THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

atsižvelgdami į Europos ekonominės bendrijos steigimo sutartį, ypač į jos 100a straipsnį,

Having regard to the Treaty establishing the European Community, and in particular Article 100a thereof,

atsižvelgdami į Komisijos pasiūlymą [1],

Having regard to the proposal from the Commission (1),

atsižvelgdami į Ekonomikos ir socialinių reikalų komiteto nuomonę [2],

Having regard to the opinion of the Economic and Social Committee (2),

laikydamiesi Sutarties 189b straipsnyje nustatytos tvarkos [3],

Acting in accordance with the procedure referred to in Article 189b of the Treaty (3),

kadangi priedų naudojimo derinimo taisyklės neturėtų daryti įtakos taikant valstybėse narėse 1992 m. sausio 1 d. galiojusias nuostatas, draudžiančias kai kuriuose konkrečiuose maisto produktuose, kurie laikomi tradiciniais ir yra gaminami valstybių narių teritorijoje, naudoti tam tikrus priedus, jei šios nuostatos netaikomos daugeliui maisto produktų, įskaitant maisto produktus, kuriems ši direktyva netaikoma, bet atsižvelgiant į tai, kurios Bendrijos nuostatos numato leidimą naudoti priedus;

Whereas rules for harmonization in the field of additives should not affect the application of provisions of Member States existing on 1 January 1992, which prohibit the use of certain additives in certain specific foodstuffs which are considered as traditional and are produced on their territory, provided that those provisions do not cover a whole series of foodstuffs including foodstuffs which do not come under this Directive but regarding which Community provisions provide for authorization of additives;

Whereas these products could be distinguished by an appropriate labelling;

Whereas the free circulation of foodstuffs conforming with directives concerning additives should not be affected;

kadangi neturi būti paveikta įsisteigimo laisvė, maisto produktų, atitinkančių direktyvas dėl priedų, gamyba ir pardavimas kiekvienos valstybės narės teritorijoje,

Whereas the freedom of establishment, the production and sale on the territory of each Member State of foodstuffs conforming with Directives concerning additives should not be affected,

PRIĖMĖ ŠIĄ DIREKTYVĄ:

HAVE ADOPTED THIS DIRECTIVE:

1 straipsnis

Į Direktyvą 89/107/EEB [4] įterpiamas šis 3a straipsnis:

"3a straipsnis

Article 1

1. Nukrypstant nuo 3 straipsnio 2 dalies a ir b punktų, Taryba, remdamasi Komisijos pasiūlymu ir laikydamasi Sutarties 100a straipsnyje nustatytos tvarkos, leidžia valstybėms narėms palikti draudimą naudoti tam tikrus priedus gaminant kai kuriuos maisto produktus, laikomus tradiciniais, jei:

- šis draudimas galiojo 1992 m. sausio 1 d.,

The following Article 3a shall be inserted in Directive 89/107/EEC (4):

- atitinkamos valstybės narės leidžia jų teritorijoje gaminti ir parduoti visus tradiciniais nelaikomus maisto produktus, kurie atitinka 3 straipsnyje numatytas taisykles.

'Article 3a

2. Nepažeisdamos Reglamentų (EEB) Nr. 2081/92 [5] ir (EEB) Nr. 2082/92 [6], valstybės narės iki 1994 m. liepos 1 d. praneša Komisijai maisto produktų, kuriuos jos laiko tradiciniais, sąrašą, pateikdamos išsamų pagrindimą ir atitinkamas įstatymų nuostatas, draudžiančias tokiuose maisto produktuose naudoti tam tikrus priedus.

1. By way of derogation from Article 3 (2) (a) and (b), the Council shall, acting on a proposal from the Commission pursuant to the procedure laid down in Article 100a of the Treaty, authorize the Member States to maintain the prohibition on the use of certain additives in the production of certain foodstuffs considered as traditional provided that:

Komisija iki 1995 m. balandžio 1 d. pateikia Tarybai pasiūlymą dėl kriterijų, kuriuos reikėtų taikyti sprendžiant, ar produktas yra tradicinis, ar ne, taip pat nacionalinius draudimus, kurie, remiantis tais kriterijais, gali būti palikti.

- this prohibition existed on 1 January 1992,

Taryba sprendimą dėl pasiūlymo priima iki 1996 m. balandžio 1 d.

- the Member States concerned authorize on their territory the production and sale of all foodstuffs not considered as traditional which conform to the rules provided for in Article 3.

3. Iki to laiko, kol Taryba priims sprendimą, kaip tai numatyta 2 dalyje, valstybės narės gali palikti visus draudimus, apie kuriuos Komisijai buvo pranešta pagal 2 dalies pirmąją pastraipą, jei jie atitinka bendrąsias sąlygas, nustatytas 1 dalyje."

2. Without prejudice to Regulations (EEC) No 2081/92 (1) and (EEC) No 2082/92 (2), before 1 July 1994, Member States shall communicate to the list of foodstuffs which they consider as traditional, giving their reasons in detail, together with the relevant legislative provisions prohibiting the use of certain additives in such foodstuffs.

Before 1 April 1995, the Commission shall submit a proposal to the Council on the criteria to be applied for deciding whether or not a product is traditional and on the national prohibitions which may be maintained in conformity with these criteria.

Valstybės narės priima įstatymus ir kitus teisės aktus, būtinus šios direktyvos įgyvendinimui.

The Council shall act on the proposal before 1 April 1996.

Apie tai jos nedelsdamos praneša Komisijai.

3. Until such time as the Council has ruled on paragraph 2, Member States may maintain any prohibitions which have been communicated to the Commission pursuant to the first subparagraph of paragraph 2, provided that they comply with the general conditions laid down in paragraph 1.

Valstybės narės, priimdamos šias priemones, daro jose nuorodą į šią direktyvą arba tokia nuoroda daroma jas oficialiai skelbiant. Nuorodos darymo tvarką nustato valstybės narės.

4 straipsnis

Article 2

Ši direktyva skirta valstybėms narėms.

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive.

Priimta Briuselyje, 1994 m. birželio 30 d.

They shall inform the Commission thereof.

Europos Parlamento vardu

When Member States adopt these measures, they shall contain a reference to this Directive or shall be accompanied by such reference when they are officially published. The methods of making such reference shall be laid down by the Member States.
