THE COMMISSION OF THE EUROPEAN COMMUNITIES,

EUROPOS BENDRIJŲ KOMISIJA,

Having regard to the Treaty establishing the European Community,

atsižvelgdama į Europos bendrijos steigimo sutartį,

Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant-protection on the market [1], and in particular Article 6(3) thereof,

atsižvelgdama į 1991 m. liepos 15 d. Tarybos direktyvą 91/414/EEB dėl augalų apsaugos produktų pateikimo į rinką [1], ypač į jos 6 straipsnio 3 dalį,

Whereas:

kadangi:

(1) Directive 91/414/EEC provides for the development of a Community list of active substances authorised for incorporation in plant protection products.

(1) Direktyvoje 91/414/EEB numatyta parengti Bendrijos veikliųjų medžiagų, kurias leidžiama naudoti augalų apsaugos produktuose, sąrašą.

(2) A dossier for the active substance chlorantraniliprole was submitted by DuPont International Operations Sarl to the authorities of Ireland on 2 February 2007 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For heptamaloxyglucan a dossier was submitted by ELICITYL to the authorities of France on 9 May 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For spirotetramat a dossier was submitted by Bayer CropScience AG to the authorities of Austria on 9 October 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For Helicoverpa armigera nucleopolyhedrovirus a dossier was submitted by Andermatt Biocontrol GmbH to the authorities of Estonia on 7 August 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC.

(2) 2007 m. vasario 2 d.DuPont International Operations Sarl Airijos valdžios institucijoms pateikė dokumentus dėl veikliosios medžiagos chlorantraniliprolo ir prašymą ją įtraukti į Direktyvos 91/414/EEB I priedą. 2006 m. gegužės 9 d.ELICITYL Prancūzijos valdžios institucijoms pateikė dokumentus dėl heptamaloksiglukano ir prašymą jį įtraukti į Direktyvos 91/414/EEB I priedą. 2006 m. spalio 9 d.Bayer CropScience AG Austrijos valdžios institucijoms pateikė dokumentus dėl spirotetramato ir prašymą jį įtraukti į Direktyvos 91/414/EEB I priedą. 2006 m. rugpjūčio 7 d.Andermatt Biocontrol GmbH Estijos valdžios institucijoms pateikė dokumentus dėl Helicoverpa armigera nukleopolihedroviruso ir prašymą jį įtraukti į Direktyvos 91/414/EEB I priedą.

(3) The authorities of Ireland, France, Austria and Estonia have indicated to the Commission that, on preliminary examination, the dossiers for the active substances concerned appear to satisfy the data and information requirements set out in Annex II to Directive 91/414/EEC. The dossiers submitted appear also to satisfy the data and information requirements set out in Annex III to Directive 91/414/EEC in respect of one plant protection product containing the active substance concerned. In accordance with Article 6(2) of Directive 91/414/EEC, the dossiers were subsequently forwarded by the applicant to the Commission and other Member States, and were referred to the Standing Committee on the Food Chain and Animal Health.

(3) Airijos, Prancūzijos, Austrijos ir Estijos valdžios institucijos Komisijai nurodė, kad išankstinio tyrimo duomenimis dokumentai dėl aptariamų veikliųjų medžiagų, manoma, atitinka duomenų ir informacijos reikalavimus, nustatytus Direktyvos 91/414/EEB II priede. Be to, pateikti dokumentai, manoma, atitinka duomenų ir informacijos reikalavimus, nustatytus Direktyvos 91/414/EEB III priede dėl vieno augalų apsaugos produkto, kurio sudėtyje yra atitinkamos veikliosios medžiagos. Remiantis Direktyvos 91/414/EEB 6 straipsnio 2 dalimi vėliau pareiškėjai perdavė dokumentus Komisijai bei kitoms valstybėms narėms ir Maisto grandinės ir gyvūnų sveikatos nuolatiniam komitetui patikrinti.

(4) By this Decision it should be formally confirmed at Community level that the dossiers are considered as satisfying in principle the data and information requirements set out in Annex II and, for at least one plant protection product containing the active substance concerned, the requirements set out in Annex III to Directive 91/414/EEC.

(4) Šiuo sprendimu Bendrijos lygmeniu turėtų būti oficialiai patvirtinta, kad dokumentai iš esmės atitinka duomenų ir informacijos reikalavimus, nustatytus Direktyvos 91/414/EEB II priede, ir tos III priede nustatytus reikalavimus dėl bent vieno augalų apsaugos produkto, kurio sudėtyje yra atitinkamos veikliosios medžiagos.

(5) This Decision should not prejudice the right of the Commission to request the applicant to submit further data or information in order to clarify certain points in the dossier.

(5) Šiuo sprendimu nepažeidžiama Komisijos teisė prašyti pareiškėjo pateikti papildomų duomenų arba informacijos siekiant išsiaiškinti tam tikrus su pateiktais dokumentais susijusius klausimus.

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

PRIĖMĖ ŠĮ SPRENDIMĄ:

Article 1

1 straipsnis

Without prejudice to Article 6(4) of Directive 91/414/EEC, the dossiers concerning the active substances identified in the Annex to this Decision, which were submitted to the Commission and the Member States with a view to obtaining the inclusion of those substances in Annex I to that Directive, satisfy in principle the data and information requirements set out in Annex II to that Directive.

Nepažeidžiant Direktyvos 91/414/EEB 6 straipsnio 4 dalies, Komisijai ir valstybėms narėms pateikti šio sprendimo priede nurodytų veikliųjų medžiagų dokumentai siekiant, kad tos medžiagos būtų įtrauktos į tos direktyvos I priedą, iš esmės atitinka tos direktyvos II priede nustatytus duomenų ir informacijos reikalavimus.

The dossiers also satisfy the data and information requirements set out in Annex III to that Directive in respect of one plant protection product containing the active substance, taking into account the uses proposed.

Atsižvelgiant į numatytas naudojimo paskirtis, dokumentai taip pat atitinka direktyvos III priede nustatytus reikalavimus duomenims ir informacijai dėl vieno augalų apsaugos produkto, kurio sudėtyje yra veikliosios medžiagos.

Article 2

2 straipsnis

The rapporteur Member States shall pursue the detailed examination for the dossiers referred to in Article 1 and shall communicate to the Commission the conclusions of their examination accompanied by a recommendation on the inclusion or non-inclusion in Annex I to Directive 91/414/EEC of the active substances referred to in Article 1 and any conditions for those inclusions as soon as possible and at the latest within a period of one year from the date of publication of this Decision in the Official Journal of the European Union.

Ataskaitą rengianti valstybė narė toliau išsamiai nagrinėja 1 straipsnyje nurodytus dokumentus ir praneša Komisijai apie tyrimų rezultatus pridėdama rekomendaciją įtraukti arba neįtraukti į Direktyvos 91/414/EEB I priedą 1 straipsnyje nurodytas veikliąsias medžiagas bei pateikia visas įtraukimo sąlygas kaip galima greičiau, bet ne vėliau kaip per vienerius metus nuo šio sprendimo paskelbimo Europos Sąjungos oficialiajame leidinyje.

Šis sprendimas skirtas valstybėms narėms.
