Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy [1], and in particular point 8b of Article 42 thereof,

After consulting the European Data Protection Supervisor,

Whereas:

considerando quanto segue:

(1) Article 44a of Regulation (EC) No 1290/2005 lays down that Member States have to ensure the annual ex-post publication of the beneficiaries of the European Agricultural Guarantee Fund (EAGF), and of the European Agricultural Fund for Rural Development (EAFRD), hereinafter referred to as Funds, and the amounts received per beneficiary under each of these Funds.

(1) A norma dell’articolo 44 bis del regolamento (CE) n. 1290/2005 gli Stati membri devono provvedere alla pubblicazione annuale a posteriori dei beneficiari di stanziamenti del Fondo europeo agricolo di garanzia (FEAGA) e del Fondo europeo agricolo per lo sviluppo rurale (FEASR), di seguito i Fondi, e degli importi percepiti da ogni beneficiario per ciascuno di tali Fondi.

(2) The purpose of the publication, which should be in accordance with the information held by the paying agencies in their books and records and which should only concern payments received in the preceding financial year, is to enhance transparency regarding the use of the Funds and improve their sound financial management. In order to meet these objectives, the information should be presented to the public in a clear, harmonised and searchable manner by the due date of 30 April. In respect of EAFRD expenditure paid between 1 January and 15 October 2007, a special date for publication should be fixed.

(2) Lo scopo della pubblicazione, che deve essere in linea con le informazioni tenute nella contabilità e nei registri degli organismi pagatori e che devono riguardare soltanto i pagamenti percepiti nel precedente esercizio finanziario, è quello di garantire la trasparenza nell’uso dei Fondi e di migliorare la sana gestione finanziaria dei medesimi. A questo scopo è opportuno che le informazioni siano presentate al pubblico in modo chiaro, armonizzato e consultabile entro il termine del 30 aprile. Per le spese del FEASR pagate tra il 1o gennaio e il 15 ottobre 2007 è opportuno fissare un termine apposito per la pubblicazione.

(3) To this end, the minimum requirements as to the content of the publication should be laid down. These requirements should not go further than what is necessary in a democratic society in order to reach the objectives pursued.

(3) Occorre per questo stabilire i requisiti minimi circa il contenuto della pubblicazione. Tali requisiti non devono andare al di là di quanto necessario in una società democratica ai fini del raggiungimento delle finalità perseguite.

(4) Publication of the information should be implemented via the internet in the form of a search tool which ensures that the public at large is in the position to consult it. The search tool should permit to search on the basis of certain criteria and the results of the search should be presented in an easily accessible form.

(4) È opportuno che la pubblicazione delle informazioni sia realizzata su internet per mezzo di uno strumento di ricerca in modo da dare ad un vasto pubblico la possibilità di consultarle. Lo strumento di ricerca dovrà permettere di compiere la ricerca in base a determinati criteri ed è necessario che i risultati siano presentati in forma facilmente accessibile.

(5) The publication of the information concerning the beneficiaries should occur as quickly as possible after the closure of the financial year in order to ensure transparency towards the public. At the same time, Member States should have sufficient time to undertake the necessary work. As the objective of transparency does not require that the information remains available indefinitely, a reasonable period of availability of the published information should be laid down.

(5) È opportuno che la pubblicazione delle informazioni relative ai beneficiari sia realizzata non appena possibile dopo la chiusura dell’esercizio finanziario, per garantire la trasparenza nei confronti del pubblico. Occorre tuttavia dare agli Stati membri il tempo di compiere i lavori necessari. L’obiettivo della trasparenza non richiede che le informazioni rimangano accessibili a tempo indeterminato, per cui appare opportuno stabilire un periodo ragionevole di disponibilità delle informazioni pubblicate.

(6) Making this information accessible to the public enhances transparency regarding the use of Community funds in the common agricultural policy and improves the sound financial management of these funds, in particular by reinforcing public control of the money used. Given the overriding weight of the objectives pursued, it is justified with regard to the principle of proportionality and the requirement of the protection of personal data to provide for the general publication of the relevant information as it does not go beyond what is necessary in a democratic society and for the prevention of irregularities.

(6) Rendendo tali informazioni accessibili al pubblico si rafforza la trasparenza sull’uso dei fondi comunitari nell’ambito della politica agricola comune e se ne migliora la corretta gestione finanziaria, grazie in particolare ad un maggior controllo pubblico sull’utilizzazione di tali somme. Data l’estrema importanza degli obiettivi perseguiti appare giustificato, alla luce del principio di proporzionalità e dell’obbligo della protezione dei dati personali, prevedere la pubblicazione generale delle informazioni pertinenti, dato che questa disposizione non va al di là di quanto è necessario fare, in una società democratica, per prevenire le irregolarità.

(7) To comply with the data protection requirements beneficiaries of the Funds should be informed of the publication of their data before the publication takes place. The information of the beneficiaries should take place through the application forms for aid or when the data are collected otherwise. Furthermore, the beneficiaries should be informed about their rights under Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data [2] and the procedures applicable for exercising these rights. As regards expenditure incurred in financial years 2007 and 2008, in so far as information of the beneficiaries is not possible at the moment of collecting the personal data, the beneficiaries should still be informed within a reasonable period of time before publication actually takes place.

(7) Per rispettare gli obblighi in materia di protezione dei dati appare opportuno che i beneficiari dei Fondi siano informati in anticipo della pubblicazione dei dati che li riguardano. Si ritiene appropriato informare i beneficiari attraverso i moduli di domanda di aiuto o in altro modo nel momento in cui i dati sono raccolti. È inoltre necessario che i beneficiari siano informati dei loro diritti in virtù della direttiva 95/46/CE del Parlamento europeo e del Consiglio, del 24 ottobre 1995, relativa alla tutela delle persone fisiche con riguardo al trattamento dei dati personali, nonché alla libera circolazione di tali dati [2] e delle procedure applicabili per l'esercizio di tali diritti. Per quanto riguarda le spese sostenute negli esercizi finanziari 2007 e 2008, se non è possibile informare i beneficiari al momento della raccolta dei dati personali è necessario farlo entro un periodo di tempo ragionevole prima della pubblicazione dei loro dati.

(8) For the sake of transparency, beneficiaries of the Funds should also be informed that, for the purpose of safeguarding the financial interests of the Communities, their personal data may be processed by auditing and investigating bodies of the Communities and the Member States. This information should be given at the same moment as the information on the publication and on the rights of individuals is given.

(8) Per garantire la trasparenza occorre informare i beneficiari dei Fondi del fatto che, per tutelare gli interessi finanziari della Comunità, i loro dati personali possono essere trattati da organismi delle Comunità e degli Stati membri competenti in materia di audit e di investigazione. È opportuno comunicare questa informazione insieme all’informazione relativa alla pubblicazione e ai diritti delle persone.

(9) In order to facilitate the access of the public to the data published, the Commission should provide for a Community website including links to the websites of the Member States on which the information has been made available. In view of the different organisational structures within the Member States, they should determine themselves which body is in charge of setting up and maintaining their single website and of publishing the data.

(9) Per facilitare l’accesso del pubblico ai dati pubblicati è opportuno che la Commissione metta a disposizione un sito internet della Comunità, con collegamenti ai siti degli Stati membri in cui sono state pubblicate le informazioni. Tenendo conto delle diverse strutture organizzative negli Stati membri, è opportuno che i medesimi provvedano alla designazione degli organismi a cui affidano il compito di creare e gestire un sito internet unico e di pubblicare i dati.

(10) Since Article 2 of Regulation (EC) No 1437/2007 provides that Article 44a of Regulation (EC) No 1290/2005, inserted by Regulation (EC) No 1437/2007, applies to EAGF expenditure incurred from 16 October 2007 and to EAFRD expenditure incurred from 1 January 2007, it is therefore necessary to apply also the implementing rules for the same time period.

(10) L’articolo 2 del regolamento (CE) n. 1437/2007 dispone che l’articolo 44 bis del regolamento (CE) n. 1290/2005, inserito dal medesimo regolamento (CE) n. 1437/2007, si applica alle spese del FEAGA sostenute a partire dal 16 ottobre 2007 e alle spese del FEASR sostenute a partire dal 1o gennaio 2007: è quindi necessario che anche le modalità di applicazione si applichino con la stessa decorrenza.

(11) The measures provided for in this Regulation are in accordance with the opinion of the Committee on the Agricultural Funds,

Article 1

Content of the publication

1. The publication referred to in Article 44a of Regulation (EC) No 1290/2005 shall include the following information:

1. La pubblicazione di cui all’articolo 44 bis del regolamento (CE) n. 1290/2005 contiene le seguenti informazioni:

(a) the first name and the surname where the beneficiaries are natural persons;

a) nome e cognome, se si tratta di persone fisiche;

(b) the full legal name as registered where the beneficiaries are legal persons;

b) ragione sociale, quale registrata, se si tratta di persone giuridiche;

(c) the full name of the association as registered or otherwise officially recognised where the beneficiaries are associations of natural or legal persons without an own legal personality;

c) nome completo dell’associazione, quale registrata o altrimenti riconosciuta ufficialmente, se si tratta di associazioni di persone fisiche o giuridiche senza personalità giuridica propria;

(d) the municipality where the beneficiary resides or is registered and, where available, the postal code or the part thereof identifying the municipality;

d) il comune di residenza o di registrazione del beneficiario e, se disponibile, il codice postale o la parte del medesimo che identifica il comune;

(e) for the European Agricultural Guarantee Fund, hereinafter referred to as EAGF, the amount of direct payments within the meaning of Article 2(d) of Regulation (EC) No 1782/2003 received by each beneficiary in the financial year concerned;

e) per il Fondo europeo agricolo di garanzia, di seguito FEAGA, l’importo dei pagamenti diretti, ai sensi dell’articolo 2, lettera d), del regolamento (CE) n. 1782/2003, percepiti da ciascun beneficiario nel corso dell’esercizio finanziario considerato;

(f) for the EAGF, the amount of payments other than those referred to in point (e) received by each beneficiary in the financial year concerned;

f) per il FEAGA, l’importo dei pagamenti diversi da quelli di cui alla lettera e), percepiti da ogni beneficiario nel corso dell’esercizio finanziario considerato;

(g) for the European Agricultural Fund for Rural Development, hereinafter referred to as EAFRD, the total amount of public funding received by each beneficiary in the financial year concerned, which includes both the Community and the national contribution;

g) per il Fondo europeo agricolo per lo sviluppo rurale, di seguito il FEASR, l’importo totale dei finanziamenti pubblici percepiti da ciascun beneficiario nel corso dell’esercizio finanziario considerato, comprensivo sia del contributo comunitario che del contributo nazionale;

(h) the sum of the amounts referred to in points (e), (f) and (g) received by each beneficiary in the financial year concerned;

h) la somma degli importi di cui alle lettere e), f) e g), percepiti da ciascun beneficiario nel corso dell’esercizio finanziario considerato;

(i) the currency of these amounts.

2. Member States may publish more detailed information than provided for in paragraph 1.

Article 2

Form of the publication

The information referred to in Article 1 shall be made available on a single website per Member State through a search tool allowing the users to search for beneficiaries by name, municipality, amounts received as referred to in (e), (f), (g) and (h) of Article 1 or a combination thereof and to extract all the corresponding information as a single set of data.

Le informazioni di cui all’articolo 1 sono pubblicate su un sito internet unico per ogni Stato membro, che gli utenti possono consultare attraverso uno strumento di ricerca che permette di cercare i beneficiari per nome, per comune, per importi percepiti, quali descritti all’articolo 1, lettere e), f), g) e h), o una combinazione di tali dati e di estrarre le informazioni corrispondenti sotto forma di un insieme unico di dati.

Date of the publication

1. The information referred to in Article 1 shall be published by 30 April each year for the preceding financial year.

1. Le informazioni di cui all’articolo 1 sono pubblicate entro il 30 aprile di ogni anno con riferimento all’esercizio finanziario precedente.

2. For the EAFRD expenditure paid between 1 January and 15 October 2007, the information shall be published by 30 September 2008, provided that the expenditure has been reimbursed by the EAFRD to the Member State concerned by that date. Otherwise, the information shall be published together with the information for the financial year 2008.

2. Per le spese del FEASR sostenute tra il 1o gennaio e il 15 ottobre 2007 le informazioni sono pubblicate entro il 30 settembre 2008 nei casi in cui le spese siano state rimborsate dal FEASR allo Stato membro entro tale data. Negli altri casi le informazioni sono pubblicate insieme alle informazioni relative all’esercizio finanziario 2008.

3. The information shall remain available on the website for two years from the date of their initial publication.

3. Le informazioni restano disponibili sul sito internet per due anni a decorrere dalla data della pubblicazione iniziale.

Article 4

Information of the beneficiaries

Informazione dei beneficiari

1. Member States shall inform the beneficiaries that their data will be made public in accordance with Regulation (EC) No 1290/2005 and this Regulation and that they may be processed by auditing and investigating bodies of the Communities and the Member States for the purpose of safeguarding the Communities' financial interests.

Gli Stati membri informano i beneficiari del fatto che i dati che li riguardano saranno resi pubblici a norma del regolamento (CE) n. 1290/2005 e del presente regolamento e che possono essere trattati da organismi di audit e di investigazione delle Comunità e degli Stati membri ai fini della tutela degli interessi finanziari delle Comunità.

2. In case of personal data, the information referred to in paragraph 1 shall be provided in accordance with the requirements of Directive 95/46/EC and the beneficiaries shall be informed of their rights as data subjects under this Directive and of the procedures applicable for exercising these rights.

2. Se si tratta di dati personali, le informazioni di cui al paragrafo 1 sono fornite nel rispetto dei requisiti della direttiva 95/46/CE e i beneficiari sono informati dei diritti loro conferiti da tale direttiva e delle procedure applicabili per esercitarli.

3. The information referred to in paragraphs 1 and 2 shall be provided to the beneficiaries by including it in the application forms for receiving funds deriving from the EAGF and EAFRD, or otherwise at the time when the data are collected.

3. Le informazioni di cui paragrafi 1 e 2 sono fornite al beneficiario nei moduli di domanda di finanziamento del FEAGA e del FEASR o in altro modo al momento della raccolta dei dati.

By way of derogation from the first subparagraph, as regards data related to payments received in the financial years 2007 and 2008, the information shall be provided at least four weeks before the date of their publication.

In deroga al primo comma, per i dati relativi ai pagamenti percepiti nel corso degli esercizi finanziari 2007 e 2008, le informazioni sono fornite ai beneficiari con almeno quattro settimane di anticipo rispetto alla data della pubblicazione.

Article 5

Cooperation between the Commission and Member States

Collaborazione fra la Commissione e gli Stati membri

1. The Commission shall set up and maintain a Community website under its central internet address which includes the links to the websites of the Member States. The Commission shall provide updates of the internet links according to the information sent by Member States.

1. La Commissione costituisce e gestisce un sito internet comunitario, a partire dall’indirizzo del proprio sito internet centrale, con collegamenti ai siti degli Stati membri. La Commissione aggiorna i collegamenti internet in base alle informazioni trasmesse dagli Stati membri.

2. The Member States shall send to the Commission the internet address of their website as soon as it has been set up as well as any subsequent changes thereof having an influence on the accessibility of their website from the Community website.

2. Gli Stati membri trasmettono alla Commissione gli indirizzi internet dei propri siti non appena li hanno costituiti ed ogni ulteriore modifica che abbia incidenza sull’accessibilità ai medesimi a partire dal sito internet della Commissione.

3. Member States shall nominate a body in charge of setting up and maintaining the single website referred to in Article 2. They shall inform the Commission of the name and address details of this body.

3. Gli Stati membri designano l’organismo incaricato di costituire e gestire il sito unico di cui all’articolo 2. Essi comunicano alla Commissione il nome e l’indirizzo dell’organismo designato.

Article 6

Entry into force and application

Entrata in vigore e applicazione

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

Il presente regolamento entra in vigore il giorno della pubblicazione nella Gazzetta ufficiale dell’Unione europea.

It shall apply to EAGF expenditure incurred from 16 October 2007 and to EAFRD expenditure incurred from 1 January 2007.

Esso si applica alle spese sostenute dal FEAGA a partire dal 16 ottobre 2007 e dal FEASR a partire dal 1o gennaio 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.
