THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

atsižvelgdami į Europos bendrijos steigimo sutartį, ypač į jos 152 straipsnio 4 dalies b punktą,

Having regard to the Treaty establishing the European Community, and in particular Article 152(4)(b) thereof,

atsižvelgdami į Komisijos pasiūlymą [1],

Having regard to the proposal from the Commission(1),

atsižvelgdami į Ekonomikos ir socialinių reikalų komiteto nuomonę [2],

Having regard to the opinion of the Economic and Social Committee(2),

pasitarę su Regionų komitetu,

Having consulted the Committee of the Regions,

laikydamiesi Sutarties 251 straipsnyje nustatytos tvarkos [3],

Acting in accordance with the procedure laid down in Article 251 of the Treaty(3),

kadangi:

Whereas:

(1) Daugybė Bendrijos teisės aktų nustato gyvūnų ir visuomenės sveikatos reikalavimus gyvūninių atliekų perdirbimui ir naikinimui bei gyvūninės kilmės produktų, kurie nėra skirti vartoti žmonėms, gamybai, pateikimui į rinką, prekybai ir importui.

(1) Numerous Community acts lay down animal and public health conditions for the processing and disposal of animal waste and for the production, placing on the market, trade and importation of products of animal origin not intended for human consumption.

(2) Tuose aktuose buvusias taisykles pakeitė 2002 m. spalio 3 d. Europos Parlamento ir Tarybos reglamentas (EB) Nr. 1774/2002, nustatantis sveikatos taisykles gyvūninės kilmės šalutiniams produktams, neskirtiems vartoti žmonėms [4].

(2) Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down the health rules concerning animal by-products not intended for human consumption(4) has replaced the rules contained in those acts.

(3) Todėl tam, kad būtų atsižvelgta į šias naujas taisykles, iš dalies turėtų būti pakeista 1990 m. birželio 26 d. Tarybos direktyva 90/425/EEB dėl Bendrijos vidaus prekyboje tam tikrais gyvais gyvūnais ir gyvūninės kilmės produktais taikomų veterinarinių ir zootechninių patikrinimų, siekiant užbaigti vidaus rinkos kūrimą [5], ir 1992 m. gruodžio 17 d. Tarybos direktyva 92/118/EEB, nustatanti gyvūnų sveikatos ir visuomenės sveikatos reikalavimus, reglamentuojančius produktų, kuriems netaikomi reikalavimai, nustatyti specialiose Bendrijos taisyklėse, nurodytose Direktyvos 89/662/EEB A priedo I dalyje, ir ligų sukėlėjų atžvilgiu Direktyvoje 90/425/EEB, prekybą Bendrijoje ir jų importą į Bendriją [6],

(3) To take account of those new rules, Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(5) and Council Directive 92/118/EEC of 17 December 1992 laying down animal health and public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A(I) to Directive 89/662/EEC and, as regards pathogens, to Directive 90/425/EEC(6), should therefore be amended,

PRIĖMĖ ŠIĄ DIREKTYVĄ:

HAVE ADOPTED THIS DIRECTIVE:

1 straipsnis

Direktyvos 90/425/EEB A priedo I skyriaus 1 skirsnio septintoji įtrauka pakeičiama taip:

Article 1

"— 2002 m. spalio 3 d. Europos Parlamento ir Tarybos reglamentas (EB) Nr. 1774/2002, nustatantis veterinarijos taisykles gyvūninės kilmės šalutiniams produktams, kurie nėra skirti vartoti žmonėms (OL L 273, 2002 10 10, p. 1)."

In Directive 90/425/EEC, the seventh indent of section 1 of Chapter I of Annex A shall be replaced by the following:

2 straipsnis

"- Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October laying down the health rules concerning animal by-products not intended for human consumption (OJ L 273, 10.10.2002, p. 1)."

Direktyva 92/118/EEB iš dalies keičiama taip:

1) 2 straipsnio e ir g punktai išbraukiami;

Article 2

2) 3 straipsnis iš dalies keičiamas taip:

Directive 92/118/EEC is hereby amended as follows:

a) pirmojoje įtraukoje išbraukiami šie žodžiai:

1. in Article 2, points (e) and (g) shall be deleted;

"taip pat želatinos, kuri nėra skirta maistui"

2. Article 3 shall be amended as follows:

ir

(a) in the first indent, the following words shall be deleted:

b) antroji įtrauka pakeičiama taip:

"together with gelatins not intended for human consumption";

"— importuoti arba prekiauti nauju maistui skirtu gyvūninės kilmės produktu, kurį pateikti į valstybės narės rinką buvo leista vėliau, negu nurodyta 20 straipsnyje, gali būti leidžiama tik po sprendimo, kuris, remiantis 15 straipsnio pirma pastraipa, priimamas po to, kai įvertinamas tikrasis paplitimo pavojus pavojingų užkrečiamųjų ligų, kuriomis dėl šio produkto judėjimo gali užsikrėsti ne tik tos gyvūnų rūšys, iš kurių toks produktas pagamintas, bet ir kitos rūšys, kurios gali pernešti ligą, tapti ligos židiniu arba kelti pavojų žmonių sveikatai, ir kai Veterinarijos mokslinis komitetas, įkurtas Sprendimu 81/651/EEB, prireikus pareiškia apie tai savo nuomonę,;"

and

3) 10 straipsnio 2 dalies b punktas pakeičiamas taip:

(b) the second indent shall be replaced by the following:

"b) jeigu II priede nenurodyta kitaip, produktai turi būti iš įmonių, įtrauktų į Bendrijos sąrašą, kuris turi būti sudarytas laikantis 18 straipsnyje nustatytos tvarkos;;"

"- any new product of animal origin intended for human consumption whose placing on the market in a Member State is authorised after the date provided for in Article 20 may not be the subject of trade or importation until a decision has been taken in accordance with the first paragraph of Article 15 after evaluation, if appropriate in the light of the opinion of the Scientific Veterinary Committee set up by Decision 81/651/EEC, of the real risk of the spread of serious transmissible diseases which could result from movement of the product, not only for the species from which the product originates but also for other species which could carry the disease, become a focus of disease or a risk to human health,";

4) I priedas iš dalies keičiamas taip:

3. in Article 10(2), subparagraph (b) shall be replaced by the following:

a) 1, 3 ir 4 skyriai išbraukiami;

"(b) unless otherwise specified in Annex II, products must come from establishments on a Community list to be drawn up in accordance with the procedure laid down in Article 18;";

4. Annex I shall be amended as follows:

(a) Chapters 1, 3 and 4 shall be deleted;

(b) Chapter 5 shall be amended as follows:

i) pavadinime pridedami tokie žodžiai:

(iii) part B shall be deleted;

"skirti maistui;"

(c) Chapter 6 shall be amended as follows:

ii) I dalis iš dalies keičiama taip:

(i) in the title, the following words shall be added:

- A pastraipa pakeičiama taip:

"intended for human consumption";

"A. Prekiaujant pateikti dokumentą arba sertifikatą, numatytą Direktyvoje 77/99/EEB, kuriame būtų patvirtinta, kad laikomasi tos direktyvos reikalavimų;";

(ii) part I shall be amended as follows:

- B pastraipos 1 dalies a punktas pakeičiamas taip:

- paragraph A shall be replaced by the following:

- "a) produktai atitinka Direktyvos 80/215/EEB reikalavimus;";

"A. As regards trade, to the production of the document or certificate provided for in Directive 77/99/EEC, stating that the requirements of that Directive have been complied with;",

d) 7 skyriuje II dalis išbraukiama ir

- in paragraph B(1), point (a) shall be replaced by the following:

e) 8, 10 ir 12–15 skyriai išbraukiami.

"a) the products fulfil the requirements of Directive 80/215/EEC;";

3 straipsnis

(d) in Chapter 7, part II shall be deleted; and

Valstybės narės priima įstatymus ir kitus teisės aktus, kurie, įsigalioję 2003 m. balandžio 30 d., įgyvendina šią direktyvą. Apie tai jos nedelsdamos praneša Komisijai.

(e) Chapters 8, 10 and 12 to 15 shall be deleted.

Valstybės narės, priimdamos šias priemones, daro jose nuorodą į šią direktyvą arba tokia nuoroda daroma jas oficialiai skelbiant. Nuorodos darymo tvarką nustato valstybės narės.

4 straipsnis

Article 3

Ši direktyva įsigalioja jos paskelbimo Europos Bendrijų oficialiajame leidinyje dieną.

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive on 30 April 2003. They shall forthwith inform the Commission thereof.

5 straipsnis

When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. The methods of making such a reference shall be laid down by the Member States.

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.
