EXPLANATORY MEMORANDUM

Contestualmente alla presente proposta, la Commissione adotta una comunicazione sull'istituzione di un programma comune di reinsediamento UE (COM (2009)) che ne chiarisce la motivazione, gli obiettivi, il contesto e il funzionamento. La presente relazione dovrebbe quindi essere letta parallelamente a detta comunicazione, alla quale di seguito si rimanda per evitare ripetizioni superflue.

Together with this proposal, the Commission is adopting a Communication on the establishment of a Joint EU Resettlement Programme (COM (2009)). It explains the grounds, objectives, context and functioning of the Joint EU Resettlement Programme. This Explanatory Memorandum should therefore be read in combination with this Communication. In order to avoid unnecessary duplications reference is made hereunder to this Communication.

La presente proposta è volta a modificare la decisione che istituisce il Fondo europeo per i rifugiati alla luce dell'istituzione di un programma comune di reinsediamento UE. Quanto ai suoi obiettivi, si rimanda alla citata comunicazione sull'istituzione di detto programma (COM (2009)).

The aim of this proposal is to amend the Decision establishing the European Refugee Fund in the light of the establishment of a Joint EU Resettlement Programme. With respect to the objectives of the proposal, further reference is made to the Communication on the establishment of a Joint EU Resettlement Programme (COM (2009)).

Il Fondo europeo per i rifugiati (FER) è stato istituito con decisione n. 573/2007/CE del Parlamento europeo e del Consiglio, del 23 maggio 2007, che istituisce il Fondo europeo per i rifugiati per il periodo 2008-2013, nell'ambito del programma generale "Solidarietà e gestione dei flussi migratori" e che abroga la decisione 2004/904/CE del Consiglio[1], in base all'articolo 63, punto 2, lettera b), del trattato che istituisce la Comunità europea.

The European Refugee Fund (ERF) was set up by Decision No 573/2007/EC of the European Parliament and of the Council of 23 May 2007 establishing the European Refugee Fund for the period 2008 to 2013 as part of the General programme "Solidarity and Management of Migration Flows" and repealing Council Decision 2004/904/EC[1], on the basis of Article 63(2)(b) of the Treaty establishing the European Community.

La presente proposta di decisione del Parlamento europeo e del Consiglio, che modifica la decisione che istituisce il Fondo europeo per i rifugiati per il periodo 2008-2013, e la comunicazione della Commissione al Consiglio e al Parlamento europeo sull'istituzione di un programma comune di reinsediamento UE sono espressione degli sforzi dell'Unione europea per realizzare un programma comune di reinsediamento, e rispondono alla richiesta del Consiglio di presentare una proposta per l'istituzione di tale programma.

This proposal for a Decision of the European Parliament and of the Council, amending the Decision establishing the European Refugee Fund for the period 2008 to 2013, and the Communication of the Commission to the Council and the European Parliament on the establishment of a Joint EU Resettlement Programme are part of the European Union's efforts to establish a Joint EU Resettlement Programme. They are a response to the requests by the Council to come forward with a proposal for the establishment of a Joint EU Resettlement Programme.

Quanto al contesto, agli sviluppi recenti e alle carenze della situazione attuale, si rimanda alla comunicazione sull'istituzione di un programma comune di reinsediamento UE (COM (2009)).

With respect to the background, recent developments and shortcomings of the current situation reference is made to the Communication on the establishment of a Joint EU Resettlement Programme (COM (2009)).

La presente proposta è diretta a modificare la decisione che istituisce il Fondo europeo per i rifugiati alla luce dell'istituzione di un programma comune di reinsediamento UE. L'attuale decisione sul FER III contiene numerose disposizioni relative al reinsediamento.

This proposal aims to amend the Decision establishing the European Refugee Fund in the light of the establishment of a Joint EU Resettlement Programme. The existing Decision on ERF III contains several provisions with regard to resettlement.

La presente proposta è pienamente coerente con le politiche e gli obiettivi individuati negli ultimi anni dall'UE nel settore dell'asilo. La comunicazione sui programmi di protezione regionale, adottata dalla Commissione nel settembre del 2005, ha sottolineato che il reinsediamento dovrebbe essere lo strumento fondamentale per fornire assistenza ai paesi terzi, e che la Commissione avrebbe esaminato l'opportunità di elaborare una proposta per un approccio più strutturato alle attività di reinsediamento. Nel Piano strategico sull'asilo, adottato il 17 giugno 2008, la Commissione ha concluso che si continuerà a lavorare sul reinsediamento per trasformarlo in uno strumento efficace di protezione a disposizione dell'UE, affinché possa soddisfare le esigenze di protezione dei rifugiati nei paesi terzi e dimostrare solidarietà nei confronti dei paesi terzi di primo asilo. In data 24 luglio 2008 il Consiglio ha adottato conclusioni in cui accoglieva favorevolmente la presentazione, da parte della Commissione, del piano strategico sull'asilo contenente la proposta di elaborare un programma comune di reinsediamento UE, a cui gli Stati membri avrebbero potuto partecipare su base volontaria. Il 16 ottobre 2008 il Consiglio europeo ha adottato il Patto europeo sull'immigrazione e l'asilo, in cui si dichiarava che, tra le nuove iniziative da adottare per completare l'istituzione di un regime comune europeo in materia di asilo, occorreva rafforzare la collaborazione con l'UNHCR per garantire una migliore protezione a chi ne facesse richiesta al di fuori del territorio dell'Unione europea, in particolare "progredendo, su base volontaria, verso il reinsediamento nel territorio dell'Unione europea di persone poste sotto la protezione dell'Alto Commissariato delle Nazioni Unite per i rifugiati".

This proposal is fully consistent with the policies and objectives with respect to asylum which were identified by the EU over the past years. In the Communication on Regional Protection Programmes, which was adopted by the Commission in September 2005, it was pointed out that resettlement should be central to providing assistance to third countries, and that the Commission would examine the desirability of making a proposal for a more structured approach to resettlement activities. In the Policy Plan on Asylum, adopted on 17 June 2008, the Commission concluded that resettlement should be further developed and expanded into an effective protection instrument to be used by the EU, so as to meet the protection needs of refugees in third countries and to show solidarity with third countries of first asylum. On 24 July 2008 the Council adopted Conclusions in which it welcomed the presentation by the Commission of the Policy Plan on Asylum foreseeing the presentation of a proposal for the development of a Joint EU Resettlement Programme, in which Member States could participate on a voluntary basis. On 16 October 2008 the European Council adopted the European Pact on Immigration and Asylum. It stated that, among the new initiatives to be taken to complete the establishment of a Common European Asylum System, cooperation with the UNHCR should be strengthened to ensure better protection for people outside the territory of European Union who request protection, in particular by "moving, on a voluntary basis, towards the resettlement within the European Union of people placed under the protection of the Office of the United Nations High Commissioner for Refugees..".

2. RISULTATI DELLE CONSULTAZIONI CON LE PARTI INTERESSATE E VALUTAZIONE D'IMPATTO

2. RESULTS OF CONSULTATIONS WITH THE INTERESTED PARTIES AND IMPACT ASSESSMENT

In seguito a un'ampia consultazione di tutte le parti interessate sulle politiche di asilo, avviata nel giugno del 2007 con la pubblicazione del Libro verde sul futuro regime comune europeo in materie di asilo[2], da cui è emersa l'opinione diffusa secondo cui il reinsediamento dovrebbe assumere un ruolo centrale nelle politiche esterne di asilo dell'UE, nel piano strategico sull'asilo[3] si è concluso che si dovrebbe continuare a lavorare sul reinsediamento per trasformarlo in uno strumento efficace di protezione a disposizione dell'UE.

Following a wide consultation of all relevant stakeholders on asylum policies, launched with the publication in June 2007 of the Green Paper on the future of the Common European Asylum System (CEAS)[2], which revealed a broad acknowledgement that resettlement should play a central role in the external asylum policies of the EU, it was concluded in the Policy Plan on Asylum[3] that resettlement should be further developed and expanded into an effective protection instrument to be used by the EU.

In merito a questa proposta specifica, la Commissione ha consultato tutti gli Stati membri e altri interessati (UNHCR, OIM, ECRE, ONG). Le consultazioni sono state condotte mediante un questionario inviato a tutti gli Stati membri, una riunione specifica con un gruppo di interessati nel dicembre del 2008, una riunione del comitato sull'immigrazione e l'asilo tenutasi nel marzo del 2009 e contributi scritti da parte di UNHCR, IOM e ECRE.

Concerning this specific proposal, the Commission consulted all Member States and other stakeholders (UNHCR, IOM, ECRE, NGOs). The consultations took place through a questionnaire which was sent out to all Member States, a specific meeting held with a group of stakeholders in December 2008, a meeting of the Committee on Immigration and Asylum held in March 2009 and written input provided by UNHCR, IOM and ECRE.

Di questa proposta è stata realizzata una valutazione d'impatto, in cui sono state esaminate tre diverse opzioni strategiche e due subopzioni, compresi i relativi effetti in termini di efficienza nel raggiungere gli obiettivi, nonché gli impatti e la realizzabilità e proporzionalità della proposta a livello politico. La valutazione d'impatto contiene un elenco dettagliato delle parti consultate.

An Impact Assessment with respect to this proposal was carried out, in which three different policy options and two sub-options were analysed as well as the effects of these options in terms of effectiveness in reaching the objectives, the impacts and the political feasibility and proportionality. A detailed list of consulted parties is included in the Impact Assessment.

La misura proposta è diretta a modificare la decisione che istituisce il Fondo europeo per i rifugiati per il periodo 2008-2013, al fine di fornire supporto finanziario supplementare per il reinsediamento delle categorie di persone che l'UE individua annualmente, per mezzo di una decisione adottata dalla Commissione, come priorità comuni di reinsediamento per l'anno successivo. L'individuazione di tali priorità sarà effettuata sulla base di una previsione indicativa delle esigenze di reinsediamento fornita dall'UNHCR ogni anno in primavera (metà marzo), consultando approfonditamente gli esperti di reinsediamento degli Stati membri, l'UNHCR e altri interessati. A tal fine sarà organizzata una riunione annuale a cui parteciperanno questi esperti. Sulla base dei risultati della riunione, la Commissione redigerà una proposta di decisione in cui saranno individuate le priorità comuni di reinsediamento dell'UE, e la presenterà ai fini della consultazione al comitato di gestione del programma generale "Solidarietà e gestione dei flussi migratori", compreso il FER III. Entro venti giorni di calendario dall'adozione della decisione della Commissione sulle priorità di reinsediamento dell'UE, gli Stati membri forniranno alla Commissione stessa la stima del numero delle persone che reinsedieranno nel corso del successivo anno di calendario conformemente a tali priorità annuali comuni. Sulla base di questi impegni, gli Stati membri riceveranno un'assistenza finanziaria supplementare pari a 4 000 euro per persona da reinsediare. Il reinsediamento di categorie specifiche di persone ai sensi delle priorità annuali comuni UE deve essere effettuato su richiesta dell'UNHCR.

The proposed measures seek to amend the Decision establishing the European Refugee Fund for the period 2008 to 2013 in order to provide additional financial support for the resettlement of those categories of persons which are annually identified as common EU resettlement priorities for the following year through a Decision to be taken by the Commission. The identification of these priorities will be done on the basis of an indicative forecast of resettlement needs which will be provided by UNHCR in spring (mid-March) each year and in close consultation with the resettlement experts of Member States, UNHCR and other stakeholders. For this purpose an annual meeting will be organized in which these experts participate. On the basis of the outcomes of the meeting, the Commission will draft a proposal for a Decision identifying the common EU resettlement priorities, and will submit it for consultation to the management committee of the General Programme "Solidarity and management of migratory flows' including the ERF III. Within twenty calendar days following the adoption of the Commission Decision on common EU resettlement priorities, Member States will provide the Commission with an estimate of the number of persons whom they will resettle in the course of the following calendar year according to these common EU annual priorities. On the basis of these pledges, Member States will receive additional financial assistance of 4.000 Euros per person to be resettled. Resettlement of the specific categories of persons according to common EU annual priorities needs to be carried out on a request of the UNHCR.

The proposal is based on Article 63(2)(b) of the Treaty establishing the European Community, which is the legal basis of the act being amended.

Il coinvolgimento della Comunità nel settore dell'asilo si basa sull'esigenza di solidarietà tra gli Stati membri di fronte a una sfida che, in un'UE senza frontiere interne, non può essere affrontata in maniera efficace dai singoli paesi. Ciò ha comportato l'adozione da parte del legislatore comunitario dell'acquis nel settore dell'asilo, sul fondamento di basi giuridiche specifiche e dedicate sancite dal trattato.

Community involvement in the asylum field is founded on the need for solidarity among Member States in addressing a challenge that, in an EU without internal borders, cannot be effectively dealt with by individual countries acting alone. This led to adoption by the Community legislator of the acquis in the field of asylum, on the basis of specific dedicated legal bases enshrined in the Treaty.

L'esigenza di agire sul fronte del regime comune europeo in materia di asilo è già stata analizzata nelle recenti valutazioni d'impatto, in particolare in quella relativa al piano strategico sull'asilo, che ha sottolineato nello specifico la necessità di elaborare un programma comune di reinsediamento UE. Il Consiglio europeo e il Parlamento europeo hanno ripetutamente chiesto di sviluppare il regime comune europeo in materia di asilo, compresa la sua dimensione esterna. Le istituzioni dell'Unione impegnate a migliorare l'attuazione dell'acquis nel settore dell'asilo hanno espresso chiaramente l'opinione secondo cui il rafforzamento della cooperazione pratica tra gli Stati membri e il potenziamento della dimensione esterna costituiscono priorità chiave.

The need to act as regards the Common European Asylum System (CEAS) has already been assessed in recent impact assessment reports, and in particular in the impact assessment on the asylum policy plan, which has pointed specifically to the need to develop a Joint EU Resettlement Programme. There have been repeated calls from the European Council and the European Parliament to develop the CEAS, including its external dimension. The institutions of the Union committed to improving implementation of the acquis in the field of asylum clearly expressed the view that strengthening practical cooperation between Member States as well as strengthening the external dimension are key priorities.

La natura degli obiettivi da conseguire – aumentare l'uso strategico del reinsediamento, sviluppare le politiche di asilo esterne – richiede che l'iniziativa venga assunta a livello UE, considerazione che vale anche per gli altri obiettivi generali. L'istituzione di un programma comune di reinsediamento UE sarà strumentale per garantire che più Stati membri vi partecipino e per dimostrare una maggiore solidarietà dell'UE nei confronti dei paesi terzi per quanto attiene all'accoglienza dei rifugiati.

The nature of the objectives to be achieved – increasing the strategic use of resettlement, developing external asylum policies – requires an initiative to be taken at the EU level. The other general objectives also require action at EU level. The establishment of a Joint EU Resettlement Programme will be instrumental in ensuring that more EU Member States participate in resettlement and in demonstrating greater solidarity by the EU with third countries in receiving refugees.

La proporzionalità della proposta è stata esaminata nella valutazione d'impatto. Ci si è interrogati su quanto ampia dovrebbe essere la portata delle misure comunitarie e sulla loro proporzionalità rispetto agli obiettivi da raggiungere. La presente proposta risponde efficacemente agli obiettivi in maniera proporzionata.

The proportionality of the proposal has been assessed in the Impact Assessment. It has been examined how far EU measures should go and whether these are proportionate to the objectives to be reached. This proposal responds effectively to the objectives in a proportionate manner.

4. INCIDENZA SUL BILANCIO

La presente proposta è conforme agli stanziamenti e alla pianificazione del programma generale "Solidarietà e gestione dei flussi migratori" fino al 2013. Inoltre, la proposta di modificare la decisione FER non muta gli obiettivi generali del FER né la sua programmazione finanziaria fino al 2013, come indicato nella proposta, datata 18 febbraio 2009, di modificare la decisione FER nell'ottica di istituire l'Ufficio europeo di sostegno per l'asilo[4].

This proposal complies with the appropriations and programming of the General programme "Solidarity and Management of Migration Flows" until 2013. Furthermore, this proposal to amend the ERF Decision does not alter the general objectives of the ERF and its financial programming until 2013, as indicated in the proposal, dated 18 February 2009, to amend the ERF Decision with a view to the establishment of the European Asylum Support Office.[4]

In conseguenza della presente proposta si prevedono costi aggiuntivi limitatissimi quanto alle spese amministrative (v. allegato).

As a result of the current proposal very limited additional costs are foreseen with respect to administrative expenses (see Annex).

5. ESPOSIZIONE DETTAGLIATA DELLA PROPOSTA

5. DETAILED EXPLANATION OF THE PROPOSAL

Articolo 13, paragrafi 4 e 5

Article 13 (4) and (5)

L'articolo 13, paragrafi 4 e 5, dispone che gli Stati membri ricevono, a titolo di assistenza finanziaria supplementare, un importo fisso di 4 000 euro per ogni rifugiato, effettivamente reinsediato durante il rispettivo anno di calendario, che appartenga a una delle categorie specifiche definite ogni anno con decisione della Commissione quali priorità annuali UE. Qualora il rifugiato appartenga a più di una delle categorie specifiche, gli Stati membri ricevono l'importo fisso per ogni persona una volta sola. Le priorità annuali possono riguardare regioni geografiche, cittadinanze o categorie specifiche di rifugiati da reinsediare.

Article 13, paragraphs (4) and (5) stipulate that Member States will receive, as an additional financial assistance, a fixed amount of 4.000 Euros for each effectively resettled refugee during a respective calendar year who will fall under one of the specific categories which will be defined annually as common EU annual priorities by the Decision of the Commission. Member States will receive this fixed amount per refugee only once in case such refugee would fall under more than one of the specific categories. These annual priorities may relate to geographic regions, nationalities or specific categories of refugees to be resettled.

L'articolo 13, paragrafo 6, prevede che le priorità annuali comuni UE siano fissate ogni anno mediante una decisione della Commissione adottata previa consultazione del comitato di gestione del programma generale "Solidarietà e gestione dei flussi migratori".

Article 13 (6) stipulates that these common EU annual priorities will be established annually by a Commission Decision adopted following the consultation of the management Committee of the General Programme "Solidarity and Management of Migration flows".

Article 13 (7)

Questo paragrafo impone agli Stati membri un nuovo termine entro il quale fornire alla Commissione una stima ('impegno') del numero di persone che intendono reinsediare durante il successivo anno di calendario conformemente alle priorità annuali comuni UE.

This paragraph provides for a new deadline for Member States within which they should provide the Commission with an estimate ("pledging") of the number of persons whom they plan to resettle in the course of the following calendar year according to these common EU annual priorities.

Article 13 (8)

L'articolo 13, paragrafo 8, prevede che i risultati e gli impatti dell'incentivo finanziario alle attività di reinsediamento secondo le priorità annuali comuni UE siano oggetto delle relazioni di valutazione a medio termine e definitive sull'attuazione del FER da parte degli Stati membri e della Commissione.

Article 13 (8) provides that the results and impacts of the financial incentive for resettlement activities according to the common EU annual priorities shall be included in the mid-term and final evaluation reports on the implementation of the ERF by Member States and the Commission.

Questi paragrafi fissano il termine per la presentazione degli impegni, necessario per calcolare le ripartizioni annuali tra gli Stati membri, il termine entro cui questi ultimi devono presentare alla Commissione i programmi annuali e il termine per l'adozione delle decisioni di finanziamento da parte della Commissione. Rispetto ai termini previsti dalla base giuridica attuale, i nuovi termini sono differiti a causa della nuova procedura per l'adozione delle priorità annuali comuni UE per il reinsediamento, che precederà il calcolo delle ripartizioni annuali tra gli Stati membri.

These paragraphs provide for setting up a timetable as regards the deadline for the submission of the pledging, necessary for the calculation of annual allocations between Member States, the deadline for the submission of annual programmes by Member States to the Commission and the deadline for the adoption of financing decisions by the Commission. In comparison to the deadlines set up in the current legal base, new deadlines are postponed due to the new procedure for the adoption of the common EU annual priorities for resettlement which will precede the calculation of annual allocations between Member States.

Questo paragrafo prevede una norma di ammissibilità, che sarà applicata per l'importo fisso di 4 000 euro per persona effettivamente reinsediata conformemente alle priorità annuali comuni UE per il reinsediamento. Tale importo fisso è concesso come somma forfettaria pari a 4 000 euro per ogni persona effettivamente reinsediata durante il rispettivo anno di calendario.

This paragraph provides for the rule of eligibility which will apply for the fixed amount of 4.000 Euros per effectively resettled person according to the common EU annual priorities for resettlement. The fixed amount is granted as a lump sum of 4.000 Euros per each effectively resettled person during a respective calendar year.

(1) Alla luce dell'istituzione di un programma comune di reinsediamento UE volto ad aumentare l'impatto degli sforzi di reinsediamento dell'UE nel fornire protezione ai rifugiati e a massimizzare l'impatto strategico del reinsediamento attraverso una migliore individuazione delle persone le cui esigenze di reinsediamento sono più pressanti, si dovrebbero formulare su base regolare a livello UE priorità comuni in questo settore.

Whereas:

(2) Risulta quindi opportuno che la Commissione decida le priorità annuali comuni UE in relazione a regioni geografiche, cittadinanze e categorie specifiche di rifugiati da reinsediare.

(1) In the light of the establishment of a Joint EU Resettlement Programme aiming at increasing the impact of the EU resettlement efforts in providing protection to refugees and maximising the strategic impact of resettlement through a better targeting to those persons who are in greatest need of resettlement, common priorities with respect to resettlement should be formulated at EU level on a regular basis.

(3) In considerazione delle esigenze di reinsediamento fissate dalla decisione della Commissione sulle priorità annuali comuni UE, è altresì necessario fornire un supporto finanziario supplementare per il reinsediamento di persone in relazione a regioni geografiche e cittadinanze specifiche, nonché a categorie specifiche di rifugiati da reinsediare, qualora il reinsediamento sia considerato lo strumento più adatto a soddisfare le loro esigenze particolari.

(2) Therefore it is appropriate, that the Commission decides on common EU annual priorities with respect to specific geographic regions and nationalities as well as to the specific categories of refugees to be resettled.

(4) In questo contesto è opportuno adattare la scadenzario relativo al termine per la presentazione dei dati necessari per calcolare le ripartizioni annuali tra gli Stati membri, il termine entro cui questi ultimi devono presentare alla Commissione i programmi annuali e il termine per l'adozione delle decisioni di finanziamento da parte della Commissione.

(3) Taking into account the resettlement needs set up by the Commission Decision on common EU annual priorities for resettlement, it is also necessary to provide additional financial support for the resettlement of persons with respect to specific geographic regions and nationalities as well as to the specific categories of refugees to be resettled, where resettlement is determined to be the most appropriate response to their special needs.

(5) È inoltre necessario stabilire le norme per l'ammissibilità delle spese per il supporto finanziario supplementare a favore del reinsediamento,

(4) In this context, it is appropriate to adapt the timetable as regards the deadline for the submission of data necessary for the calculation of annual allocations between the Member States, the deadline for the submission of annual programmes by Member States and the deadline for adoption of financing decisions by the Commission.

Article 1

1. L'articolo 13, paragrafo 3, diventa articolo 13, paragrafo 4, ed è così formulato:

Decision No 573/2007/EC of the European Parliament and of the Council is amended as follows:

"Gli Stati membri ricevono un importo fisso pari a EUR 4000 per persona reinsediata appartenente a una delle categorie definite dalle priorità annuali comuni UE stabilite in conformità dell'articolo 13, paragrafo 6 in relazione alle regioni geografiche e alle cittadinanze, nonché a categorie specifiche di rifugiati da reinsediare".

"Member States shall receive a fixed amount of EUR 4000 for each resettled person falling into one of the categories defined by the common EU annual priorities established in accordance with Article 13(6) with respect to geographic regions and nationalities as well as to specific categories of refugees to be resettled."

"Quando uno Stato membro procede al reinsediamento di una persona appartenente a più d'una delle categorie di cui alle priorità annuali comuni UE per il reinsediamento stabilite in conformità dell'articolo 13, paragrafo 6, riceve l'importo fisso per tale persona una volta sola".

2. Article 13(4) becomes Article 13(5) and reads as follows:

3. All'articolo 13, il paragrafo 5 diventa il paragrafo 3.

"Where a Member State resettles a person falling within more than one of the categories referred to in the common EU annual priorities for resettlement established in accordance with Article 13(6), it shall receive the fixed amount for this person only once."

4. All'articolo 13, il paragrafo 6 è sostituito dal seguente:

"La Commissione stabilisce le priorità annuali comuni UE per il reinsediamento secondo la procedura di cui all'articolo 52, paragrafo 2".

4. Article 13(6) is replaced by the following:

5. All'articolo 13 è inserito un nuovo paragrafo 7, così formulato:

"The Commission shall establish the common EU annual priorities for resettlement in accordance with the procedure referred to in Article 52(2)."

"Entro venti giorni di calendario dopo la notifica della decisione della Commissione che stabilisce le priorità annuali comuni UE per il reinsediamento in conformità dell'articolo 13, paragrafo 6, gli Stati membri forniscono alla Commissione la stima del numero di persone che intendono reinsediare secondo tali priorità annuali comuni nel corso del successivo anno di calendario. La Commissione comunica tali informazioni al comitato di cui all'articolo 52".

5. In Article 13 a new paragraph (7) is inserted and reads as follows:

6. All'articolo 13 è inserito un nuovo paragrafo 8, così formulato:

"Within twenty calendar days following the notification of Commission Decision establishing the common EU annual priorities for resettlement in accordance with Article 13(6), Member States shall provide the Commission with an estimate of the number of persons whom they will resettle according to these common EU annual priorities in the course of the following calendar year. The Commission shall communicate this information to the Committee referred to in Article 52."

"I risultati e l'impatto dell'incentivo finanziario alle attività di reinsediamento secondo le priorità annuali comuni UE devono essere inseriti dagli Stati membri nella relazione di cui all'articolo 50, paragrafo 2, e dalla Commissione nella relazione di cui all'articolo 50, paragrafo 3.

6. In Article 13 a new paragraph (8) is inserted and reads as follows:

"The results and impact of the financial incentive for resettlement activities according to the common EU annual priorities shall be reported by the Member States in the report referred to in Article 50(2) and by the Commission in the report referred to in Article 50(3).

"Entro il 1° settembre di ogni anno la Commissione comunica agli Stati membri una stima degli importi che saranno loro attribuiti per il successivo anno di calendario a partire dagli stanziamenti globali decisi nel quadro della procedura di bilancio annuale, secondo i calcoli di cui all'articolo 13".

7. Article 20(2) is replaced by the following:

8. All'articolo 20, il paragrafo 3 è sostituito dal seguente:

"The Commission shall provide the Member States, by 1 September of each year, with an estimate of the amounts to be allocated to them for the following calendar year from the total appropriations allocated under the annual budgetary procedure, calculated as provided for by Article 13."

"Entro il 1° dicembre di ogni anno gli Stati membri presentano alla Commissione un progetto di programma annuale per l'anno successivo, stabilito in base al programma pluriennale e articolato negli elementi seguenti:

"Member States shall submit to the Commission, by 1 December of each year, a draft annual programme for the following year, established in accordance with the multiannual programme and consisting of the following elements:

a) the general rules for selection of projects to be financed under the annual programme;

c) la prevista ripartizione finanziaria del contributo del Fondo tra le varie azioni del programma e un'indicazione dell'importo richiesto a titolo dell'assistenza tecnica di cui all'articolo 16 per l'attuazione del programma annuale".

b) a description of the actions to be supported under the annual programme;

9. All'articolo 20, paragrafo 5, il terzo comma è sostituito dal seguente:

c) the proposed financial breakdown of the Fund's contribution between the programme's various actions; and an indication of the amount requested to cover technical assistance under the Article 16 for the purpose of implementing the annual programme."

"La Commissione adotta la decisione di finanziamento che approva il programma annuale entro il 1° aprile dell'anno in questione. La decisione indica l'importo attribuito allo Stato membro interessato e il periodo di ammissibilità delle spese".

9. Article 20(5) third subparagraph is replaced by the following:

10. All'articolo 35 è inserito un nuovo paragrafo 5, così formulato:

"The Commission shall adopt the financing decision approving the annual programme by 1 April of the year in question. The decision shall indicate the amount allocated to the Member State concerned and the period for which the expenditure is eligible."

"L'importo fisso di EUR 4 000 assegnato agli Stati membri per ogni reinsediato è concesso a titolo di somma forfettaria per ogni persona effettivamente reinsediata.

10. In Article 35, a new paragraph (5) is inserted and reads as follows:
