THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 96/49/EC of 23 July 1996 on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail(1), and in particular Article 8 thereof,

vista la direttiva 96/49/CE del Consiglio, del 23 luglio 1996 , per il ravvicinamento delle legislazioni degli Stati membri relative al trasporto di merci pericolose per ferrovia(1), in particolare l'articolo 8,

Whereas:

considerando quanto segue:

(1) The Annex to Directive 96/49/EC refers to the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID), as applicable with effect from 1 July 2003 .

(1) L'allegato alla direttiva 96/49/CE rimanda al regolamento concernente il trasporto internazionale di merci pericolose per ferrovia (RID), in vigore a decorrere dal 1° luglio 2003 .

(2) The RID is normally updated every two years, the latest update being in force from 1 January 2003 , with a transitional period up to 30 June 2003 .

(2) Il RID normalmente è aggiornato con cadenza biennale. L'ultimo aggiornamento è entrato in vigore il 1° gennaio 2003 e prevede un periodo transitorio fino al 30 giugno 2003 .

(3) Exceptionally the RID was updated again after one year so that the amended version entered into force on 1 January 2004 .

(3) Eccezionalmente il RID è stato nuovamente aggiornato dopo un anno, cosicché la versione modificata è entrata in vigore il 1° gennaio 2004 .

(4) It is therefore necessary to amend the Annex to Directive 96/49/EC.

(5) The measures provided for in this Directive are in accordance with the opinion of the Committee on the transport of dangerous goods referred to in Article 9 of Directive 96/49/EC,

HAS ADOPTED THIS DIRECTIVE:

Article 1

The Annex to Directive 96/49/EC is replaced by the following:

L'allegato alla direttiva 96/49/CE è sostituito dal seguente:

«Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) appearing in Annex I to Appendix B to the Convention concerning International Carriage by Rail (COTIF), as applicable with effect from 1 January 2004 , it being understood that the terms «contracting party» and «the States or the railways» will be replaced by the term «Member State» .

«Regolamento concernente il trasporto internazionale di merci pericolose per ferrovia (RID) di cui all'allegato I dell'appendice B della Convenzione relativa ai trasporti internazionali per ferrovia (COTIF), in vigore a decorrere dal 1° gennaio 2004 , fermo restando che le espressioni «parte contraente» e «gli Stati o le ferrovie» sono sostituti da «Stato membro» .

The text of the amendments of the 2004 version of the RID will be published as soon as it is available in all official languages of the Community.»

Le versioni nelle lingue ufficiali della Comunità saranno pubblicate non appena sarà disponibile in tali lingue il testo delle modifiche della versione 2004 del RID.»

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 October 2004 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

1. Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari ed amministrative necessarie per conformarsi alla presente direttiva entro il 1° ottobre 2004 . Essi comunicano immediatamente alla Commissione il testo di tali disposizioni nonché una tavola di concordanza tra queste ultime e la presente direttiva.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità del riferimento sono decise dagli Stati membri.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Gli Stati membri comunicano alla Commissione il testo delle disposizioni essenziali di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.

Article 3

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea .

This Directive is addressed to the Member States.
