Having regard to the Treaty establishing the European Community, and in particular Article 129 thereof,

Acting in accordance with the procedure laid down in Article 189b of the Treaty (4), in the light of the joint text approved by the Conciliation Committee on 27 May 1998,

(1) Whereas the prevention of disease, in particular of the major health scourges, is a priority for Community action, requiring a global approach coordinated between Member States;

atsižvelgdami į Regionų komiteto nuomonę [3],

(2) Whereas the European Parliament, in its resolution on public health policy after Maastricht (5), invited the Commission to set up a transfrontier network to devise working definitions of notifiable diseases, to collect, update, analyse and disseminate Member States data on such diseases and to work with national and international agencies on these matters;

(3) Whereas in its resolution of 2 June 1994 (6) on the framework for Community action in the field of public health the Council agreed that priority should be given at present to communicable diseases in particular;

(1) kadangi ligų, ypač nulemiančių didžiausias sveikatos problemas, profilaktika yra Bendrijos veiklos prioritetas, kuriam būtini visuotiniai, tarp valstybių narių koordinuojami veiklos metodai;

(4) Whereas in its conclusions of 13 December 1993 (7) the Council considered that there was a need to develop at Community level a network for the surveillance and control of communicable diseases, the main purpose of which would be to collect and coordinate information from monitoring networks in the Member States;

(2) kadangi Europos Parlamentas rezoliucijoje dėl visuomenės sveikatos politikos po Mastrichto sutarties [5] pakvietė Komisiją sukurti tarpvalstybinį tinklą, siekiant sudaryti registruojamų ligų, apie kurias reikia pranešti, darbinius apibrėžimus, kaupti, atnaujinti, analizuoti ir platinti valstybių narių pateiktus duomenis apie šias ligas bei šioje srityje dirbti su nacionalinėmis ir tarptautinėmis agentūromis;

(5) Whereas in those same conclusions the Council requested the Commission to devote special attention, in its proposals relating to the framework for action in the field of public health, to setting up an epidemiological network in the Community, taking account of the current proceedings and mechanisms existing at Community and at Member State level, and ensuring the comparability and compatibility of data;

(3) kadangi 1994 m. birželio 2 d. Rezoliucijoje dėl Bendrijos veiksmų visuomenės sveikatos srityje programos [6] Taryba pritarė, jog šiuo metu prioritetas visų pirma turėtų būti teikiamas užkrečiamosioms ligoms;

(6) Whereas in their resolution of 13 November 1992 on the monitoring and surveillance of communicable diseases (8) the Council and the Ministers for Health, meeting within the Council, underlined the desirability of improving, within the Community, the coverage and effectiveness of existing networks between Member States for the surveillance of communicable diseases (including data-processing networks), and also the desirability of maintaining, establishing or strengthening coordination between them for monitoring outbreaks of communicable diseases, where such action could add to the value of existing measures;

(4) kadangi 1993 m. gruodžio 13 d. išvadose [7] Taryba pritarė, kad būtina Bendrijos lygiu sukurti užkrečiamųjų ligų priežiūros ir kontrolės tinklą, kurio pagrindinis tikslas būtų kaupti ir koordinuoti valstybių narių monitoringo tinklais gautą informaciją;

(7) Whereas in that same resolution, the Council and the Ministers for Health, meeting within the Council, underlined the value of collecting data from the Member States on a limited number of rare and serious diseases which require large samples for epidemiological study;

(5) kadangi tose pačiose išvadose Taryba pareikalavo Komisijos, rengiant pasiūlymus dėl veiksmų, susijusių su visuomenės sveikata, sistemos, ypatingą dėmesį skirti epidemiologinio tinklo sukūrimui Bendrijoje, atsižvelgiant į šiuo metu Bendrijoje ir valstybėse narėse taikomą metodiką ir mechanizmus bei garantuojant duomenų palyginamumą ir suderinamumą;

(8) Whereas in that same resolution the Council and the Ministers for Health, meeting within the Council, invited the Commission to examine the desirability of giving priority to certain suitable proposals relating to the control and surveillance of communicable diseases, in the light, inter alia, of their estimated cost-effectiveness;

(6) kadangi 1992 m. lapkričio 13 d. Rezoliucijoje dėl užkrečiamųjų ligų priežiūros ir monitoringo [8] Taryba ir sveikatos ministrai Tarybos susitikime pabrėžė, kad Bendrijoje reikėtų išplėsti jau esančių užkrečiamųjų ligų priežiūros valstybių narių tinklų aprėptį ir padidinti jų veiksmingumą (įskaitant duomenų apdorojimo tinklus), remti, pradėti ar stiprinti jų veiksmų koordinavimą, kad būtų vykdomas užkrečiamųjų ligų protrūkių monitoringas, jei tokiais veiksmais būtų galima prisidėti prie jau taikomų priemonių;

(9) Whereas, in accordance with the principle of subsidiarity, any new measure taken in an area which does not fall within the exclusive competence of the Community, such as the epidemiological surveillance and control of communicable diseases, may be taken by the Community only if, by reason of the scale or effects of the proposed action, the objectives of the proposed action can be better achieved by the Community than by the Member States;

(7) kadangi toje pačioje rezoliucijoje Taryba ir sveikatos ministrai Tarybos susitikime pabrėžė, jog labai svarbu iš valstybių narių rinkti duomenis apie tam tikras retas ir ypač pavojingas ligas, kurių epidemiologiniams tyrimams reikalingi duomenys apie daugelį atvejų;

(10) Whereas the varying levels and needs of epidemiological surveillance of communicable diseases in the Member States make it necessary to establish a permanent network at Community level;

(8) kadangi toje pačioje rezoliucijoje Taryba ir sveikatos ministrai Tarybos susitikime paragino Komisiją išsiaiškinti, ar reikėtų teikti prioritetą tam tikriems tinkamiems su užkrečiamųjų ligų priežiūra ir kontrole susijusiems pasiūlymams, be kita ko, įvertinus šių pasiūlymų ekonominį efektyvumą;

(11) Whereas measures to be taken in the health field must take into account other actions undertaken by the Community in the field of public health or which have an impact on public health;

(9) kadangi pagal subsidiarumo principą su išskirtine Bendrijos kompetencija nesusijusioje srityje, pavyzdžiui, užkrečiamųjų ligų epidemiologinės priežiūros ir kontrolės srityje, Bendrija naujų priemonių gali imtis tik tada, jei dėl siūlomų veiksmų masto ir poveikio jų tikslus geriau pasiektų Bendrija, nei valstybės narės;

(12) Whereas the measures to be taken under this Decision are adopted excluding any harmonisation of the laws and regulations of the Member States;

(10) kadangi dėl skirtingo užkrečiamųjų ligų priežiūros lygio ir skirtingų poreikių valstybėse narėse būtina Bendrijos lygiu sukurti nuolat veikiantį tinklą;

(13) Whereas Decision 647/96/EC of the European Parliament and of the Council of 29 March 1996 adopting a programme of Community action on the prevention of AIDS and certain other communicable diseases within the framework for action in the field of public health (1996 to 2000) (9) envisages a number of Community actions for the creation and development of networks for the control and surveillance of certain communicable diseases, the early detection of such diseases, and promotion of the training of field epidemiologists;

(11) kadangi, imantis priemonių sveikatos srityje, būtina atsižvelgti į kitus veiksmus, kurių Bendrija imasi visuomenės sveikatos srityje arba kurie turi įtakos visuomenės sveikatai;

(14) Whereas cooperation with the competent international organisations, particularly the World Health Organisation, notably with regard to disease classification, must be fostered, as well as the use of appropriate language and technology;

(12) kadangi priemonės, kurių reikės imtis pagal šį sprendimą, priimamos nederinant valstybių narių įstatymų ir kitų teisės aktų;

(15) Whereas cooperation with non-member countries, in particular in the case of the appearance or resurgence of serious communicable diseases, must be supported;

(13) kadangi 1996 m. kovo 29 d. Europos Parlamento ir Tarybos sprendime 647/96/EB, priimančiame Bendrijos AIDS ir tam tikrų kitų užkrečiamųjų ligų profilaktikos veiksmų programą pagal veiksmų visuomenės sveikatos srityje programą (1996-2000 m.) [9], numatyta daugelis Bendrijos veiksmų, skirtų tam tikrų užkrečiamųjų ligų priežiūros ir kontrolės tinklams sukurti ir plėtoti, šioms ligoms kuo anksčiau nustatyti ir mokymams epidemiologijos srityje skatinti;

(16) Whereas the recent appearance or resurgence of serious communicable diseases has demonstrated that when an emergency situation occurs all necessary information and data gathered in accordance with an agreed methodology must be communicated swiftly to the Commission;

(14) kadangi būtina skatinti bendradarbiavimą su kompetentingomis tarptautinėms organizacijomis, visų pirma su Pasaulio sveikatos organizacija, ypač atsižvelgiant į ligų klasifikavimą, taip pat tinkamos kalbos vartojimą bei technologijų taikymą;

(17) Whereas, in order to ensure protection of the population in an emergency, Member States must exchange relevant data and information immediately via the Community network; whereas priority must be given at all times to the protection of public health;

(15) kadangi būtina remti bendradarbiavimą su ES nepriklausančiomis šalimis, ypač išsiaiškinus naujas arba vėl suaktyvėjusias ypač pavojingas užkrečiamąsias ligas;

(18) Whereas Council Directive 92/117/EEC of 17 December 1992 concerning measures for protection against specified zoonoses and specified zoonotic agents in animals and products of animal origin in order to prevent outbreaks of food-borne infections and intoxications (10) applies equally to information concerning zoonoses which affect human beings; whereas that same Directive provides for a system for collecting and transmitting information on specified zoonoses and zoonotic agents;

(16) kadangi pastaruoju metu, išsiaiškinus naujas arba vėl suaktyvėjusias ypač pavojingas užkrečiamąsias ligas, paaiškėjo, kad, susiklosčius ypatingai situacijai, visa pagal sutartą metodiką surinkta reikalinga informacija ir duomenys turi būti nedelsiant pateikiami Komisijai;

(19) Whereas the setting-up of a network for the epidemiological surveillance and control of communicable diseases at Community level necessarily presupposes compliance with the legal provisions concerning the protection of individuals with regard to the processing of personal data and the introduction of arrangements to guarantee the confidentiality and security of such data; whereas in this connection the European Parliament and the Council adopted Directive 95/46/EC (11);

(17) kadangi, siekiant apsaugoti gyventojus, susiklosčius ypatingai situacijai, valstybės narės privalo nedelsdamos Bendrijos tinklu pasikeisti atitinkamais duomenimis ir informacija; kadangi bet kuriuo atveju prioritetas turi būti teikiamas visuomenės sveikatos apsaugai;

(20) Whereas the Community projects in the field of the telematic interchange of data between administrations (IDA) (12) and the G7 projects should be closely coordinated with the implementation of the Community actions relating to the epidemiological surveillance and control of communicable diseases;

(18) kadangi 1992 m. gruodžio 17 d. Tarybos direktyva 92/117/EEB dėl priemonių, skirtų apsisaugoti nuo tam tikrų zoonozių ir zoonozių sukėlėjų, plintančių gyvūnuose ir gyvūninės kilmės produktuose, siekiant užkirsti kelią su maistu plintančių infekcijų ir apsinuodijimo maisto produktais protrūkiams [10] taip pat taikoma informacijai apie zoonozes, kuriomis serga ir žmonės; kadangi toje pačioje direktyvoje numatyta informacijos apie tam tikras zoonozes ir tam tikrus zoonozių sukėlėjus surinkimo bei perdavimo sistema;

(21) Whereas consideration must be given to the efforts deployed with a view to encouraging international cooperation in this field, particularly as part of a joint plan of action with the United States;

(19) kadangi, kuriant užkrečiamųjų ligų epidemiologinės priežiūros ir kontrolės tinklą Bendrijos lygiu, būtina iš anksto numatyti, kad jis atitiktų teisines nuostatas, reglamentuojančias asmenų apsaugą tvarkant asmens duomenis, ir būtų taikomi susitarimai, garantuojantys tokių duomenų konfidencialumą ir apsaugą; kadangi Europos Parlamentas ir Taryba priėmė su tuo susijusią Direktyvą 95/46/EB [11];

(22) Whereas it is important, in an emergency situation, that the competent national structures and/or authorities should strengthen their cooperation, in particular with regard to the identification of biological samples;

(20) kadangi Bendrijos projektai dėl telematinio keitimosi duomenimis tarp administracijų (IDA) [12] ir G7 projektai turėtų būti glaudžiai koordinuojami su Bendrijos veiksmų, susijusių su užkrečiamųjų ligų epidemiologine priežiūra ir kontrole, įgyvendinimu;

(23) Whereas any Community procedures which may be set up for the rapid exchange of information do not affect the Member States' rights and obligations under bilateral or multilateral agreements and conventions;

(21) kadangi dėmesys turi būti skiriamas veiklai, skatinančiai tarptautinį bendradarbiavimą šioje srityje, ypač jei ta veikla yra bendrojo su Jungtinėmis Valstijomis vykdomų veiksmų plano dalis;

(24) Whereas a procedure needs to be established to promote coordination between the Member States concerning the measures they may decide to take to control the spread of communicable diseases; whereas the adoption and implementation of these measures fall within the exclusive competence of the Member States;

(22) kadangi, susiklosčius ypatingai situacijai, svarbu, kad kompetentingos nacionalinės struktūros ir (arba) institucijos stiprintų tarpusavio bendradarbiavimą, ypač identifikuojant užkrečiamųjų ligų sukėlėjus;

(25) Whereas it is important that the Commission should implement the Community network in close cooperation with the Member States; whereas a procedure therefore needs to be established to ensure the Member States' full participation in this implementation;

(23) kadangi Bendrijos procedūros, kurios gali būti pradėtos taikyti siekiant greitai pasikeisti informacija, nepažeidžia valstybių narių teisių ir įsipareigojimų, numatytų dvišaliuose arba daugiašaliuose susitarimuose ir konvencijose;

(26) Whereas the costs which may result from the operation of the network at Community level should be met from Community resources and/or from relevant Community programmes;

(24) kadangi reikia nustatyti tvarką, kurios laikantis būtų skatinamas valstybių narių priemonių, kurių jos gali nuspręsti imtis užkrečiamųjų ligų plitimui kontroliuoti, koordinavimas; kadangi šių priemonių priėmimas ir įgyvendinimas priklauso išskirtinei valstybių narių kompetencijai;

(27) Whereas the costs which may result from the operation of the network at national level will have to be financed by the Member States themselves, unless Community provisions provide otherwise;

(25) kadangi svarbu, kad Komisija diegtų Bendrijos tinklą glaudžiai bendradarbiaudama su valstybėmis narėmis; kadangi reikia nustatyti tvarką, kuri užtikrintų visapusišką valstybių narių dalyvavimą diegiant šį tinklą;

(28) Whereas a modus vivendi between the European Parliament, the Council and the Commission concerning the implementing measures for acts adopted in accordance with the procedure laid down in Article 189b of the Treaty (13) was concluded on 20 December 1994,

(26) kadangi tinklo eksploatavimo Bendrijos lygiu išlaidos turėtų būti finansuojamos iš Bendrijos išteklių ir (arba) iš atitinkamų Bendrijos programų;

HAVE ADOPTED THIS DECISION:

(27) kadangi tinklo eksploatavimo nacionaliniu lygiu išlaidas turi padengti pačios valstybės narės, nebent Bendrijos nuostatos numato kitaip;

(28) kadangi 1994 m. gruodžio 20 d. buvo pasirašytas trumpalaikis susitarimas (modus vivendi) tarp Europos Parlamento, Tarybos ir Komisijos dėl Sutarties 189b straipsnyje nustatyta tvarka priimtų teisės aktų įgyvendinimo priemonių [13],

PRIĖMĖ ŠĮ SPRENDIMĄ:

Article 1

1 straipsnis

The objective of this Decision is to set up a network at Community level to promote cooperation and coordination between the Member States, with the assistance of the Commission, with a view to improving the prevention and control, in the Community, of the categories of communicable diseases specified in the Annex. This network shall be used for:

Šio sprendimo tikslas — Bendrijos lygiu sukurti tinklą ir padedant Komisijai skatinti valstybių narių bendradarbiavimą ir jų veiksmų koordinavimą bei pagerinti priede išvardytų kategorijų užkrečiamųjų ligų profilaktiką ir kontrolę Bendrijoje. Šis tinklas naudojamas:

- the epidemiological surveillance of these diseases, and

- šių ligų epidemiologinei priežiūrai ir

- an early warning and response system for the prevention and control of these diseases.

- šių ligų profilaktikai bei kontrolei, taikant skubaus įspėjimo ir reagavimo sistemą.

As regards epidemiological surveillance, the network shall be established by bringing into permanent communication with one another, through all appropriate technical means, the Commission and those structures and/or authorities which, at the level of each Member State and under the responsibility of that Member State, are competent at national level and are charged with collecting information relating to the epidemiological surveillance of communicable diseases, and by establishing procedures for the dissemination of the relevant surveillance data at Community level.

Atsižvelgiant į epidemiologinės priežiūros būtinybę, tinklas diegiamas siekiant visomis tinkamomis techninėmis priemonėmis užmegzti nuolatinius ryšius tarp Komisijos bei tų struktūrų ir (arba) institucijų, kurios, kiekvienos valstybės narės lygiu ir tos valstybės narės atsakomybe, yra kompetentingos nacionaliniu lygiu ir kurioms pavedama rinkti informaciją, susijusią su užkrečiamųjų ligų epidemiologine priežiūra, bei patvirtinant atitinkamų priežiūros duomenų platinimo Bendrijos lygiu tvarką.

As regards the early warning and response system, this network shall be formed by bringing into permanent communication with one another, through appropriate means, the Commission and the competent public health authorities in each Member State responsible for determining the measures which may be required to protect public health.

Atsižvelgiant į skubaus įspėjimo ir reagavimo sistemos būtinybę, tinklas kuriamas tinkamomis priemonėmis užmezgant nuolatinius ryšius tarp Komisijos ir kiekvienos valstybės narės kompetentingų visuomenės sveikatos institucijų, atsakingų už priemonių, kurių gali prireikti visuomenės sveikatai apsaugoti, parinkimą.

The Commission shall provide for the coordination of the network in collaboration with the Member States.

Komisija, bendradarbiaudama su valstybėmis narėmis, užtikrina tinklo koordinavimą.

2 straipsnis

Article 2

Šiame sprendime toliau nurodyti terminai vartojami šia reikšme:

For the purpose of this Decision, the following terms shall have the following meanings:

1) "epidemiologinė priežiūra" — nuolatinis sistemingas sveikatos duomenų rinkimas, analizė, interpretavimas ir platinimas, įskaitant priede išvardytų kategorijų užkrečiamųjų ligų epidemiologinius tyrimus, ypač susijusius su šių ligų plitimo laiko ir erdvės požiūriu modeliais bei rizikos faktorių analize, siekiant sustabdyti tokių ligų plitimą ir taikyti tinkamas profilaktines bei atsakomąsias priemones;

1. 'epidemiological surveillance`: the ongoing systematic collection, analysis, interpretation and dissemination of health data, including epidemiological studies, concerning the categories of communicable diseases set out in the Annex, in particular relating to the pattern of spread of such diseases over time and space and analysis of the risk factors for contracting such diseases, for the purpose of enabling appropriate preventive measures and counter-measures to be taken;

2) "užkrečiamųjų ligų profilaktika ir kontrolė" — grupė priemonių, įskaitant epidemiologinius tyrimus, kurias vykdo kompetentingos visuomenės sveikatos institucijos valstybėse narėse, siekdamos išvengti užkrečiamųjų ligų plitimo ir jį sustabdyti;

2. 'prevention and control of communicable diseases`: the range of measures, including epidemiological investigations, taken by the competent public health authorities in the Member States to prevent and stop the spread of communicable diseases;

3) "Bendrijos tinklas" — užkrečiamųjų ligų epidemiologinės priežiūros ir kontrolės tinklas — sistema, kuria keičiamasi šio straipsnio 1 ir 2 punktuose nurodytai veiklai vykdyti būtina informacija.

3. 'Community network`: network for the epidemiological surveillance and control of communicable diseases, namely the system by which the necessary information for carrying out the activities referred to in points 1 and 2 is exchanged.

3 straipsnis

Kad Bendrijos epidemiologinės priežiūros tinklas veiksmingai veiktų ir būtų gaunama vienarūšė informacija, 7 straipsnyje numatyta tvarka nustatoma:

Article 3

a) į Bendrijos tinklą palaipsniui įtrauktinos užkrečiamosios ligos;

With a view to the effective operation of the Community network with regard to epidemiological surveillance and to achieving uniform information within this framework, the following shall be determined in accordance with the procedure laid down in Article 7:

b) šių ligos atrankos kriterijai, atsižvelgiant į priede išvardytas kategorijas ir turimus bendrus ligų priežiūros tinklus, kuriais gali būti remiamasi;

(a) the communicable diseases to be progressively covered by the Community network;

c) susirgimų apibrėžimai, ypač klinikinės ir mikrobiologinės charakteristikos;

(b) the criteria for selection of these diseases, having regard to the categories set out in the Annex and the existing collaborative networks for disease surveillance that can be built on;

d) su epidemiologine priežiūra susijusių duomenų ir informacijos, kurią turės rinkti ir perduoti 1 straipsnio antroje pastraipoje minėtos struktūros ir (arba) institucijos, pobūdis bei rūšis ir tokių duomenų palyginimo bei suderinimo būdai;

(c) case definitions, in particular clinical and microbiological characteristics;

e) epidemiologinės ir mikrobiologinės priežiūros metodai;

(d) the nature and type of data and information to be collected and transmitted by the structures and/or authorities referred to in the second paragraph of Article 1 in the field of epidemiological surveillance and the ways in which such data are to be made comparable and compatible;

f) apsaugos priemonių, kurių visų pirma reikės imtis prie valstybių narių išorės sienų, ypač susiklosčius ypatingoms situacijoms, naudojimo rekomendacijos;

(e) epidemiological and microbiological surveillance methods;

g) su informacija susijusios rekomendacijos ir visuomenei skirti geros praktikos vadovai;

(f) guidelines on the protective measures to be taken, in particular at external frontiers of the Member States, notably in emergency situations;

h) atitinkamos techninės priemonės ir tvarka, kuriomis remiantis duomenys bus platinami ir analizuojami Bendrijos lygiu.

(g) guidelines on information and guides to good practice for the public;

4 straipsnis

(h) the appropriate technical means and the procedures by which the data will be disseminated and analysed at Community level.

Kiekviena 1 straipsnio antroje arba trečioje pastraipose minėta struktūra ir (arba) institucija Bendrijos tinklui perduoda:

a) informaciją apie valstybėje narėje, kuriai priklauso struktūra ir (arba) institucija, nustatytas ir pakartotinai nustatytas užkrečiamąsias ligas, kaip nurodyta 3 straipsnio a punkte, ir informaciją apie taikytas kontrolės priemones;

Article 4

b) bet kokią svarbią rinktiną informaciją apie epideminių situacijų progresavimą;

Each structure and/or authority referred to in the second paragraph or in the third paragraph, whichever is appropriate of Article 1 shall communicate to the Community network:

c) informaciją apie neįprastus epideminius reiškinius arba naujas užkrečiamąsias ligas, kurių kilmė nėra žinoma;

(a) information regarding the appearance or resurgence of cases of communicable diseases as referred to in Article 3(a) in the Member State to which the structure and/or authority belongs, together with information on control measures applied;

d) bet kokią turimą svarbią informaciją:

(b) any relevant information concerning the progression of epidemic situations for which it has responsibility for information collection;

(c) information on unusual epidemic phenomena or new communicable diseases of unknown origin;

- apie ES nepriklausančiose šalyse naujas užkrečiamąsias ligas, kurių kilmė nėra žinoma;

(d) any relevant information in its possession:

e) informaciją apie egzistuojančius ir siūlomus užkrečiamųjų ligų profilaktikos ir kontrolės mechanizmus bei procedūras, ypač tas, kurios taikomos susiklosčius ypatingoms situacijoms;

- on cases of communicable diseases covered by the categories set out in the Annex,

f) kitus svarbius dalykus, kurie galėtų padėti valstybėms narėms koordinuoti savo veiksmus užkrečiamųjų ligų profilaktikos ir kontrolės srityje, įskaitant visas atsakomąsias priemones.

- on new communicable diseases of unknown origin in non-member countries;

5 straipsnis

(e) information concerning existing and proposed mechanisms and procedures for the prevention and control of communicable diseases, in particular in emergency situations;

Komisija leidžia naudotis 3 straipsnyje nurodyta informacija visoms 1 straipsnyje minėtoms struktūroms ir institucijoms. Kiekviena struktūra (institucija) garantuoja, kad informacija, kurią jos perduoda tinklui pagal 4 straipsnį, būtų skubiai perduota visoms kitoms suinteresuotoms struktūroms (institucijoms) ir Komisijai.

(f) any relevant considerations which could help Member States to coordinate their efforts for the prevention and control of communicable diseases, including any counter-measures implemented.

6 straipsnis

1. Remdamosi Bendrijos tinkle prieinama informacija, valstybės narės konsultuojasi viena su kita kartu su Komisija, siekdamos koordinuoti savo veiksmus užkrečiamųjų ligų profilaktikai ir kontrolei vykdyti.

Article 5

2. Valstybė narė, ketinanti imtis užkrečiamųjų ligų kontrolės priemonių, prieš jų imdamasi Bendrijos tinklu kitoms valstybėms narėms ir Komisijai praneša apie šių priemonių pobūdį ir jų taikymo sritį. Tokia valstybė narė Bendrijos tinklu taip pat konsultuojasi su kitomis valstybėmis narėmis ir Komisija dėl ketinamų taikyti priemonių pobūdžio ir taikymo srities, nebent prireiktų nedelsiant apsaugoti visuomenės sveikatą ir tokios konsultacijos būtų neįmanomos.

The Commission shall make available the information referred to in Article 3 to all the structures and authorities referred to in Article 1. Each structure/authority shall ensure that the information which they communicate to the network, pursuant to Article 4, is promptly forwarded to all other participating structures/authorities and the Commission.

3. Jei valstybė narė dėl nustatytų ir pakartotinai nustatytų užkrečiamųjų ligų turi skubiai imtis kontrolės priemonių, ji nedelsdama Bendrijos tinklu apie tai praneša kitoms valstybėms narėms ir Komisijai.

Pagrįstais ypatingais atvejais to pageidaujančios valstybės narės gali imtis tinkamų bendru valstybių narių ir Komisijos susitarimu patvirtintų profilaktikos ir apsaugos priemonių.

Article 6

4. Valstybės narės, remdamosi konsultacijomis ir pateikta informacija, kartu su Komisija koordinuoja savo veiksmus, susijusius su priemonėmis, kurių jos ėmėsi arba ketina imtis nacionaliniu lygiu.

1. Member States shall, on the basis of the information available through the Community network, consult each other in liaison with the Commission with a view to coordinating their efforts for the prevention and control of communicable diseases.

5. Su šio straipsnio 1, 2 ir 3 dalyse minėta informacija ir konsultacijomis bei šio straipsnio 1 ir 4 dalyse minėtu koordinavimu susijusios procedūros nustatomos 7 straipsnyje nustatyta tvarka.

2. Where a Member State intends to adopt measures for the control of communicable diseases, it shall, before adopting those measures, inform the other Member States and the Commission on the nature and scope of those measures, through the Community network. The Member State in question shall also consult other Member States and the Commission through the Community network on the nature and scope of intended measures unless the need to protect public health is so urgent that consultation proves impossible.

3. Where a Member State has to adopt, as a matter of urgency, control measures in response to the appearance or resurgence of communicable diseases, it shall, as soon as possible, inform through the Community network the other Member States and the Commission.

1. Siekiant įgyvendinti šį sprendimą, Komisijai padeda iš valstybių narių atstovų sudarytas komitetas, kuriam pirmininkauja Komisijos atstovas.

In duly justified specific cases, appropriate prevention and protection measures, adopted by mutual agreement among Member States in conjunction with the Commission, may be taken by the Member States which so desire.

2. Komisijos atstovas Komitetui pateikia priemonių, kurių turi būti imtasi, projektą. Komitetas savo nuomonę dėl projekto pareiškia per tokį laiką, kurį gali nustatyti pirmininkas, atsižvelgdamas į klausimo skubumą. Tais atvejais, kai Taryba turi priimti sprendimą Komisijos pasiūlymu, nuomonė patvirtinama Sutarties 148 straipsnio 2 dalyje nustatyta balsų dauguma. Valstybių narių atstovų komitete balsai skaičiuojami taip, kaip nustatyta tame straipsnyje. Pirmininkas nebalsuoja.

4. Member States shall, on the basis of their consultations and the information provided, coordinate among themselves in liaison with the Commission with regard to the measures which they have adopted, or intend to adopt at national level.

3. a) Komisija patvirtina numatytas priemones, jeigu jos atitinka Komiteto nuomonę;

5. Procedures concerning the information and consultation referred to in paragraphs 1, 2 and 3 and procedures concerning the coordination referred to in paragraphs 1 and 4 shall be established in accordance with the procedure laid down in Article 7.

b) kai numatytos priemonės neatitinka Komiteto nuomonės arba nuomonė nepareiškiama, Komisija nedelsdama pateikia Tarybai pasiūlymą dėl priemonių, kurių turi būti imtasi. Taryba sprendžia kvalifikuota balsų dauguma.

Jei, gavusi pasiūlymą, Taryba per tris mėnesius nepriima jokio sprendimo, pasiūlytas priemones patvirtina Komisija.

Article 7

8 straipsnis

1. For the purposes of implementing this Decision, the Commission shall be assisted by a committee composed of representatives of each of the Member States and chaired by the representative of the Commission.

Priedas gali būti iš dalies keičiamas arba papildomas 7 straipsnyje nustatyta tvarka.

2. The representative of the Commission shall submit to the committee a draft of the measures to be taken. The committee shall deliver its opinion on the draft within a time limit which the chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 148(2) of the Treaty in the case of decisions which the Council is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the committee shall be weighted in the manner set out in that Article. The chairman shall not vote.

3. (a) The Commission shall adopt the measures envisaged if they are in accordance with the opinion of the committee.

Per šešis mėnesius nuo šio sprendimo įsigaliojimo dienos kiekviena valstybė paskiria 1 straipsnio antroje ir trečioje pastraipose minėtas struktūras ir (arba) institucijas bei apie tai praneša Komisijai ir kitoms valstybėms narėms. Valstybės narės viešai paskelbia paskirtąsias struktūras ir (arba) institucijas, kurios priklauso šiuo sprendimu sukurtam Bendrijos tinklui.

(b) If the measures envisaged are not in accordance with the opinion of the committee, or if no opinion is delivered, the Commission shall without delay submit to the Council a proposal relating to the measures to be taken. The Council shall act by a qualified majority.

10 straipsnis

If within three months of the matter being referred to it the Council has not acted, the proposed measures shall be adopted by the Commission.

Siekdamos įgyvendinti šį sprendimą, valstybių narių kompetentingos institucijos ir Komisija skatina bendradarbiavimą su ES nepriklausančiomis šalimis ir tarptautinėmis visuomenės sveikatos organizacijomis, ypač Pasaulio sveikatos organizacija.

11 straipsnis

Article 8

Šis sprendimas taikomas nepažeidžiant Direktyvos 92/117/EEB ir Direktyvos 95/46/EB.

The Annex may be amended or supplemented in accordance with the procedure laid down in Article 7.

12 straipsnis

1. Šis sprendimas nepažeidžia valstybių narių teisės savo nacionalinėse užkrečiamųjų ligų epidemiologinės priežiūros ir kontrolės sistemose toliau taikyti ar diegti kitų susitarimų, procedūrų ir priemonių.

Article 9

2. Šis sprendimas nepažeidžia valstybių narių teisių ir pareigų, kylančių iš esamų ar būsimų dvišalių ar daugiašalių susitarimų ar konvencijų šio sprendimo taikymo srityje.

Each Member State shall designate, within six months of the entry into force of this Decision, the structures and/or authorities referred to in the second and third paragraphs of Article 1 and shall notify the Commission and the other Member States thereof. The structures and/or authorities which have been so designated shall be described in public by the Member States as forming part of the Community network established by this Decision.

13 straipsnis

Komisija, padedama valstybių narių, užtikrina, kad šis sprendimas neprieštarautų atitinkamoms Bendrijos programoms bei iniciatyvoms, įskaitant susijusias su visuomenės sveikatos srityje taikomais atitinkamais veiksmais, visų pirma taikomais statistinės informacijos bendrajai programai, telematinio keitimosi duomenimis tarp administracijų projektams ir bendrajai mokslinio tiriamojo darbo ir technikos plėtros programai, ypač pastarosios programos telematiniams taikymo būdams, bei jas papildytų.

Article 10

14 straipsnis

For the purposes of this Decision, the competent authorities of the Member States and the Commission shall foster cooperation with non-member countries and international organisations competent in the field of public health, in particular the World Health Organisation.

1. Komisija Europos Parlamentui ir Tarybai pateikia reguliarias ataskaitas, kuriose įvertina Bendrijos tinklo veikimą.

2. Pirmojoje ataskaitoje, pateikiamoje per trejus metus nuo šio spendimo įsigaliojimo dienos, pirmiausia nurodomi tie Bendrijos tinklo elementai, kuriuos reikėtų pagerinti arba patikslinti. Joje taip pat pateikiami pasiūlymai, kurie, Komisijos nuomone, yra būtini šiam sprendimui iš dalies pakeisti arba patikslinti.

Article 11

3. Po to Komisija kas penkeri metai vertina Bendrijos tinklo veikimą, ypač atkreipdama dėmesį į jo struktūrinius pajėgumus ir veiksmingą išteklių naudojimą, bei Europos Parlamentui ir Tarybai pateikia ataskaitą.

This Decision shall apply without prejudice to Directives 92/117/EEC and 95/46/EC.

15 straipsnis

Šis sprendimas įsigalioja 1999 m. sausio 3 d.

Article 12

16 straipsnis

1. This Decision shall not affect the right of the Member States to maintain or introduce other arrangements, procedures and measures for their national systems for the epidemiological surveillance and control of communicable diseases.

Šis sprendimas skirtas valstybėms narėms.

2. This Decision shall not affect Member States' rights and obligations deriving from existing or future bilateral or multilateral agreements or conventions in the field covered by this Decision.

The Commission, with the help of the Member States, shall ensure that there is consistency and complementarity between this Decision and the relevant Community programmes and initiatives, including those in the context of public health action as well as, in particular, the framework programme for statistical information, projects in the field of telematic interchange of data between administrations and the framework programme for research and technological development, especially the telematics applications of the latter programme.

1. The Commission shall submit regular reports evaluating the operation of the Community network to the European Parliament and the Council.

It shall also include any proposal that the Commission considers necessary for the amendment or adaptation of this Decision.
