Whereas liberalization measures adopted by the Council in July 1990 represent a further step towards a fully developed common air transport policy;

Whereas common action in the field of the protection of the interests of air transport users is required, in order to ensure a well-balanced development in the light of the radically changing environment in which air carriers have to operate;

Whereas current practice in the field of denied-boarding compensation differs substantially between air carriers;

Whereas certain common minimum standards in the field of denied-boarding compensation should ensure that the quality of air carriers' services is maintained in a context of increased competition;

considerando che talune norme minime comuni in materia di compensazione per negato imbarco contribuiranno a garantire il mantenimento della qualità dei servizi offerti dai vettori aerei in un contesto di maggiore concorrenza;

Whereas an air carrier should be obliged to establish rules for boarding in the event of an overbooked flight;

considerando che i vettori aerei devono essere tenuti a fissare regole per l'imbarco in caso di sovraprenotazione;

Whereas in the event of boarding being denied the rights of passengers should be defined;

considerando che occorre fissare i diritti dei passeggeri in caso di negato imbarco;

Whereas air carriers should be obliged to pay compensation and to provide additional services to passengers who are denied boarding;

considerando che i vettori aerei devono essere tenuti a corrispondere compensazioni e a fornire servizi aggiuntivi ai passeggeri cui viene rifiutato l'imbarco;

Whereas passengers should be clearly informed about applicable rules,

considerando che i passeggeri devono essere chiaramente informati circa le norme applicabili,

HAS ADOPTED THIS REGULATION:

HA ADOTTATO IL PRESENTE REGOLAMENTO:

Article 1

Articolo 1

This Regulation establishes common minimum rules applicable where passengers are denied access to an overbooked scheduled flight for which they have a valid ticket and a confirmed reservation departing from an airport located in the territory of a Member State to which the Treaty applies, irrespective of the State where the air carrier is established, the nationality of the passenger and the point of destination.

Il presente regolamento stabilisce norme minime comuni applicabili nel caso in cui venga negato l'accesso a un volo di linea sovraprenotato a passeggeri in possesso di biglietto valido e di prenotazione confermata, in partenza da un aeroporto situato nel territorio di uno Stato membro e al quale si applica il trattato, indipendentemente dallo Stato in cui ha sede il vettore aereo, dalla nazionalità del passeggero e dal luogo di destinazione.

Article 2

Articolo 2

For the purposes of this Regulation:

Ai sensi del presente regolamento si intende per:

(a) 'denied boarding' means a refusal to accommodate passengers on a flight although they have:

a) « negato imbarco », il rifiuto di accogliere passeggeri su un volo sebbene i medesimi:

- a valid ticket,

- siano in possesso di un biglietto valido,

- a confirmed reservation on that flight, and

- abbiano una prenotazione confermata su detto volo e

- presented themselves for check-in within the required time limit and as stipulated;

- si siano presentati nel termine e nelle condizioni richiesti all'accettazione;

(b) 'confirmed reservation' means that a ticket sold by the air carrier or its authorized travel agent contains:

b) « prenotazione confermata », un biglietto di viaggio venduto dal vettore aereo o dal suo agente di viaggio autorizzato che rechi:

- a specification of the number, date and time of the flight, and

- l'indicazione del numero, della data e dell'ora del volo e

- the notation 'OK', or any other entry, in the appropriate space on the ticket signifying the registration by the air carrier as well as the express confirmation by the air carrier of the reservation;

- l'annotazione « OK » o qualsiasi altra annotazione nell'apposito spazio sul biglietto indicante la registrazione da parte del vettore aereo nonché l'espressa conferma della prenotazione da parte del vettore aereo medesimo;

(c) 'scheduled flight' means a flight possessing all of the following characteristics:

c) « volo di linea », un volo che presenti tutte le seguenti caratteristiche:

- it is performed by aircraft for the transport of passengers or passengers and cargo and/or mail for remuneration, in such a manner that, for each flight, seats are available for purchase by members of the public, either directly from the carrier or from its authorized agents,

- è effettuato, a titolo oneroso, con un aeromobile adibito al trasporto di passeggeri o di passeggeri e di merci e/o di posta, in condizioni tali che i posti siano messi in vendita al pubblico direttamente dal vettore aereo o dai suoi agenti autorizzati e

- it is operated to serve traffic between two or more points, either:

- è organizzato in modo da assicurare il traffico tra due o più punti:

(i) according to a published timetable; or

i) in base ad un orario pubblicato, oppure

(ii) with flights so regular or frequent that they constitute a recognizably systematic series;

ii) con voli tanto regolari o frequenti da costituire una serie sistematica evidente;

(d) 'overbooked flight' means a flight where the number of passengers holding a confirmed reservation and presenting themselves for check-in within the required time limit and as stipulated exceeds the number of available seats on that flight;

d) « volo sovraprenotato », un volo in cui il numero di passeggeri in possesso di prenotazione confermata e che si presentano all'accettazione entro il termine e nelle condizioni richiesti supera il numero di posti disponibili sul volo medesimo;

(e) 'volunteer' means a person who has:

e) « volontario », una persona che:

- a valid ticket,

- è in possesso di biglietto valido,

- a confirmed reservation, and

- ha una prenotazione confermata,

- presented himself for check-in within the required time limit and as stipulated and who responds positively to the air carrier's call for passengers being prepared to surrender their confirmed reservation in exchange for compensation;

- si presenta entro il termine e nelle condizioni richiesti all'accettazione e risponde affermativamente alla domanda del vettore aereo se vi siano passeggeri disposti a rinunziare alla propria prenotazione confermata in cambio di una compensazione;

(f) 'final destination' means the destination on the flight coupon presented at the check-in counter or, in the case of successive flights, on the last flight coupon of the ticket. Connecting flights which can be carried out without difficulties although a delay has been caused by denied boarding are not taken into account.

f) « destinazione finale », la destinazione indicata sul biglietto presentato all'accettazione o, in caso di voli successivi, sull'ultimo tagliando di volo del biglietto. I voli di collegamento che possono essere effettuati senza difficoltà anche quando il negato imbarco abbia provocato un ritardo non sono presi in considerazione.

Article 3

Articolo 3

1. The air carrier must lay down the rules which it will follow for boarding in the event of an overbooked flight. It shall notify these rules and any changes therein to the Member State concerned and to the Commission, which shall make them available to the other Member States. Any such changes shall enter into force one month after their notification.

1. Il vettore aereo deve fissare le regole che intende seguire per l'imbarco dei passeggeri in caso di volo sovraprenotato. Esso notifica dette regole e tutte le eventuali modifiche allo Stato membro interessato e alla Commissione, che le metterà a disposizione degli altri Stati membri. Le eventuali modifiche entrano in vigore un mese dopo la notifica.

2. The rules referred to in paragraph 1 shall be made available to the public at the carrier's agencies and check-in counters.

2. Le regole di cui al paragrafo 1 saranno poste a disposizione del pubblico nelle agenzie e presso i banchi di accettazione del vettore aereo.

3. The rules referred to in paragraph 1 should include the possibility of a call for volunteers prepared not to board.

4. In any event the air carrier should take into consideration the interests of passengers who must be given boarding priority for legitimate reasons, such as handicapped persons and unaccompanied children.

4. In ogni caso, il vettore aereo dovrebbe prendere in considerazione gli interessi dei passeggeri che devono avere la precedenza all'imbarco per motivi legittimi, come le persone con difficoltà di movimento e i bambini non accompagnati.

Article 4

1. In the event of boarding being denied, a passenger shall have the choice between:

- reimbursement without penalty of the cost of the ticket for the part of the journey not made, or

- il rimborso senza penali del prezzo del biglietto per la parte del viaggio non effettuata,

- re-routing to his final destination at the earliest opportunity, or

- un volo alternativo quanto prima possibile fino alla destinazione finale, o

- re-routing at a later date at the passenger's convenience.

2. Irrespective of the passenger's choice mentioned in the case referred to in paragraph 1, the air carrier shall, immediately after boarding has been denied, pay minimum compensation, without prejudice to paragraphs 3 and 4, amounting to:

having regard to the final destination specified in the ticket.

3. Where the air carrier offers re-routing to the final destination on an alternative flight, the arrival time of which does not exceed the scheduled arrival time of the flight originally booked by two hours for flights of up to 3 500 km, and by four hours for flights of more than 3 500 km, the compensation provided for in paragraph 2 above may be reduced by 50 %.

Qualora il vettore offra un volo alternativo sino alla destinazione finale la cui ora d'arrivo non ecceda quella programmata per il volo inizialmente riservato di 2 ore per collegamenti sino a 3 500 km e di 4 ore per collegamenti oltre i 3 500 km, le compensazioni di cui al paragrafo 2 possono essere ridotte del 50 %.

4. The amounts of compensation need not exceed the price of the ticket in respect of the final destination.

4. Gli importi delle compensazioni possono limitarsi al prezzo del biglietto corrispondente alla destinazione finale.

5. The compensation shall be paid in cash or, in agreement with the passenger, in travel vouchers and/or other services.

5. Le compensazioni sono pagate in contanti o, d'accordo con il passeggero, con buoni di viaggio e/o altri servizi.

6. If, on an overbooked flight, a passenger agrees to be placed in a class lower than that for which a ticket has been purchased, he shall be entitled to reimbursement of the difference in price.

6. Qualora su un volo sovraprenotato il passeggero accetti di viaggiare in una classe inferiore a quella per la quale è stato pagato il biglietto, egli ha diritto a un rimborso della differenza di prezzo.

7. The distances given in paragraphs 2 and 3 shall be measured by the great circle track method (great circle route).

7. Le distanze indicate ai paragrafi 2 e 3 sono misurate in funzione del metodo della distanza del cerchio massimo (rotta ortodromica).

Article 5

Articolo 5

1. In the event of boarding being denied on a flight sold as part of a package tour, the air carrier shall be obliged to compensate the tour operator who has concluded a contract with the passenger and who is liable to him for the proper performance of the contract for the said package tour under Council Directive 90/314/EEC of 13 June 1990 on package travel, package holidays and package tours [4].

In caso di negato imbarco nel quadro di un viaggio « tutto compreso » il vettore aereo è tenuto al versamento di una compensazione all'operatore che ha concluso un contratto con il passeggero ed è responsabile nei suoi confronti dell'adempimento del contratto per tale viaggio « tutto compreso », in forza della direttiva 90/314/CEE del Consiglio, del 13 giugno 1990, concernente i viaggi, le vacanze ed i circuiti « tutto compreso » [4].

2. Without prejudice to the rights and obligations arising under Directive 90/314/EEC, the tour operator shall be obliged to pass on to the passenger the sums collected under paragraph 1.

2. Senza pregiudizio dei diritti e degli obblighi a norma della direttiva 90/314/CEE, l'operatore è tenuto a trasferire al passeggero le somme ricevute conformemente al paragrafo 1.

Article 6

Articolo 6

1. Apart from the minimum compensation amounts set out in Article 4, the air carrier shall offer free of charge to passengers who are denied boarding:

1. Oltre agli importi minimi di compensazione stabiliti all'articolo 4, il vettore aereo offre a titolo gratuito ai passeggeri cui è stato negato l'imbarco:

(a) the expenses for a telephone call and/or telex/fax message to the point of destination;

a) il rimborso delle spese per una telefonata e/o un messaggio a mezzo telescritto o telecopia al punto di destinazione;

(b) meals and refreshments in a reasonable relation to the waiting time;

b) pasti e rinfreschi in congrua relazione alla durata dell'attesa;

(c) hotel accommodation in cases where an additional stay of one or more nights is necessary.

c) la sistemazione in albergo nei casi in cui siano necessari anche uno o più pernottamenti.

2. When a town, city or region is served by several airports and an air carrier offers a passenger, who has been denied boarding, a flight to an airport other than the destination airport that the passenger had booked, the cost of travelling between the alternative airports or to an alternative close-by destination, agreed with the passenger, shall be borne by the air carrier.

2. Qualora una città o una regione sia servita da più aeroporti ed un vettore aereo offra ad un passeggero cui sia stato negato l'imbarco un volo per un aeroporto alternativo all'aeroporto di destinazione prenotato dal passeggero, le spese di spostamento tra gli aeroporti alternativi o verso una destinazione alternativa in prossimità, convenuta con il passeggero, sono a carico del vettore aereo.

Article 7

Articolo 7

The air carrier shall not be obliged to pay denied-boarding compensation in cases where the passenger is travelling free of charge or at reduced fares not available directly or indirectly to the public.

Il vettore aereo non è tenuto a versare alcuna compensazione per il negato imbarco qualora il passeggero viaggi gratuitamente o a tariffe ridotte non disponibili, direttamente o indirettamente, al pubblico.

Article 8

Articolo 8

Air carriers shall provide each passenger affected by denied boarding with a form setting out the denied-boarding compensation rules.

I vettori aerei devono fornire a ciascun passeggero cui è stato negato l'imbarco un formulario recante le regole di compensazione per negato imbarco.

Article 9

Articolo 9

1. This Regulation shall apply without prejudice to subsequent application to the courts having jurisdiction with a view to further compensation.

1. Le disposizioni del presente regolamento lasciano impregiudicato l'ulteriore ricorso alle giurisdizioni competenti per risarcimenti supplementari.

2. Paragraph 1 shall not apply to the volunteers as defined in Article 2 (e) who have accepted compensation under the rules referred to in Article 3.

2. Il paragrafo 1 non si applica ai volontari definiti all'articolo 2, lettera e) che hanno accettato una compensazione in applicazione delle regole di cui all'articolo 3.

Article 10

Articolo 10

This Regulation shall enter into force two months after the date of its publication in the Official Journal of the European Communities.

Il presente regolamento entra in vigore due mesi a decorrere dalla pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.
