Having regard to the Treaty establishing the European Community, and in particular Article 95 thereof,

Acting in accordance with the procedure laid down in Article 251 of the Treaty(3),

(1) The eighth Directive, 97/44/EC, of the European Parliament and of the Council of 22 July 1997 on summer-time arrangements(4) introduced a common date and time in all Member States, for the beginning and end of summer time in 1998, 1999, 2000 and 2001.

(1) L'ottava direttiva 97/44/CE del Parlamento europeo e del Consiglio, del 22 luglio 1997, concernente le disposizioni relative all'ora legale(4) ha introdotto una data e un'ora comune, in tutti gli Stati membri per l'inizio e la fine del periodo di ora legale degli anni 1998, 1999, 2000 e 2001.

(2) Given that the Member States apply summer-time arrangements, it is important for the functioning of the internal market that a common date and time for the beginning and end of the summer-time period be fixed throughout the Community.

(2) Poiché gli Stati membri applicano disposizioni relative all'ora legale, è importante per il funzionamento del mercato interno continuare a fissare una data e un'ora comuni per l'inizio e la fine del periodo di ora legale, valide nella Comunità.

(3) Since the summer-time period considered most appropriate by the Member States runs from the end of March to the end of October, it is appropriate that that period therefore be maintained.

(3) Il periodo di ora legale ritenuto il più opportuno dagli Stati membri va da fine marzo a fine ottobre e bisogna pertanto mantenere questo periodo.

(4) The proper functioning of certain sectors, not only transport and communications, but also other sectors of industry, requires stable, long-term planning. Provisions concerning summer time should therefore be laid down for an unspecified period. Article 4 of Directive 97/44/EC provides, in that respect, that the European Parliament and the Council are to adopt, by 1 January 2001, the arrangements to apply from 2002 onwards.

(4) Il buon funzionamento di alcuni settori, non soltanto quello dei trasporti e delle comunicazioni, ma anche di altri settori industriali, necessita una programmazione stabile a lungo termine. Di conseguenza è opportuno stabilire per una durata non specificata disposizioni relative al periodo dell'ora legale. L'articolo 4 della direttiva 97/44/CE prevede che il Parlamento europeo e il Consiglio adottino, entro il 1o gennaio 2001, il regime applicabile a decorrere dal 2002.

(5) For reasons of clarity and accuracy of information, a timetable for the implementation of the summer-time period for the following five years should be published every five years.

(5) Per motivi di chiarezza e precisione dell'informazione, occorre fissare e pubblicare ogni cinque anni il calendario di applicazione del periodo di ora legale per i cinque anni successivi.

(6) Implementation of this Directive should, moreover, be monitored by means of a report, to be presented by the Commission to the European Parliament, the Council and the Economic and Social Committee, on the impact of these provisions in all of the areas concerned. That report should be based on the information made available to the Commission by the Member States in sufficient time to enable the report to be presented at the specified time.

(6) È inoltre opportuno seguire l'applicazione della presente direttiva sulla base di una relazione al Parlamento europeo, al Consiglio e al Comitato economico e sociale sulle implicazioni delle presenti disposizioni in tutti i settori interessati. Questa relazione deve basarsi sulle informazioni comunicate dagli Stati membri alla Commissione in tempo utile per poter presentare la relazione alla data stabilita.

(7) Given that the complete harmonisation of the timetable for the summer-time period with a view to facilitating transport and communications cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may take measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. This Directive does not go beyond what is necessary to achieve those objectives.

(7) Poiché la completa armonizzazione del calendario di applicazione dell'ora legale al fine di facilitare i trasporti e le comunicazioni non può essere adeguatamente realizzata dagli Stati membri ed è pertanto meglio realizzabile a livello comunitario, la presente direttiva è conforme al principio di sussidiarietà enunciato all'articolo 5 del trattato. La presente direttiva si limita a quanto è necessario per conseguire tale scopo.

(8) For geographical reasons, the common summer-time arrangements should not apply to the overseas territories of the Member States,

HAVE ADOPTED THIS DIRECTIVE:

Article 1

Articolo 1

For the purposes of this Directive "summer-time period" shall mean the period of the year during which clocks are put forward by 60 minutes compared with the rest of the year.

Ai fini della presente direttiva, si intende per "periodo dell'ora legale" il periodo dell'anno durante il quale l'ora è anticipata di 60 minuti rispetto all'ora del resto dell'anno.

Article 2

From 2002 onwards, the summer-time period shall begin, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in March.

A decorrere dall'anno 2002 in ciascuno Stato membro il periodo dell'ora legale ha inizio alle ore 1.00 del mattino, ora universale, dell'ultima domenica di marzo.

From 2002 onwards, the summer-time period shall end, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in October.

A decorrere dall'anno 2002 in ciascuno Stato membro il periodo dell'ora legale termina alle ore 1.00 del mattino, ora universale, dell'ultima domenica di ottobre.

Article 4

Articolo 4

The Commission shall publish a communication in the Official Journal of the European Communities(5), for the first time on the occasion of the publication of this Directive, and every five years thereafter, containing the timetable showing the dates on which the summer-time period will begin and end for the following five years.

La Commissione pubblica nella Gazzetta ufficiale delle Comunità europee(5), per la prima volta al momento della pubblicazione della presente decisione e in seguito ogni cinque anni, una comunicazione contenente l'indicazione della data iniziale e della data finale del periodo di ora legale nei cinque anni successivi.

Article 5

The Commission shall report to the European Parliament, the Council and the Economic and Social Committee on the impact of the provisions of this Directive on the sectors concerned by 31 December 2007 at the latest.

La Commissione presenta una relazione al Parlamento europeo, al Consiglio e al Comitato economico e sociale, entro il 31 dicembre 2007 sull'incidenza delle presenti disposizioni nei settori interessati.

That report shall be drawn up on the basis of the information made available to the Commission by each Member State by 30 April 2007 at the latest.

La relazione sarà redatta sulla base delle informazioni comunicate alla Commissione da ogni Stato membro entro il 30 aprile 2007.

The Commission shall, if necessary and following the conclusions of the report, make appropriate proposals.

Se necessario e sulla base delle conclusioni della relazione, la Commissione formula le opportune proposte.

Article 6

Articolo 6

This Directive shall not apply to the overseas territories of the Member States.

La presente direttiva non si applica ai territori d'oltremare degli Stati membri.

Article 7

Articolo 7

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 December 2001 at the latest. They shall forthwith inform the Commission thereof.

Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva entro e non oltre il 31 dicembre 2001. Essi ne informano immediatamente la Commissione.

When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Le disposizioni adottate dagli Stati membri contengono un riferimento alla presente direttiva; o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità di riferimento sono decise dagli Stati membri.

Article 8

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.

La presente direttiva entra in vigore il giorno della pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Directive is addressed to the Member States.

Gli Stati membri sono destinatari della presente direttiva.
