THE COUNCIL OF THE EUROPEAN COMMUNITIES,

DIRETTIVA DEL CONSIGLIO

Having regard to the Treaty establishing the European Economic Community, and in particular Articles 100 and 235 thereof;

IL CONSIGLIO DELLE COMUNITÀ EUROPEE ,

Whereas any disparity between the provisions on the disposal of waste oils already applicable or in preparation in the various Member States may create unequal conditions of competition and thus directly affect the functioning of the common market ; whereas it is therefore necessary to approximate laws in this field as provided for in Article 100 of the Treaty;

Whereas it seems necessary for this approximation of laws to be accompanied by Community action so that one of the aims of the Community in the sphere of protection of the environment can be achieved by wider regulations ; whereas certain specific provisions to this effect should therefore be laid down ; whereas Article 235 of the Treaty should be invoked as the powers required for this purpose have not been provided by the Treaty;

Whereas all provisions relating to the disposal of waste oils should have as one of their essential objectives the protection of the environment against the harmful effects caused by the discharge, deposit or treatment of these oils;

Whereas the recycling of waste oils may he conducive to a fuel supply policy;

visto il parere del Comitato economico e sociale ( 2 ) ,

Whereas the programme of action of the European Communities on the environment (3) underlines the importance of the problem of the disposal of waste oils without harmful effects upon the environment;

considerando che una disparità tra le disposizioni in applicazione o in preparazione nei vari Stati membri per ciò che concerne l ' eliminazione degli oli usati può creare disuguaglianza nelle condizioni di concorrenza e avere perciò un ' incidenza diretta sul funzionamento del mercato comune ; che è quindi necessario procedere , in questo settore , al ravvicinamento delle legislazioni previsto dall ' articolo 100 del trattato ;

Whereas the quantities of waste oils and in particular of emulsions have increased in the Community;

considerando che appare necessario che tale ravvicinamento delle legislazioni sia accompagnato da un ' azione della Comunità per raggiungere con una più ampia regolamentazione uno degli obiettivi della Comunità nel settore della protezione dell ' ambiente ; che occorre quindi prevedere a tal fine talune disposizioni specifiche ; che , non essendo stati previsti dal trattato i poteri d ' azione necessari a tal fine , occore fare ricorso all ' articolo 235 del trattato ;

Whereas an efficient and coherent system of treatment for waste oils, which will neither create barriers to intra-Community trade nor affect competition, should apply to all such products, even those which are composed only in part of oil, and should provide for their safe treatment under economically satisfactory conditions;

considerando che ogni regolamento in materia di eliminazione degli oli usati deve avere fra i suoi obiettivi principali la protezione dell ' ambiente contro gli effetti nocivi dello scarico , del deposito o del trattamento di detti oli ;

Whereas such a system should regulate the treatment, discharge, deposit and collection of waste oils and provide for a system of permits for undertakings which dispose of such oils, for compulsory collection and/or disposal of such oils in certain cases and for suitable inspection procedures;

considerando che la riutilizzazione degli oli usati può contribuire ad una politica d ' approvvigionamento di combustibili ;

Whereas in cases where certain undertakings are required to collect and/or dispose of waste oils, compensation by indemnities of that part of their costs relating thereto and not covered by their earnings should be possible and whereas these indemnities may be financed, among other methods, by a charge on new or regenerated oils,

considerando che il programma d ' azione delle Comunità europee in materia ambientale ( 3 ) sottolinea l ' importanza del problema dell ' eliminazione degli oli usati senza conseguenze nocive per l ' ambiente ;

HAS ADOPTED THIS DIRECTIVE:

considerando che le quantità di oli usati , ed in particolare delle emulsioni , sono aumentate nella Comunità ;

considerando che un sistema efficace e coerente di trattamento di questi oli , tale da non ostacolare gli scambi intracomunitari e da non alterare le condizioni di concorrenza , dovrebbe essere applicato a tutti questi prodotti , compresi quelli composti soltanto in parte di olio , e prevederne il trattamento innocuo a condizioni economicamente soddisfacenti ;

Article 1

considerando che un tale sistema dovrebbe regolare il trattamento , lo scarico , il deposito e la raccolta degli oli usati e prevedere un meccanismo di autorizzazione delle imprese che eliminano tali oli , nonché , in taluni casi , la raccolta e/o l ' eliminazione obbligatoria di questi oli e le idonee procedure di controllo ;

considerando che , qualora determinate imprese fossero tenute a procedere alla raccolta e/o all ' eliminazione degli oli usati , la parte delle spese da esse sostenute e non coperte dalle loro entrate dovrebbe poter essere compensata da indennità che possono tra l ' altro , essere finanziate da una tassa sugli oli nuovi o rigenerati ,

of mineral or synthetic oil, including the oily residues from tanks, oil-water mixtures and emulsions.

HA ADOTTATO LA PRESENTE DIRETTIVA :

Articolo 1

Article 2

Nell ' applicazione della presente direttiva , per oli usati si intende qualsiasi prodotto usato , fluido o liquido , composto interamente o parzialmente di olio minerale o sintetico , compresi i residui oleosi di cisterne , i miscugli di acqua e olio e le emulsioni .

Member States shall take the necessary measures to ensure the safe collection and disposal of waste oils.

Articolo 2

Gli Stati membri adottano le misure necessarie per garantire la raccolta e l ' eliminazione innocua degli oli usati .

Article 3

Articolo 3

Member States shall take the necessary measures to ensure that, as far as possible, the disposal of waste oils is carried out by recycling (regeneration and/or combustion other than for destruction).

Gli Stati membri adottano le misure necessarie affinché , per quanto possibile , l ' eliminazione degli oli usati avvenga mediante riutilizzazione ( rigenerazione e/o combustione a scopi diversi dalla distruzione ) .

Articolo 4

Article 4

Gli Stati membri adottano le misure necessarie affinché siano vietati :

Member States shall take the necessary measures to ensure the prohibition of: 1. any discharge of waste oils into internal surface waters, ground water, coastal waters and drainage systems;

1 . qualsiasi scarico degli oli usati nelle acque interne di superficie , nelle acque sotterranee , nelle acque costiere e nelle canalizzazioni ;

2. any deposit and/or discharge of waste oils harmful to the soil and any uncontrolled discharge of residues resulting from the processing of waste oils;

2 . qualsiasi deposito e/o scarico di oli usati che abbiano effetti nocivi per il suolo , come pure qualsiasi scarico incontrollato di residui risultanti dalla trasformazione di oli usati ;

3. any processing of waste oils causing air pollution which exceeds the level prescribed by existing provisions.

3 . qualsiasi trattamento di oli usati che provochi un inquinamento dell ' aria superiore al livello fissato dalle disposizioni vigenti .

Articolo 5

Qualora gli obiettivi previsti negli articoli 2 , 3 e 4 non possano essere conseguiti diversamente , gli Stati membri adottano tutte le misure necessarie , affinché una o più imprese effettuino la raccolta e/o l ' eliminazione dei prodotti offerti dai detentori , eventualmente nella zona loro assegnata dall ' amministrazione competente .

Articolo 6

Article 5

In osservanza delle misure previste dall ' articolo 4 , le imprese che eliminano gli oli usati debbono ottenere un ' autorizzazione .

Where the aims defined in Articles 2, 3 and 4 cannot otherwise be achieved, Member States shall take the necessary measures to ensure that one or more undertakings carry out the collection and/or disposal of the products offered to them by holders, where appropriate in the zone assigned to them by the competent authorities.

Tale autorizzazione è concessa dall ' amministrazione competente , previo esame degli impianti , ove necessaria ; essa impone le condizioni richieste dai progressi della tecnica .

Articolo 7

Article 6

Chiunque detenga oli usati , se non è in grado di rispettare le misure indicate nell ' articolo 4 , deve tenerli a disposizione di una o delle imprese di cui all ' articolo 5 .

In order to comply with the measures taken pursuant to Article 4, any undertaking which disposes of waste oils must obtain a permit.

Articolo 8

This permit shall be granted by the competent authorities after examination of the installations, if necessary. These authorities shall impose the conditions required by the state of technical development.

I detentori di determinate quantità di oli usati contenenti impurità che superino determinate percentuali , debbono raccoglierli e immagazzinarli separatamente .

Le autorità competenti stabiliranno , eventualmente per categoria di prodotti , le quantità e le percentuali di cui al primo comma .

Article 7

Articolo 9

A person holding waste oils must, if he is unable to comply with the measures taken pursuant to Article 4, place them at the disposal of the undertaking or undertakings referred to in Article 5.

Le imprese che raccolgono e/o eliminano gli oli usati debbono svolgere tali operazioni in modo da evitare conseguenze dannose all ' acqua , all ' aria o al suolo .

Articolo 10

Article 8

Gli stabilimenti che producono , raccolgono e/o eliminano una quantità di olio usato maggiore di quella da determinarsi da ogni Stato membro in misura comunque non superiore a « 500 litri all ' anno » , devono :

The holders of certain quantities of waste oils containing impurities in excess of certain percentages must handle and stock them separately.

- tenere un registro contenente indicazioni sui quantitativi , sulla qualità , sull ' origine , sull ' ubicazione nonché sulla cessione e sul ricevimento , specificando in particolare la data di questi ultimi

The competent authorities shall fix the quantities and percentages, which may differ according to category of product, referred to in the first subparagraph.

e/o

- notificare tali informazioni all ' amministrazione competente , a richiesta di quest ' ultima .

Article 9

Gli Stati membri sono autorizzati a determinare , in conformità del primo comma , la quantità degli oli usati , in funzione dell ' equivalente in olio nuovo calcolato secondo un ragionevole coefficiente di conversione .

Undertakings collecting and/or disposing of waste oils must carry out these operations in such a way that there will be no avoidable risk of water, air or soil pollution.

Articolo 11

Ogni impresa che elimina oli usati deve comunicare alle autorità competenti , a loro richiesta , qualsiasi informazione riguardante l ' eliminazione o il deposito di oli usati oppure dei loro residui .

Article 10

Articolo 12

Any establishment producing, collecting and/or disposing of more than a given quantity of waste oils per year, to be specified by each Member State but not higher than 500 litres, must: - keep a record of the quantity, quality, origin and location of such oils and of their despatch and receipt, including the dates of the latter and/or

Le imprese di cui all ' articolo 6 sono controllate periodicamente dall ' amministrazione competente , soprattutto per quanto riguarda l ' osservanza delle condizioni di autorizzazione .

- convey such information to the competent authorities on request.

Articolo 13

Quale contropartita degli obblighi che gli Stati membri impongono alle imprese di raccolta e/o di eliminazione , ai sensi dell ' articolo 5 , queste ultime possono beneficiare di indennità per i servizi resi . Queste indennità non devono superare le spese annuali delle imprese non coperte ed effettivamente accertate , tenuto conto di un ragionevole utile .

L ' importo di tali indennità non deve creare distorsioni di concorrenza di un certo rilievo né correnti artificiali di scambi di prodotti .

Member States are authorized to fix the quantity of waste oils in accordance with the first subparagraph in terms of an equivalent quantity of new oil calculated according to a reasonable conversion factor.

Articolo 14

Le indennità possono essere tra l ' altro finanziate mediante una tassa riscossa sui prodotti che , dopo la loro utilizzazione , sono trasformati in oli usati , o sugli oli usati .

Article 11

Il finanziamento delle indennità deve essere conforme al principio di « chi inquina paga » .

Any undertaking which disposes of waste oils must convey to the competent authorities, at their request, any information concerning the disposal or deposit of such waste oils or residues thereof.

Articolo 15

Ciascuno Stato membro comunica periodicamente alla Commissione le proprie conoscenze tecniche nonché l ' esperienza ed i risultati che derivano dall ' applicazione delle disposizioni adottate in virtù della presente direttiva .

Article 12

La Commissione trasmette agli Stati membri un resoconto generale di tali informazioni .

The undertakings referred to in Article 6 shall be inspected periodically by the competent authorities, particularly as regards their compliance with the conditions of their permits.

Articolo 16

Gli Stati membri redigono ogni tre anni una relazione sulla situazione dell ' eliminazione degli oli usati nei loro paesi e la trasmettono alla Commissione .

Article 13

Articolo 17

As a reciprocal concession for the obligations imposed on them by the Member States pursuant to Article 5, indemnities may be granted to collection and/or disposal undertakings for the service rendered. Such indemnities must not exceed annual uncovered costs actually recorded by the undertaking taking into account a reasonable profit.

Gli Stati membri mettono in vigore le misure necessarie per conformarsi alla presente direttiva entro 24 mesi a decorrere dalla sua notifica e ne informano immediatamente la Commissione .

The amount of these indemnities must be such as not to cause any significant distortion of competition or to give rise to artificial patterns of trade in the products.

Articolo 18

Le disposizioni adottate dagli Stati membri in virtù della presente direttiva possono essere applicate progressivamente alle imprese di cui all ' articolo 6 , esistenti al momento della notifica di questa direttiva , nel termine di quattro anni a decorrere da tale notifica .

Article 14

Articolo 19

The indemnities may be financed, among other methods, by a charge imposed on products which after use are transformed into waste oils, or on waste oils.

Gli Stati membri comunicano alla Commissione il testo delle disposizioni essenziali di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva .

The financing of indemnities must be in accordance with the "polluter pays" principle.

Articolo 20

Gli Stati membri sono destinatari della presente direttiva .

Article 15

Fatto a Lussemburgo , addì 16 giugno 1975 .

Each Member State shall periodically convey to the Commission information concerning its technical expertise and the experience gained and results obtained through the application of measures taken pursuant to this Directive.

The Commission shall send an overall summary of such information to the Member States.

Every three years, Member States shall draw up a situation report on the disposal of waste oils in their respective countries and shall send it to the Commission.

Article 17

Member States shall implement the measures necessary to comply with this Directive within 24 months of its notification, and shall forthwith inform the Commission thereof.

Article 18

The provisions adopted by the Member States pursuant to this Directive may be progressively applied to the undertakings referred to in Article 6, existing at the time of notification of this Directive, within four years of the said notification.

Article 19

Member States shall communicate to the Commission the texts of the main provisions of national law which they adopt in the field covered by this Directive.

Article 20

This Directive is addressed to the Member States.
