THE COUNCIL OF THE EUROPEAN UNION,

IL CONSIGLIO DELL'UNIONE EUROPEA,

Having regard to the Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis [1], and in particular to article 6 thereof,

vista la decisione 2000/365/CE del Consiglio, del 29 maggio 2000 riguardante la richiesta del Regno Unito di Gran Bretagna e Irlanda del Nord di partecipare ad alcune disposizioni dell'acquis di Schengen [1], e in particolare l'articolo 6 di tale decisione,

Whereas:

considerando quanto segue:

(1) The United Kingdom has expressed its intention to commence implementation of the following parts of the Schengen acquis: Judicial cooperation, Drugs cooperation, Article 26 and Article 27 of the Schengen Convention, and Police cooperation.

(1) Il Regno Unito ha manifestato l'intenzione di avviare l'attuazione delle seguenti parti dell'acquis di Schengen: cooperazione giudiziaria, cooperazione in materia di stupefacenti, articoli 26 e 27 della Convenzione di applicazione di Schengen e cooperazione tra forze di polizia.

(2) The United Kingdom indicated to be ready to apply all provisions of the Schengen acquis referred to in Article 1 of Decision 2000/365/EC with the exception of those concerning the Schengen Information System.

(2) Il Regno Unito ha indicato di essere disposto ad applicare tutte le disposizioni dell'acquis di Schengen di cui all'articolo 1 della decisione 2000/365/CE del Consiglio, ad eccezione di quelle relative al Sistema di informazione Schengen.

(3) The United Kingdom will continue to prepare for the implementation of the relevant provisions of the Schengen Information System and for data protection.

(3) Il Regno Unito continuerà i preparativi per l'attuazione delle pertinenti disposizioni del Sistema di informazione Schengen e di quelle relative alla protezione dei dati.

(4) A questionnaire was forwarded to the United Kingdom, whose replies were recorded and a subsequent verification and evaluation visit was made to the United Kingdom in accordance with the procedures applicable in the area of police cooperation.

(4) Al Regno Unito è stato trasmesso un questionario. Le risposte a quest'ultimo sono state registrate e successivamente è stata effettuata una visita di verifica e di valutazione nel Regno Unito conformemente alle procedure applicabili al settore della cooperazione tra forze di polizia.

(5) As regards the application of the Schengen acquis relating to the abovementioned areas, the questionnaire and the visit demonstrated that the requirements relating to legislation, manpower levels, training, infrastructure and material resources have been satisfied.

(5) Per quanto riguarda l'applicazione dell'acquis di Schengen nei summenzionati settori, dal questionario e dalla visita è emerso che i requisiti sul piano legislativo e in materia di personale, di formazione, di infrastruttura e di materiale disponibile sono stati soddisfatti.

(6) The preconditions for the implementation by the United Kingdom of those provisions of the Schengen acquis as listed in Article 1(a)(i), (b), (c)(i) and (d)(i) of Decision 2000/365/EC have been fulfilled, allowing these provisions and their later developments to be put into effect for the United Kingdom.

(6) Le condizioni preliminari per l'attuazione da parte del Regno Unito delle disposizioni dell'acquis di Schengen di cui all'articolo 1, lettera a), punto i), lettera b), lettera c, punto i), e lettera d) punto i) della decisione 2000/365/CE, sono state soddisfatte, così consentendo che tali disposizioni ed il loro successivo sviluppo prendono effetto per il Regno Unito.

(7) Decision 2000/365/EC defines, in its Article 5(2), which provisions of the Schengen acquis are applicable to Gibraltar.

(7) La decisione 2000/365/CE definisce all’articolo 5, paragrafo 2, quali disposizioni dell’acquis di Schengen che si applicano a Gibilterra.

(8) An Agreement has been concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway on the establishment of rights and obligations between Ireland and the United Kingdom of Great Britain and Northern Ireland, on the one hand, and the Republic of Iceland and the Kingdom of Norway, on the other, in areas of the Schengen acquis which apply to these States [2]. On the basis of Article 2 of that Agreement, the Mixed Committee, established pursuant to Article 3 of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application, and development of the Schengen acquis [3], has been consulted, in accordance with Article 4 thereof, about the preparation of this Decision,

(8) È stato concluso un accordo dal Consiglio dell'Unione europea e dalla Repubblica d'Islanda e il Regno di Norvegia sull'instaurazione di diritti e obblighi tra l'Irlanda e il Regno Unito di Gran Bretagna e Irlanda del Nord, da un lato, e la Repubblica d'Islanda e il Regno di Norvegia, dall'altro, nei settori dell'acquis di Schengen che riguardano tali Stati [2]. In base all'articolo 2 di tale accordo, il comitato misto, istituito a norma dell'articolo 3 dell'accordo concluso dal Consiglio dell'Unione europea con la Repubblica d'Islanda e il Regno di Norvegia sulla loro associazione all'attuazione, all'applicazione e allo sviluppo dell'acquis di Schengen [3], è stato consultato, a norma dell'articolo 4 di detto accordo, in merito all'elaborazione della presente decisione,

HAS DECIDED AS FOLLOWS:

DECIDE:

Article 1

Articolo 1

The provisions referred to in Article 1(a)(i), (b), (c)(i) and (d) (i) of Decision 2000/365/EC shall be put into effect for the United Kingdom as from 1 January 2005.

Le disposizioni cui rimanda l'articolo 1, lettera a), punto i), all'articolo 1, lettera b), all'articolo 1, lettera c), punto i) e lettera d), punto i), della decisione 2000/365/CE del Consiglio hanno effetto nei confronti del Regno Unito a decorrere dal 1o gennaio 2005.

The provisions referred to in Article 5(2) of Decision 2000/365/EC shall be put into effect for Gibraltar as from 1 January 2005.

Le disposizioni cui rimanda l'articolo 5, paragrafo 2 della decisione 2000/365/CE hanno effetto nei confronti di Gibilterra a decorrere dal 1o gennaio 2005.

The provisions of the acts constituting developments of the Schengen acquis adopted since Decision 2000/365/EC and listed in Annex I of this Decision shall be put into effect for the United Kingdom and for Gibraltar as from 1 January 2005.

Le disposizioni degli atti che costituiscono sviluppi dell'acquis di Schengen adottati dopo la decisione 2000/365/CE ed elencati nell'allegato I della presente decisione hanno effetto nei confronti del Regno Unito e di Gibilterra a decorrere dal 1o gennaio 2005.

The provisions of the acts constituting developments of the Schengen acquis adopted since Decision 2000/365/EC and listed in Annex II of this Decision shall be put into effect for the United Kingdom as from 1 January 2005.

Le disposizioni degli atti che costituiscono sviluppi dell'acquis di Schengen adottati dopo la decisione 2000/365/CE del Consiglio ed elencati nell'allegato II della presente decisione hanno effetto nei confronti del Regno Unito a decorrere dal 1o gennaio 2005.

Article 2

Articolo 2

Formal communications and transmission of decisions between the Gibraltar authorities, including the judicial authorities, and those of the Member States of the European Union (except the United Kingdom) for the purposes of this Decision shall be carried out in accordance with the procedure provided for in the arrangements relating to the Gibraltar authorities in the context of EU and EC instruments and related treaties (see Annex III to this Decision), concluded between Spain and the United Kingdom on 19 April 2000 and communicated to the Member States and the institutions of the European Union.

Le comunicazioni formali e la trasmissione di decisioni tra le autorità di Gibilterra, comprese le autorità giudiziarie, e quelle degli Stati membri dell'Unione europea (eccettuato il Regno Unito) ai fini della presente decisione hanno luogo secondo la procedura prevista nelle intese relative alle autorità di Gibilterra nel contesto degli strumenti dell'UE e della CE e dei trattati connessi (vedasi l'allegato III della presente decisione), concluse tra la Spagna ed il Regno Unito il 19 aprile 2000 e comunicate agli Stati membri ed alle istituzioni dell'Unione europea.

This Decision shall take effect on the day following that of its publication in the Official Journal of the European Union.

La presente decisione ha effetto il giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.
