REGULATION No 1 determining the languages to be used by the European Economic Community

THE COUNCIL OF THE EUROPEAN ECONOMIC COMMUNITY,

IL CONSIGLIO

Having regard to Article 217 of the Treaty which provides that the rules governing the languages of the institutions of the Community shall, without prejudice to the provisions contained in the rules of procedure of the Court of Justice, be determined by the Council, acting unanimously;

DELLA COMUNITÀ ECONOMICA EUROPEA,

Whereas each of the four languages in which the Treaty is drafted is recognised as an official language in one or more of the Member States of the Community;

visto l'articolo 217 del Trattato, ai termini del quale il regime linguistico delle istituzioni della Comunità è fissato, senza pregiudizio delle disposizioni previste nel Regolamento della Corte di Giustizia, dal Consiglio che delibera all'unanimità,

HAS ADOPTED THIS REGULATION:

considerando che le quattro lingue in cui il Trattato è redatto sono riconosciute come lingue ufficiali, ciascuna in uno o più Stati membri della Comunità,

HA ADOTTATO IL PRESENTE REGOLAMENTO

Article 1

Articolo 1

The official languages and the working languages of the institutions of the Community shall be Dutch, French, German and Italian.

Le lingue ufficiali e le lingue di lavoro delle istituzioni della Comunità sono la lingua francese, la lingua italiana, la lingua olandese e la lingua tedesca.

Article 2

I testi, diretti alle istituzioni da uno Stato membro o da una persona appartenente alla giurisdizione di uno Stato membro, sono redatti, a scelta del mittente, in una delle lingue ufficiali. La risposta è redatta nella medesima lingua.

Documents which a Member State or a person subject to the jurisdiction of a Member State sends to institutions of the Community may be drafted in any one of the official languages selected by the sender. The reply shall be drafted in the same language.

Articolo 3

I testi, diretti dalle istituzioni ad uno Stato membro o ad una persona appartenente alla giurisdizione di uno Stato membro, sono redatti nella lingua di tale Stato.

Articolo 4

Documents which an institution of the Community sends to a Member State or to a person subject to the jurisdiction of a Member State shall be drafted in the language of such State.

I regolamenti e gli altri testi di portata generale sono redatti nelle quattro lingue ufficiali.

La Gazzetta Ufficiale delle Comunità è pubblicata nelle quattro lingue ufficiali.

Regulations and other documents of general application shall be drafted in the four official languages.

Articolo 6

Le istituzioni possono determinare le modalità di applicazione del presente regime linguistico nei propri regolamenti interni.

The Official Journal of the Community shall be published in the four official languages.

Il regime linguistico della procedura della Corte di Giustizia è determinato nel Regolamento di procedura della medesima,

Article 6

Per quanto concerne gli Stati membri in cui esistono più lingue ufficiali, l'uso della lingua sarà determinato, a richiesta dello Stato interessato, secondo le regole generali risultanti dalla legislazione di tale Stato.

The institutions of the Community may stipulate in their rules of procedure which of the languages are to be used in specific cases.

Il presente Regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.

The languages to be used in the proceedings of the Court of Justice shall be laid down in its rules of procedure.

Article 8

If a Member State has more than one official language, the language to be used shall, at the request of such State, be governed by the general rules of its law.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
