THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular 130s thereof,

Whereas the Council Resolution of 28 June 1988 on the protection of the North Sea and of other waters in the Community [4] invited the Commission to submit proposals for measures required at Community level for the treatment of urban waste water;

Whereas pollution due to insufficient treatment of waste water in one Member State often influences other Member States' waters; whereas in accordance with Article 130r, action at Community level is necessary;

considerando che l'inquinamento dovuto ad un trattamento insufficiente delle acque reflue in uno Stato membro ha spesso ripercussioni sulle acque di altri Stati membri; che, in conformità dell'articolo 130 R, è necessaria un'azione a livello della Comunità;

Whereas to prevent the environment from being adversely affected by the disposal of insufficiently-treated urban waste water, there is a general need for secondary treatment of urban waste water;

considerando che, per evitare ripercussioni negative sull'ambiente, dovute allo scarico di acque reflue urbane trattate in modo insufficiente, occorre, su un piano generale, sottoporre tali acque a trattamento secondario;

Whereas it is necessary in sensitive areas to require more stringent treatment; whereas in some less sensitive areas a primary treatment could be considered appropriate;

considerando che nelle aree sensibili occorre prevedere un trattamento più spinto e che in ambienti meno sensibili si potrebbe invece ritenere sufficiente il trattamento primario;

Whereas industrial waste water entering collecting systems as well as the discharge of waste water and disposal of sludge from urban waste water treatment plants should be subject to general rules or regulations and/or specific authorizations;

considerando che le acque reflue industriali che confluiscono in reti fognarie e lo smaltimento di acque reflue e fanghi provenienti da impianti di trattamento delle acque reflue urbane dovrebbero essere soggetti a norme generali o regolamentazioni e/o autorizzazioni specifiche;

Whereas discharges from certain industrial sectors of biodegradable industrial waste water not entering urban waste water treatment plants before discharge to receiving waters should be subject to appropriate requirements;

considerando che gli scarichi provenienti da taluni settori industriali di acque reflue industriali biodegradabili non addotte ad impianti di trattamento delle acque reflue urbane prima dello scarico nelle acque recipienti dovrebbero essere soggetti a determinati requisiti;

Whereas the recycling of sludge arising from waste water treatment should be encouraged; whereas the disposal of sludge to surface waters should be phased out;

considerando che si dovrebbe promuovere il riciclaggio dei fanghi provenienti dal trattamento delle acque reflue e che lo smaltimento di fanghi nelle acque superficiali dovrebbe gradualmente cessare;

Whereas it is necessary to monitor treatment plants, receiving waters and the disposal of sludge to ensure that the environment is protected from the adverse effects of the discharge of waste waters;

considerando che occorre effettuare controlli sugli impianti di trattamento, sulle acque recipienti e sullo smaltimento dei fanghi, al fine di garantire la protezione dell'ambiente dalle conseguenze negative dello scarico di acque reflue;

Whereas it is important to ensure that information on the disposal of waste water and sludge is made available to the public in the form of periodic reports;

considerando che è importante assicurare che il pubblico venga informato mediante relazioni periodiche in merito allo smaltimento delle acque reflue urbane e dei fanghi;

Whereas Member States should establish and present to the Commission national programmes for the implementation of this Directive;

Whereas a Committee should be established to assist the Commission on matters relating to the implementation of this Directive and to its adaptation to technical progress,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Articolo 1

This Directive concerns the collection, treatment and discharge of urban waste water and the treatment and discharge of waste water from certain industrial sectors.

La presente direttiva concerne la raccolta, il trattamento e lo scarico delle acque reflue urbane, nonché il trattamento e lo scarico delle acque reflue originate da taluni settori industriali.

The objective of the Directive is to protect the environment from the adverse effects of the abovementioned waste water discharges.

Essa ha lo scopo di proteggere l'ambiente dalle ripercussioni negative provocate dai summenzionati scarichi di acque reflue.

Article 2

Articolo 2

For the purpose of this Directive:

Ai fini della presente direttiva si intende per:

1. "urban waste water" means domestic waste water or the mixture of domestic waste water with industrial waste water and/or run-off rain water;

1) "Acque reflue urbane": acque reflue domestiche o il miscuglio di acque reflue domestiche, acque reflue industriali e/o acque meteoriche di dilavamento.

2. "domestic waste water" means waste water from residential settlements and services which originates predominantly from the human metabolism and from household activities;

2) "Acque reflue domestiche": acque reflue provenienti da insediamenti di tipo residenziale e da servizi e derivanti prevalentemente dal metabolismo umano e da attività domestiche.

3. "industrial waste water" means any waste water which is discharged from premises used for carrying on any trade or industry, other than domestic waste water and run-off rain water;

3) "Acque reflue industriali": qualsiasi tipo di acque reflue scaricate da edifici in cui si svolgono attività commerciali o industriali, diverse dalle acque reflue domestiche e dalle acque meteoriche di dilavamento.

4. "agglomeration" means an area where the population and/or economic activities are sufficiently concentrated for urban waste water to be collected and conducted to an urban waste water treatment plant or to a final discharge point;

4) "Agglomerato": area in cui la popolazione e/o le attività economiche sono sufficientemente concentrate così da rendere possibile la raccolta e il convogliamento delle acque reflue urbane verso un impianto di trattamento di acque reflue urbane o verso un punto di scarico finale.

5. "collecting system" means a system of conduits which collects and conducts urban waste water;

5) "Rete fognaria": un sistema di condotte per la raccolta e il convogliamento delle acque reflue urbane.

6. "1 p.e. (population equivalent)" means the organic biodegradable load having a five-day biochemical oxygen demand (BOD5) of 60 g of oxygen per day;

6) "1 a.e. (abitante equivalente)": il carico organico biodegradabile, avente una richiesta biochimica di ossigeno a 5 giorni (BOD5) di 60 g di ossigeno al giorno.

7. "primary treatment" means treatment of urban waste water by a physical and/or chemical process involving settlement of suspended solids, or other processes in which the BOD5 of the incoming waste water is reduced by at least 20 % before discharge and the total suspended solids of the incoming waste water are reduced by at least 50 %;

7) "Trattamento primario": il trattamento delle acque reflue urbane mediante un processo fisico e/o chimico che comporti la sedimentazione dei solidi sospesi, ovvero mediante altri processi a seguito dei quali il BOD 5 delle acque reflue in arrivo sia ridotto almeno del 20 % prima dello scarico e i solidi sospesi totali delle acque reflue in arrivo siano ridotti almeno del 50 %.

8. "secondary treatment" means treatment of urban waste water by a process generally involving biological treatment with a secondary settlement or other process in which the requirements established in Table 1 of Annex I are respected;

8) "Trattamento secondario": trattamento delle acque reflue urbane mediante un processo che in genere comporta il trattamento biologico con sedimentazioni secondarie, o un altro processo in cui vengano rispettati i requisiti stabiliti nella tabella 1 dell'allegato I.

9. "appropriate treatment" means treatment of urban waste water by any process and/or disposal system which after discharge allows the receiving waters to meet the relevant quality objectives and the relevant provisions of this and other Community Directives;

9) "Trattamento appropriato": il trattamento delle acque reflue urbane mediante un processo e/o un sistema di smaltimento che dopo lo scarico garantisca la conformità delle acque recipienti ai relativi obiettivi di qualità e alle relative disposizioni della presente direttiva e di altre direttive comunitarie pertinenti.

10. "Sludge" means residual sludge, whether treated or untreated, from urban waste water treatment plants;

10) "Fanghi": i fanghi residui, trattati o non trattati, provenienti dagli impianti di trattamento delle acque reflue urbane.

11. "eutrophication" means the enrichment of water by nutrients, especially compounds of nitrogen and/or phosphorus, causing an accelerated growth of algae and higher forms of plant life to produce an undesirable disturbance to the balance of organisms present in the water and to the quality of the water concerned;

11) "Eutrofizzazione": l'arricchimento delle acque in nutrienti, in particolar modo composti dell'azoto e/o del fosforo, che provoca una proliferazione di alghe e di forme superiori di vita vegetale, producendo una indesiderata perturbazione dell'equilibrio degli organismi presenti nell'acqua e della qualità delle acque interessate.

12. "estuary" means the transitional area at the mouth of a river between fresh-water and coastal waters. Member States shall establish the outer (seaward) limits of estuaries for the purposes of this Directive as part of the programme for implementation in accordance with the provisions of Article 17 (1) and (2);

12) "Estuario": l'area di transizione tra le acque dolci e le acque costiere alla foce di un fiume. Gli Stati membri definiscono i limiti esterni (verso il mare) degli estuari ai fini della presente direttiva come parte del programma di applicazione di questa conformemente alle disposizioni dell'articolo 17, paragrafi 1 e 2.

13. "coastal waters" means the waters outside the low-water line or the outer limit of an estuary.

Article 3

Articolo 3

1. Member States shall ensure that all agglomerations are provided with collecting systems for urban waste water,

- at the latest by 31 December 2000 for those with a population equivalent (p.e.) of more than 15000, and

- entro il 31 dicembre 2000 per quelli con un numero di abitanti equivalenti (a.e.) superiore a 15000 e

- at the latest by 31 December 2005 for those with a p.e. of between 2000 and 15000.

- entro il 31 dicembre 2005 per quelli con numero di a.e. compreso tra 2000 e 15000.

For urban waste water discharging into receiving waters which are considered "sensitive areas" as defined under Article 5, Member States shall ensure that collection systems are provided at the latest by 31 December 1998 for agglomerations of more than 10000 p.e.

Per le acque reflue urbane che si immettono in acque recipienti considerate "aree sensibili" ai sensi della definizione di cui all'articolo 5, gli Stati membri garantiscono che gli agglomerati con oltre 10000 a.e. siano provvisti di reti fognarie al più tardi entro il 31 dicembre 1998.

Where the establishment of a collecting system is not justified either because it would produce no environmental benefit or because it would involve excessive cost, individual systems or other appropriate systems which achieve the same level of environmental protection shall be used.

Laddove la realizzazione di una rete fognaria non sia giustificata o perché non presenterebbe vantaggi dal punto di vista ambientale o perché comporterebbe costi eccessivi, occorrerà avvalersi di sistemi individuali o di altri sistemi adeguati che raggiungano lo stesso livello di protezione ambientale.

2. Collecting systems described in paragraph 1 shall satisfy the requirements of Annex I (A). These requirements may be amended in accordance with the procedure laid down in Article 18.

2. Le reti fognarie di cui al paragrafo 1 devono rispondere ai requisiti dell'allegato I A. Tali requisiti possono essere modificati secondo la procedura prevista all'articolo 18.

Article 4

Articolo 2

1. Member States shall ensure that urban waste water entering collecting systems shall before discharge be subject to secondary treatment or an equivalent treatment as follows:

- at the latest by 31 December 2000 for all discharges from agglomerations of more than 15000 p.e.,

- al più tardi entro il 31 dicembre 2000 per tutti gli scarichi provenienti da agglomerati con oltre 15000 a.e.;

- at the latest by 31 December 2005 for all discharges from agglomerations ofbetween 10000 and 15000 p.e.,

- entro il 31 dicembre 2005 per tutti gli scarichi provenienti da agglomerati con un numero di a.e. compreso tra 10000 e 15000;

- at the latest by 31 December 2005 for discharges to fresh-water and estuaries from agglomerations of between 2000 and 10000 p.e.

- entro il 31 dicembre 2 005 per gli scarichi in acque dolci ed estuari provenienti da agglomerati con un numero di a.e. compreso tra 2000e 10000.

2. Urban waste water discharges to waters situated in high mountain regions (over 1500 m above sea level) where it is difficult to apply an effective biological treatment due to low temperatures may be subjected to treatment less stringent than that prescribed in paragraph 1, provided that detailed studies indicate that such discharges do not adversely affect the environment.

3. Discharges from urban waste water treatment plants described in paragraphs 1 and 2 shall satisfy the relevant requirements of Annex I.B. These requirements may be amended in accordance with the procedure laid down in Article 18.

3. Gli scarichi provenienti dagli impianti di trattamento delle acque reflue urbane descritti ai paragrafi 1 e 2 devono soddisfare ai requisiti previsti all'allegato I B. Tali requisiti possono essere modificati conformemente alla procedura prevista all'articolo 18.

4. The load expressed in p.e. shall be calculated on the basis of the maximum average weekly load entering the treatment plant during the year, excluding unusual situations such as those due to heavy rain.

Article 5

Articolo 5

1. For the purposes of paragraph 2, Member States shall by 31 December 1993 identify sensitive areas according to the criteria laid down in Annex II.

1. Per conseguire gli scopi di cui al paragrafo 2, gli Stati membri individuano, entro il 31 dicembre 1993, le aree sensibili secondo i criteri stabiliti nell'allegato II.

2. Member States shall ensure that urban waste water entering collecting systems shall before discharge into sensitive areas be subject to more stringent treatment than that described in Article 4, by 31 December 1998 at the latest for all discharges from agglomerations of more than 10000p.e.

2. Gli Stati membri provvedono affinché le acque reflue urbane che confluiscono in reti fognarie siano sottoposte, prima dello scarico in aree sensibili, ad un trattamento più spinto di quello descritto all'articolo 4 al più tardi entro il 31 dicembre 1998 per tutti gli scarichi provenienti da agglomerati con oltre 10000 a.e.

3. Discharges from urban waste water treatment plants described in paragraph 2 shall satisfy the relevant requirements of Annex I B. These requirements may be amended in accordance with the procedure laid down in Article 18.

3. Gli scarichi provenienti dagli impianti di trattamento delle acque reflue urbane descritti al paragrafo 2 devono soddisfare ai pertinenti requisiti previsti dall'allegato I B. Tali requisiti possono essere modificati secondo la procedura prevista all'articolo 18.

4. Alternatively, requirements for individual plants set out in paragraphs 2 and 3 above need not apply in sensitive areas where it can be shown that the minimum percentage of reduction of the overall load entering all urban waste water treatment plants in that area is at least 75 % for total phosphorus and at least 75 % for total nitrogen.

In alternativa, i requisiti stabiliti ai paragrafi 2 e 3 per i singoli impianti non necessitano di applicazione nelle aree sensibili in cui può essere dimostrato che la percentuale minima di riduzione del carico complessivo in ingresso a tutti gli impianti di trattamento delle acque reflue urbane in quella determinata area è pari almeno al 75 % per il fosforo totale e almeno al 75 % per l'azoto totale.

5. Discharges from urban waste water treatment plants which are situated in the relevant catchment areas of sensitive areas and which contribute to the pollution of these areas shall be subject to paragraphs 2, 3 and 4.

5. Gli scarichi provenienti dagli impianti di trattamento delle acque reflue urbane situati all'interno dei bacini drenanti in aree sensibili e che contribuiscono all'inquinamento di tali aree, sono soggetti ai paragrafi 2, 3 e 4.

In cases where the above catchment areas are situated wholly or partly in another Member State Article 9 shall apply.

Qualora i suddetti bacini drenanti siano situati, totalmente o parzialmente, in un altro Stato membro si applica l'articolo 9.

6. Member States shall ensure that the identification of sensitive areas is reviewed at intervals of no more than four years.

6. Gli Stati membri provvedono affinché si proceda alla reidentificazione delle aree sensibili ad intervalli non superiori ai quattro anni.

7. Member States shall ensure that areas identified as sensitive following review under paragraph 6 shall within seven years meet the above requirements.

7. Gli Stati membri provvedono affinché le aree individuate come sensibili in seguito alla reidentificazione di cui al paragrafo 6 soddisfino, entro sette anni, ai requisiti di cui sopra.

8. A Member State does not have to identify sensitive areas for the purpose of this Directive if it implements the treatment established under paragraphs 2, 3 and 4 over all its territory.

8. Uno Stato membri non è tenuto ad individuare aree sensibili ai sensi della presente direttiva qualora applichi il trattamento prescritto dai paragrafi 2, 3 e 4 in tutto il suo territorio.

Article 6

Articolo 6

1. For the purposes of paragraph 2, Member States may by 31 December 1993 identify less sensitive areas according to the criteria laid down in Annex II.

1. Per il conseguimento degli scopi di cui al paragrafo 2, gli Stati membri possono individuare, entro il 31 dicembre 1993, aree meno sensibili, secondo i criteri stabiliti nell'allegato II.

2. Urban waste water discharges from agglomerations of between 10000 and 150000 p.e. to coastal waters and those from agglomaterions of between 2000 and 10000 p.e. to estuaries situated in areas described in paragraph 1 may be subjected to treatment less stringent than that prescribed in Article 4 providing that:

Gli scarichi di acque reflue urbane provenienti da agglomerati con un numero di a.e. compreso tra 10000 e 150000 se immessi in acque costiere e tra 2000 e 10000 se immessi in estuari, situati nelle aree di cui al paragrafo 1, possono essere sottoposti ad un trattamento meno spinto di quello previsto all'articolo 4, purché:

- such discharges receive at least primary treatment as defined in Article 2 (7) in conformity with the control procedures laid down in Annex I D,

- tali scarichi subiscano almeno il trattamento primario così come definito all'articolo 2, punto 7), conformemente alle procedure di controllo stabilite nell'allegato I D;

- comprehensive studies indicate that such discharges will not adversely affect the environment.

- studi esaurienti comprovino che essi non avranno ripercussioni negative sull'ambiente.

Member States shall provide the Commission with all relevant information concerning the abovementioned studies.

Gli Stati membri forniscono alla Commissione tutte le informazioni relative agli studi summenzionati.

3. If the Commission considers that the conditions set out in paragraph 2 are not met, it shall submit to the Council an appropriate proposal.

3. La Commissione, se ritiene che le condizioni di cui al paragrafo 2 non siano soddisfatte, presenta al Consiglio una proposta adeguata.

4. Member States shall ensure that the identification of less sensitive areas is reviewed at intervals of not more than four years.

4. Gli Stati membri provvedono affinché si proceda ad una reidentificazione delle aree meno sensibili, ad intervalli non superiori ai quattro anni.

5. Member States shall ensure that areas no longer identified as less sensitive shall within seven years meet the requirements of Articles 4 and 5 as appropriate.

5. Gli Stati membri provvedono affinché le aree non più individuate come meno sensibili soddisfino, entro sette anni, ai requisiti fissati agli articoli 4 e 5, in quanto applicabili.

Article 7

Member States shall ensure that, by 31 December 2005, urban waste water entering collecting systems shall before discharge be subject to appropriate treatment as defined in Article 2 (9) in the following cases:

Gli Stati membri provvedono affinché, entro il 31 dicembre 2005, le acque reflue urbane che confluiscono in reti fognarie siano sottoposte, prima dello scarico, ad un trattamento appropriato, così come definito all'articolo 2, punto 9) nei seguenti casi:

- for discharges to fresh-water and estuaries from agglomerations of less than 2000 p.e.,

- per scarichi in acque dolci e in estuari provenienti da agglomerati con meno di 2000 a.e.;

- for discharges to coastal waters from agglomerations of less than 10000 p.e.

- per scarichi in acque costiere provenienti da agglomerati con meno di 10000 a.e.;

Article 8

Articolo 8

1. Member States may, in exceptional cases due to technical problems and for geographically defined population groups, submit a special request to the Commission for a longer period for complying with Article 4.

1. In casi eccezionali dovuti a problemi tecnici e per gruppi di popolazione definitii geograficamente, gli Stati membri possono presentare alla Commissione una richiesta speciale intesa ad ottenere un periodo più lungo per adempiere le disposizioni dell'articolo 4.

2. This request, for which grounds msut be duly put forward, shall set out the technical difficulties experienced and must propose an action programme with an appropriate timetable to be undertaken to implement the objective of this Directive. This timetable shall be included in the programme for implementation referred to in Article 17.

2. Tale richiesta, che deve essere debitamente motivata, deve indicare le difficoltà teniche riscontrate e proporre un programma d'azione con un calendario appropriato, da adottare al fine di conseguire l'obiettivo della presente direttiva. Tale calendario è incluso nel programma per l'attuazione, in conformità dell'articolo 17.

3. Only technical reasons can be accepted and the longer period referred to in paragraph 1 may not extend beyond 31 December 2005.

3. Possono essere accettati solo motivi tecnici e il periodo più lungo di cui al paragrafo 1 non può andare oltre il 31 dicembre 2005.

4. The Commission shall examine this request and take appropriate measures in accordance with the procedure laid down in Article 18.

4. La Commissione esamina la richiesta e adotta le misure appropriate secondo la procedura prevista all'articolo 18.

5. In exceptional circumstances, when it can be demonstrated that more advanced treatment will not produce any environmental benefits, discharges into less sensitive areas of waste waters from agglomerations of more than 150000 p.e. may be subject to the treatment provided for in Article 6 for waste water from agglomerations of between 10000 and 150000 p.e.

5. In circostanze eccezionali, quando sia possibile dimostrare che un trattamento più completo non produce effetti positivi sull'ambiente, gli scarichi in aree meno sensibili di acque reflue provenienti da agglomerati con un numero di a.e. superiore a 150000 possono essere sottoposti al trattamento previsto all'articolo 6 per le acque reflue provenienti da agglomerati con un numero di a.e. compreso tra 10000e 150000.

In such circumstances, Member States shall submit beforehand the relevant documentation to the Commission. The Commission will examine the case and take appropriate measures in accordance with the procedure laid down in Article 18.

In tali circostanze, gli Stati membri presentano anticipatamente la documentazione pertinente alla Commissione. La Commissione esamina il caso e adotta le miusre appropriate secondo la procedura prevista all'articolo 18.

Article 9

Articolo 9

Where waters within the area of jurisdiction of a Member State are adversely affected by discharges of urban waste water from another Member State, the Member State whose waters are affected may notify the other Member State and the Commission of the relevant facts.

Lo Stato membro nella cui giurisdizione rientrino acque soggette alle conseguenze negative provocate dagli scarichi di acque reflue urbane provenienti da un altro Stato membro può notificare le circostanze del caso allo Stato membro responsabile e alla Commissione.

The Member States concerned shall organize, where appropriate with the Commission, the concertation necessary to identify the discharges in question and the measures to be taken at source to protect the waters that are affected in order to ensure conformity with the provisions of this Directive.

Gli Stati membri interessati organizzano, se del caso con la Commissione, la concertazione necessaria per individuare gli scarichi in questione e le misure da adottare all'origine per proteggere le acque recipienti al fine di assicurare la conformità alla presente direttiva.

Article 10

Member States shall ensure that the urban waste water treatment plants built to comply with the requirements of Articles 4, 5, 6 and 7 are designed, constructed, operated and maintained to ensure sufficient performance under all normal local climatic conditions. When designing the plants, seasonal variations of the load shall be taken into account.

Gli Stati membri provvedono affinché la progettazione, la costruzione, la gestione e la manutenzione degli impianti di trattamento delle acque reflue urbane realizzati per ottemperare ai requisiti fissati agli articoli da 4 a 7 siano condotte in modo da garantire prestazioni sufficienti nelle normali condizioni climatiche locali. La progettazione degli impianti deve tener conto delle variazioni stagionali di carico.

Article 11

1. Member States shall ensure that, before 31 December 1993, the discharge of industrial waste water into collecting systems and urban waste water treatment plants is subject to prior regulations and/or specific authorizations by the competent authority or appropriate body.

Gli Stati membri provvedono affinché, entro il 31 dicembre 1993, lo scarico di acque reflue industriali in reti fognarie ed impianti di trattamento delle acque reflue urbane sia preventivamente subordinato a regolamentazioni e/o ad autorizzazioni specifiche da parte dell'autorità competente o dell'organismo abilitato.

2. Regulations and/or specific authorization shall satisfy the requirements of Annex I C. These requirements may be amended in accordance with the procedure laid down in Article 18.

2. Le regolamentazioni e/o le autorizzazioni specifiche devono soddisfare ai requisiti di cui all'allegato I C. Tali requisiti possono essere modificati secondo la procedura prevista all'articolo 18.

3. Regulations and specific authorization shall be reviewed and if necessary adapted at regular intervals.

1. Treated waste water shall be reused whenever appropriate. Disposal routes shall minimize the adverse effects on the environment.

1. Le acque reflue che siano state sottoposte a trattamento devono essere riutilizzate, ogniqualvolta ciò risulti appropriato. Le modalità di smaltimento devono rendere minimo l'impatto negativo sull'ambiente.

2. Competent authorities or appropriate bodies shall ensure that the disposal of waste water from urban waste water treatment plants is subject to prior regulations and/or specific authorization.

2. Le autorità competenti o gli organismi abilitati provvedono affinché lo smaltimento di acque reflue provenienti da impianti di trattamento delle acque reflue urbane sia preventivamente subordinato a regolamentazioni e/o ad autorizzazioni specifiche.

3. Prior regulations and/or specific authorization of discharges from urban waste water treatment plants made pursuant to paragraph 2 within agglomerations of 2000 to 10000 p.e. in the case of discharges to fresh waters and estuaries, and of 10000p.e. or more in respect of all discharges, shall contain conditions to satisfy the relevant requirements of Annex I B. These requirements may be amended in accordance with the procedure laid down in Article 18.

3. Le regolamentazioni e/o le autorizzazioni specifiche preventive relative agli scarichi provenienti da impianti di trattamento di acque reflue urbane, emanate conformemente al paragrafo 2 relativamente ad agglomerati di 2000-10000 a.e. nel caso di scarichi in acque dolci e in estuari, e di 10000 o più a.e. per tutti gli scarichi, precisano le condizioni atte a soddisfare ai requisiti previsti nell'allegato I B. Tali requisiti possono essere modificati secondo la procedura prevista all'articolo 18.

4. Regulations and/or authorization shall be reviewed and if necessary adapted at regular intervals.

Article 13

1. Member States shall ensure that by 31 December 2000 biodegradable industrial waste water from plants belonging to the industrial sectors listed in Annex III which does not enter urban waste water treatment plants before discharge to receiving waters shall before discharge respect conditions established in prior regulations and/or specific authorization by the competent authority or appropriate body, in respect of all discharges from plants representing 4000 p.e. or more.

Gli Stati membri provvedono affinché entro il 31 dicembre 2000 le acque reflue industriali biodegradabili provenienti da impianti appartenenti ai settori industriali di cui all'allegato III, che prima dello scarico in acque recipienti non vengono addotte ad impianti di trattamento delle acque reflue urbane, rispettino prima dello scarico, le condizioni preventivamente stabilite nelle regolamentazioni e/o nelle autorizzazioni specifiche da parte dell'autorità competente o dell'organismo abilitato, per tutti gli scarichi provenienti da impianti corrispondenti a 4000o più a.e.

2. By 31 December 1993 the competent authority or appropriate body in each Member State shall set requirements appropriate to the nature of the industry concerned for the discharge of such waste water.

2. Entro il 31 dicembre 1993 le autorità competenti o gli organismi abilitati degli Stati membri stabiliscono per lo scarico di tali acque reflue appropriati requisiti in funzione della tipologia industriale interessata.

3. The Commission shall carry out a comparison of the Member States' requirements by 31 December 1994. It shall publish the results in a report and if necessary make an appropriate proposal.

3. La Commissione procede ad una comparazione dei requisiti fissati dagli Stati membri entro il 31 dicembre 1994. Essa rende noti i risultati in una relazione e presenta, se del caso, una proposta adeguata.

Article 14

1. Sludge arising from waste water treatment shall be re-used whenever appropriate. Disposal routes shall minimize the adverse effects on the environment.

1. I fanghi derivanti dal trattamento delle acque reflue devono essere riutilizzati, ogniqualvolta ciò risulti appropriato. Le modalità di smaltimento devono rendere minimo l'impatto negativo sull'ambiente.

2. Competent authorities or appropriate bodies shall ensure that before 31 December 1998 the disposal of sludge from urban waste water treatment plants is subject to general rules or registration or authorization.

2. Le autorità competenti o gli organismi abilitati provvedono affinché entro il 31 dicembre 1998 lo smaltimento di fanghi provenienti da impianti di trattamento delle acque reflue urbane sia subordinato a norme generali o a registrazione o autorizzazione.

3. Member States shall ensure that by 31 December 1998 the disposal of sludge to surface waters by dumping from ships, by discharge from pipelines or by other means is phased out.

3. Gli Stati membri provvedono, entro il 31 dicembre 1998, affinché lo smaltimento dei fanghi nelle acque superficiali mediante immersione da navi, scarico attraverso condotte, ovvero mediante altri mezzi sia gradualmente eliminato.

4. Until the elimination of the forms of disposal mentioned in paragraph 3, Member States shall ensure that the total amount of toxic, persistent or bioaccumulable materials in sludge disposed of to surface waters is licensed for disposal and progressively reduced.

4. Fino alla cessazione dello smaltimento di cui al paragrafo 3, gli Stati membri provvedono affinché le quantità totali di materie tossiche, persistenti o bioaccumulabili, presenti nei fanghi immessi nelle acque superficiali siano assoggettate ad una licenza per lo smaltimento e progressivamente ridotte.

Article 15

Articolo 15

1. Competent authorities or appropriate bodies shall monitor:

1. Le autorità competenti o gli organismi abilitati esercitano controlli:

- discharges from urba waste water treatment plants to verify compliance with the requirements of Annex I.B in accordance with the control procedures laid down in Annex I.D,

- sugli scarichi provenienti dagli impianti di trattamento delle acque reflue urbane, al fine di verificarne la conformità ai requisiti dell'allegato I B, secondo le procedure di controllo stabilite nell'allegato I D;

- amounts and composition of sludges disposed of to surface waters.

- sulla qualità e la composizione dei fanghi immessi nelle acque superficiali.

2. Competent authorities or appropriate bodies shall monitor waters subject to discharges from urban waste water treatment plants and direct discharges as described in Article 13 in cases where it can be expected that the receiving environment will be significantly affected.

Le autorità competenti o gli organismi abilitati esercitano controlli sulle acque recipienti interessate dagli scarichi provenienti da impianti di trattamento delle acque reflue urbane e dagli scarichi diretti ai sensi dell'articolo 13 quando esiste la probabilità che l'ambiente ricettore sia influenzato in modo significativo.

3. In the case of a discharge subject to the provisions of Article 6 and in the case of disposal of sludge to surface waters, Member States shall monitor and carry out any other relevant studies to verify that the discharge or disposal does not adversely affect the environment.

3. Nel caso di uno scarico soggetto alle disposizioni dell'articolo 6 e di smaltimento di fanghi nelle acque superficiali, gli Stati membri effettuano controlli e conducono gli studi del caso, allo scopo di verificare che lo scarico o lo smaltimento non esercita un impatto negativo sull'ambiente.

4. Information collected by competent authorities or appropriate bodies in complying with paragraphs 1, 2 and 3 shall be retained in the Member State and made available to the Commission within six months of receipt of a request.

4. Le informazioni raccolte dalle autorità competenti o dagli organismi abilitati conformemente alle disposizioni dei paragrafi 1, 2 e 3, sono conservate dallo Stato membro e comunicate alla Commissione entro sei mesi dalla data di ricevimento di un'apposita richiesta.

5. Guidelines on the monitoring referred to in paragraphs 1, 2 and 3 may be formulated in accordance with the procedure laid down in Article 18.

5. I criteri per l'effettuazione dei controlli di cui ai paragrafi 1, 2 e 3 possono essere definiti secondo la procedura prevista all'articolo 18.

Article 16

Articolo 16

Without prejudice to the implementation of the provisions of Council Directive 90/313/EEC of 7 June 1990 on the freedom of access to information on the environment [5], Member States shall ensure that every two years the relevant authorities or bodies publish situation reports on the disposal of urban waste water and sludge in their areas. These reports shall be transmitted to the Commission by the Member States as soon as they are published.

Fatta salva l'applicazione delle disposizioni della direttiva 90/313/CEE del Consiglio, del 7 giugno 1990, concernente la libertà di accesso all'informazione in materia di ambiente [5], gli Stati membri provvedono affinché ogni due anni le autorità o gli organismi competenti pubblichino un rapporto sulle attività di smaltimento delle acque reflue urbane e dei fanghi nell'area di loro competenza. I rapporti sono trasmessi alla Commissione dagli Stati membri non appena pubblicati.

Article 17

Articolo 17

1. Member States shall by 31 December 1993 establish a programme for the implementation of this Directive.

1. Gli Stati membri elaborano, entro il 31 dicembre 1993, un programma per l'applicazione della presente direttiva.

2. Member States shall by 30 June 1994 provide the Commission with information on the programme.

2. Entro il 30 giugno 1994, gli Stati membri comunicano alla Commissione le informazioni relative ai loro programmi.

3. Member States shall, if necessary, provide the Commission by 30 June every two years with an update of the information described in paragraph 2.

3. Ogni due anni gli Stati membri forniscono, se del caso, alla Commissione, entro il 30 giugno, un aggiornamento delle informazioni di cui al paragrafo 2.

4. The methods and formats to be adopted for reporting on the national programmes shall be determined in accordance with the procedure laid down in Article 18. Any amendments to these methods and formats shall be adopted in accordance with the same procedure.

4. I metodi e le specifiche redazionali da adottare per riferire sui programmi nazionali sono definiti secondo la procedura prevista all'articolo 18. Eventuali modifiche di detti metodi e specifiche sono adottate secondo la medesima procedura.

5. The Commission shall every two years review and assess the information received pursuant to paragraphs 2 and 3 above and publish a report thereon.

5. La Commissione esamina e valuta ogni due anni le informazioni fornitele ai sensi dei paragrafi 2 e 3 e pubblica una relazione in merito.

Article 18

Articolo 18

1. The Commission shall be assisted by a Committee composed of the representatives of the Member States and chaired by the representative of the Commission.

1. La Commissione è assistita da un comitato composto dai rappresentanti degli Stati membri e presieduto da un rappresentante della Commissione.

2. The representative of the Commission shall submit to the committee a draft of the measures to be taken. The committee shall deliver its opinion on the draft within a time limit which the chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 148 (2) of the Treaty in the case of decisions which the Council is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the committee shall be weighted in the manner set out in that Article. The chairman shall not vote.

2. Il rappresentante della Commissione sottopone al comitato un progetto delle misure da adottare. Il comitato formula il suo parere sul progetto entro un termine che il presidente può fissare in funzione dell'urgenza della questione in esame. Il parere è formulato alla maggioranza prevista dall'articolo 148, paragrafo 2, del trattato per l'adozione delle decisioni che il Consiglio deve prendere su proposta della Commissione. Nelle votazioni al comitato, viene attribuita ai voti dei rappresentanti degli Stati membri la ponderazione definiti all'articolo precitato. Il presidente non partecipa alla votazione.

3. (a) The Commission shall adopt the measures envisaged if they are in accordance with the opinion of the committee.

3. a) La Commissione adotta le misure previste qualora siano conformi al parere del comitato.

(b) If the measures envisaged are not in accordance with the opinion of the committee, or if no opinion is delivered, the Commission shall, without delay, submit to the Council a proposal relating to the measures to be taken. The Council shall act by a qualified majority.

b) Se le misure previste non sono conformi al parere del comitato, o in mancanza di parere, la Commissione sottopone senza indugio al Consiglio una proposta in merito alle misure da prendere. Il Consiglio delibera a maggioranza qualificata.

If, on the expiry of a period of three months from the date of referral to the Council, the Council has not acted, the proposed measures shall be adopted by the Commission, save where the Council has decided against the said measures by a simple majority.

Se il Consiglio non ha deliberato entro un termine di tre mesi a decorrere dalla data in cui gli è stata sottoposta la proposta, la Commissione adotta le misure proposte, tranne nel caso in cui il Consiglio si sia pronunciato a maggioranza semplice contro tali misure.

Article 19

Articolo 19

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive no later than 30 June 1993. They shall forthwith inform the Commission thereof.

1. Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva al più tardi il 30 giugno 1993. Essi ne informano immediatamente la Commissione.

2. When Member States adopt the measures referred to in paragraph 1, they shall contain a reference to this Directive or shall be accompanied by such a reference on the occasion of their official publication. The methods of making such a reference shall be laid down by the Member States.

2. Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate da un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità di tale riferimento sono decise degli Stati membri.

3. Member States shall communicate to the Commission the texts of the main provisions of national law which they adopt in the field governed by this Directive.

3. Gli Stati membri comunicano alla Commissione il testo delle disposizioni essenziali di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.
