Having regard to the Treaty establishing the European Community, and in particular Article 152(4)(b) thereof,

Acting in accordance with the procedure laid down in Article 251 of the Treaty(3),

Whereas:

considerando quanto segue:

(1) Numerous Community acts lay down animal and public health conditions for the processing and disposal of animal waste and for the production, placing on the market, trade and importation of products of animal origin not intended for human consumption.

(1) Numerosi atti comunitari stabiliscono norme sanitarie e di polizia sanitaria per la trasformazione e l'eliminazione dei rifiuti di origine animale e per la produzione, l'immissione sul mercato, gli scambi e l'importazione di prodotti di origine animale non destinati al consumo umano.

(2) Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down the health rules concerning animal by-products not intended for human consumption(4) has replaced the rules contained in those acts.

(2) Il regolamento (CE) n. 1774/2001 del Parlamento europeo e del Consiglio, del 3 ottobre 2002, recante norme sanitarie relative ai sottoprodotti di origine animale non destinati al consumo umano(4) ha sostituito le norme contenute in tali atti.

(3) To take account of those new rules, Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(5) and Council Directive 92/118/EEC of 17 December 1992 laying down animal health and public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A(I) to Directive 89/662/EEC and, as regards pathogens, to Directive 90/425/EEC(6), should therefore be amended,

(3) Per tener conto delle nuove disposizioni è pertanto necessario modificare la direttiva 90/425/CEE del Consiglio, del 26 giugno 1990, relativa ai controlli veterinari e zootecnici applicabili negli scambi intracomunitari di taluni animali vivi e prodotti di origine animale, nella prospettiva della realizzazione del mercato interno(5) e la direttiva 92/118/CEE del Consiglio, del 17 dicembre 1992, che stabilisce le condizioni sanitarie e di polizia sanitaria per gli scambi e le importazioni nella Comunità di prodotti non soggetti, per quanto riguarda tali condizioni, alle normative comunitarie specifiche di cui all'allegato A, capitolo I, della direttiva 89/662/CEE e, per quanto riguarda i patogeni, alla direttiva 90/425/CEE(6),

HAVE ADOPTED THIS DIRECTIVE:

HANNO ADOTTATO LA PRESENTE DIRETTIVA:

Article 1

Articolo 1

In Directive 90/425/EEC, the seventh indent of section 1 of Chapter I of Annex A shall be replaced by the following:

Nella direttiva 90/425/CEE, allegato A, capitolo I, sezione 1, il settimo trattino è sostituito dal seguente:

"- Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October laying down the health rules concerning animal by-products not intended for human consumption (OJ L 273, 10.10.2002, p. 1)."

"- Regolamento (CE) n. 1774/2002 del Parlamento europeo e del Consiglio, del 3 ottobre 2002, recante norme sanitarie relative ai sottoprodotti di origine animale non destinati al consumo umano (GU L 273 del 10.10.2002, pag. 1)."

Directive 92/118/EEC is hereby amended as follows:

La direttiva 92/118/CEE è così modificata:

1. in Article 2, points (e) and (g) shall be deleted;

2. Article 3 shall be amended as follows:

2) L'articolo 3 è così modificato:

(a) in the first indent, the following words shall be deleted:

a) al primo trattino, sono soppressi i seguenti termini:

"together with gelatins not intended for human consumption";

"nonché delle gelatine non destinate al consumo umano";

and

e

(b) the second indent shall be replaced by the following:

b) il secondo trattino è sostituito dal seguente:

"- any new product of animal origin intended for human consumption whose placing on the market in a Member State is authorised after the date provided for in Article 20 may not be the subject of trade or importation until a decision has been taken in accordance with the first paragraph of Article 15 after evaluation, if appropriate in the light of the opinion of the Scientific Veterinary Committee set up by Decision 81/651/EEC, of the real risk of the spread of serious transmissible diseases which could result from movement of the product, not only for the species from which the product originates but also for other species which could carry the disease, become a focus of disease or a risk to human health,";

"- i nuovi prodotti d'origine animale destinati al consumo umano di cui è autorizzata l'immissione sul mercato di uno Stato membro successivamente alla data prevista all'articolo 20 possano essere oggetto di scambi o d'importazione soltanto dopo che sarà stata presa una decisione in conformità all'articolo 15, primo comma, previo esame, fatto eventualmente alla luce di un parere del comitato veterinario scientifico istituito con decisione 81/651/CEE, del rischio effettivo di propagazione di malattie trasmissibili gravi per effetto del movimento del prodotto, non soltanto per la specie dalla quale il prodotto è derivato, ma anche per altre specie che possono fungere da veicolo o serbatoio della malattia o comportare un rischio per la sanità pubblica.".

3. in Article 10(2), subparagraph (b) shall be replaced by the following:

3) All'articolo 10, paragrafo 2, la lettera b) è sostituita dalla seguente:

"(b) unless otherwise specified in Annex II, products must come from establishments on a Community list to be drawn up in accordance with the procedure laid down in Article 18;";

"b) salvo disposizioni specifiche contrarie contenute nell'allegato II, provengono da stabilimenti che figurano in un elenco comunitario da redigere conformemente alla procedura di cui all'articolo 18;".

4. Annex I shall be amended as follows:

4) L'allegato I è così modificato:

(a) Chapters 1, 3 and 4 shall be deleted;

a) i capitoli 1, 3 e 4 sono soppressi;

(b) Chapter 5 shall be amended as follows:

(i) in the title, the following words shall be added:

(c) Chapter 6 shall be amended as follows:

"A. As regards trade, to the production of the document or certificate provided for in Directive 77/99/EEC, stating that the requirements of that Directive have been complied with;",

"A. per quanto riguarda gli scambi, alla presentazione del documento o certificato di cui alla direttiva 77/99/CEE attestante il rispetto dei requisiti di tale direttiva;"

- in paragraph B(1), point (a) shall be replaced by the following:

- alla sezione B, punto 1, la lettera a) è sostituita dalla seguente:

"a) the products fulfil the requirements of Directive 80/215/EEC;";

"a) i prodotti soddisfano i requisiti di cui alla direttiva 80/215/CEE;"

(d) in Chapter 7, part II shall be deleted; and

d) al capitolo 7, la parte II è soppressa; e

(e) Chapters 8, 10 and 12 to 15 shall be deleted.

e) i capitoli 8, 10 e da 12 a 15 sono soppressi.

Article 3

Articolo 3

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive on 30 April 2003. They shall forthwith inform the Commission thereof.

Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva entro il 30 aprile 2003. Essi ne informano immediatamente la Commissione.

When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. The methods of making such a reference shall be laid down by the Member States.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità di tale riferimento sono decise dagli Stati membri.

Article 4

Articolo 4

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.

La presente direttiva entra in vigore il giorno della pubblicazione nella Gazzetta ufficiale delle Comunità europee.

Article 5

Articolo 5

This Directive is addressed to the Member States.

Gli Stati membri sono destinatari della presente direttiva.
