Having regard to the Treaty establishing the European Community, and in particular Article 61(c) and Article 67(1) thereof,

(1) Within the framework of the objective of the Community to establish progressively an area of freedom, security and justice in which the free movement of persons is ensured, Regulation (EC) No 44/2001(4) was adopted on 22 December 2000 and has entered into force on 1 March 2002.
|
(1) Nel quadro dell'obiettivo della Comunità di istituire progressivamente uno spazio di libertà, sicurezza e giustizia nel quale sia garantita la libera circolazione delle persone, il 22 dicembre 2000 è stato adottato il regolamento (CE) n. 44/2001 del Consiglio(4), che è entrato in vigore il 1o marzo 2002.

(2) Regulation (EC) No 44/2001 provides for rules on jurisdiction in matters relating to individual contracts of employment. In particular, Article 20 of that Regulation provides for a rule on jurisdiction for proceedings brought by the employer. Judgments issued in accordance with Article 20 will be recognised and enforced under that Regulation.

(2) Il regolamento (CE) n. 44/2001 prevede norme riguardanti la competenza in materia di contratti individuali di lavoro. In particolare, l'articolo 20 di detto regolamento stabilisce una norma sulla competenza per le azioni proposte dal datore di lavoro. Le decisioni emesse in conformità dell'articolo 20 sono riconosciute ed eseguite in virtù di tale regolamento.

(3) Due to difficulties that have arisen in trans-border labour relationships, it has become necessary to amend Article 20 of Regulation (EC) No 44/2001. According to the labour law of some Member States, as regards the termination of an employment contract, employers have the option to petition for judicial annulment instead of a dismissal, and in some cases, judicial annulment is mandatory. Judicial annulments offer advantages for both the employee and the employer.

(3) Tenuto conto delle difficoltà sorte relativamente ai contratti di lavoro transfrontalieri, si è reso necessario modificare l'articolo 20 del regolamento (CE) n. 44/2001. In virtù del diritto del lavoro di alcuni Stati membri, per quanto riguarda la risoluzione del contratto di lavoro, il datore di lavoro ha anche la possibilità, anziché procedere al licenziamento del lavoratore, di chiedere al giudice di risolvere giudizialmente il contratto di lavoro e, in alcuni casi, la risoluzione giudiziale è obbligatoria. La risoluzione giudiziale del contratto di lavoro presenta dei vantaggi sia per il datore di lavoro che per il lavoratore.

(4) Considering the principle of free movement of workers and with a view to improving the conditions for judicial annulments, the employer is given the option to bring proceedings in the courts for the place where the employee habitually carries out his work. These courts have a particularly close link to the dispute, the point of connection generally being the same for the determination of the applicable law, and generally have the best possibilities to obtain information,

(4) Tenuto conto del principio della libera circolazione dei lavoratori e al fine di migliorare le condizioni per quanto concerne le risoluzioni giudiziali il datore di lavoro può proporre l'azione davanti al giudice del luogo in cui il lavoratore svolge abitualmente la propria attività. Tale giudice è particolarmente adatto a conoscere della controversia, in quanto il punto di collegamento è in genere lo stesso per la determinazione della legge applicabile, e il suddetto giudice ha le migliori possibilità di ottenere informazioni,

HAS ADOPTED THIS REGULATION:

In Article 20 of Regulation (EC) No 44/2001 the following paragraph shall be inserted: "1a. Proceedings brought by an employer to terminate a contract of employment may also be brought in the courts for the place where the employee habitually carries out his work or, if the employee does not habitually carry out his work in any one country, in the courts for the place where the business which engaged the employee is situated."

Nell'articolo 20 del regolamento (CE) n. 44/2001 è inserito il paragrafo seguente: "1 bis L'azione del datore di lavoro per la risoluzione del contratto di lavoro può altresì essere proposta davanti al giudice del luogo in cui il lavoratore svolge abitualmente la propria attività o, qualora il lavoratore non svolga abitualmente la propria attività in un solo paese, davanti al giudice del luogo in cui è situata la sede d'attività presso la quale è stato assunto."

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Communities.
|
Il presente regolamento entra in vigore il giorno successivo alla pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Regulation shall be binding in its entirety and directly applicable in the Member States in accordance with the Treaty establishing the European Community.
|
Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile negli Stati membri in base al trattato che istituisce la Comunità europea.
