COUNCIL DIRECTIVE of 19 December 1978 on the exemption from taxes of imports of small consignments of goods of a non-commercial character from third countries (78/1035/EEC)

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

DIRETTIVA DEL CONSIGLIO

Having regard to the Treaty establishing the European Economic Community, and in particular Article 99 thereof,

relativa alle franchigie fiscali applicabili all ' importazione di merci oggetto di piccole spedizioni a carattere non commerciale provenienti dai paesi terzi

IL CONSIGLIO DELLE COMUNITA EUROPEE ,

Whereas Council Directive 74/651/EEC of 19 December 1974 on the tax reliefs to be allowed on the importation of goods in small consignments of a non-commercial character within the Community (4), as amended by Directive 78/1034/EEC (5), laid down the limits and conditions under which such consignments may be exempted from value added tax and from any other taxes on consumption;

visto il trattato che istituisce la Comunità economica europea , in particolare l ' articolo 99 ,

Whereas Community rules should likewise be laid down for the exemption from turnover taxes and excise duties of imports of small consignments of a similar nature from third countries;

vista la proposta della Commissione ( 1 ) ,

Whereas to that end the limits within which such exemption is to be applied should, for practical reasons, be as far as possible the same as those laid down by the arrangements for exemption from customs duties in Council Regulation (EEC) No 3060/78 (6);

Whereas finally it appears necessary to set special limits for certain products because of the high level of taxation to which they are at present subject in the Member States,

HAS ADOPTED THIS DIRECTIVE:

considerando che la direttiva 74/651/CEE del Consiglio , del 19 dicembre 1974 , relativa alle franchigie fiscali applicabili all ' importazione delle merci oggetto di piccole spedizioni a carattere non commerciale all ' interno della Comunità ( 4 ) , modificata dalla direttiva 78/1034/CEE ( 5 ) , ha fissato i limiti e le condizioni in base ai quali le suddette spedizioni possono essere esentate dall ' imposta sul valore aggiunto nonché , eventualmente , da altre imposte di consumo ;

considerando che conviene inoltre fissare le norme comunitarie che permettano di esentare dalle imposte sulla cifra d ' affari e dalle imposizioni indirette interne l ' importazione in piccole spedizioni della stessa natura provenienti da paesi terzi ;

Article 1

considerando a questo riguardo che per ragioni pratiche i limiti entro i quali si applica questa franchigia devono essere per quanto possibile uguali a quelli previsti per i regimi di franchigia doganale dal regolamento ( CEE ) n . 3060/78 ( 6 ) ;

1. Goods in small consignments of a non-commercial character sent from a third country by private persons to other private persons in a Member State shall be exempt on importation from turnover tax and excise duty.

considerando che sembra infine necessario prevedere limiti particolari per alcuni prodotti a causa dell ' alto livello d imposta al quale sono attualmente assoggettati negli Stati membri ,

2. For the purposes of paragraph 1, "small consignments of a non-commercial character" means consignments which: - are of an occasional nature,

HA ADOTTATO LA PRESENTE DIRETTIVA :

- contain only goods intended for the personal or family use of the consignees, the nature and quantity of which do not indicate that they are being imported for any commercial purpose,

- contain goods with a total value not exceeding 30 EUA.

1 . Le merci oggetto di piccole spedizioni , prive di carattere commerciale , spedite da un paese terzo da un privato e destinate ad un altro privato che si trovi in uno Stato membro , godono all ' importazione di una franchigia dalle imposte sulla cifra di affari e dalle altre imposizioni indirette interne .

- are sent by the sender to the consignee without payment of any kind.

2 . Ai sensi del paragrafo 1 , si considerano come " piccole spedizioni prive di carattere commerciale " le spedizioni che nel contempo :

_ presentano carattere occasionale ;

_ riguardano esclusivamente merci riservate all ' uso personale o familiare dei destinatari e che , per la loro natura o quantità , escludano qualsiasi interesse di ordine commerciale ;

_ riguardano merci il cui valore globale non superi 30 unità di conto europee ;

Article 2

_ sono inviate dallo speditore al destinatario senza pagamento di alcun genere .

1. Article 1 shall apply to the goods listed below subject to the following quantitative limits: (a) tobacco products

50 cigarettes,

1 . L ' articolo 1 si applica alle merci sotto elencate soltanto entro i limiti quantitativi seguenti :

or 25 cigarillos (cigars of a maximum weight of three grams each),

a ) prodotti del tabacco :

or 10 cigars,

50 sigarette

or 50 grams of smoking tobacco;

oppure 25 sigaretti ( sigari del peso massimo di 3 grammi al pezzo )

(b) alcoholic beverages - distilled beverages and spirits of an alcoholic strength exceeding 22º : one standard bottle (not exceeding one litre),

oppure 10 sigari

or

oppure 50 grammi di tabacco da fumo ;

- distilled beverages and spirits and aperitifs with a wine or alcohol base, of an alcoholic strength not exceeding 22º ; sparkling wines and liqueur wines : one standard bottle (not exceeding one litre),

b ) bevande alcoliche :

or

_ bevande distillate e bevande alcoliche di gradazione alcolica superiore a 22 * : 1 bottiglia standard ( sino a 1 litro )

- still wines : two litres;

oppure

_ bevande distillate e bevande alcoliche , aperitivi a base di vino o di alcole , di gradazione alcolica pari o inferiore a 22 * ; vini spumanti , vini liquorosi : 1 bottiglia standard ( sino a 1 litro )

oppure

(c) perfumes : 50 grams,

_ vini tranquilli : 2 litri ;

or

c ) profumi :

oppure

or

2. The Member States shall have the right to reduce the quantities of the products referred to in paragraph 1 eligible for exemption from turnover tax and excise duties, or to abolish exemption for such products altogether.

3. Under no circumstances shall tax exemption granted for small consignments from non-member countries exceed that applicable to small consignments sent within the Community.

2 . Gli Stati membri hanno la facoltà di ridurre o di escludere dal beneficio della franchigia dalle imposte sulla cifra d ' affari e dalle imposizioni indirette interne i prodotti di cui al paragrafo 1 .

Article 3

3 . In nessun caso le franchigie fiscali accordate alle piccole spedizioni in provenienza da paesi terzi possono essere superiori a quelle applicabili alle piccole spedizioni all ' interno della Comunità .

Goods listed in Article 2 contained in a small consignment of a non-commercial character in quantities exceeding those laid down in the said Article shall be excluded in their entirety from exemption.

Articolo 3

Le merci menzionate all ' articolo 2 , che sono oggetto di una piccola spedizione priva di carattere commerciale , in quantità superiore alle quantità previste in tale articolo , sono totalmente escluse dal beneficio della franchigia .

Article 4

Articolo 4

1. For the purpose of this Directive, "European unit of account" (EUA) shall be as defined in the Financial Regulation of 21 December 1977 (1).

1 . Ai fini dell ' applicazione della presente direttiva , l ' unità di conto europea ( UCE ) è quella definita dal regolamento finanziario del 21 dicembre 1977 ( 7 ) .

2. The EUA equivalent in national currency which shall apply for the implementation of this Directive shall be fixed once a year. The rates applicable shall be those obtaining on the first working day of October with effect from 1 January of the following year.

2 . Il controvalore dell ' UCE in moneta nazionale da prendere in considerazione per l ' applicazione della present direttiva è fissato una volta l ' anno . I tassi da applicare sono quelli del primo giorno lavorativo del mese di ottobre , con effetto dal 1 * gennaio dell ' anno successivo

3. Member States may round off the amounts in national currency resulting from the conversion of the amounts in European units of account provided for in Article 1 (2), provided such rounding-off does not exceed 2 EUA.

3 . Gli Stati membri hanno la facoltà di arrotondare gli importi in moneta nazionale risultanti dal cambio dell ' importo in unità di conto previsto all ' articolo 1 , paragrafo 2 , purché tale arrotondamento non sia superiore a 2 UCE .

4. Member States may maintain the amount of the exemption in force at the time of the annual adjustment provided for in paragraph 2 if, prior to the rounding-off provided for in paragraph 3, conversion of the amount of the exemption expressed in EUA would result in a change of less than 5 % in the exemption expressed in national currency.

4 . Gli Stati membri hanno la facoltà di mantenere l ' importo della franchigia in vigore al momento dell ' adattamento annuo di cui al paragrafo 2 , qualora la conversione dell ' importo della franchigia espresso in UCE comporti , prima dell ' arrotondamento di cui al paragrafo 3 una modifica della franchigia espressa in moneta nazionale inferiore al 5 % .

Article 5

1 . Gli Stati membri mettono in vigore le misure necessarie per conformarsi alla presente direttiva entro il 1 * gennaio 1979 .

1. Member States shall bring into force the measures necessary to comply with this Directive no later than 1 January 1979.

2 . Gli Stati membri informano la Commissione delle disposizioni che essi adottano per l ' applicazione della presente direttiva . La Commissione ne informa gli altri Stati membri .

2. Member States shall inform the Commission of the provisions which they adopt to implement this Directive. The Commission shall inform the other Member States thereof.

Articolo 6

Gli Stati membri sono destinatari della presente direttiva .
