/ha azoto. Kasmet kitoje ūkio dirbamojoje žemėje naudojamo gyvulių mėšlo kiekis neviršija 115 kg/ha azoto.

3. A fertilisation plan shall be kept for each farm describing the crop rotation, the planned application of manure and nitrogen and phosphate fertilisers. It shall be available in the farm each calendar year by 31 March at the latest.

3. Kiekvienas ūkis rengia tręšimo planą, kuriame aprašoma sėjomaina, planuojamas mėšlo, azoto bei fosfatinių trąšų naudojimas. Ūkis tokį planą sudaro ne vėliau kaip iki kiekvienų kalendorinių metų kovo 31 d.

The fertilisation plan shall include the following:

Tręšimo plane pateikiama ši informacija:

(a) the number of livestock, a description of the housing and storage system, including the volume of manure storage available;

a) gyvulių skaičius, mėšlo laikymo ir saugojimo sistemos aprašymas, įskaitant saugomo mėšlo kiekį;

(b) a calculation of manure nitrogen (less losses in housing and storage) and phosphorus produced in the farm;

b) azoto ir fosforo kiekio ūkyje pagamintame mėšle apskaičiavimas (atėmus laikymo ir saugojimo metu patirtus nuostolius);

(c) the crop rotation and acreage for grassland and for each crop, including a sketch map indicating location of individual fields;

c) sėjomaina ir intensyvaus naudojimo pievų bei kiekvieno pasėlio plotas, įskaitant scheminį žemėlapį, kuriame nurodytas atskirų laukų išdėstymas;

(d) the foreseeable nitrogen and phosphorus crop requirements;

d) numatomas pasėliams reikalingas azoto ir fosforo kiekis;

(e) the amount and the type of manure delivered outside and to the farm;

e) už ūkio ribų ir ūkiui tiekiamo mėšlo kiekis ir tipas;

(f) nitrogen and phosphorus application from manure over each field;

(g) application of nitrogen and phosphorus with chemical and other fertilisers over each field.

Plans shall be revised no later than seven days following any changes in agricultural practices to ensure consistency between plans and actual agricultural practices.

Siekiant užtikrinti planų ir realios žemės ūkio praktikos derėjimą, planai peržiūrimi ne vėliau kaip per septynias dienas nuo bet kokių pasikeitimų žemės ūkio praktikoje.

4. Fertilisation accounts shall be prepared by each farm. They shall be submitted to the competent authority for each calendar year.

4. Kiekvienas ūkis rengia tręšimo ataskaitas. Kiekvienais kalendoriniais metais šios ataskaitos pateikiamos kompetentingoms institucijoms.

5. Each farm benefiting from an individual derogation shall accept that the application referred to in Article 4(1), the fertilisation plan and the fertilisation accounts can be subject to control.

5. Kiekvienas ūkis, kuriam taikoma individuali leidžianti nukrypti nuostata, sutinka, kad būtų tikrinamas 4 straipsnio 1 dalyje nurodytas prašymas, tręšimo planas ir tręšimo ataskaitos.

6. Phosphorous analysis in soil shall be performed for each farm which benefits from an individual derogation at least once every four years for each homogeneous area of the farm, with regard to crop rotation and soil characteristics. At least one analysis every five hectares of farmland shall be required.

Dirvožemio fosforo analizė atliekama mažiausiai kas ketverius metus kiekvieno ūkio, kuriam taikoma individuali leidžianti nukrypti nuostata, kiekviename vienarūšiame plote, atsižvelgiant į sėjomainą ir dirvožemio charakteristikas. Kiekviename 5 hektarų ūkio dirbamosios žemės plote atliekama ne mažiau kaip viena analizė.

7. Nitrate concentration in soil shall be measured every year in each farm which benefits from an individual derogation. At least five samples per year shall be analysed for each farm.

7. Nitratų koncentracija dirvoje matuojama kiekvienais metais kiekviename ūkyje, kuriam taikoma individuali leidžianti nukrypti nuostata. Kasmet tikrinami mažiausiai penki mėginiai iš kiekvieno ūkio.

8. Manure shall not be spread in the autumn before grass cultivation.

8. Mėšlo negalima skleisti rudenį prieš žolės sėją.

Article 6

1. 48 % or more of the acreage available for manure application on the cattle holding shall be cultivated with grass.

2. Farmers benefiting from an individual derogation shall carry out the following measures:

(a) Temporary grassland shall be ploughed in spring.

a) laikinos ganyklos suariamos pavasarį;

(b) Grassland shall not include leguminous or other plants fixing atmospheric nitrogen. This will however not apply to leguminous in grassland with less than 50 % leguminous.

b) pievose neauginami atmosferos azotą kaupiantys ankštiniai ar kiti augalai. Tačiau tai nebus taikoma dobilams pievose, kur jų kiekis neviršija 50 %.

Article 7

1. This derogation shall be applied without prejudice to the measures needed to comply with other Community environmental legislation.

1. Šios leidžiančios nukrypti nuostatos taikymas neprieštarauja priemonėms, kurių reikia imtis, kad būtų laikomasi kitų Bendrijos aplinkosaugos teisės aktų.

2. Each farmer benefiting from an individual derogation shall be provided with technical assistance through an advisory service, which shall ensure the evaluation of the results of soil analysis, fertilisation plans and fertilisation accounts. Results of evaluation shall be transmitted to the competent authorities in charge of compliance checking in respect to the conditions set out in Articles 5 and 6.

2. Kiekvienam ūkininkui, kuriam taikoma individuali leidžianti nukrypti nuostata, konsultacinė tarnyba teikia techninę pagalbą, kuri užtikrina dirvos analizės rezultatų, tręšimo planų ir tręšimo ataskaitų vertinimą. Vertinimo rezultatai perduodami kompetentingoms valdžios institucijoms, kurios yra atsakingos už 5 ir 6 straipsniuose nustatytų sąlygų atitikties tikrinimą.

Article 8

Monitoring

1. Maps showing the percentage of farms, percentage of livestock and percentage of agricultural land covered by individual derogation in each agricultural zone shall be drawn by the competent authority and shall be updated every year. Those maps shall be submitted to the Commission annually and for the first time by the end of 2007.

1. Kompetentinga institucija sudaro ir kasmet atnaujina žemėlapius, kuriuose procentais nurodomi kiekvienos žemės ūkio zonos ūkiai, gyvulių skaičius ir žemės ūkio naudmenos, kuriems taikoma individuali leidžianti nukrypti nuostata. Šie žemėlapiai kasmet pateikiami Komisijai, o pirmą kartą jie pateikiami iki 2007 m. pabaigos.

2. A monitoring network for sampling of surface and shallow groundwater shall be established and maintained to assess the impact of the derogation on water quality.

2. Siekiant įvertinti leidžiančios nukrypti nuostatos poveikį vandens kokybei, sukuriamas ir remiamas stebėsenos tinklas, skirtas paviršinio vandens ir negilaus gruntinio vandens mėginių ėmimui.

3. Survey and nutrient analysis shall provide data on local land use, crop rotations and agricultural practices on farms benefiting from individual derogations. Those data can be used for model-based calculations of the magnitude of nitrate leaching and phosphorus losses from fields where up to 230 kg nitrogen per hectare per year from livestock manure is applied.

Atliekant tyrimą ir maistinių medžiagų analizę gaunami duomenys apie vietinį žemės naudojimą, pasėlių sėjomainas ir žemės ūkio praktiką ūkiuose, kuriems taikoma individuali leidžianti nukrypti nuostata. Šie duomenys gali būti naudojami atliekant modelinius nitratų išplovimo ir fosforo nuostolių apskaičiavimus laukuose, kuriuose per metus į vieną hektarą su gyvulių mėšlu patenka iki 230 kg azoto.

4. Monitoring sites shall be established in order to provide data on nitrogen concentration in soil water and corresponding nitrogen losses through the root zone into groundwater, as well as on nitrogen losses by surface and subsurface runoff, both under derogation and non derogation conditions.

Stebėjimo vietos įrengiamos, kad būtų renkami duomenys apie azoto kiekio koncentraciją dirvožemio vandenyje ir atitinkamus azoto nuostolius, kurie per šaknų zoną patenka į požeminį vandenį, bei azoto nuostolius dėl paviršinio ir gruntinio vandens nutekėjimo, neatsižvelgiant į tai, ar taikoma leidžianti nukrypti nuostata, ar ne.

Article 9

Reporting

Ataskaitų teikimas

1. The competent authority shall submit the results of the monitoring every year to the Commission, with a concise report on water quality evolution, evaluation of nitrate residue in soil in autumn in farms benefiting from a derogation and evaluation practice. The report shall provide information on how the evaluation of the implementation of the derogation conditions is carried on through controls at farm level and include information on non compliant farms based on the results of administrative and field inspections. The first report shall be transmitted by June 2008 and subsequently every year by June.

1. Kompetentinga institucija kasmet pateikia Komisijai stebėsenos rezultatus kartu su trumpa ataskaita apie vandens kokybės raidą, rudenį dirvožemyje likusį azoto kiekį ir vertinimo praktiką. Ataskaitoje pateikiama administraciniais ir vietos patikrinimais grindžiama informacija apie tai, kaip atliekant patikrinimus ūkiuose buvo įvertintas leidžiančios nukrypti nuostatos sąlygų vykdymas bei įtraukiama informacija apie ūkius, kurie nesilaikė reikalavimų. Pirmoji ataskaita perduodama iki 2008 m. birželio mėn., o kitos ataskaitos atitinkamai iki kiekvienų kitų metų birželio mėn.

2. The results thus obtained will be taken into consideration by the Commission with regard to an eventual new request for a derogation.

2. Komisija į gautus rezultatus atsižvelgs vertindama galimą naują prašymą dėl leidžiančios nukrypti nuostatos taikymo.

Article 10

This Decision shall apply in the context of the second action programme 2007-2010 for the Region of Wallonia. "Arrêté du Gouvernement wallon du 15 février 2007 modifiant le Livre II du Code de l’Environnement constituant le Code de l’Eau en ce qui concerne la gestion durable de l’azote en agriculture". It shall expire on 31 December 2010.

Šis sprendimas taikomas pagal 2007–2010 m. Antrąją veiksmų programą, skirtą Valonijos regionui. Remiamasi "Arrêté du Gouvernement wallon du 15 février 2007 modifiant le Livre II du Code de l’Environnement constituant le Code de l’Eau en ce qui concerne la gestion durable de l’azote en agriculture". Jis nustoja galioti 2010 m. gruodžio 31 d.
