RESOLUTION OF THE COUNCIL AND OF THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES, MEETING WITHIN THE COUNCIL of 13 November 1991 concerning the protection of the financial interests of the Communities (91/C 328/01)

THE COUNCIL OF THE EUROPEAN COMMUNITIES AND THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN COMMUNITIES, MEETING WITHIN THE COUNCIL,

IL CONSIGLIO DELLE COMUNITÀ EUROPEE E I RAPPRESENTANTI DEI GOVERNI DEGLI STATI MEMBRI DELLE COMUNITÀ EUROPEE, RIUNITI IN SEDE DI CONSIGLIO,

A. Concerned about fraud (including tax evasion and customs fraud) being committed on a large scale and with an international impact, and conscious of the importance of taking effective and powerful measures aimed at preventing and combating inadmissible practices by which harm is done to the financial interests of the Communities;

A. Preoccupati del fatto che le frodi (comprese la frode fiscale e la frode doganale) sono commesse su ampia scala e a livello internazionale e consapevoli dell'importanza di adottare misure efficaci e vigorose intese a prevenire e combattere le pratiche inammissibili che recano pregiudizio agli interessi finanziari delle Comunità;

B. In appreciative recognition of the various efforts that have already been made on the part of the Commission of the European Communities to expose and help prevent fraud relating to the income and expenditure of the Communities;

B. Apprezzando i vari sforzi già compiuti dalla Commissione per smascherare le frodi relative alle entrate e alle spese delle Comunità nonché per aiutare a prevenirle;

C. Conscious of the great concern that also exists in the European Parliament and the European Court of Auditors at the extent to which fraud is believed to be committed at the expense of the financial interests of the Communities;

C. Consapevoli della grande preoccupazione esistente anche in seno al Parlamento europeo e alla Corte dei conti delle Comunità europee circa l'entità stimata delle frodi commesse a danno degli interessi finanziari delle Comunità;

D. Aware, in this regard, of the report and the resolution of the European Parliament of 24 October 1991 concerning the legal protection of the financial interests of the Communities;

D. Avendo preso atto, a questo proposito, della relazione e della risoluzione del Parlamento europeo, del 24 ottobre 1991, relativa alla tutela giuridica degli interessi finanziari delle Comunità;

E. Recalling the statement made by the Council on 8 July 1991 concerning the fight against fraud affecting the Community budget;

E. Rifacendosi alla dichiarazione fatta dal Consiglio l'8 luglio 1991 sulla lotta contro le frodi a danno del bilancio della Comunità;

F. Recognizing that large-scale fraud relating to the income and expenditure of the Communities often assumes cross-border forms and that the increasingly free movement of goods, persons, services and capital can also increase the risk of the organization of fraud offences becoming internationalized;

Riconoscendo che la frode su ampia scala relativa alle entrate e alle spese delle Comunità spesso oltrepassa le frontiere e che un aumento della libera circolazione di merci, persone, servizi e capitali può anche aumentare il rischio che l'organizzazione di reati fraudolenti si evolva a livello internazionale;

G. Convinced that a responsibility rests with the Community institutions as well as with Member States, each within their own sphere of competence, where necessary in close cooperation, to take suitable measures to analyse, prevent and combat this phenomenon;

G. Convinti che le istituzioni della Comunità così come gli Stati membri, nell'ambito delle rispettive sfere di competenza e, se necessario, in stretta cooperazione, hanno la responsabilità di prendere gli opportuni provvedimenti per analizzare, prevenire e combattere tale fenomeno;

H. Recognizing, however, that the Commission's proposal dating from 1976 containing a draft to amend the Communities' Treaties so as to permit the adoption of common rules on the protection under criminal law of the financial interests of the Communities has not as yet received a favourable opinion by the Council, but that in the light of recent developments there might be reason to re-examine the merits of this proposal;

H. Riconoscendo, tuttavia, che la proposta della Commissione del 1976 che contiene un progetto per modificare i trattati delle Comunità ai fini dell'adozione di una regolamentazione comune sulla tutela penale degli interessi finanziari delle Comunità non ha ancora ricevuto il parere favorevole del Consiglio, ma che, alla luce dei recenti sviluppi, può rivelarsi opportuno riesaminare la sostanza di tale proposta;

I. Stressing their interest in the development which was started in the framework of the Intergovernmental Conference on Political Union and trusting that suitable attention will be paid to problems related to the combating of fraud against the financial interests of the Communities;

I. Sottolineando il loro interesse per lo sviluppo avviato nel contesto della Conferenza intergovernativa sull'Unione politica e fiduciosi che si presterà la necessaria attenzione ai problemi connessi con la lotta contro le frodi a danno degli interessi finanziari delle Comunità;

J. Recognizing that in the context of Political Union a more clearly defined structure for consideration by Member States of matters of common interest in areas of justice and internal affairs is envisaged, that measures to combat fraud against the financial interests of the Communities would be appropriately dealt with in that framework, and that nothing in this Resolution is intended to prejudice decisions to be taken in that framework:

Riconoscendo che nel contesto dell'Unione politica è previsto che gli Stati membri prendano in considerazione una struttura più chiaramente definita dei problemi di interesse comune nei settori della giustizia e degli affari interni, che i provvedimenti volti a combattere le frodi commesse ai danni delle Comunità sarebbero adeguatamente trattati in tale ambito e che nella presente risoluzione non esiste alcuna intenzione di pregiudicare le decisioni da prendere in tale ambito;

1. Take the view that combating fraud of an international dimension should be one of the first topics to be addressed under the new arrangements which it is hoped will emerge from the Intergovernmental Conference and that in this perspective the points cited below should be noted;

Ritengono che la lotta contro le frodi su scala internazionale debba essere uno dei punti principali da trattare in base ai nuovi accordi che si spera emergeranno dalla conferenza intergovernativa e che in questa prospettiva debbano essere presi in considerazione i punti menzionati qui di seguito;

2. Welcome the proposals to bring about:

2. Si compiacciono delle proposte intese a conseguire:

(a) a form of voluntary cooperation among interested Member States for setting up an easily and generally accessible documentation network for scientific information relating to cross-border crime, including fraud at Community level; and

a) una forma di cooperazione volontaria tra Stati membri interessati, volta ad attuare una rete di documentazione su scala europea a tutti accessibile con facilità, riguardante le informazioni scientifiche sulla criminalità transfrontaliera comprese le frodi a livello comunitario e

(b) improved contacts on a European scale in respect of projects for scientific research into such forms of cross-border crime;

b) migliori contatti su scala europea per quanto riguarda progetti nel settore della ricerca scientifica in fatto di dette forme di criminalità transfrontaliera;

3. Have noted with interest the report submitted to them on the relationship between Community law and criminal law, the report being the result of a study by and ad hoc group of government experts in the context of European Political Cooperation;

3. Hanno preso atto con interesse della relazione a loro presentata sui rapporti esistenti tra il diritto comunitario e il diritto penale, relazione nata da uno studio effettuato da un Gruppo ad hoc di esperti governativi nell'ambito della Cooperazione Politica Europea;

4. Are of the opinion that the study needs to be continued, taking into account the judgments of the Court of Justice in cases which are still pending and other relevant legal developments and provisionally invite the ad hoc group of government experts in the context of European Political Cooperation to pursue this task until further decisions are taken in the light of the new structures resulting from the Intergovernmental Conference on Political Union;

4. Ritengono che lo studio suddetto debba essere proseguito, tenendo conto delle sentenze della Corte di giustizia nelle cause pendenti e di altri sviluppi giuridici attinenti ed invitano per ora il Gruppo ad hoc degli esperti governativi nel contesto della cooperazione politica europea a proseguire questo compito, fino a che saranno prese ulteriori decisioni, sulla base delle nuove strutture che emergeranno dalla Conferenza intergovernativa sulla Unione politica;

5. Instruct the ad hoc Working Party of the Council to re-examine, in the meantime, the Commission's proposal dating from 1976 for a draft to amend the Communities' Treaties so as to permit the adoption of common rules on the protection under criminal law of the financial interests of the Communities, taking into account recent developments in order to evaluate its usefulness and actuality;

Incaricano il Gruppo ad hoc del Consiglio di riesaminare contemporaneamente la proposta della Commissione del 1976 intesa a modificare i trattati comunitari per rendere possibile l'adozione di una regolamentazione comune sulla tutela penale degli interessi finanziari delle Comunità, tenendo conto dei recenti sviluppi per valutarne l'utilità e l'attualità;

6. Take the view that the Member States should not simply adopt for themselves the necessary general or specific measures to ensure the upholding of Community law and effective operation of the Communities themselves, but that it is likewise important to have in place an effectively functioning system of instruments for administrative and criminal cooperation for the purposes of preventing and combating infringements of Community law and of other practices by which the interests of the Communities are damaged;

Ritengono che gli Stati membri non debbano semplicemente adottare ciascuno per se stesso le necessarie misure generali e specifiche atte ad assicurare l'affermazione del diritto comunitario e il funzionamento efficiente delle Comunità, ma che sia altrettanto importante porre in essere un sistema valido ed efficiente di strumenti per una cooperazione amministrativa e penale con apporti reciproci ai fini della prevenzione e della lotta contro le infrazioni del diritto comunitario e altre pratiche che ledono gli interessi delle Comunità;

7. Invite those Member States which have not yet done so to consider becoming party, as soon as possible, to the relevant Conventions in the field of judicial cooperation in criminal matters;

7. Invitano gli Stati membri che ancora non lo abbiano fatto a prendere in considerazione la possibilità di sottoscrivere al più presto le pertinenti convenzioni nel campo della cooperazione giudiziaria in materia di diritto penale;

8. State that cooperation between the Member States in the prevention and combating of fraudulent practices by which harm is done to the financial interests of the Communities is enhanced by a compatibility of norms in the legal and administrative provisions of the Member States by which such conduct is sanctioned;

8. Dichiarano che la cooperazione tra gli Stati membri in materia di prevenzione e lotta contro le pratiche fraudolente ai danni degli interessi finanziari delle Comunità è resa più efficace dalla compatibilità delle norme contenute nelle disposizioni giuridiche e amministrative degli Stati membri a cui spetta infliggere sanzioni in materia;

9. Emphasize the urgency for the Commission to complete, in the course of 1992, the study currently undertaken and request the Commission to conduct, as soon as possible, a comparative law study of the abovementioned legal and administrative provisions of the Member States, in order to see whether action should be taken to achieve greater compatibility of these provisions;

Sottolineano l'urgenza che la Commissione completi nel corso del 1992 lo studio in corso e invitano la Commissione ad effettuare al più presto uno studio di diritto comparato sulle suddette disposizioni giuridiche e amministrative degli Stati membri per verificare se si possano prendere iniziative per realizzare una maggiore compatibilità di dette disposizioni;

10. Request the Commission to pay particular attention in such a comparative study to the following aspects:

10. Invitano la Commissione a dedicare, in detto studio comparato, particolare attenzione ai seguenti elementi:

1. definition of concept of fraud (levy fraud, subsidy fraud);

1) definizione del concetto di frode (frode fiscale e frode sulle sovvenzioni),

2. components of offence;

2) elementi costitutivi del reato,

3. territorial applicability;

3) applicabilità territoriale,

4. applicable sanctions;

4) sanzioni applicabili,

5. liability, including liability for legal persons;

5) responsabilità, compresa la responsabilità per le persone giuridiche;

11. Invite the Commission to submit the results of these studies to the appropriate forum as soon as possible but not later than in the first part of 1993.

11. Invita la Commissione a presentare in sede opportuna i risultati di questi studi al più presto e non più tardi che nel primo semestre del 1993.

12. This resolution does not prejudice the question of distribution of competence between the Community and the Member States.

12. La presente risoluzione lascia impregiudicata la ripartizione delle competenze tra la Comunità e gli Stati membri.
